HomeMy WebLinkAboutBy-law No. 1998-034 CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 98-34 A BY-LAW FOR THE ESTABLISHMENT OF THE MUNICIPALITY OF BAYHAM FIRE DEPA1 MENT WHEREAS the Municipal Act provides that the Council may by by-law establish and regulate a fire department; THEREFORE, the Council of the Corporation of the Municipality of Bayham enacts as follows: 1. In this by-law, unless the context otherwise requires: (a) "Member" includes an officer; (b) "Fire Protection" means a range of services as determined by council policy. 2. (a) A Department for the Municipality of Bayham to be known as the Bayham Fire Department is hereby established and the head of the Department shall be known as the Fire Chief. (b) The goals and mission statement of the department shall be those contained in Schedule"A" of this by-law. 3. In addition to the Fire Chief, the Department personnel shall consist of Two Station Chiefs, and such number of Captains and other officers and members as from time to time may be deemed necessary by the Council. 4. (a) The Fire Chief may recommend to the Administrator the appointment of any qualified person as a member of the Department subject to approved hiring policies contained in Schedule "B" of this by-law. (b) Every member of the Department appointed for fire fighting duties is subject to a medical examination at such times as the Chief may require. (c) A person appointed as a member of the Department for fire fighting and fire prevention duties shall be on probation for a period of twelve months during which time he/she shall take such training and examination as may be required by the Chief. (d) If a probationary member fails any such examinations, the Chief may recommend to Council that he/she be dismissed or the probation period be extended. 5. (a) The Chief may reprimand, suspend or recommend dismissal of any member for insubordination, inefficiency, misconduct, tardiness or for non-compliance with any of the provisions of this by-law or general orders and departmental rules, that in the opinion of the Chief, would be detrimental to the efficiency of the department. (b) Following the suspension of any member, the Chief shall report the suspension and his/her recommendations to the Administrator. (c) A member shall not be dismissed without being afforded the opportunity for a hearing before Council, if he/she makes a written request for such hearing within seven days after receiving notice of his/her proposed dismissal. 6. The remuneration of all members of the department shall be as determined by the Council. 7. The Chief of the department is responsible to the Administrator for the proper administration and operation of the department, for the discipline of its members and; (a) shall develop and publish such written standard operation guidelines and such general orders and departmental rules as may be necessary for the care and protection of the department equipment and department personnel, and generally for the efficient operation of the department, provided that such orders and rules do not conflict with the provisions of any by-law of the municipality. (b) shall review periodically the policies and guidelines of the department and may establish an Advisory Committee consisting of such members and he/she may deem necessary to assist him/her in these duties. By-law No. 98-34 Page 2 (c) Shall take proper measures for the prevention, control, and extinguishment of fires and for the protection of life and property and exercise the powers imposed on him/her by the Fire Prevention and Protection Act, and the Fire Chief or his/her designate shall be empowered to authorize fire department members to; (i) pull down or demolish any building or structure to prevent the spread of fire (ii) when unable to contact the property owner,to take such necessary action which may include boarding up or barricading of buildings to guard against fire or other danger, risk or accident. (iii) The corporation may recover expenses incurred by such necessary action in a manner provided by the Municipal Act. (d) is responsible for the enforcement of this by-law and the general orders and departmental rules. (e) Shall, through the Station Chiefs, report all fires to the Fire Marshal as required by the Fire Prevention&Protection Act. (f) Shall submit to the Treasurer for council approval the annual estimates for the department. 8. The Station Chiefs shall report to the Chief on the activities of the divisions that are his responsibility and carry out the orders of the Chief, and in the absence of the Chief, the Station Chief has all the powers and shall perform all the duties of the Chief. 9. (a) The department is composed of the following divisional functions; Division of Administration Division of Apparatus and Equipment Division of Fire Suppression Division of Fire Prevention Division of Training (b) Each division of the department is the responsibility of the Chief and is under the direction of the Chief or such member designated by the Chief 10. In addition to the Chief and Station Chiefs, the Bayham Fire Department shall have the following number of officers,three Captains, one Training Officer and one Fire Prevention Officer per station. Including the Chief, Station Chiefs and Officers, the department will consist of no more than thirty-eight members. The duties and responsibilities of each position are described in Schedule"C" of this by-law. 11. The Fire Prevention Policy of the Bayham Fire Department shall be conducted as described in Schedule"D" of this by-law. 12. The Bayham Fire Department shall not respond to a call with respect to a fire or emergency outside the limits of the municipality except with respect to a fire or emergency, (a) that in the opinion of the Fire Chief threatens property in the municipality or property outside the municipality that is owned or occupied by the municipality, (b) at the discretion of the Fire Chief to a municipality authorized to participate in the county emergency fire service plan and program(mutual aid), (c) on those highways that are under the jurisdiction of the Ministry of Transportation or within the county where the county has established a rescue support system, (d) outside the municipal boundary where the Fire Chief or his/her designate determines that immediate action is necessary to preserve and protect life and/or property and the serving Fire Department is notified to respond and assume command. 13. Job descriptions for all officers and members of the Bayham Fire Department shall be as described in Schedule"C" of this by-law. 14. The promotional policy of the Bayham Fire Department shall be conducted as described in Schedule "E" of this by-law. 15. Officers and members of the Bayham Fire Department shall receive remuneration as described in Schedule"F" of this by-law. By-law No. 98-34 Page 3 16. AND THAT all by-laws and amendments thereto enacted by the former Village of Port Burwell,the Village of Vienna, and the Township of Bayham,pertaining to the Establishment of a Fire Department,be hereby repealed. Mayor 1 Clerk . • • • Gletcbiu,a 1.6 Li � � -�� SCHEDULE "A" TO BY-LAW NO. 98-34 PRIMARY GOALS OF THE BAYHAM FIRE DEPARTMENT The goal of the Bayham Fire Department is to provide fire protection services through a range of programs designated to protect the lives and property of the inhabitants from the adverse effects of fires, exposure to dangerous conditions created by man or nature; first to the municipality; second to those municipalities requiring assistance through authorized emergency fire service plans and programs (mutual aid). Fire protection services provided by the Bayham Fire Department will include, but not be limited to the following no-fire emergencies. (a) Rescue from motor vehicle accidents, industrial accidents, confined spaces and building collapse, agricultural accidents (b) Rescues involving water and ice (levels one, two and three) (c) Emergencies involving hazardous materials (level one responder) Operations will only be carried out only to the limit of equipment available and training taken. In order to achieve the goals of the fire department, Council will ensure that necessary funding is in place and Council will authorize all programs conducted by the fire department either by motion of council or by-law. FIRE DEPARTMENT MISSION STATEMENT The primary mission of the Bayham Fire Department is to provide a range of programs to protect the lives and property of the inhabitants of the Municipality of Bayham from the adverse effects of fires or exposure to dangerous conditions created by man or nature. SCHEDULE "B" TO BY-LAW NO. 98-34 HIRING POLICY Any person wishing to become a member of the Bayham Fire Department shall fill out an application form provided by the Fire Chief. All application forms will be received by the Fire Chief and reviewed by the Fire Chief and Station Chief. The Fire Chief and Station Chief will choose the successful applicant based on information contained in the application and the results of any tests or interviews required by the Fire Chief The names of the successful applicants along with the Chief's recommendation for appointment will be turned over to the Administrator for final approval. QUALIFICATIONS NECESSARY TO BECOME A FIRE FIGHTER 1. Must be at least 18 years of age. 2. Must pass a medical exam. 3. Must pass such tests as may be required by the Chief 4. Must attend pre employment interviews as required. 5. Must hold a valid Class "D" license with"Z" endorsements or obtain such a license within one year of joining the fire department. SCHEDULE "C" TO BY-LAW NO. 98-34 JOB DESCRIPTIONS C-1 Fire Chief C-2 Station Chief C-3 Captain C-4 Fire Prevention Officer C-5 Training Officer C-6 Fire Fighter SCHEDULE "C-1" MUNICIPALITY OF BAYHAM Job Description FIRE CHIEF GENERAL STATEMENT OF DUTIES: The Fire Chief reports directly to the Administrator. The Fire Chief has responsible charge for the overall operation of the department including fire fighting, fire prevention, hazardous materials incidents, auto extrication incidents, rescue, all life and property saving functions with which the department may be involved, purchasing, maintenance and budgeting. His/her work is administrative and supervisory oriented. The Fire Chief is required to work 21 hours per week. In the event of exceeding the 21 hours per week, due to required attendance at emergencies, meetings, inspections or presentations, the Fire Chief will receive time off in lieu of remuneration. EXAMPLES OF WORK—MAJOR: • preparation, with the assistance of Station Chiefs, presentation and administration, of the fire department budget • plans, co-ordinates and directs the fire fighting, fire prevention, rescue and life and property saving functions • reports to and assumes command at major incidents • supervises the fire prevention activities • supervises the training programs and assists in the development of these programs • maintains discipline and morale of the Station Chiefs • purchases all major equipment and ensures the maintenance of same in accordance with Municipal purchasing policy • attends conferences and seminars to keep abreast of changes in equipment and methods of operation to ensure that the department will maintain, and where possible, improve the level of service in the municipality • confers with the Administrator to ensure that the activities of the department are consistent with the goals and objectives of the municipality as established by council • meets regularly with the station chief and other officers to ensure that they are following the procedures and goals of the department • supervises the performance appraisal program and conducts regular appraisals of those under his direct supervision • recommends to the Administrator the hiring of personnel as required to maintain the manning level as established by council EXAMPLES OF WORK—MINOR: As required, the Fire Chief will: • comment on site plans, re-zonings, subdivision agreements and new buildings • attend department head meetings SCHEDULE "C-1" cont'd Page 2 • attend area Fire Chiefs' meetings • attend committee and council meetings as required • participate in the public relations programs by speaking to groups and organizations ▪ comments to the municipal administrator on present and proposed council and staff policies • supervises the activities of the Fire Department Health& Safety Committee REQUIRED KNOWLEDGE, SKILL AND ABILITIES: • advanced knowledge of modern fire fighting and fire prevention methods • advanced knowledge of the municipality and surrounding areas protected by agreement • advanced knowledge of the type of buildings in the municipality • advanced knowledge of rescue and first aid procedures • advanced knowledge of safety procedures, rules and equipment • must have demonstrated ability to supervise fire fighters, maintain discipline, have sound judgement, be resourceful and in good physical condition EXPERIENCE AND TRAINING: Recommend at least five years satisfactory experience as an officer and have received additional training at the Ontario Fire College, regional fire schools or educational seminars. SCHEDULE "C-2" MUNICIPALITY OF BAYHAM Job description STATION CHIEF GENERAL STATEMENT OF DUTIES: The Station Chief reports directly to the Fire Chief and is in charge of fire fighting and training in a supervisory role under the direction of the Fire Chief DISTINGUISHING FEATURES OF THE RANK: This rank holds the responsibility for co-ordinating and directing the activities of the fire fighting units of the municipality. This person is also responsible to oversee the training and is to maintain discipline within the fire station ranks. The above work is performed under the direction of the fire chief and all policy matters are referred to the fire chief. The station chief relieves the fire chief during sick leave, time off, vacations, seminars, conventions, etc. A high degree of responsibility for the protection of lives and property is involved. EXAMPLES OF WORK: • responds to all alarms of emergency and assumes command of the scene until relieved by the fire chief • supervises the fire ground to ensure that the officers and fire fighters operate in a manner consistent with established procedures and accepted fire fighting methods • determines causes of fires in conjunction with other officers and ensures that the necessary forms are completed • advises the fire chief of any changes in procedures or methods necessary to maintain or increase the fire fighting efficiency • advises the fire chief of any repairs necessary to maintain the vehicles, equipment and stations • maintains discipline and morale of the volunteers in the fire fighting ranks • maintains a performance appraisal system, conducts regular reviews of all staff and recommends personnel for promotion • meets regularly with the officers and fire chief to assist in developing and maintaining a progressive and efficient training program • assumes command of the fire department in the absence of the fire chief as outlined in the establishing and regulating by-law of the department • purchases all supplies and maintains equipment and facilities in accordance with annually approved budget estimates • ensures that the station is maintained and kept in good repair • any other duties as assigned by fire chief SCHEDULE "C-2" cont'd Page 2 REQUIRED KNOWLEDGE, SKILL AND ABILITIES: • good knowledge of modern fire fighting and fire prevention methods • good knowledge of the municipality and surrounding areas protected by agreement • good knowledge of the type of buildings in the municipality • good knowledge of rescue and first aid procedures • good knowledge of safety procedures, rules and equipment • must have the ability to supervise fire fighters, maintain discipline, have sound judgement, be resourceful and in good physical condition ATTENDANCE: The Station Chief must attend 70%of training sessions and meetings. EXPERIENCE AND TRAINING: Recommend a least five years satisfactory experience as an officer and have received additional training at the Ontario Fire College, regional fire schools or educational seminars. WORKING CONDITIONS: The station chief will be expected to respond and work in all types of weather and less than ideal conditions. He/she could have to enter hazardous atmospheres and areas and will be expected to work in a safe manner. SCHEDULE "C-3" MUNICIPALITY OF BAYHAM Job Description CAPTAIN GENERAL STATEMENT OF DUTIES: The Captain reports to the Station Chief and has responsible charge of an assigned fire station and does the related work as required. DISTINGUISHING FEATURES OF THE RANK: This is supervisory work involving responsibility for directing the activity of a fire station at an emergency scene or around the fire station. The work is done in accordance with established policies and requires the exercise of good judgment in emergency situations. The captain responds to emergency calls assigned to his/her company and assumes command until relieved by a senior officer. EXAMPLES OF WORK: • responds to alarms assigned to his/her station • assigns personnel to lay out and connect hose lines and nozzles, turn water on and off, direct hose streams, raise ladders, ventilate buildings, perform salvage, perform rescue operations, stabilize hazardous materials scenes and any other life and property saving functions which the station may be involved in, within one's own capabilities • inspects the fire scene to prevent re-ignition • supervises the cleaning, checking and replacement of tools and equipment after an emergency • supervises the work of the fire fighters to ensure that it is done safely and in accordance with established procedures • inspects equipment, grounds and station to insure proper order and conditions • reports deficiencies to the station fire chief • maintains discipline • trains and drills fire fighters • maintains a record of training activities • meets on a regular basis with the fire chief and station chief to discuss the overall operation of the department • any other duties as assigned by station chief REQUIRED KNOWLEDGE, SKILL AND ABILITIES: • good knowledge of modern fire fighting and fire prevention methods SCHEDULE "C-3" cont'd Page 2 • good knowledge of the municipality and surrounding areas protected by agreement • good knowledge of the type of buildings in his/her assigned area • good knowledge of rescue and first aid procedures • good knowledge of safety procedures, rules and equipment • must have the ability to supervise fire fighters, maintain discipline, have sound judgement, be resourceful and in good physical condition ACCEPTABLE TRAINING: Must participate in at least 70%of the required annual training. WORKING CONDITIONS: The captain will be expected to respond and work in all types of weather and less than ideal conditions. He/she could have to enter hazardous atmospheres and areas and will be expected to work in a safe manner. SCHEDULE "C-4" MUNICIPALITY OF BAYHAM Job Description FIRE PREVENTION OFFICER GENERAL STATEMENT OF DUTIES: The Fire Prevention officer is in charge of the fire prevention division under the direction of the Fire Chief and reports to the Fire Chief monthly. DISTINGUISHING FEATURES OF THE RANK: The rank holds the responsibility for co-ordinating and directing the activities of the fire prevention division of the fire station. This person is also responsible for providing fire prevention training to other members of the station. The above work is performed under the direction of the fire chief and all policy matters are referred to the station chief. This position has a high degree of responsibility for the prevention of loss of lives and property in the municipality. EXAMPLES OF WORK: Assists the Fire Chief to: • conduct fire prevention inspections of premises • enforce fire prevention by-laws in consultation with the station chief • examine building plans • make presentations to the public on fire prevention and education • develop and implement an in-service fire prevention inspection program • receive, process and follow up reports of fire prevention inspections conducted by fire fighting companies Also to perform the following: • comment on site plans, re-zonings, subdivision agreements and new buildings as requested • determine causes of fires in conjunction with other officers and ensures that the necessary forms are completed • advise the station chief of any changes in procedures or methods necessary to maintain or improve the fire prevention programs of the department • meet regularly with the officers and fire chief to assist in developing and maintaining a progressive and efficient training program • any other duties as assigned by station chief SCHEDULE "C-4" cont'd Page 2 REQUIRED KNOWLEDGE, SKILL AND ABILITIES: • good knowledge of modern fire fighting and fire prevention methods • good knowledge of the municipality and surrounding areas protected by agreement • good knowledge of the type of buildings in the municipality ACCEPTABLE TRAINING: Must participate in at least 70% of the required annual training. SCHEDULE "C-5" MUNICIPALITY OF BAYHAM Job Description TRAINING OFFICER GENERAL STATEMENT OF DUTIES: The Training Officer is in charge of the fire training division under the direction of the Station Chief and will report to the Station Chief as required to ensure quality training is being performed. DISTINGUISHING FEATURES OF THE RANK: This rank holds the responsibility for co-ordinating and directing the activities of the fire training division of the fire station. This person is also responsible for providing fire prevention training to other members of the station. The above work is performed under the direction of the fire chief and all policy matters are referred to the station chief. This position has a high degree of responsibility for the training of fire department members. EXAMPLES OF WORK: • meets regularly with the officers and station chief to assist in developing and maintaining a progressive and efficient training program • develops and implements an in-service fire training program • receives, processes and follows up reports of fire training activities conducted by fire fighting stations • advises the station chief of any changes in procedures or methods necessary to maintain or improve the fire training programs of the station • attends all major emergencies • attends all post-emergency evaluations • involved in all major pre-emergency planning • any other duties as assigned by station chief REQUIRED KNOWLEDGE, SKILL AND ABILITIES: • must have a sound basis in the principles of training and education • good knowledge of modern fire fighting and fire prevention methods • good knowledge of the municipality and surrounding areas protected by agreement • good knowledge of the type of buildings in the municipality • good knowledge of rescue and first aid procedures • good knowledge of safety procedures, rules and equipment SCHEDULE "C-5" cont'd Page 2 ® must have the ability to supervise fire fighters, maintain discipline, have sound judgment, be resourceful and in good physical condition ACCEPTABLE TRAINING: Must participate in at least 70%of the required annual training. SCHEDULE "C-6" MUNICIPALITY OF BAYHAM Job Description FIRE FIGHTER GENERAL STATEMENT OF DUTIES: Performs fire fighting duties and other related work as required. Fire Fighters are to report to the Captains of their department. DISTINGUISHING FEATURES OF THE RANK: This is manual work of a hazardous nature involving the fighting of fires, salvage, rescue work and some first aid generally under the direct supervision of superior officers. Regular training and some maintenance work on the fire station and vehicles are required. Fire fighters may be required to make decisions and work without supervision until an officer arrives at the scene. EXAMPLES OF WORK: • responds to fire, rescue, hazardous materials emergencies and other emergencies assigned to his/her station • lays and connects hose lines, nozzles and other related appliances, turns water on and off • holds fire hose and directs fire streams • operates a pressure pump as assigned • operates elevating devices as assigned • drives fire apparatus as assigned • carries, puts up and climbs ladders • operates rescue equipment • performs salvage work at fire and emergency scenes using salvage covers, vacuums, mops, squeegees, etc. • performs ventilation by making openings in buildings, using exhaust fans or fog streams • enters burning or contaminated buildings, structures and other areas to fight fires and/or perform rescues while wearing required clothing and safety equipment • assists in giving first aid to the injured • assists in cleaning fire fighting equipment upon return to the station after an emergency call or a practice • attends regular training sessions to practice existing procedures and to learn and practice new fire fighting and rescue methods • cleans and maintains areas of the fire station used by the members as scheduled SCHEDULE "C-6" cont'd Page 2 • assists with the fire prevention program • other duties as assigned by station chief REQUIRED KNOWLEDGE, SKILLS AND ABILITIES: Mental alertness, mechanical aptitude, ability to get along well with others, willingness to perform and task assigned, conscientious and dependable, good physical conditions, holder of a valid Class"D" license complete with"Z" endorsement or able to obtain such licenselwithin one year of joining the fire department. ACCEPTABLE TRAINING AND PHYSICAL CONDITION: Must participate in at least 70% of the required annual training and must pass a medical to be provided at the Municipality's expense by a physician designated by the fire department before becoming a member of the fire department and as required by the Fire Chief. WORKING CONDITIONS: The fire fighter will be expected to respond and work in all types of weather and less than ideal conditions. He/she could have to enter hazardous atmospheres and areas and will be expected to work in a safe manner. SCHEDULE "D" TO BY-LAW NO. 98-34 FIRE PREVENTION POLICY The Fire Prevention Policy of the Bayham Fire Department shall consist of the following: (a) to conduct inspections of property and buildings upon written request or complaint; (b) to conduct public awareness programs designed to educate the public on matters pertaining to fire prevention and safety. SCHEDULE "E" TO BY-LAW NO. 98-34 PROMOTIONAL POLICY Any member of the department having at least five years service with the department may make application in writing to the Fire Chief to qualify him/her for a promotion in rank. The Fire Chief and Station Chief shall review all applications for promotion and the successful applicant shall be chosen based on the applicant's experience, fire and station record, training record and any tests and interviews as may be required by the Fire Chief. The name of the successful applicant along with the Fire Chiefs recommendation for promotion shall be presented to the Administrator for final approval. SCHEDULE "F" TO BY-LAW NO. 98-34 REMUNERATIONS OF FIRE DEPARTMENT MEMBERS 1. FIRE CHIEF The Fire Chief shall receive an annual salary as set in accordance with the Municipal Remuneration By-law and benefits as set out in the Municipal Personnel Policy. 2. STATION CHIEF The two Station Chiefs shall receive an annual salary as set out by Council. 3. OFFICERS AND FIRE FIGHTERS The Officers and Fire Fighters of the department, excluding the Fire Chief and two Station Chiefs, shall receive semi-annual payments for services performed according to the Bayham Fire Department Point System. 4. DESCRIPTION OF BAYHAM FIRE DEPARTMENT POINT SYSTEM a) The point system will consist of a point fund, in accordance with the Municipal Remuneration By-law. b) The total monies of the point system will be divided evenly in two, so as to provide semi- annual payments to eligible members. c) For each six month pay period, the total amount of points used by both Bayham Fire Stations' members will be divided into the allotted amount, thereby producing the amount of one points value. This value will be multiplied by each individual Fire Fighter's accumulated points, thus giving his/her amount of pay. d) Descriptions for point allotments: Points Fire/Emergency Call -first two hours 4 - after two hours 2 per hour Stand-by(1 pt.
