Present were Mayor Paul Ens, Councillors Wayne Casier, Tom Southwick and Ed Ketchabaw, Administrator Kyle Kruger and Clerk Lynda Millard. Deputy Mayor Cliff Evanitski was absent. Drainage Superintendent Bill Knifton and Water Wastewater Superintendent Ed Roloson were in attendance to present their respective reports. 1. CALL TO ORDER Mayor Ens called the meeting to order at 7:00 p.m. 2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF None. 3. CARRIED UNANIMOUSLY PUBLIC MEETING 8:00 p.m. - Soreny Branch Municipal Drain - to consider Spriet Associates Engineer's Report#213136 dated June 28, 2013. File: E09 DECLARATION OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF None. STAFF PRESENTATION Staff Report DR2013-014 and attached Engineer's Report regarding Soreny Branch Municipal Drain. File: E09 John Spriet Jr., Engineer, of Spriet Associates was in attendance to present the Drainage Report. The watershed area contains approximately 0.5 hectares of farmland, containing 4 newly created residential lots, located in Lot 124, Concession NTR fronting on the north limit of Donnelly Drive. The proposed work will be constructed in accordance with Drainage Act guidelines and the cost will be assessed against property Roll No. 004-09700, owned by Soreny Farms. The Drainage Superintendent noted that the Provisional by-law requires first and second reading and the setting of a date for the Court of Revision. PUBLIC COMMENTS None. COUNCIL COMMENTS AND QUESTIONS Q. Councillor Casier questioned where the branch would tie in. A. Mr. Spriet responded that the farmland property is tributary to, and will tie in to Drain No. 7 of the Straffordville Drain. Q. Mayor Ens questioned the capacity of the drain. A. Mr. Spriet confirmed that the new branch should not overload the existing drain. Council members expressed interest in knowing the amount of revenue generated through the firefighter training workshops. 2013-338 Moved by Councillor W Casier Seconded by Councillor E Ketchabaw "THAT Cheque Register being Cheque#014913 to Cheque#015033 inclusive, except Cheque#014930 totaling $276,871.74 and Payroll Disbursements for the period ending July 21,2013 totaling$61,539.90 be approved." CARRIED UNANIMOUSLY (b) Correspondence dated July 17, 2013 from Ontario Building Officials Association, Southwestern Chapter regarding "Re-qualification of Building Officials". File: A01 Page 4 of 8 Council Minutes August 01, 2013 Staff noted that the proposed requirements for CBO training is beyond that of other such professionals and re-certification is unjust and costly. 2013-339 Moved by Councillor T Southwick Seconded by Councillor W Casier "WHEREAS, municipal building officials are the main practitioners of the Ontario Building Code (OBC) and use the OBC on a daily basis in the carrying out of their duties; AND WHEREAS Bill 124 passed in 2005 required all municipal building officials to undertake a series of qualification exams; AND WHEREAS a subsequent regulation 332/12 (knowledge and maintenance examinations) requires our already qualified officials to re-qualify by taking a similar series of qualification exams again; AND WHEREAS this re-qualification process will provide municipalities with financial hardships in terms of registration costs, mileage costs, days away from the office to undertake their regular duties in performing timely inspections that is expected by the building industry; AND WHEREAS, municipal building officials acknowledge the need to stay current with legislation and to undergo necessary training to do so; AND WHEREAS, the builders and home owners will suffer slower response time for building permits and inspections until all of the building officials are qualified; AND WHEREAS, there may be an increase to permit fees to absorb the additional costs due to training/courses, examinations, travel, accommodations, additional staffing; NOW, THEREFORE, the Municipality of Bayham, in support of the Southwestern Chapter of the Ontario Building Officials Association resolves; THAT any amendments to the OBC include provisions for training opportunities rather than requalification examinations as the means by which building officials remain current of changes to the OBC; THAT municipal building officials, as the primary practitioners of the OBC, receive the same treatment as plumbers, electricians, professional engineers and architects with regards to exemption from re-qualification; THAT the negative impact and delays that Ontario regulation 332/12 will have on the issuance of permits, inspections and response times to inquiries by municipal building officials should be taken in to consideration; Page 5 of 8 Council Minutes August 01, 2013 AND THAT municipalities and taxpayers be spared the cost of'knowledge and maintenance examinations' under the proposed amendment to the OBC which will provide undue hardship to municipalities through lost productivity, early retirement and costs associated with the 13 categories of examinations required by fully qualified inspectors." CARRIED UNANIMOUSLY (d) Correspondence dated July 12, 2013 from Straffordville Public School regarding "Crossing Guard". File: C13 The Administrator noted that the establishment of school crossing guards is at the discretion of either the local or upper tier government under the Highway Traffic Act. Pavement markings, signage, installation of flashing lights and/or other methods may be incorporated to support a higher level of safety for school children and the public. File: C13 2013-342 Moved by Councillor W Casier Seconded by Councillor E Ketchabaw "THAT Council supports a reduction in the rental fee paid by Jessica Black for use of the Bayham Community Centre to $25.00 per session for the months of August and September 2013." CARRIED UNANIMOUSLY Page 6 of 8 Council Minutes August 01, 2013 10. ENVIRONMENT (a) Staff Memorandum and Letter from Stantec Consulting regarding Richmond Community Water Tender Results. File: E01 Water/Wastewater Manager Ed Roloson noted that all submissions failed to meet the necessary requirements for approval. He noted that staff propose to incorporate scaled down modifications to keep the contractors interested and reduce costs significantly. During construction, delivery twice daily by a local water hauler will ensure potable water for the existing users from the Secondary Water System. This will have minimal impact on the pressure at the tower on Nova Scotia Line. The water will be tested on the truck and at the Richmond station. MOE approval is based on the design of the system and does not require inspection. Staff are working with the MOE to ensure full compliance before turning on the valve for the new system. 2013-343 Moved by Councillor W Casier Seconded by Councillor E Ketchabaw "THAT the Council of the Municipality of Bayham hereby rejects the three Contractor submissions, as recommended by Stantec Consulting Ltd; THAT staff be authorized and directed to modify the scope of work for the Richmond Community Water Project and obtain contractor quotations as per the Municipal Procurement Policy; AND THAT staff be authorized to proceed with the works upon receipt of a suitable quote."
