1. CALLTO ORDER
A. The Secretary-Treasurer called the meeting to order at 6:30 p.m. and asked for those in
attendance for this meeting to sign in at the podium.
2. APPOINTMENT OF CHAIRMAN

THAT Tom Southwick be appointed Chairman of the Committee of Adjustment for
consideration of Minor Variance Applications A01/16 submitted by Jeffrey and Marcy Elliott
and A-02/16 submitted by Frank Pihokker.

3. DISCLOSURES OF PECUNIARY INTEREST &THE GENERAL NATURE THEREOF
A. No disclosures of pecuniary interest were declared.

4. APPLICATIONS
A. Minor Variance Application A-01/16 Elliott— Request to grant relief from Zoning By-law
Z456-2003, Section10.11 — regulations for Accessory Buildings and Section 4.2 —
Accessory Uses to permit the construction of a two vehicle garage with a floor area of 62.4
m2 (672 ft2) and a height of 4.25 m (14 feet) in the front yard of the lot.
B. Minor Variance Application A-02/16 Pihokker— Request to grant relief from Zoning By-
law Z456-2003, Section 5.1 — regulations for Accessory Living Quarters to permit the
installation of a second accessory bunkhouse building to accommodate an additional eight
persons for a total of sixteen seasonal farm labourers in two bunkhouse buildings.

5. STAFF PRESENTATION
A. Report DS-07/16 re Committee of Adjustment— Minor Variance —A-01/16 Elliott
Secretary-Treasurer M. Underhill presented Report DS-07/16 and advised no public
submissions had been received.
B. Report DS-08/16 re Committee of Adjustment— Minor Variance —A-02/16 Pihokker
Secretary-Treasurer M. Underhill presented Report DS-08/16 and advised no public
submission had been received.
6. PRESENTATIONS BY APPLICANT/AGENT
A. Mr. Elliott provided information from LPRCA noting they support the Minor Variance
application, the septic bed can be to the west or east of the cottage, the holding tank can
be placed lakeside of the cottage. Mr. Elliott wishes to locate the septic bed between the
cottage and the new garage thereby requesting the setback of 2 meters from the front lot
line.
B. Mr. Pihokker advised the Minor Variance application is to provide sufficient housing for
seasonal help.
7. PUBLIC SUBMISSIONS

8. COMMITTEE QUESTIONS AND DISCUSSION
A. When asked by Committee members as to the need and location of the new septic bed,
Mr. Elliott explained it is not a necessity but desired to replace the existing holding tank
system, new bed will have to be placed in the front yard between the proposed garage and
residence whereby requiring the variance for the 2 metre front lot line setback, new bed
cannot fit on the west or east side of residence and only the holding tank can be placed
lakeward of the residence according to LPRCA stipulations. Committee requested to see
a site plan of the proposed septic system and garage to clarify actual setback needs.
B. W. Casier advised he has no issues with the application.
9. DECISION OF COMMITTEE (Motions)

"THAT Minor Variance Application A-01/16 Elliott be deferred until March 3, 2016 at 6:30
p.m. for consideration of a site plan drawing showing new field bed and proposed garage
placement."

B. Decision

"THAT the Committee of Adjustment Secretary-Treasurer's report DS-08/16 regarding the
PIHOKKER minor variance be received;
AND WHEREAS the Committee agrees that the proposed variances meet Section 45.1(1)
of the Planning Act and the variance is considered minor;
THEREFORE application A-02/16 submitted by Frank Pihokker, pursuant to Section 45 of
the Planning Act for minor variance, is granted to allow relief from Municipality of Bayham
Zoning By-law Z456-2003:
• Section 5.1 — Permitted Uses —to permit the placement of a second
bunkhouse (mobile home) as a supplementary farm dwelling on an agricultural
lot identified as 58126 Calton Line in accordance with Section 2.1.10 of the
Official Plan
Condition of Minor Variance: Subject to a Development Agreement with the
Municipality of Bayham to be executed within 60 days of minor variance
approval.
