HomeMy WebLinkAboutMay 16, 2013 - Council COUNCIL MINUTES THE CORPORATION OF THE MUNICIPALITY OF BAYHAM 9344 Plank Road, Straffordville Thursday, May 16,2013 7:00 PM The regular meeting of the Council of the Municipality of Bayham was held on Thursday, May 16, 2013 in the Council Chambers. Present were Mayor Paul Ens, Deputy Mayor Cliff Evanitski, Councillors Wayne Casier, Tom Southwick and Ed Ketchabaw, Administrator Kyle Kruger and Clerk Lynda Millard. Planning Coordinator/Deputy Clerk Margaret Underhill and Chief Building Official/Drainage Superintendent Bill Knifton were in attendance to present their respective reports. 1. CALL TO ORDER Mayor Ens called the meeting to order at 7:00 p.m. 2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF None. 3. APPROVAL OF MINUTES AND ADDITION OF AGENDA ITEMS (a) Minutes of the regular meeting of Council held May 2, 2013. Mayor Ens noted that his comments under item 5(i) in reference to east and West Elgin should be reversed. 2013-225 Moved by Councillor T Southwick Seconded by Councillor W Casier "THAT the minutes of the regular meeting held May 2, 2013 be approved as amended." STATEMENTS BY COUNCIL It was questioned whether staff was following up with any action on the gas pumps and suggested that the pumps be removed or boxes be built over the pumps. It was felt that building boxes might create opportunities for vandalism or graffiti. It was also questioned whether this is a property standards issue and costs could be assessed to the property. The Administrator confirmed that the property has been abandoned and no taxes are being collected on this property. Staff was requested to have a response for the next meeting. 3. UPDATES ON PROJECTS (a) Richmond Community Water System The Administrator advised that the equipment has been ordered and delivery is expected in the next week or two. He reported that an on site meeting is planned with contractors and the project should meet the required time frame for completion. (b) Harbour Divestiture The Administrator noted that there has been no update by Small Craft Harbours. 5. File: Fl1 Councillor Casier noted that there are funds allocated to reserves for upgrades to the Vienna Community Centre and received support from Council to have staff obtain quotes to drywall and paint the basement side walls and install new flooring based on previous information and samples. CARRIED UNANIMOUSLY 6. PLANNING, DEVELOPMENT, RECREATION & TOURISM (a) Staff Report D2013-018 regarding Dyck Development Agreement/By-Law. File: L04.DYCKG 2013-228 Moved by Councillor E Ketchabaw Seconded by Councillor T Southwick "THAT By-law No. 2013-046, being a By-law to authorize the execution of a Development Agreement between Gerhard and Maria Dyck and the Municipality, pertaining to a supplementary farm dwelling, be presented to Council for enactment." CARRIED UNANIMOUSLY 7. ROADS, AGRICULTURE & DRAINAGE (a) Staff Report DR2013-007 regarding Petition for Drainage from CD Phillips Limited. File: E09 Drainage Superintendent Bill Knifton noted that adequate drainage is a requirement for the new lots created in the hamlet of Calton. The ravine to the north will provide a legal and natural outlet. Page 4 of 8 Council Minutes May 16, 2013 2013-229 Moved by Councillor T Southwick Seconded by Councillor E Ketchabaw "THAT Council of the Municipality of Bayham acknowledges the filing with the Clerk of the Petition for drainage works by CD Phillips Limited on May 7, 2013; AND THAT Staff Report DR2013-007 regarding the petition for drainage and for drainage improvement be received; AND THAT Council wishes to proceed with this matter and appoints Spriets Associates,Engineers, to prepare a report on the proposed drainage area pursuant to Section 5 and Section 8(1) of the Drainage Act, for Council's consideration." CARRIED UNANIMOUSLY 8. PROPERTY, BUILDING & PROTECTIVE SERVICES (a) Staff memo requesting discussion regarding areas impacted by Project Ojibwa west of Robinson Street and potential restoration. File: D06 The Administrator provided a map and layout of the affected property west of Robinson Street that is believed to be on municipal lands. He added that the Public Works department can grade the soil piled south of the property to level the area within a couple days at an estimated cost of $2,000 to $3,000. An application for a permit has already been submitted to the LPRCA. The Elgin Military Museum, owner of the nearby Pitt Street property, has retained a contractor to grade that area and make it more passable. Council discussion included: • determining that the property owner is agreeable to the proposed works, • advising the Elgin Military Museum that the Municipality deems the works necessary due to the Ojibwa move and they will be responsible for the costs, • using the existing berm material near the pier to bring up to a standard grade and add gravel and level, • owner may want the pile of earth to the north on the map leveled. Staff was directed to contact the owner and proceed with his permission. 9. FINANCE,ADMINISTRATION & PERSONNEL (a) Cheque Register being Cheque#014414 to Cheque#014531 inclusive, except Cheque #014509 totaling $445,759.58 and Payroll Disbursements for the period ending April 28, 2013 totaling$55,922.48. CARRIED UNANIMOUSLY (b) Bayham Rail Trail Suggestions submitted May 7, 2013 by the Otter Valley Naturalists. File: D06 The Administrator noted that there are monies allocated in the budget for improvements to the Otter Valley Recreation Trail and Utility Corridor between Port Burwell and Vienna. As requested, he approached the Otter Valley Naturalists for suggestions and they provided their list for Council's consideration. Following discussion, staff was directed to advertise for interested volunteers to serve on a trail committee to be established by Council. (c) Staff Report PW2013-07 regarding Village and Hamlet Entrance Signs Policy File: T07 The Administrator advised that some of the municipal signage is in need of maintenance and/or replacement and staff are looking for Council to determine a policy for staff to address the needs of custom and standard signage currently in place. 2013-231 Moved by Councillor E Ketchabaw Seconded by Councillor T Southwick "THAT the policy for Village and Hamlet entrance signs as recommended in report PW2013-07 be adopted." CARRIED UNANIMOUSLY (d) Email correspondence from Fran Southwick requesting hanging of flags in Vienna. File: C13 It was noted that permission from, and installation of flags on hydro poles by Hydro One had been completed in 2012 in Vienna. When these Canadian flags became tattered, they were removed by Public Works staff. It was suggested that installation of flags and banners be requested by the groups in their annual Municipal Assistance application.
