HomeMy WebLinkAboutBy-law No. 2002-052 CORPORATION OF THI1 MUNICIPALITY OF BAYHAM BY-LAW NO. 2002-052 A BY-LAW TO PROHIBIT AND/OR REGULATE THE USE OF OFF ROAD MOTORIZED VEHICLES IN THE MUNICIPALITY OF BAYHAM WHEREAS authority is granted to the Council of the Municipality of Bayham by Section 191 (6) of the Municipal Act, R.S.O. 1990 Chapter M.45 provides that Councils of all Municipalities may pass by-laws providing for the use by the public of lands which the Corporation is the owner and for the regulation of such use and the protection of such lands. AND WHEREAS it is deemed expedient for the safety and welfare of residents of the Municipality to prohibit and/or regulate the use of certain types of motorized vehicles within property owned by the Municipality of Bayham. BE IT THEREFORE ENACTED by the Council of the Municipality of Bayham as follows: 1. (a) No person shall use, ride on or operate a motorized vehicle within the limits of any property owned by the Municipality of Bayham except on a road, street or highway designed and dedicated for the use by motorized vehicles. (b) Motorized vehicle means a vehicle propelled or driven otherwise than by muscular power or wind and designed to travel on two or more wheels whether designed to be operated on a road or off road. (c) The prohibition contained in paragraph(a)hereof does not apply to police or emergency service vehicles, or vehicles operated by authorized maintenance workers or to a conveyance designed for the handicapped. 2. No person shall use,ride or operate any off road motorized vehicle or similar conveyance other than a conveyance designed for the handicapped, on any side walk or walkway, square, or boulevard within the Municipality of Bayham. 3. Any person who contravenes any provision under this By-law is,upon conviction, guilty of an offence and is liable to any penalty as provided in the Provincial Offenses Act. 4. The court in which the conviction has been entered and any court of competent jurisdiction thereafter, may make an order prohibiting the continuation or repetition of the offence by the person convicted and such order shall be in addition to any other penalty imposed on the person. 5. This by-law shall come into force and effect upon final passing. READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 18T DAY OF AUGUST,2002. MAYOR CLERK
