Council Chambers The special meeting of Council of the Municipality of Bayham was held on Monday, April 22, 2013 in the Council Chambers. Present were Mayor Paul Ens, Deputy Mayor Cliff Evanitski, Councillors Wayne Casier and Tom Southwick,Administrator Kyle Kruger and Public Works Manager Vance Czerwinski. It was noted that Councillor Ketchabaw sends his regrets, as he is attending a prior meeting commitment out of town. 1. CALL TO ORDER Mayor Ens called the meeting to order at 7:00 p.m. 2. DECLARATION OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF None 3. ADMINISTRATION (a) Staff Report PW 2013-05 regarding Municipal Beach Maintenance 2013. File: A20 The Public Works Manager reviewed report PW2013-15. He noted the meeting held Friday April 19th with Riggs Engineering and LPRCA staff, followed by a meeting with a contractor to discuss activities and costs. He highlighted the cost of$15,000 cited in the report is an upset limit based on those discussions. He also noted that confirmation had subsequently been received from LPRCA that the MNR has been made aware of the situation and the potential permit application forthcoming. Council members discussed the situation and the current conditions. It was highlighted that the conditions of the pond area and sand bar change daily, where in certain times of the day it is below water, and other times it is again visible. Council members questioned when the last depths of the pond area where checked. Staff advised that the last measurements were approximately two weeks ago. Council members further discussed the need to proceed with permit applications to ensure works can be done within the available window, and options for potential works. There was further discussion on whether any works should proceed given the related expense, or whether the natural processes on the beach will correct the situation. In regard to expenses, opinion was also expressed that the Elgin Military Museum should. be responsible for costs, as was noted to them in correspondence in November 2012. Page 1 of Council Special Meeting Minutes April 22,2013 2013-195 Moved by Councillor T Southwick Seconded by Deputy Mayor C Evanitski "THAT Staff be directed to obtain the necessary permits to remove the sand bar near the east beach shoreline prior to May 1, 2013 and take updated depth measurements; THAT the Elgin Military Museum be contacted to confirm that they agree to fmancial responsibility for costs associated with the sand bar removal, as proposed; THAT, should the Elgin Military Museum acknowledge responsibility,that a contractor be retained and the works proceed; AND THAT,in the event the Elgin Military Museum does not acknowledge responsibility, a further meeting be held Wednesday,April 24, 2013." BY-LAWS (a) By-law 2013-041 A By-law to confirm all actions of Council 2013-196 Moved by Deputy Mayor C Evanitski Seconded by Councillor W Casier "THAT confirming By-law 2013-041 be read a first, second and third time and finally passed."
