The regular meeting of the Council of the Municipality of Bayham was held on Thursday, March
7, 2013 in the Council Chambers. Present were Mayor Paul Ens,Acting Deputy Mayor Wayne
Casier, Councillors Tom Southwick and Ed Ketchabaw, Administrator Kyle Kruger and Clerk
Lynda Millard.
Planning Co-ordinator Margaret Underhill was in attendance to present her report.
1. CALL TO ORDER
Mayor Ens called the meeting to order at 7:00 p.m.
2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL NATURE

3. APPROVAL OF MINUTES AND ADDITION OF AGENDA ITEMS
(a) Minutes of the budget meeting held February 20, 2013.

4. DELEGATIONS, STATEMENTS AND UPDATES
1. DELEGATIONS
(a) 7:05 p.m. - Inspector Brad Fishleigh, Elgin OPP Detachment Commander and Douglas
Gunn, Chairman, Elgin Police Services Board regarding "2012 Annual Report".
Commander Fishleigh reviewed the 2012 OPP Annual Report,highlighting areas of
particular interest in Bayham.
Mr. Gunn noted the increase in calls for service and domestic violence responses. He
commended Commander Fishleigh for the Elgin OPP having one of the lowest per capita
costs in Ontario.

(b) 7:45 p.m. - Susan Noseworthy, Dan Scott and Doug Park on behalf of Port Burwell
Firefighter Association regarding permission to use Bayham Station 1 for fundraising
events during the 2013 calendar year.
The Firefighter representatives noted that Zumba classes and pancake breakfasts are
being held at the Port Burwell firehall as part of their fundraising endeavours with funds
going toward the purchase of an Air filling station for cylinders used by both fire stations.
According to the new policy recently adopted by Council, any functions held at the
firehalls are to be supervised by a firefighter and a list of all events provided to Council at
year end.

"THAT the correspondence from the Port Burwell Firefighter Association be
received;
AND THAT Council approves the use of the Port Burwell Fire Station by the
Association for fundraising events for 2013 as requested."

(c) 8:00 p.m. -Honor Wassing regarding "Concerns regarding eligibility of by-election
candidates".
Ms Wassing raised concerns that employees of a conservation authority and/or a school
board may not be eligible to hold a Council position. She commented that Council should
address concerns as to what constitutes a local board,particularly as it pertains to the
Long Point Region Conservation Authority and whether an employee qualifies as a
candidate for the upcoming municipal by-election.

The Administrator noted that Council can seek clarification, however, when a candidate
submits a nomination form,they must certify that they meet the requirements. This
certification can be challenged through the court system. If a successful candidate is
determined ineligible,he/she would be required to vacate the seat and the position filled
by appointment or by a by-election. Council has no authority to remove a person's name
from the certified list of candidates.

3. UPDATES ON PROJECTS
(a) Richmond Community Water System.
The Administrator advised that the Engineer expects to finalize the equipment
specification details for the system by the end of the week and will be seeking quotes.
Work on the final design is proceeding and is on schedule.
(b) Harbour Divestiture.
Staff advised that Small Craft Harbours expects the final ESA report will be available at
the end of March.

(a) Breaking News dated February 19, 2013 from Association of Municipalities of Ontario
regarding "Speech from the Throne Emphasizes Action on Economic Growth,
Infrastructure, Employment and Arbitration".

regarding "Municipal Confinement of Dogs and Cats in Elgin County Under the

PUBLIC MEETING
7:37 p.m. -Bayham Rezoning- 9299 Plank Road-to change the zoning on a
municipally owned parcel of land from the compound Central Business District(C1)
and Village Residential (R1)Zone to a site-specific Village Residential (R1-9) Zone
submitted by the Municipality of Bayham.

The Planning Co-ordinator noted that the re-zoning is to remove the commercial
designation for the medical facility property, owned by the Municipality, as a condition

"THAT the request from Fred Shelly on behalf of the Trinity Anglican Church to
have a Camp Fire type burn on the East beach near the Handicap Platform for the
Easter Sunrise Service on Sunday,March 31,2013 at 7:00 a.m. be approved,
subject to provision of proof of liability insurance coverage naming the
Municipality of Bayham as an additional insured in the minimum amount of
$2,000,000;
THAT a burn permit be provided;
AND THAT the permit fee of$25.00 be waived."

(b) Correspondence dated March 1,2013 from Oxford County regarding "Highway 3 and
Highway 19 (Vienna Road) Intersection Improvements".

The Administrator commented that the correspondence pertains to installation of a round-
about to replace the stop lights at the intersection of Vienna Road and Highway#3, at the
southern area of Tillsonburg. The proposed five month project would have a considerable
negative impact on emergency responses to Bayham and tourism.
