meeting is to consider Engineer’s Report #224032 regarding the proposed works on the
North Street Drain serving parts of Lots 14 and 15, Concession 3 in the Municipality of
Bayham.

NOTICE OF A PUBLIC MEETING
CONCERNING THE PROPOSED DRAINAGE WORKS FOR THE
NORTH STREET MUNICIPAL DRAIN
IN THE MUNICIPALITY OF BAYHAM
TAKE NOTICE that further to Chap. D.17, Section 41 of the DRAINAGE ACT, the Council of the
Corporation of the Municipality of Bayham will hold a public meeting on Thursday, October 17, 2024
at 8:00 p.m. at the Bayham Municipal Office, 56169 Heritage Line, Straffordville Ontario.
THE PURPOSE of the meeting is to inform area landowners that Council will consider the enclosed
Engineer’s Report #224032 filed with the Clerk at the Bayham Municipal Office on September 24,
2024 regarding the proposed works on the North Street Drain serving parts of Lots 14 and 15,
Concession 3 in the Municipality of Bayham. The work was initiated from a request.
ANY PERSON may attend the meeting and/or make a written or verbal representation in support of,
or in opposition to the proposed drainage works by forwarding your comments to the Municipal Office
prior to the meeting.
ADDITIONAL INFORMATION relating to the proposed drainage works may be obtained by
contacting the Drainage Superintendent Steve Adams at the Municipal Office, 56169 Heritage Line,

REPORT: DR-12/24 SUBJECT: NORTH STREET DRAIN CONSIDERATION REPORT
BACKGROUND
The purpose of this Report is to hold a Public Meeting to consider Spriet Associates Engineer’s
Report No. 224032, received from Spriet Associates and dated September 20, 2024, and filed
with the Clerk on September 24, 2024.
On December 20, 2023, a request was received from William Redecop for the property at Con.
3 Lot D, E, G better known as East side of North Street, North of the Edison Cemetery laneway
within the Municipality of Bayham. On January 18, 2024, Council appointed Spriet Associates to
make an examination of the drainage area and prepare a report for Council’s consideration.
On March 6, 2024, a second Petition for Drainage was filed in regards to this Petition for the
property know as 46 Chapel Street. This petition was signed by landowner John Nezezon for
the requirement of a legal outlet pertaining to the land severance for the creation of lots off of
Chapel Street.
On August 27, 2024, the municipal engineer organized a preliminary meeting held at the
Municipal Office to discuss the future report. All property owners effected by the petition were
invited. Excluding staff and municipal engineer eight persons were in attendance for the
meeting.
On September 24, 2024, the Engineer’s Report was filed with the Municipal Clerk. The report
was submitted with a new drain name titled North Street Drain. The report indicates that two
new extension to extend from a current road side drain at the intersection of North Street and
Plank Road that will extend North up North Street to the northernly portions of the subdivided
lots with an extension travelling East into Mr. Nezezon field where the outlet would be utilized to
drain his future subdivided lots.
On October 3, 2024, Staff proceeded to mail a Notice under the Drainage Act of Public Meeting
to all interested parties. A Notice of Public Meeting, pursuant to Chapter D17, Section 41 of the
Drainage Act, was prepared. This Notice confirmed that the Municipality will hold a Public
Meeting on Thursday October 17, 2024 at 8 p.m. to consider the proposed construction of the
drainage works known as the North Street Drain. The Notice of Public Meeting and a copy of
the Engineer’s Report were mailed to:
(a) Every landowner within the area requiring drainage.
(b) Clerk of every other local municipality in which any land or road that is assessed for the
drainage works, or for which compensation or other allowances have been provided in the
report is situate.
(c) Any public utility, railway company or road authority that may be affected.
(d) Long Point Region Conservation Authority.
(e) The Ministry of Natural Resources.
(d) The Director, of the Ministry of Agriculture, Food and Rural Affairs.
Pursuant to Section 42 of the Drainage Act, Council of the initiating municipality shall give an
opportunity to any person to withdrawal from the petition, sign the petition or speak to the
matter. If, at the end of such Council meeting, the petition contains a sufficient number of names
to comply with Section 4, the Council may proceed to adopt the report by giving two readings by
Council to the Provisional By-law and set the date for the first sitting of the Court of Revision.
DISCUSSION
Following the Engineer’s presentation at the Public Meeting, landowners and all other affected
parties are given the opportunity to voice their concerns relating to any design aspect of the
report. If for any reason the report should be reconsidered, Council may refer the report back to
the engineer.
In addition, landowners in the area requiring drainage shall be given an opportunity to withdraw
or add their names to the petition. This shall include affected Municipalities if their lands or
roads are within the area requiring drainage.
If the petition does comply with Section 4, Council may proceed to adopt the report by giving
two readings to the attached Provisional By-Law.

RECOMMENDATION
THAT Report DR-12/24 re North Street Drain Consideration Report be received for
information;
AND THAT, in accordance with Sections 44 to 46 of the Drainage Act, the Council of The
Corporation of the Municipality of Bayham hereby adopts Spriet Associates Report No.
224032, dated September 20, 2024, referred to as the “North Street Drain” report;
ANDTHAT Provisional By-law No. 2024-062 be given first and second reading;
AND THAT the Clerk be directed to distribute copies of the Provisional By-law and Notice
of the time and place of the first sitting of the Court of Revision to the affected parties
pursuant to Section 46(2) of the Drainage Act;
AND THAT a date of November 6, 2024 at 8:00 p.m. be set for the first sitting of the Court
of Revision.
