BY-LAW NO. 99-77
A BY-LAW TO AUTHORIZE THE EXECUTION
OF A LEASE AGREEMENT BETWEEN THE
MUNICIPALITY OF BAYHAM AND THE
GOVERNMENT OF CANADA,FISHERIES AND
OCEANS, SMALL CRAFT HARBOURS REGARDING
THE MANAGEMENT OF THE PORT BURWELL
HARBOUR
WHEREAS the Council of the Corporation of the Village of Port Burwell enacted and passed
By-law Na 97-08 on December 29, 1997 to authorize the Reeve and Acting Clerk to enter into
an Agreement with the Department of Fisheries and Oceans for the lease of Harbour Lands in
Port Burwell for a term to expire on May 31, 1999;
AND WHEREAS Township of Bayham by order of the Minister of Municipal Affairs and
Housing amalgamated with the Village of Port Burwell and the Village of Vienna effective
January 1, 1998 to form the Municipality of Bayham;
AND WHEREAS the Government of Canada, Fisheries and Oceans Small Craft Harbours is
desirous of divesting ownership of the said harbour lands and transferring ownership to the
Municipality or alternatively,to a public or private body;
AND WHEREAS pursuant to the provisions of Section 210.1(2) of the Municipal Act,R.S.O.
1990, Chapter M.45, as amended,the Council of the Corporation of the Municipality of Bayham
desires to renew the said lease agreement for a one year term to expire May 31, 1999 while
considering the implications of municipal ownership of the harbour lands.
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk be and are hereby authorized to execute the Lease
Agreement attached hereto as Schedule"A" and forming part of this by-law between the
Municipality of Bayham and the Government of Canada, Fisheries and Oceans, Small
Craft Harbours for the lease of harbour lands described therein for a term commencing
June 1, 1999 and ending May 31, 2000.
2. THAT the rental fee payable shall be $500.00 (Five Hundred Dollars), per annum plus
$35.00 (Thirty-five Dollars), g.s.t.
3. THAT this By-law shall take effect retroactively to June 1, 1999.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 7T11 DAY
OF OCTOBER, 1999.
