BY-LAW NO. 99-66
A BY-LAW TO ADOPT AMENDMENT NO. 107
TO THE MUNICIPAL OFFICIAL PLAN
(David &Peggy Shelly, [St. Luke's Cemetery],
Part Lot 16, Concession 3)
The Council of the Corporation of the Municipality of Bayham, in accordance with the
provisions of the PLANNING ACT,hereby enacts as follows:
1 THAT Amendment No. 107 to the Official Plan of the Township of Bayham consisting
of the attached text and map schedule is hereby adopted.
2. THAT the Clerk is hereby authorized and directed to make application to the Minister of
Municipal Affairs and Housing for approval of the aforementioned Amendment No. 107
to the Official Plan of the Township of Bayham.
3. THAT no part of this By-law shall come into force and take effect until approved by the
Minister of Municipal Affairs and Housing.
Read a first, second and third time this 2"d day of September, 1999.

The attached text and map schedule constituting Amendment No. 107 to the
Official Plan of the Township of Bayham was prepared upon the
recommendation of the Council of the Corporation of the Municipality of Bayham
after evaluation of public input pursuant to the provisions of the PLANNING
ACT.
This Amendment was adopted by the Council of the Corporation of the
Municipality of Bayham by By-law No. 99-66, in accordance with Section 17 of
the PLANNING ACT, on the 2nd day of September, 1999.

AMENDMENT NO. 107
1. PURPOSE
The purpose of this Amendment is to change the land use designation on a parcel of
property from "Agriculture"to "Rural (Estate Residential)"and"Rural (Public
Institutional)" in the Official Plan of the Township of Bayham.
2. LOCATION
The area affected by this Amendment comprises approximately 1.42 hectares (3.6
acres). Approximately 0.91 hectares will be used to expand an existing cemetery which
lies immediately south of the subject lands. The remaining 0.51 hectares at the
intersection of Light Line and Plank Road (County Rd. No. 19)will b used for estate
residential purposes. The subject lands are situated on the east side of Plank Road,
south of Light Line in Part Lot 16, Concession 3, in the Municipality of Bayham.
3. BASIS OF THE AMENDMENT
The subject lands are part of an area immediately north of the Village of Vienna that is
fragmented with substantial non-farm development occurring along Plank Road adjacent
to the subject lands. The subject lands are relatively small in size, and they are
separated from the larger prime agricultural areas to the north and east by a large,
heavily wooded ravine. These physical characteristics along with the significant existing
non-farm residential development in the local area have effectively eliminated any
potential for agricultural production on the subject lands. The attached Schedule"B"
(Consolidated Zoning Map for Vienna Area) shows the subject lands in their existing
local land use context adjacent to the former Village of Vienna.
4. DETAILS OF THE AMENDMENT
i) Schedule"A" Future Land Use of the Official Plan of the Township of Bayham is
hereby amended by changing from "Agriculture"to "Rural Estate Residential"
and "Rural Public Institutional"those lands identified as subject of this
Amendment and marked "R(E)" and "R(I)" respectively on the attached Schedule
"'A", which schedule shall constitute part of this Amendment.
ii) The lands subject to this Amendment and designated "Rural Estate Residential" may
be used, developed and zoned in accordance with the policies of Section 4.3.2.
(Estate Residential) of the Official Plan, as amended.
iii) The lands subject to this Amendment and designated "Rural Public Institutional may
be used, developed and zoned in accordance with the policies of Section 4.3.5.
(Recreational and public Institutional Uses) of the Official Plan, as amended.
