Zoning By-law to permit the construction of an accessory building with a gross floor area of 81.3
m² and a building height of 5.182 m, and to permit a total lot coverage of 37.6% resulting from
the proposed single detached dwelling and accessory building combined, on the property
known municipally as 11420 Bailey Court (east side) in Eden:
• Section 9.4 to permit a maximum lot coverage of 37.6%, resulting from the proposed single detached dwelling and accessory building combined, whereas a maximum lot coverage of 30% is permitted.
• Section 9.5.1 to permit a maximum accessory building height of 5.182 m, whereas a maximum building height of 4.5 m is permitted.

THE EFFECT of this variance is to permit the construction of a single detached dwelling and an

TAKE NOTICE that the applicant has withdrawn the application for a proposed Minor Variance (COA-12/26), which had
requested relief from Section 10.3 of Zoning By-law No. Z456-2003 to reduce the minimum lot area requirement from 800
m² to 637.6 m², and relief from Section 10.4 to reduce the minimum lot frontage requirement from 20 m to 15.25 m, in order
to facilitate the relocation of an existing cottage from the neighbouring property at 130 Faye Street onto the property
municipally known as 129 Faye Street.
AND TAKE NOTICE that, as a result of this withdrawal, the public meeting previously scheduled for Thursday, August
20th, 2026, at 6:45 p.m. in the Municipal Council Chambers, 56169 Heritage Line, Straffordville, to consider this application
will NOT proceed.
REASON FOR WITHDRAWAL: It has been determined that the subject lands at 129 Faye Street and 130 Faye Street are
held under common ownership and are legally merged as a single lot for the purposes of Zoning By-law No. Z456-2003. As
the lands are considered one lot, the minor variance relief originally sought is no longer required to facilitate the proposed
cottage relocation.

Background
The Municipality of Bayham has completed a review of the Minor Variance application COA-13/26, submitted by Ross Graham for the subject lands located at 56957 Talbot Line. The application is requesting a Minor Variance under Section 45 of the Planning Act to facilitate the construction of a building addition to provide additional warehouse and storage space on the property, in support of the ongoing operations of the existing business. Relief is requested as follows:
• Section 21.10.12.1 to permit a maximum gross floor area of 8,980 m², whereas 8,450 m² is the maximum permitted. Subject Lands and Surrounding Area The subject lands are designated "Agricultural" on Schedule "B" – Land Use Plan and "Natural Heritage" on Schedule "C" – The Natural System of the Municipality of Bayham Official Plan, and are zoned "Rural Industrial subzone 12 (M2-12)" in Schedule A (Map 2) of the Municipality of Bayham Zoning By-law Z456-2003. The Natural Heritage designation applies to a portion of the subject lands; the proposed building addition is not located within, and does not encroach upon, the area of the
property subject to the Natural Heritage designation. The subject lands, municipally known as 56957 Talbot Line, are occupied by an existing industrial building associated with Legend Rubber. The application proposes to construct a building addition to provide additional warehouse and storage space in support of the ongoing operations of the existing business. The existing building has a gross floor area of approximately 7,791 m². The proposed addition of approximately 1,189 m² would bring the total gross floor area to approximately 8,980 m², exceeding the maximum permitted gross floor area of 8,450 m² under Section 21.10.12.1 of the Zoning By-law.

The subject property has a frontage of approximately 226 m, a depth of approximately 300 m, and an area of approximately 61,236 m². The Minor Variance requested is required to permit this increased gross floor area to facilitate the proposed addition. The surrounding area is characterized by agricultural uses zoned Agricultural (A1) to the north, east, and south, and residential uses zoned Rural Residential (RR) to the west. Public Comments
No written comment submissions have been received. The application was circulated to the Long Point Region Conservation Authority (LPRCA), which advised no concerns with the proposal. Planning Analysis When presented with an Application for Minor Variance, the Committee of Adjustment must be satisfied the application meets the “Four Tests” of subsection 45(1) of the Planning Act: Does the variance maintain the intent of the Official Plan?
The subject lands are designated "Agricultural Area" in the Municipality of Bayham Official Plan. The Official Plan directs industrial growth in the rural area to the Bayham Industrial Park for dry industrial uses; however, the subject lands accommodate an existing, site-specific industrial use that was previously recognized through a Zoning By-law Amendment permitting the expansion of an existing industrial business on an adequately sized parcel for dry industrial uses. The business imports, sizes, and stores rubber mats/flooring for the agricultural sector (cattle building mats) and the automotive sector. While a portion of the subject lands is designated "Natural Heritage" on Schedule "C" of the Official Plan, the proposed building addition is not located within this designated area. The application was circulated to the Long Point Region Conservation Authority (LPRCA), which advised no concerns with the proposal. In approving that prior amendment, the scale of the industrial use in the Agricultural Area was deliberately limited by way of a maximum building floor area, rather than an unrestricted permission,
in order to control the extent of industrial operations in an agricultural designation while still allowing for the recognition of existing buildings and anticipated future building redevelopment/expansion. The current application seeks relief to exceed that established maximum floor area by 530 m², to permit a total gross floor area of 8,980 m², in order to accommodate additional warehouse and storage space for the same existing use. The requested increase is modest relative to the scale of the existing facilities on the subject lands, and the proposed addition remains within the existing building cluster rather than extending industrial development into new areas of the surrounding agricultural land. A significant natural buffer is maintained between the proposed building addition and the neighbouring property, minimizing potential impacts on adjacent agricultural operations. Official Plan Section 1.1 (Purpose of the Plan) provides that future development and redevelopment in the Municipality is to occur in an orderly and controlled manner, and that the Municipality promote and facilitate the expansion of the economy and tax base. The proposed increase in floor area supports the continued operation and growth of an existing local business, consolidating storage currently spread across multiple rented off-site locations and reducing associated truck traffic.
Given the modest scale of the increase relative to the existing facilities, its containment within the existing building cluster, and the natural buffering from adjacent lands, the proposed variance maintains the general intent and purpose of the Official Plan. Does the variance maintain the intent of the Zoning By-law?

The subject lands are zoned "Rural Industrial subzone 12 (M2-12)" in Zoning By-law Z456-2003, which permits general industrial use, light industrial use, a commercial use as an accessory use, and one dwelling unit as an accessory use. The proposed warehouse and storage use is consistent with a light industrial use, and is therefore a permitted use within the M2-12 zone. The subject application seeks relief from Section 21.10.12.1 of the Zoning By-law to increase the maximum permitted gross floor area from 8,450 m² to 8,980 m², to facilitate the construction of a building addition providing additional warehouse and storage space for the existing business.
The intent of Section 21.10.12.1 is to limit the overall scale and footprint of industrial development on the subject lands, given their location within the Agricultural Area designation, in order to ensure the industrial use remains appropriately contained and does not expand disproportionately into the surrounding agricultural context. The subject lands have adequate lot frontage, depth, and area (226 m frontage, approximately 300 m depth, and 61,236 m² in total lot area) to accommodate the proposed building addition, and all other applicable yard and setback requirements of the Zoning By-law are met. The proposed addition remains within the existing building cluster on the site, and the increase in floor area is modest relative to the scale of the existing facilities. A significant natural buffer is maintained between the proposed addition and the neighbouring property, limiting any potential impact on surrounding agricultural or
residential uses. The proposal does not introduce a new use, alter the existing industrial character of the site, or extend industrial development into new areas of the surrounding lands. As such, the proposed variance maintains the general intent and purpose of the Zoning By-law. Is the variance an appropriate use of the land? The proposed variance is desirable for the appropriate development of the land. The application facilitates a building addition to the existing industrial facility, providing additional warehouse and storage space to support the continued operation of a business that imports, sizes, and stores rubber mats/flooring for the agricultural and automotive sectors. The relief sought is limited to an increase in the maximum permitted gross floor area and does not involve any change to the established use, lot
configuration, or setbacks on the property. The proposal supports the continued operation and growth of an existing local business, allowing storage functions currently spread across multiple off-site rented locations to be consolidated on the subject lands, reducing associated truck traffic. This consolidation is consistent with the surrounding land use pattern, given the subject lands are bordered by Agricultural (A1) uses to the north, east and south and Rural Residential (RR) uses to the west. No new use is introduced, and the application does not alter the established industrial character of the site. As such, the proposed variance is considered desirable and appropriate for the subject lands. Is the variance minor in nature? While the Planning Act does not define what is considered "minor," the assessment is based on the nature and impact of the variance rather than its numerical magnitude. The proposed increase in maximum permitted gross floor area, from 8,450 m² to 8,980 m², represents approximately 6% over
the existing permitted floor area, and does not represent a substantial departure from the scale of industrial use previously contemplated and approved for the site. No new use is introduced and the addition is sited to comply with all other applicable Zoning By-law provisions, including yard and setback requirements. The application was circulated to LPRCA, which advised no concerns, and no written comment submissions have been received to date. On this basis,

the proposed variance is not anticipated to result in adverse impacts on adjacent properties, and is considered minor in nature. Conclusions and Recommendations Subject to receiving further questions and comments from the Committee of Adjustment and members of the public, staff is in a position to state that the application, as proposed: i. Is in keeping with the general intent of the Official Plan;
ii. Is in keeping with the general intent of Zoning By-law Z456-2003, as amended, for the Municipality of Bayham; iii. Is desirable and will result in the appropriate development of the area; and, iv. Is minor in nature not causing any adverse impact that may result from granting this application. Upon the Committee of Adjustment making a decision, the required Notice of Decision for the Minor Variance will be circulated within 15 days of the meeting. There is a 20-day appeal period during which objections to the decision can be submitted to the Ontario Land Tribunal. The Committee of Adjustment should be able to demonstrate why the application does or does not meet the “Four Tests” for a minor variance under the Planning Act and state those reasons in making
a decision. RECOMMENDATION
THAT the Committee of Adjustment Secretary/Treasurer's Report DS-28/26 regarding the Legend Rubber minor variance be received;
