The regular meeting of the Council of the Municipality of Bayham was held beginning at 7:00 p.m.
Thursday, July 7, 2005 in Council Chambers. Present were Mayor Lynn Acre, Deputy Mayor Mathew
Schafer, Councillors Mark Taylor, Paul Ens and Cliff Evanitski, Administrator Kyle Kruger and Clerk
Lynda Millard. Planning Co-ordinator Margaret Underhill and the Drainage Superintendent Dwayne
Daniel were in attendance to present their respective reports. The Administrator and Clerk were
requested to vacate Chambers during discussion of a portion of Item 11.1(b).
1. CALL TO ORDER Mayor Acre called the meeting to order at 7:00 p.m.
2. DISCLOSURE OF PECUNIARY INTEREST& THE GENERAL NATURE
THEREOF Councillor Ens disclosed an interest in item 6.3(a) as he is the applicant
for the rezoning request and vacated Council Chambers during the
discussion and vote of this matter.

3. Staff Presentation
Staff Report D2005-035 was presented by the Planning Co-ordinator. She indicated that the
proposed development would remove the three commercial blocks permitting an increase in
residential lots from 29 to 42.

She noted receipt of comments from the County of Elgin since her report had been circulated to
Council. The correspondence indicated support for the proposed two accesses off Nova Scotia
Line and that the southern entrance would need to be aligned with Chatham Street.
In addition, a written submission of concerns received July 7th from Andrea and Joe Stephenson
was circulated to Council.
She added that David Roe,planning consultant, was in attendance and would be addressing
Council on behalf of the applicant.
4. Public Comments
David Roe elaborated on his report attached to the Staff Report circulated to Council. He
indicated that the increase in residential lots from 29 to 42 would target retirees. He noted that
approval for a storm water outlet to address erosion control would be required from the
municipality and Long Point Region Conservation Authority,
Allan Spicer,neighbouring resident(within 600 metres) spoke in support of the proposed
development.
Mrs. Stephenson,an abutting property owner,requested Council to seek assurance that
environmental concerns be addressed so as not to cause closing of beach areas.
2005- Council Comments and Questions
Councillor Evanitski suggested that this development could be a boom to the area similar to that
being experienced in Port Rowan. He agreed that an appropriate storm water outlet would be
necessary to maintain a low level of impact on the beaches. He questioned the potential for
installation of retention ponds.
Mr.Rowe responded that ponds are used when an outlet is not of adequate size. A requirement of
the MOE is evaluation of quantity and quality of storm water dispersed through the outlet.
C.Evanitsld added that ponds are good filters and that the conservation authority will be
requesting this be addressed.
Councillor Taylor supported the development and the need to address storm water quality to
maintain the integrity of the beaches.
Mr.Roe noted that there are various methods to control out flow and erosion concerns must also
be addressed.
Deputy Mayor Schafer questioned whether the Ministry of Municipal Affairs also circulates the
amendment to the Ministry of the Environment,to which the Planning Co-ordinator responded
yes.
Councillor Evanitski questioned the Planning Co-ordinator whether the reduction of the lot size
from 800 to 600 square meters was sufficient,to which she responded that the proposed lots are
of more urban nature making better use of the lands. The proposed lot density is consistent with
the new Provincial Policy Statement,which encourages lots sizes that will minimize the amount
of land used.

The Administrator advised that the storm water outlet and realignment of the County Road(Nova
Scotia Line)with Chatham Street would be addressed with a subdivision agreement.
