Present were Mayor Paul Ens, Deputy Mayor Cliff Evanitski, Councillors Wayne Casier, Tom Southwick, and Ed Ketchabaw, Administrator Kyle Kruger and Clerk Lynda Millard. Planning Coordinator/Deputy Clerk Margaret Underhill, Chief Building Official/Drainage Superintendent Bill Knifton and Water Wastewater Manager Ed Roloson were in attendance to present their respective reports. 1. CALL TO ORDER Mayor Ens called the meeting to order at 7:00 p.m. 2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF No disclosures of pecuniary interest were declared. 3. CARRIED UNANIMOUSLY 4. DELEGATIONS, STATEMENTS AND UPDATES 1. DELEGATIONS (a) 7:05 p.m. - Elizabeth VanHooren from Kettle Creek Conservation Authority regarding County of Elgin Joint Shoreline Management Plan. Ms. VanHooren provided a powerpoint presentation and confirmed that the four Conservation Authorities in Elgin County have passed resolutions supporting a collaborative update of their respective Shoreline Management Plans(established in 1989)proposed for 2014. The cost estimate for the entire project is$150,000. The County has been asked to cover 50% of the cost and has agreed to include$75,000 in the 2014 preliminary budget for consideration. A joint plan, incorporated into the Official Plans would ensure the integrity of the investment and a review every five years rather than the existing 25 year requirement. The lower tier municipalities are being asked to participate and fund the remaining half based on the amount of shoreline in their jurisdiction. Bayham's share, based on 14 km at 50%is $7,000. A Council or staff representative from each participating municipality would be appointed to a Joint Shoreline Management Steering Committee to formalize terms of reference, review and comment on documentation. 2013-475 Moved by Councillor E Ketchabaw Seconded by Councillor W Casier "THAT the Council of the Municipality of Bayham supports an Elgin County Joint Shoreline Management Plan including the Kettle Creek,Catfish Creek,Long Point Region and Lower Thames Valley Conservation Authorities; AND THAT monies be allocated in the 2014 operating budget to go toward the cost for consideration during the 2014 Budget deliberations." CARRIED UNANIMOUSLY Page 2 of 17 Council Agenda November 07, 2013 (b) 7:20 p.m. -Marion Rogers regarding "Questions on Economic Development. Ms. Roger raised her views, opinions and concerns regarding inadequacy of replies to public questions on economic development, protection of public health and welfare and stimulation of local economic development. Mayor Ens identified the following efforts being support by Council: zoning changes that support expansion of value-added agricultural products, crops grown on reduced size parcels, funding to support local businesses through the façade program,trail development through the re-establishment of the Otter Valley Trail Committee,health care in East Elgin through the Family Health Team and establishment of part-time ambulance services at the Straffordville firehall. He also noted that Stats Canada is responsible for census,population and other related survey updates. (c) 7:35 p.m. -Nelson Oliveira from Stantec Consulting Ltd regarding "Richmond Community Water System construction update". Nelson Oliveira gave an update on the Richmond Community Water System, noting that MOE representatives recently attended at the site and were pleased with the works completed to date. He reminded Council that the building had to be refurbished, including the installation of a brand new treatment system, calibration of new equipment, adjustment of chemicals, chlorine and pumps to provide water from two separate sources that is safe for consumption. New equipment failed and was replaced under warranty. It is expected that the system will be operational in a couple of weeks. 2. STATEMENTS BY COUNCIL There were no statements by Council. 3. File: T04 The Administrator noted that the load limit downgrade by the County limits access to properties on the north-west side of the bridge for waste management, fire protection and delivery and pick up of agricultural products from the existing farm properties. File: E09 Bill Knifton, Drainage.Superintendent,presented his report, noting that the full allocation of costs is to the property owner as a condition of severance. John Spriet Sr., Engineer noted that the properties have an ample water supply and the drain will not be constructed as deep as the wells. STAFF PRESENTATION Staff Report DR2013-024 regarding Corinth Drain Branch "B" Court of Revision. File: E09 The Drainage Superintendent presented his report, noting that the allocation of costs has been determined by the Engineer. He noted that no written appeals have been received, however, Ms. Chyrlynn Chilcott, on behalf of Mr. Walter Chilcott wishes to present a verbal appeal for a reduction to their assessment being Roll#005-187-10. John Spriet Sr. noted that 1985 original Branch "B" drain that was built on Railroad land, did not include the Chilcott property and later became a Municipal drain. He noted that the drain has not been working properly for some time and a through investigation has been made into the cause of the malfunction. Using new technology, a video camera was utilized to examine the tile, which showed considerable blockage indicating that the drain had collapsed. Mr. Spriet noted that any assessment can be appealed, and that any decrease in assessment for one property triggers an equal increase to another. He then proceeded to explain to Council their options should Council wish to make an amendment to the Chilcott or any assessment. He agreed that the Chilcotts are extremely affected by the flooding. CARRIED UNANIMOUSLY PUBLIC COMMENTS Ms. Chilcott raised the issue that they have had excessive flooding of their property for quite some time. Over the past year, they have purchased and utilized a number of inside and outside sump pumps on their property and recently added a generator, (equipment they had never needed in the past) in attempts to deal with the heavy flooding. She noted that the flooding appears to be more than just from the rain water and they have added fill hoping to keep the water away from their door. Ms. Chilcott was concerned that above and beyond their costs already incurred, the Engineer's original estimate of$900 has increased to $1,400. Ms. Chilcott advised that they had experienced no flooding before the Henry Street Drain was constructed. She claimed the Municipality has not been maintaining the drains in Corinth on a regular basis, otherwise there wouldn't be so much flooding. She requested that the assessment on the Chilcott property be reduced. COURT MEMBER COMMENTS AND QUESTIONS Council discussed options available with Mr. Spriet,that would not delay the construction. D.17 of the Drainage Act, R.S.O. 1990 the appeal period which allows any owner of land assessed for drainage works to appeal: -that road or land has been assessed too high or too low, or - that any land or road that should be assessed has not been assessed, or -that due consideration has not been given as to type of use of land and the Court of Revision has determined the assessment appeal for property owned by Walter Chilcott, being Lot 5 Conc. 9, Roll#005-187-100 shall be approved and that the following adjustments be made; Page 9 of 17 Council Agenda November 07, 2013 Roll#005-187-10 reduced benefit charge by $500.00 Municipality of Bayham roads assessment increased by $500.00." John Spriet Jr., Engineer noted that the County of Elgin is assuming some of the costs for work that will address current issues with the rain water run-off from Plank Road. File: C06 The Clerk advised of recommended changes to the Municipal Alcohol Policy since the OPP have advised that using their services for Buck and Doe functions is no longer an option. She also noted that since the refinishing of the wood floors at the Vienna hall were not included in the 2013 operating budget, it was recommended that Council authorize payment from the reserve fund. File: C06 Councillor Southwick commented that since there may be potential health concerns, no one he has spoken with sees any reason for Council not to request that the Small Craft Harbours proceed with the Detailed Risk Assessment of the Port Burwell Harbour.
