MEMO: WAC-05/23 SUBJECT: 2023 BEACH TOUR
BACKGROUND
The Waterfront Advisory Committee set their meeting dates for 2023 at the May 16, 2023 meeting
with noting the July meeting would be at the Port Burwell East Beach.
DISCUSSION
The July 17, 2023 Waterfront Advisory Committee Meeting will kick-off at the Port Burwell East
Beach for a general Beach Tour with staff then continue for further committee discussions in the
Trackless Lounge.
General operations topics during the Beach Tour will include maintenance, signage/flags,
bioswales, and parking. There may also be high-level reference to ongoing and future capital
works. The Beach Tour will be led by the Manager of Public Works|Drainage Superintendent,
who oversees general beach operations and maintenance for the Municipality.
In-depth discussion on matters such as capital items for the 2024-2033 Capital Budget, and
previous Council direction regarding the potential for a community barbecue space will take
place after the Beach Tour in the Trackless Lounge at the Straffordville Community Centre,
56169 Heritage Line, Straffordville.
Please note that the Beach Tour is weather-dependent. If rain or storms are in the forecast, the
Committee will be advised the morning of the meeting, and the Beach Tour item will be handled
as a discussion item on Beach operations, which will take place in the in the Trackless Lounge
at the Straffordville Community Centre, 56169 Heritage Line, Straffordville.

MEMO: WAC-06/23 SUBJECT: COUNCIL DECISIONS – WAC RECOMMENDATIONS TO COUNCIL
BACKGROUND
The Waterfront Advisory Committee had a meeting on May 16, 2023, from which two (2)
motions included recommendations to Council. These were presented to Council at the June 1,
2023 Regular Meeting and the following motion was passed:

THAT the Waterfront Advisory Committee resolution from the May 16, 2023 Meeting that
includes recommendations to Council be received for information;
AND THAT staff be directed to report to Council on the cost implications of the Blue Flag
Beach Status prior to the 2024 application;
AND THAT staff be directed to report to Council prior to 2024 budget deliberations on
alternative beach accessibility options other than mobimats.
DISCUSSION
As direction has been provided from Council on these items, staff will be reporting back to
Council with further information as directed and any further outcomes will be relayed back to the
Waterfront Advisory Committee for information.

BACKGROUND
At its May 18, 2023 meeting, Council received Report BL-02/23 re Port Burwell East Beach –
By-law Review of Enclosed Tents and Barbeques – Parks By-law No. 2017-125, as presented
by the Fire Chief|By-law Enforcement Officer. Council passed the following motion:

THAT Report BL-02/23 re Port Burwell East Beach – By-law Review of Enclosed Tents and
Barbeques – Parks By-law No. 2017-125 be received for information;
AND THAT Staff be directed to prepare an amending by-law, incorporating the twelve (12)
recommendations identified in Report BL-02/23, to amend the Municipality’s Parks By-law
No. 2017-125;
AND THAT the appropriate amending by-law be brought forward for Council’s
consideration;
AND THAT discussion pertaining to a community barbecue location at the East Beach be
referred to the July meeting of the Waterfront Advisory Committee to make
recommendation to Council.
DISCUSSION
Report BL-02/23 is attached for detailed information. Council is requesting the Waterfront
Advisory Committee to provide a recommendation on if a Community Barbecue would be viable
and a proposed location. High-level discussion of general benefits and concerns may take place
during the Beach Tour under Memo WAC-05/23, however, in-depth discussion and a final
decision should be rendered during presentation of this Memo on the matter.

REPORT: BL-02/23 SUBJECT: PORT BURWELL EAST BEACH – BY-LAW REVIEW OF ENCLOSED TENTS AND
BARBECUES – PARKS BY-LAW NO. 2017-125
BACKGROUND
At its October 6, 2022 meeting, Council received a motion from the September 14, 2022
meeting of the Blue Flag Beach Committee, requesting that Council consider a number of
recommendations, including reviewing prohibitions of barbecues and enclosed tents on the Port
Burwell East Beach. Council passed the following motion:

THAT the Blue Flag Beach Committee resolution from the September 14, 2022 Meeting
that includes recommendations to Council be received for information;
AND THAT staff investigate and report back to Council on a By-law review regarding the
prohibition of enclosed tents and barbecues.

DISCUSSION
To begin the process, Staff reviewed other neighbouring municipalities and other municipalities
in the province with municipal beaches as to their respective beach by-laws. Although
municipalities do have their own Beach By-laws, others include the beach as part of their Parks
By-Law, which is how the Municipality currently addresses the Port Burwell East Beach.
Staff has prepared a comparison chart, attached hereto this Report, which summarizes the
different municipal by-law restrictions and prohibitions employed by other municipalities with
municipal beaches. The words “Not Allowed” indicates that there is a by-law prohibiting the
activity.
It should also be noted that some of the nieghbouring municipalities have no by-laws regarding
their beach. This is also clearly denoted in the summary chart.
Although the original scope was specific to enclosed tents and barbecues, staff believes that
this would be an appropriate time to review the current by-law in a more comprehensive manner
and make any further amendments that Council considers appropriate.
Staff recommends that the Municipality of Bayham’s Parks By-law No. 2017-125 be amended to
include any changes Council recommends as the Beach already is included within this By-law.
Staff would recommend Council consider the following restrictions and prohibitions for the
beach area:
1) That ‘East Beach’ be defined as the Municipal-owned sand area from the grass park
land and parking lots to and including the shores of Lake Erie.
2) A prohibition of all cooking devices
3) A restriction of any tent to include the size be limited to 3.048m x 3.048m (10 ft. x 10 ft.)
and that only onside allowed to be opaque
4) A prohibition of urination and defecation on the beach except in the facilities provided
5) A prohibition of glass containers on the beach
6) A prohibition of fires and fireworks on the beach
7) A prohibition of gas generators on the beach
8) A prohibition of sales of items except through approval of the Municipality
9) A prohibition of Golf on the beach
10) A restriction of any other sport on the beach that interferes with the lawful enjoyment of
others
11) A prohibition regarding the use of any recording device without the permission of those
being recorded.
12) Prohibition of music containing foul and insulting language that could reasonably
considered may offend others and children.
These recommendations are not meant to restrict the community from enjoying the Port Burwell
East Beach. In fact, with the increasing popularity of the beach, these recommendations are
designed so everyone in the community can enjoy the beach.

MEMO: WAC-08/23 SUBJECT: 2024-2033 PORT BURWELL EAST BEACH / PIER CAPITAL ITEMS
BACKGROUND
Every Q4, Council considers and approves a Capital Budget and 10-year Capital Plan. These
items constitute a major policy document for the Municipality, which guides core and non-core
infrastructure and similar investment within the 10-year time horizon ensure renew or expand
municipal assets for the betterment of the community. The Draft Capital Budget is published on
the Municipal website for public consumption in August. Staff generally allocate time in July and
August to compile the Draft for publication.
At its December 13, 2022 Special Meeting, Council received Report TR-18/22 re 2023-2032
Capital Budget – Draft and passed the following motion, in part:

AND THAT the 2023-2032 Capital Budget – Draft be amended as discussed and
approved in principle.
The approved-in-principle Capital Budget contained a number of capital projects applicable to the
Port Burwell East Beach and Pier. These items were presented to the Committee via Memo
WAC-04/23 on May 16, 2023 and are outlined below.
FA-09 – Port Burwell East Beach Washroom Expansion – $500,000
PR-11 – East Pier Rehabilitation – $300,000
PR-13 – Beach Accessibility – $50,000
PR-14 – Beach Shade Structure – $80,000
PR-16 – Electric Charging Station – $10,000
DISCUSSION
In preparation for the 2024-2033 Capital Budget, staff have commenced preliminary internal
discussions regarding East Beach and Pier capital needs over the 10-year term of the Budget.
When these discussions take place, Capital Items are sometimes altered in the budget to
recognize adjusted priorities and/or costs for Council to formally consider.
The following Capital Item Sheets are attached in Draft format for Committee review.
FA-09 – Port Burwell East Beach Washroom Expansion – $575,000
2024 & 2028 project with a $75,000 cost increase (engineering and inflation)
PR-11 – East Pier Rehabilitation – $325,000
2024/2025 project with a $25,000 cost increase (engineering)
PR-13 – Beach Accessibility – $50,000
No changes at this time. Council has provided direction to staff to investigate
alternatives
PR-14 – Beach Shade Structure – $80,000
No changes at this time
PR-16 – Electric Charging Station – $20,000
Cost increased by $10,000 (inflation)
The recommendation is to receive this Memo for information. However, should the Committee
wish to make recommendations on Capital Items not previously referred to Council, the
Committee may do so.
