Present were Mayor Paul Ens, Acting Deputy Mayor Wayne Casier, Councillors Tom Southwick and Ed Ketchabaw, Administrator Kyle Kruger and Clerk Lynda Millard. Treasurer David Aristone, Planning Coordinator/Deputy Clerk Margaret Underhill and Water Wastewater Superintendent Ed Roloson were in attendance to present their respective reports. 1. CALL TO ORDER Mayor Ens called the meeting to order at 7:00 p.m. 2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF None. 3. APPROVAL OF MINUTES AND ADDITION OF AGENDA ITEMS (a) Minutes of the regular meeting of Council held January 24, 2013. 2013-064 Moved by Councillor T Southwick Seconded by Acting Deputy Mayor W Casier "THAT the minutes of the regular meeting held January 24,2013 be approved as circulated." DELEGATIONS (a) 7:05 p.m. - Erica Arnett from Elgin St. Thomas Public Health and Nicole Ooms from Doug Tarry Ltd. regarding "Elgin St. Thomas Active Transportation Initiative". Ms. Arnett and Ms. Ooms gave a presentation on the transportation and active recreation opportunities initiative, sharing the vision, objectives and highlights from the completed report. There were 850 responses to the survey across the County and St. Thomas, however, few from Bayham. A grant of$5,900 has been received to implement low budget amenities including education, awareness and signage programs that educate cyclists and drivers about sharing the road. 2013-066 Moved by Acting Deputy Mayor W Casier Seconded by Councillor T Southwick "THAT the Council of the Municipality of Bayham adopts the Elgin St. Thomas Active Transportation Initiative as a guidance document for the development of active transportation facilities throughout Elgin St. Thomas; AND THAT Council approves participation of the Municipality in the Share the Road program and attendance of the Public Works Manager at a meeting to co- ordinate installation of signs throughout Elgin St. Thomas." CARRIED UNANIMOUSLY 2. STATEMENTS BY COUNCIL (a) Queen's Jubilee Medal presentation. Acting Deputy Mayor Wayne Casier presented Mayor Paul Ens with a Queen's Jubilee Medal. The nomination was put forward by the Federation of Canadian Municipalities for all Mayors of Municipalities who have been a member of the Federation for five years or more. Mayor Ens acknowledged his appreciation. (b) Winner of bag tag draw. Mayor Ens announced that the winner of the$250 Bayham Bucks in the Bag Tag draw that closed January 30,being Lynn Acre. 3. UPDATES ON PROJECTS (a) Richmond Community Water. Nothing to report (b) Harbour Divestiture. The Administrator noted that an email has been sent requesting an update from Small Craft Harbours. File: C06 (g) Correspondence dated January 21, 2013 from Ontario Provincial Police Detachment Commander Inspector Brad Fishleigh regarding "Elgin Group Police Services Board meeting held January 16, 2013". File: P17 Acting Deputy Mayor Wayne Casier brought the correspondence to member attention regarding the efficiencies that are being achieved by the Elgin OPP. He noted that Elgin OPP operate as one of the lowest per capita costs in Ontario. (h) Bayham Community Centres Committee minutes of meeting held January 31,2013. File: C06 Acting Deputy Mayor Casier explained the recommendation from the Community Centres Committee regarding a rental rate for use of the Vienna hall by the Periscope Playhouse group during July and October. Staff was requested to provide the recommendation to the group for consideration and that Council consider the matter and comments from the group at the next budget meeting on February 20th. 2013-067 Moved by Acting Deputy Mayor W Casier Seconded by Councillor E Ketchabaw "THAT information items 5(a)through 5(g)be received for information." CARRIED UNANIMOUSLY Page 4 of 9 Council Minutes February 07, 2013 (c) Staff Report F2013-06 regarding Water& Sewer Rates. File: F05.11 The Treasurer noted that the local water rates build upon the primary and secondary water rates established by those systems and provide for the local costs, based on the 2013 draft departmental budgets for Bayham. Other documentation relied upon to establish rates for 2013 included the 2010 Water Financial Plan and the 2006 Wastewater Study,both produced by C.N. Watson and Associates. He noted that the financial sustainability of the Waste Water system is intact. Reserve transfers for the next five years will increase substantially due to landowner debenture payments. The ten year sewer debenture was completed in 2012, however some repayments continue. This additional revenue was not factored into projections in the 2006 Wastewater study and enhances the projected reserve transfers in that study. It was recommended that Council maintain the rates as set in 2012. In regard to the wastewater rate structure, he noted that it may be possible to establish a water surcharge structure for Port Burwell and Vienna, as water consumption for individual users in those communities can be determined. For other system users it will be impossible to establish such a structure, as their source of water is private wells. Implementation of a water surcharge structure will need to include the calculation of a fixed cost component charge similar to the water rate structure to insure low water consumers will bear the appropriate system costs. The administrative process of a two structure rate system needs to be investigated to insure complex situations or disadvantages between communities and businesses do not occur. The Water/Wastewater Superintendent noted that staff time for the following systems is assessed at 65% for wastewater, Bayham water at 20%, Richmond Community Water at 14% and 1/2% related to municipal small non-residential water wells. Additional training and licensing will be required for operation of the Richmond system when the project is completed. 2013-071 Moved by Councillor E Ketchabaw Seconded by Acting Deputy Mayor W Casier "THAT By-Law 2011-016 being a by-law to set water and sewer rates be maintained and that the Richmond Water System flat fee of$912 per year be confirmed for 2013." CARRIED UNANIMOUSLY (d) Staff Memorandum regarding Amendments to Municipal Property Insurance - Buildings. File: L06 Page 5 of 9 Council Minutes February 07, 2013 The Administrator noted the following options put forth by our insurers for coverage of vacant buildings: 1. Amend the locations to our Commercial Building, Equipment and Stock Named Perils Form on an Actual Cash Value basis subject to a minimum$ 10,000 deductible. -Vacant Former Fire Hall, 24 Pitt St(Actual Cash Value$195,400)= $1,501 additional annual premium. -Vacant Former Library 6208 Plank Rd(Actual Cash Value per current policy$334,800) = $3,777 additional annual premium, or recalculated Actual Cash Value ($201,100)=$2,159. additional annual premium. 2. Amend the locations to our Demolition and Debris Named Perils Endorsement subject to a minimum$ 10,000 deductible. -Vacant Former Fire Hall, 24 Pitt St(Demolition and Debris Value$56,000)= $ 177 additional annual premium. -Vacant Former Library 6208 Plank Rd(Demolition and Debris Value$47,500)= $ 301 additional annual premium. He also noted the option to remove the buildings from the policy entirely(the locations would remain covered for liability). 2013-072 Moved by Acting Deputy Mayor W Casier Seconded by Councillor E Ketchabaw "THAT Council approves the Municipal Property Insurance Option for the vacant former Port Burwell fire hall and the vacant former Vienna library option that the buildings be covered for demolition and debris only."
