The regular meeting of the Council of the Municipality of Bayham was held on Thursday,
January 23, 2014 in the Council Chambers. Present were Mayor Paul Ens, Deputy Mayor Cliff
Evanitski, Councillors Wayne Casier, Tom Southwick and Ed Ketchabaw, Treasurer and Acting
Administrator David Aristone and Clerk Lynda Millard.
Public Works Manager Vance Czerwinski and Chief Building Official/Drainage Superintendent
Bill Knifton were in attendance to present their respective reports.
1. CALL TO ORDER
Mayor Ens called the meeting to order at 7:00 p.m.
(a) Mayor Ens introduced Bayham's new Fire Chief, Randy White.
Mr. White thanked the Mayor and Council for the opportunity to work in Bayham. He noted that
he is impressed with the existing fire equipment and the quality of training demonstrated by fire
fighter personnel. He also commended Chris McQuiggan for his excellent efforts as interim
acting Fire Chief.

4. DELEGATIONS, STATEMENTS AND UPDATES
1. DELEGATIONS
(a) 7:05 p.m. -Margot (Auber) Pieters regarding Port Burwell Public School "Pole
Painting Event"
Ms. Pieters made an excellent presentation regarding efforts by staff and students at the Port
Burwell Public School to arrange a hydro pole painting event under the "PoleStars Program" in
partnership with Hydro One, which has requested confirmation of Council's support.
She advised that a proposal in December requesting permission to decorate designated hydro
poles along Robinson Street, south of the bridge, has been approved by Hydro One.
Ms. Pieters provided a long list of accomplishments to date, including a video created by the
children, sent to Hydro One's President and posted on YOUTUBE.
In preparation for the pole-decorating event, Hydro One will bring its Mobile Electricity
Discovery Centre to the school to educate students with respect to electrical safety
on Wednesday, February 5th. On Thursday,February 6, the Centre will host students from
Tillsonburg, Aylmer, and Straffordville schools.
On Friday, February 7th the President&CEO, Mr. Marcello will make a presentation to Port
Burwell Public School. In return, the school has arranged a private tour of the Ojibwa submarine
for Mr. Marcello and his team,with lunch to follow.
The Mobile Electricity Discovery Centre will welcome the public from Wednesday,February 5
through Friday, February 7 from 5:00 p.m.to 8:00 p.m.

The pole-decorating event is proposed for late April or early May depending on when Mr.
Marcello is available to be the first to decorate one of the poles.
Ms. Pieters noted that community support has been generous and requested Council to provide
support up to $2,000 to purchase tubes of acrylic paint and more T-shirts.
Council directed that a letter of support be sent to the group and agreed to consider a contribution
at the budget meeting being held January 30th.

3. UPDATES ON PROJECTS
(a) Richmond Community Water System
David Aristone, acting Administrator confirmed the system is working well, and staff time has •
been reduced to three hours per week. He added that a report on the distribution system is being
completed by Cyril J Demeyere Ltd. and will be provided to Council shortly.
Mayor Ens suggested that an Open House for the users be held at the facility once a summary of
the costs and results of the recent MOE inspection are known.

Councillor Southwick requested and Deputy Mayor Evanitski agreed that Council make their
opposition known to a suggestion by the Provincial government of an HST tax increase to
support transit in the GTA.

as Given Road, commencing at Baldwin Line north-westerly to the Big Otter Creek,
surplus to municipal needs;
THAT Staff confirm with the abutting property owners their expression of interest
to acquire the lands, before proceeding;

AND THAT upon confirmation, Staff be directed to take the necessary steps to
convey the said lands to the abutting property owners, subject to shared payment, at
the appraised value per acre,to the Municipality,plus their proportionate share of

It was noted that the owner of the house property along the unopened road allowance has an
agreement with the municipality permitting access, without which the property is landlocked.
Council indicated a preference for establishing a permanent frontage rather than an access
agreement.
Staff was requested to research the original reason for closure.

The Public Works Manager advised that the company is not receptive to negotiation of the
purchase price.
He was requested to investigate and report how many hours the rental unit was used in 2013 by
both the Public Works and Water/Wastewater departments.
(c) Staff Report PW2014-06 regarding "Crossing Guard Request". Murray Quinton to
attend to respond to any questions from Council. (Deferred from January 9, 2014
meeting)

The Public Works Manager Czerwinski noted that Mr. Quinton of the Commissionaires is ill and
unable to attend.
The acting Administrator/Treasurer advised that inquiry has been made to the insurer regarding
ramifications under the Highway Traffic Act and potential liability should no action be taken.

"THAT the Ontario Association of Police Services Boards correspondence dated
November 25, 2013 regarding Ontario Provincial Police Alternative Billing
Consultations be received;
THAT the Council of the Municipality of Bayham agrees with the concerns raised in
the correspondence regarding the Process and Research, the Implications for
Citizen Oversight of Policing and the Potential Impact on Individual Municipalities;
THAT Council supports the emphasis detailed in the summary including:
•exploration of other options for paying for policing;
• across the board redistribution of costs is not a wise response;

• the province play a stronger role in building and defending mechanisms for citizen
oversight that serve all taxpayers,including those who contract for police services
with the OPP;
• future billing models recognize complexities in the economic and taxation base of
municipalities and ensure that it is not only the residential taxpayer that carries the
burden of policing costs;
•the Province consider their approach to billing for OPP services in light of their
commitment to strengthen rural municipalities;
AND FURTHER THAT this resolution be forwarded to Premier Kathleen Wynne,
the Minister of Community Safety & Correctional Services,the Attorney General of
Ontario,the Minister of Rural Affairs,the Ontario Association of Police Services
Boards, OPP Commissioner Chris Lewis,Leaders of the Opposition,Jeff Yurek,
M.P.P. Elgin-Middlesex-London, the Mayors Coalition for Affordable and
Sustainable Policing and the Association of Municipalities of Ontario (AMO) for
action as appropriate."

AND THAT this resolution and a copy of the presentation be forwarded to Premier
Kathleen Wynne,the Minister of Community Safety& Correctional Services,the
Attorney General of Ontario,the Minister of Rural Affairs,the Ontario Association
of Police Services Boards, OPP Commissioner Chris Lewis,Leaders of the
Opposition,Jeff Yurek,M.P.P. Elgin-Middlesex-London,the Mayors Coalition for
Affordable and Sustainable Policing and the Association of Municipalities of

• the request to empower staff to partner with Dundee Energy to issue separate quotes for
dredging and to commit up to $20,0000 from the reserves in 2014;
• the MOE would want to know what is in the dredgeate prior to permitting it to be used in the
beach parking area;
• the dredging timeframe for the most effective results; and

financing the purchase of 8 benches at an approximate cost of$2,400.00 which will

The Treasurer advised that the asset management study does not include buildings.
He referred to:
• the Executive Summary on page 4;
• Road Network page 16 (does not include equipment replacement);
• Bridges and culverts page 25 does not include smaller culverts;
• Water system page 31 identifies only 2.2% in reserve for major system upgrades;
The secondary water system, including Dexter Line is 68% local responsibility
with minimal reserves; and
• Sanitary sewer system page 36 identifies limited reserves with a cost replacement
of $43million.

(g) Request for discussion regarding the old Vienna Hall.
Mayor Ens noted that several applications for funding to help save the Old Vienna Town Hall
submitted to the Ontario Trillium Foundation have been unsuccessful and suggested it is time to
consider demolition of the building and make the site safe.
He suggested that there may be items of historical interest that could be salvaged from the
building before/when being demolished. He named the upper area window.
Other potential items may be the hanging light fixtures(and globes?) and the ceiling arch beams,
or a portion thereof.
Council agreed that Staff be directed to obtain quotes for demolition and restoration, including
removal of the foundation and leveling. It was suggested that green space be created.
Staff was also requested to send a letter to the Vienna citizen group, advising them that no
funding is available and that Council has agreed to proceed with demolition.
