BY-LAW NO. 99-67
A BY-LAW TO APPOINT FENCE VIEWERS
AND TO SET OUT THE REMUNERATION
WHEREAS Section 2 of the Line Fences Act, Chapter L.17 states that the Council of
every local municipality shall by by-law appoint such number of fence viewers as are required to
carry out the provisions of this Act and the by-law shall fix the remuneration to be paid to the
fence viewers and the remuneration shall be fixed on an hourly or daily rate or a rate for each
attendance or re-attendance by the fence viewers;
AND WHEREAS the Council of the Corporation of the Municipality of Bayham desires
to appoint Fence Viewers for the terms set out below;
THEREFORE the Council of the Corporation of the Municipality of Bayham hereby
enacts as follows:
1. THAT the following persons are hereby appointed as Fence Viewers for the Municipality
of Bayham for a term to expire December 31, 2000:
Andrew Dieleman, 11140 Culloden Road, RR#4,Aylmer, ON NSH 2R3
Fred Lewis, 111 Bidwell Street, Tillsonburg, ON N4G 3V4
C. Ron Phillips,Box 91, Straffordville, ON NOJ 1Y0
Fraser De La Plante,RR#2,Port Burwell, ON NOJ 1TO
Ross Learn,RR# 1,Vienna, ON NOJ 1Z0
2. THAT a minimum of three Fence Viewers shall be required to attend and re-attend when
necessary as directed by the Clerk in accordance with Section 4(2) of the Line Fences Act,
R.S.O. 1990, Chapter L.17.
3. THAT Fence Viewers will each be paid an attendance fee of$65.00 (sixty-five dollars)
for each attendance at an owner's premises. The owner requesting the Fence Viewers
shall pay to the Municipality of Bayham an initial deposit of$195.00 (one hundred and
ninety-five dollars)in cash or certified cheque which will be applied against the fence
viewers' fees. The proportion of the Fence Viewers' fees that will be paid by the owner
and the adjoining owner shall be decided by the Fence Viewers. No decision shall be
made by the Fence Viewers until they are paid.
4. THAT this by-law shall take effect upon the date of its enactment.
5. THAT all previous by-laws in this regard enacted by the former Villages of Vienna and
Port Burwell and the Township of Bayham are hereby repealed.
