BY-LAW NO.2001-66
BEING A BY-LAW TO ADOPT THE ASSESSMENT ON WHICH
TAXES SHALL BE LEVIED FOR THE YEAR 2001, THE
CURRENT ESTIMATES FOR YEAR 2001, TO ESTABLISH A
LEVY FOR THE YEAR 2001, TO ADOPT TAX RATES, PROVIDE
FOR PENALTY AND INTEREST IN DEFAULT OF PAYMENT
AND THE COLLECTION THEREOF.
WHEREAS the Municipal Act, Chapter M.45, R.S.O. 1990, as amended provides that the Council of a
local municipality shall adopt estimates for the year, and pass a by-law to levy a separate tax rate on the
assessment in each property class, and;
WHEREAS Sections 362 and 363 of the Municipal Act, Chapter M.45, R.S.O. 1990 require tax rates to be
established in the same proportion to tax ratios, and;
WHEREAS certain regulations require reductions in certain tax rates for certain classes or subclasses of
property-
WHEREAS
ropertyWHEREAS the Municipal Act, Chapter M.45, R.S.O. 1990, as amended, also provides that the Council of
each lower-tier municipality shall in each year prepare and adopt estimates of all sums required during the
year for the purposes of the lower-tier municipality,and;
WHEREAS by action of the Province of Ontario, provision was made for the taking of the assessment of
the Municipality by the Regional Assessment Commissioner, as the assessment on which the rate of
taxation for the year 2000 should be levied,and;
WHEREAS it is necessary and expedient to levy on the whole rateable property according to the last
revised assessment roll of the Municipality the sum of $1,574,930 for the purposes of the lower-tier
municipality for the current year,
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
BAYHAM HEREBY ENACTS AS FOLLOWS:
1. THAT the assessment contained in the assessment roll of the Municipality of Bayham as made
pursuant to Province of Ontario Regulations, be hereby adopted and confirmed as the assessment of
which the rate of taxation for the year 2001 shall be levied.
2. THAT the said assessment roll be hereby adopted and confirmed as the last revised assessment roll
for the said Municipality.
3. THAT for the purpose of providing for the Corporation's general purposes, the tax rates set out in
Schedule "A" be hereby levied for the year 2001 upon the whole of the said assessment of the
Municipality according to the last revised assessment roll.
4. THAT for the purpose of providing for the County of Elgin general levy, the tax rates set out in
County of Elgin By-Law 2001-01-17, attached hereto as Schedule "C", be hereby levied for the
year 2001 upon the whole of the said assessment of the Municipality according to the last revised
assessment roll.
5. THAT in addition, for the purposes of providing for the public and separate school education
purposes, the tax rates set out by the Minister of Finance under Regulation 169/01 of the Education
Act, attached as Schedule "D", be hereby levied for the year 2001 upon the respective portions of
the said assessment of the School supporters of the said Municipality according to the last revised
assessment roll.
7. THAT the following tax rates appended hereto as Schedule "A" is hereby adopted to be
applied against the whole assessment for real property in the respective property class.

8. THAT the current estimates appended hereto as Schedule"B"are hereby adopted.
9. THAT the Clerk shall prepare and deliver the Collector's Roll to the Tax Collector on or
before August 3,2001.
10. THAT all taxes and other special rates shall be paid in the office of the Tax Collector or
Treasurer of the Municipality of Bayham.
11. THAT taxes for all properties, except for Commercial and Industrial properties, shall
become due and payable one-half on or before August 31, 2001 and one-half on or before
October 26, 2001, and for Commercial and Industrial properties taxes shall become due
and payable one-half on or before September 28, 2001 and one-half on or before
November 30, 2001, and non-payment of the amount, as noted, on the dates stated in
accordance with this section shall constitute default.
12. THAT on all taxes,which are in default on the 1st day following the above noted due dates,
a penalty of 1.25% shall be added and thereafter a penalty of 1.25% per month will be
added on the l' day of each and every month the default continues, until December 31',
2001.
13. THAT on all taxes in default on January 19`, 2002, interest shall be added at the rate of
1.25%per month for each month or fraction thereof in which the default continues.
14. THAT penalties and interest added in default shall become due and payable and shall be
collected as if the same had originally been imposed and formed part of such unpaid tax
levy.
15. THAT the Collector shall cause the same to be mailed to the residence or place of business
of such person indicated on the last revised assessment roll, a written or printed

"BEING A BY-LAW TO PROVIDE FOR THE ADOPTION OF THE 2001 BUDGET OF
THE CORPORATION OF THE COUNTY OF ELGIN AND TO ESTABLISH THE 2001
TAX RATIOS,AND TO E=STABLISH THE 2001 TAX RATES FOR THE COUNTY
CONSTITUENT MUNICIPALITIES"
WHEREAS Section 363 of the Municipal Act, R.S.O. 1990, Chapter M.45, as
amended,provides that the Council of an upper-tier municipality shalt in each year
establish the tax ratios for that year for the upper-tier municipality and its lower-tier
municipalities; and
WHEREAS Section 365 of the Municipal Act, R.S.O. 1990,Chapter M.45,as
amended, provides that the Council of each upper-tier municipality shall in each year
prepare and adopt estimates of all sums required during the year for the purposes of the
upper-tier municipality; and
WHEREAS Section 366 of the Municipal Act, R.S.O. 1990, Chapter M.45, as
amended, provides that the Council of each upper-tier municipality establish a separate tax
rate on the assessment in each property class in the lower-tier municipalities rateable for
upper-tier purposes; and,
WHEREAS Section 363 of the Municipal Act, RSO 1990, Chapter M45,as
amended,provides that the Council of each upper-tier municipality may opt to have certain
optional property classes apply within the County.
NOW THEREFORE the Municipal Council of the Corporation of the County of Elgin
enacts as follows:
1. That the 2001 tax ratios for the County of Elgin set out on Schedule MA',attached
hereto and forming part of this by-law,be approved and adopted by Council.
2. That the 2001 budget of the County of Elgin set out on Schedule"B', attached
hereto and forming part of this by-law,which incorporates estimates for revenue and for
expenditures be approved and adopted by Council.
3. That the 2001 tax rates-for the assessment in each property class set out in
Schedule"C", attached hereto and forming part of this by-law,be approved and adopted
by Council.
4. That the large industrial class be chosen as an optional property class.
READ a first and second time this 29th day of May,2001.
READ a third time and finally passed this 29th day of May, 2001.
