BY-LAW NO. 2000-54
A BY-LAW TO AUTHORIZE THE EXECUTION OF A
EASEMENT AGREEMENT WITH CHRISTINE MICHELE
SZORENYI
WHEREAS Section 191 (1) of the Municipal Act, R.S.O. 1990 Chapter M.45 as amended authorizes
municipalities to pass by-laws for acquiring or expropriating any land required for the purposes of the
corporation, and for erecting and repairing buildings thereon, and for making additions to or alterations
of such buildings, and may sell or otherwise dispose of the same when no longer required;
AND WHEREAS the Council of the Municipality of Bayham is desirous of acquiring the use of real
property by entering into a permanent easement agreement for property, described as Part of Lots 1, 2,
3, 4, 5, 6, 14 and 15, Block B, Plan 205, for the Village of Straffordville, in the Municipality of
Bayham, in the County of Elgin(Geographic Township of Bayham), being PARTS 1, 2, 3, 4, 5, 6 and
7 according to Reference Plan 11R-7243,for the purpose of a municipal sanitary sewer line.
AND WHEREAS the Council of the Municipality of Bayham deems it necessary to approve the
Easement Agreement by by-law;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk be and they are hereby authorized and directed to execute the
permanent Easement Agreement with Christine Michele Szorenyi attached hereto and forming part
of this By-law and marked as Schedule"A", being a permanent easement agreement for property,
described as Part of Lots 1, 2, 3, 4, 5, 6, 14 and 15, Block B, Plan 205, for the Village of
Straffordville, in the Municipality of Bayham, in the County of Elgin (Geographic Township of
Bayham), being PARTS 1, 2, 3, 4, 5, 6 and 7 according to Reference Plan 11R-7243, for the
purpose of a municipal sanitary sewer line, and the Mayor and Clerk be and are hereby further
authorized to execute all additional documents necessary to complete this transaction.

(7) EASEMENT
In consideration of the sum of Two Dollars ($2.00)now paid by the Transferee to the Transferor, receipt of
which is acknowledged, the Transferor grants to the Transferee, its successors and assigns an easement
and rights:
(1) to enter, construct, maintain, inspect, alter and repair a sanitary sewer including all appurtenances
on it, on and under the lands described in Box 5 hereof and further described on a Schedule on Page
2 hereof;
(2) for the servants, agents, contractors and workers of the Transferee to enter with machinery, material,
vehicles and equipment necessary for the use of the easement.
(3) The Transferee covenants that the said sanitary sewers shall be laid to a depth so as not to interfere
with the ordinary use of the easement lands for farming purposes, and to a depth that will not
obstruct the normal surface runoff from the easement Iands, nor the ordinary cultivation of the
easement lands, nor any tile drainage system existing in the easement lands, and that the topsoil and
subsoil shall be separated so that on completion of the project the land will be suitable for fanning
purposes.
(4) The Transferee covenants to fill in all excavations and as far as practicable restore the surface to the
same condition as prior to the commencement of construction or of any subsequent work to it,
including the repair of any curbs and gutters.
(5) The Transferee further covenants that no soil shall be removed from the property.
(6) The Transferee shall have the right at any time and from time to time to remove any boulder or rock
and to sever, fell, remove or control the growth of any roots, trees, stubs or brush on or under the
easement lands.
(7) The Transferor and its successors and assigns shall retain the right to construct a driveway, fencing
and landscaping, except trees, on the lands over which the easement is granted. The Transferee
confirms that the use and enjoyment of the portion of the easement used as a driveway will not
interfere with the rights of the Transferee and further confirms that should it be necessary during the
course of the Transferee's operation to disturb the driveway, fencing or landscaping, the Transferee
will restore the disturbed portion. Additionally, the Transferor shall have the right to fully use and
enjoy the easement lands, except as may be necessary for any of the purposes hereby granted to the
Transferee.
(8) The Transferee shall indemnify the Transferor against all actions, suits, claims and demands by any
person or persons whomsoever in respect of any loss, injury or damages arising out of or connected
with any operations carried out by the Transferee on the said easement lands, unless any such loss,
injury or damage was caused by the act or omission of the Transferor, its agents, employees or
contractors.
The following lands (the dominant lands) which are owned by the Transferee are those benefitted by the
within transfer of easement:
Lots 2, 3 and 4, Registered Plan 205 for the Village of Straffordville, in the Municipality of Bayham, in the
County of Elgin.
The Transferee described in Box 11 herein agrees to abide by the covenants above set out.
