The regular meeting of the Council of the Municipality of Bayham was held beginning at
7:00 p.m. on Thursday,April 5, 2007 in Council Chambers. Present were Mayor Lynn
Acre, Deputy Mayor Cliff Evanitski, Councillors Mark Taylor, Wayne Casier and Ed
Ketchabaw,Administrator Kyle Kruger, and Clerk Lynda Millard.
Planning Co-ordinator Margaret Underhill, Public Works Superintendent Bob Bartlett,
Chief Building Official Bill Knifton, Fire Chief Paul Groeneveld and Treasurer Suzann
Mantel were in attendance to present their respective reports.
1. CALL TO ORDER
Mayor Acre called the meeting to order and invited John(Jack)Barclay forward and presented
him with a Provincial 50 year volunteer certificate and pin. She acknowledged and thanked him
for his many years of community service in Bayham.
Mr. Barclay thanked the Mayor and Council noting that his long-time employer, Lyle Grant, was
responsible for many years by allowing him time off to pursue his volunteer efforts.
2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL NATURE
THEREOF None
3. APPROVAL OF MINUTES
Councilor Ketchabaw referred to previous discussion regarding the development of the
Interpretive Centre site and suggested that the minutes should note direction to staff.
The Clerk noted that March 6"minutes had already been approved and that the March
22nd minutes should reflect "open & closed sessions"and were corrected as follows:

4. DELEGATIONS
(a) 7:05 p.m.—David Roe- Civic Planning& Solutions Inc. was in attendance regarding
Abe Peters' application for a plan of subdivision in the Hamlet of North Hall. (Item
6.1(a)
Mr. Roe also brought to Council's attention that the Counties of Brant, Oxford and
Norfolk have approval authority over Plans of Subdivision and are currently permitting
subdivision development on private services involving more than five lots in hamlet
areas.
He noted that municipalities in Elgin must submit Plans of Subdivision to the Ministry of
Municipal Affairs and Housing,however,based on Provincial Policy Statements, such
Plans utilizing private services are not being approved

Mr. Roe added that he has raised the issue of unfairness for development in Elgin County
with the Ministry of Municipal Affairs and Housing and copied the information
submitted to the IBI Group, planning consultants for the Municipality of Bayham and the
Township of Malahide.
(b) 8:30 p.m.—Harris Teal.,representing the Vienna Skatepark Committee, was in
attendance requesting permission for the Committee to undertake beautification efforts at
the Vienna Memorial Park. He advised that the group has purchased an arbour and
would like to stake it securely near the waterfall and tend the flower beds in the area
nearby. He added that many people come to the park to take wedding pictures.

(c) 9:00 p.m.—Helen McCreadie was in attendance requesting support regarding the
purchase of dog tags for the"Helping Paws"rescue. Ms. McCreadie advised that she
accepts stray dogs picked up by the Animal Control Officer, has them spayed or neutered,
cares and finds homes for them,noting that she usually has no more than two such dogs
at a time. She added that only one animal has been adopted locally,noting that many
people go for"rescue"dogs. She suggested she is doing a service to the Municipality and
would appreciate consideration for her endeavours.
Item 9.1(d)
(d) 9:15 p.m.—Ian Almond&Jim Wilgar were present regarding an update of the Wind
Farm Interpretive Centre. A revised version of the site plan, indicating the location of a
proposed former portable classroom,was provided.

Mr.Almond noted that total donations of$32,000 have been confirmed.
Mr. Wilgar indicated that AMEC, Black and McDonald and White Construction
are lead supporters, with IBI having provided the site plan drawing. These
companies want to know how they will get recognition for the monies they are
contributing. Although info panels are to be placed, he stressed the importance of
a kiosk building for placement of promotional materials and shelter on rainy
days.
Mr. Almond suggested that the Port Burwell Business Development Association
would provide staff for up to three years.
In response to questions, Administrator Kyle Kruger discussed Council's options
to proceed, including waiting until all monies are raised before works go ahead.
He added that the County of Elgin has agreed to permit the Municipality to use
the lands as a wind tower viewing location.

Mr. Wilgar outlined budget details and noted that proceeding by May 24th is
critical to those committing funds.
The need for a building, servicing, maintenance, staffing, in-kind contributions
and other concerns were discussed.
Mr. Wilgar suggested that approximately 1/3 of the area should be graveled and
that if the proposed budget amount of $51,500 isn't sufficient he would make up
the difference,
Some Council members indicated support for site preparation and development of
parking area, but had many concerns with the placement of a building.

The Planning Co-ordinator noted that Mr. Donelan was present. She requested
clarification from him of the proposed development of the cottage to be noted on
the site plan drawing. Mr. Donelan responded that he would contact the engineer
and provide an amended drawing as soon as possible.
He confirmed that all applicable permits would be obtained from the Municipality
as soon as possible and that the septic system installation would be completed
thereafter. He confirmed that the completion date of June 30, 2007 in the
agreement is acceptable.

Q. Councillor Ketchabaw questioned whether the new parcel would be used right
away.
A. The Clerk responded that the Board is currently divided on the need to utilize
immediately.

Q. Councillor Casier questioned whether the rezoning was not a requirement of the
severance process.
A. The Planning Co-ordinator responded that the Municipality is exempt from the
severance process.
Q. Councillor Taylor questioned whether there were liability issues if the land
continues to be used for agricultural rather than for cemetery purposes.
A. The Administrator advised that a lease agreement should be put in place for the
lands to continue to be used for agricultural purposes.

(i} Request by Councillor Casier to discuss stray cat population.
Councillor Casier noted that he had been approached regarding health concerns due to
numerous stray cats in an urban area and questioned whether there were any by-laws in
place restricting same.
He was advised that the municipality has no such by-law and that enforcement would be
very difficult.
It was noted that the local Health Unit only becomes involved whenthere is a scratch or
bite causing rabies concerns.

The Administrator was requested to have by-law enforcement check into the situation to
see what may be done.
