Council Highlights
By-law Enforcement Presentation
Council received a Presentation from Stephen Miller, Bayham’s new By-law
Enforcement Officer. The Presentation was an introduction to by-law enforcement
including an overview of the by-law enforcement approach and what Council can and
cannot do.
Drainage Public Meeting
A Statutory Drainage Public Meeting was held for consideration of the Hampton
Drain. A Court of Revision for the Hampton Drain is scheduled for September 21,
2023 at 8 pm.
Zoning Enforcement Policy
The By-law Enforcement Officer presented a Report on options for Zoning By-law
enforcement. Council resolved to request a Policy return to Council that considers a
reasonable approach to education versus enforcement for zoning by-law non-
compliance.
MECP Consolidated Linear Infrastructure Environmental Compliance
Approvals (ECAs)
The Manager of Capital Projects presented a Report on ECAs that impact stormwater
and sanitary systems in Bayham. Particular emphasis was placed on the impacts that
ECAs could have on capital and operational requirements for ongoing maintenance
and monitoring of stormwater management facilities. It was noted to Council that
there will be an upfront cost to the Municipality to incorporate ECA requirements into
municipal operations.
Development Reports
Council approved a pair of rezoning applications (Gregory Underhill Farms Ltd.
Rezoning Application ZBA-06/23 and Crevits Rezoning Application ZBA-07/23), while
recommending support for Consent Application E53-23 Pettigrew (6423 Plank Road)
to the Elgin County Land Division Committee.
Council also approved a Development Agreement regarding the Minor Variance
application A-06/23 Redsell (7363 Coyle Road).
Correspondence for Action
Two pieces of correspondence were received for action. A concern regarding
speeding on Jackson Line was referred to municipal staff under the Speed Limit
Assessment Policy as Jackson Line is a municipal road. While a concern regarding
speeding on Plank Road was referred to Elgin County and the OPP as Plank Road is
County jurisdiction.
2023 Q2 Variance Report
Council received the Q2 Variance Report from the Treasurer and resolved to reinvest
$1.5 million into a 1-year GIC at 5.75 percent. This is a reinvestment of a GIC that
matured in July 2023.
Curbside Bulk Garbage Pick-Up Program Policy
Council adopted a Curbside Bulk Garbage Pick-Up Program Policy. Curbside Bulk
Garbage Pick-up will recommence in September and October under the Policy. A
Form will be available on the website for registration in the coming weeks.
Contract Extension – OPP – Elgin Group Policing Services Agreement
Council authorized the extension of the existing Elgin Group Policing Services
Agreement for a two-year period, until December 31, 2025, or until the new
Community Policing and Safety Act formally recognizes the composition of the Elgin
Group Police Services Board under the Act.
Update of Building and Planning Fees
Council received a consultant report on recommended updates to Building and
Planning fees for the Municipality. Council approved the recommended fees as
presented in the Report. The fees will be presented to Council in a comprehensive
Rates and Fees By-law update later in 2023.
Withdraw from Shared Planning Services with Malahide
Correspondence from the Township of Malahide was received, which requested that
Council consider their request to withdraw from the planning components of the
Shared Services MOU as it has been impossible to recruit a Director of Development
Services.
Council agreed to the request. The shared arrangement for Building and By-law
services is still in force and effect.
Port Burwell Lighthouse Restoration Cost Estimate
A cost estimate for the rehabilitation of the Port Burwell Lighthouse was received and
presented to Council via Addendum Report. The estimated construction,
design/engineering, and contract administration costs for the Lighthouse
rehabilitation is $1.53 million.
Council referred further discussion on the timeline and funding of this project to the
2024-2033 Capital Budget meeting in October.
Committees of Council Recommendations
Recommendations from the Waterfront Advisory Committee and Museum Advisory
Committee were received by Council.
Council referred discussion on bioswale maintenance, a beach playground, Marine
Museum Accessibility, and lighthouse fundraising to the applicable upcoming budget
discussions. Council also accepted the WAC’s recommendation to cease discussion
on a community barbecue location at the Port Burwell East Beach.
