Pursuant to Chapter D17, Section 41 of the Drainage Act the purpose of the public
meeting is to consider the proposed reconstruction of the drainage as outlined in the
Hampton Municipal Drain Engineer’s Report #220242 dated June 5, 2023 as prepared
by Spriet Associates.

NOTICE OF A PUBLIC MEETING
CONCERNING THE PROPOSED DRAINAGE WORKS FOR THE
HAMPTON MUNICIPAL DRAIN
IN THE MUNICIPALITY OF BAYHAM
TAKE NOTICE that further to Chap. D.17, Section 41 of the DRAINAGE ACT, the Council of the
Corporation of the Municipality of Bayham will hold a public meeting on Thursday, August 17, 2023
at 8:00 p.m. at the Bayham Municipal Office, 56169 Heritage Line, Straffordville Ontario.
THE PURPOSE of the meeting is to inform area landowners that Council will consider the enclosed
Engineer’s Report #220242 filed with the Clerk at the Bayham Municipal Office on July 24, 2023
regarding the proposed reconstruction of the Hampton Municipal Drain serving parts of Lots 118
to 120, Concessions 5 and South Gore, Municipality of Bayham. The work was initiated from a
request.
ANY PERSON may attend the meeting and/or make a written or verbal representation in support of,
or in opposition to the proposed drainage works by forwarding your comments to the Municipal Office
prior to the meeting.
ADDITIONAL INFORMATION relating to the proposed drainage works may be obtained by
contacting the Drainage Superintendent Steve Adams at the Bayham Municipal Office, 56169
Heritage Line, PO Box 160, Straffordville, Ontario N0J 1Y0, Telephone: 519-866-5521, Monday –
Friday 8:30 a.m. – 4:30 p.m.

REPORT: DR-04/23 SUBJECT: HAMPTON DRAIN IMPROVEMENTS CONSIDERATION REPORT
BACKGROUND
The purpose of this Report is to hold a Public Meeting to consider Spriet Associates Engineer’s
Report #220242, received from Spriet Associates and dated June 5, 2023, and filed with the
Clerk on July 24, 2023.
On May 21, 2020, a request was received from Thomas Eisenhauer, president of Bonnefield
farmland for farming on lands known as Lots 11, 12, 13 Con 6 to make repairs to the Hampton
Drain that situated on this property. On June 4, 2020, Council appointed Spriet Associates to
make an examination of the drainage area and prepare a report for Council’s consideration.
On September 15, 2022 at the sitting of the Court of revision, Council acknowledged the
Gregson’s willingness to construct a berm along Jackson Line road allowance on the North side
of Lots 9 and 10. This berm would be subject to inspection time to time by a Municipal Engineer
or designate.
In the spring of 2023, the berm was completed by the landowner of Lots 9 and 10 along the road
allowance on Jackson Line West of Mitchell Road to the satisfaction of the Municipal Engineer
and the Municipal Drainage Superintendent. Upon completion of the berm, the Municipal engineer
revised the drainage report to accommodate the new berm.
On July 24, 2023, the revised Engineer’s Report was filed with the Municipal Clerk. The new
report has been edited in a way which the design of the drain has been changed along with the
adjustment to the assessments due to the additional berm construction.
On July 26, 2023, Staff proceeded to mail a Notice under the Drainage Act of Public Meeting to
all interested parties. A Notice of Public Meeting, dated July 26, 2023, pursuant to Chapter D17,
Section 41 of the Drainage Act was prepared. This Notice confirmed that the Municipality will
hold a Public Meeting on Thursday August 17, 2023 at 8 p.m. to consider the proposed
construction of the drainage works known as the Hampton Drain Improvements. The Notice of
Public Meeting and a copy of the Engineer’s Report were mailed to:
(a) Every landowner within the area requiring drainage.
(b) Clerk of every other local municipality in which any land or road that is assessed for the
drainage works, or for which compensation or other allowances have been provided in the
report is situate.
(c) Any public utility, railway company or road authority that may be affected.
(d) Long Point Region Conservation Authority.
(e) The Ministry of Natural Resources.
(d) The Director, of the Ministry of Agriculture, Food and Rural Affairs.
Pursuant to Section 42 of the Drainage Act, Council of the initiating municipality shall give an
opportunity to any person to withdrawal from the petition, sign the petition or speak to the
matter. If, at the end of such Council meeting, the petition contains a sufficient number of names
to comply with Section 4, the Council may proceed to adopt the report by giving two readings by
Council to the Provisional By-law and set the date for the first sitting of the Court of Revision.
DISCUSSION
Following the Engineer’s presentation at the Public Meeting, landowners and all other affected
parties are given the opportunity to voice their concerns relating to any design aspect of the
report. If for any reason the report should be reconsidered, Council may refer the report back to
the engineer.
In addition, landowners in the area requiring drainage shall be given an opportunity to withdraw
or add their names to the petition. This shall include affected Municipalities if their lands or
roads are within the area requiring drainage.
If the petition does comply with Section 4, Council may proceed to adopt the report by giving
two readings to the attached Provisional By-Law.

RECOMMENDATION
THAT Report DR-04/23 re Hampton Drain Improvements Consideration Report be received for
information;
AND THAT, in accordance with Sections 44 to 46 of the Drainage Act, the Council of The
Corporation of the Municipality of Bayham hereby adopts Spriet Associates report #220242,
dated June 5, 2023, referred to as the “Hampton Drain” report;
ANDTHAT Provisional By-law No. 2023-065 be given first and second reading;
AND THAT the Clerk be directed to distribute copies of the Provisional By-law and Notice of the
time and place of the first sitting of the Court of Revision to the affected parties pursuant to
Section 46(2) of the Drainage Act;
AND THAT a date of September 21, 2023 at 8:00 p.m. be set for the first sitting of the Court of
Revision.
