4. ANNOUNCEMENTS
The CAO|Clerk reminded residents of the Christmas office closure, from noon on December 23,
2022 until 8:30 am on January 3, 2023 and noted that bag tags are available for pick-up prior to
the Christmas office closure.
The CAO|Clerk advised that the 2023-24 Operating Budget Draft is available on the website and
will be considered by Council at a Special Meeting on Wednesday, January 18, 2023,
commencing at 6:30 pm.
Mayor Ed Ketchabaw informed that on Wednesday, December 14, 2022, Bayham participated
in a joint emergency exercise and reviewed the Emergency Response Plan (ERP) with other
Elgin County municipalities, including Elgin County. The exercise is an annual condition of
compliant with Emergency Management Ontario.
Mayor Ed Ketchabaw advised that, on Sunday, December 18, 2022, there will be breakfast at
the Masonic Hall from 8-1. The Mayor also wished all those a safe and happy Christmas and a
relaxing festive time before we return in the New Year.

8. MOTIONS AND NOTICE OF MOTION
A. Councillor Chilcott re Province-wide Shortage of Children’s Medication
Moved by: Councillor Chilcott
Seconded by: Councillor Froese
WHEREAS staffing shortages of healthcare professionals, especially nurses, is an ongoing
problem in Ontario;
AND WHEREAS this problem continues to grow since the COVID-19 Pandemic and the
passing of Bill 124, a Bill which suppresses the wages of nurses and health-care professionals
and limits their ability to negotiate freely;
AND WHEREAS these staffing shortages are causing substantial wait times in emergency

rooms, noticeably widening gaps in health care, and emergency room closures;
AND WHEREAS there has been an increase in child sicknesses contributed by a lack of timely
and available health care;
AND WHEREAS there is a province-wide shortage in children and medications, both over-the
counter and prescribed;
NOW THEREFORE BE IT RESOLVED THAT the Municipality of Bayham calls on the Ontario
government to recognize and address the deepening health care crisis in Ontario and take
urgent action to remedy human resources and medication shortages to properly serve Ontario
residents;
AND THAT a copy of this Resolution be sent to:
• The Premier of Ontario and the Ontario Minister of Health;
• The Leader of the Official Opposition and the Opposition Critic for Health;
• All Members of Provincial Parliament representing constituencies in Bayham; and,
• The Association of Municipalities of Ontario (AMO), requesting they share with their
member municipalities.

Act (CPSA), 2022, whichever is earlier.

to appoint a Deputy Chief Building Official be brought forward for Council’s consideration.

The Chairman stated the purpose and effect of the proposed amendment.
4. PURPOSE AND EFFECT OF THE PROPOSED AMENDMENT
A. Vienna Ridge Subdivision 34T-BA2201
THE PURPOSE OF THIS MEETING is to inform the public of the nature of the Draft Plan of
Subdivision proposal, to invite public input and to answer questions regarding the application.
THE PURPOSE AND EFFECT of this Draft Plan of Subdivision will be to divide the subject
parcel of land into eight (8) single detached residential lots. The proposed lots will be accessed
by North Street, an existing local road, south of Chapel Street. The residential lots will be
serviced by municipal sanitary sewage disposal system, municipal water services and municipal
storm water services. The subject lands are designated ‘Residential’ in the Municipality of
Bayham Official Plan and are zoned Holding Village Residential 1 (R1(h2)) in the Municipality of
Bayham Zoning By-law No. Z456-2003.
The applicants will be required to apply for and obtain Zoning By-law Amendment approval to
remove the Holding Provision (h2) subject to entering into subdivision agreement between the

THE PURPOSE of these Amendments is to change the land use designation on a portion of
lands with two parcels and combined lot area of 3,604 m2 (0.89 acre), to change the Official
Plan designation for 2,760 m2 (0.68 acres) of lands from “Residential” to “site-specific Multi-Unit
Residential” designation in the Official Plan of the Municipality of Bayham to permit the
development of a 13-unit townhouse block with density of 48 units per hectare and criteria for
slope development on the southern portion of the subject lands. The subject lands are located
on the east side of Robinson Street, west side of Erieus Street, south of Brock Street in the
village of Port Burwell and known as 2 Robinson Street and 3 Erieus Street.
And furthermore, to change the zoning of the townhouse block lands from Village Residential 1
(R1) and Holding Village Residential 1 (R1(h2)) Zones to Site-specific Village Residential 2 (R2-
xx) Zone to permit townhouse development and to permit specific to the townhouse lands: lot

area per unit of 212 m2 whereas 340 m2 is the permitted minimum; setback distance for a

symbol by way of entering into a development agreement with the municipality, in Zoning By-law
Z456-2003.
THE EFFECT of these Amendments will be to permit a townhouse development with site-
specific zoning, either standard condominium or rental, in the form of 2 buildings with 13 total
units, proposed with reduced driveway setback from an intersection, reduced front yard setback,
and the removal of holding provisions requiring the applicant/owner enter into development or
subdivision agreement with the municipality.

Laverne Kirkness, planning consultant for the applicant, presented a slideshow outlining the
revised plan including the removal of Block A to eliminate shadowing concerns, the height of the
buildings will not obstruct existing homes views, the lands are not in a flood hazard, there will be
no short-term rentals and construction will be only on their lands and will not use municipal
property.

Hilary Utting, resident, spoke in opposition of the application. Utting provided background
information of the lands and wildlife that has been present over the years. Utting noted concerns
with traffic, driveway location, removing the retainer wall, the amount of ground water that
nearby residents with basements have issues with and the risk of Port Burwell losing its charm.
Christina Tuffin, resident, spoke in opposition of the application. Tuffin noted concerns with
traffic, use of the buildings, and the risk of Port Burwell losing its charm. Tuffin noted being in
support of development but the right kind in the right location.

BACKGROUND
On October 5, 2021, the Council of the Corporation of the Municipality of Bayham passed the
following motion:

The 2022 Capital Budget included Capital Item No. FD-02, for a total budget allotment of
$29,000.
Staff Report FR-04/22 was presented to Council on March 3, 2022. Council passed the
following motion:
THAT Report FR-04/22 re Awarding Contract for Fire Hydrant Flow Survey be received
for information;
AND THAT Council approves the award of the Fire Hydrant Flow Survey to SCG
Flowmetrix;
AND THAT the appropriate by-law to enter into an Agreement with SCG Flowmetrix for
the Fire Hydrant Flow Survey be brought before Council for enactment.
DISCUSSION
The attached Fire Flow Testing Report conducted by SCG Flowmetrix details the fire flow
testing results as per the NFPA 291. A total of sixty-eight (68) fire hydrants across Port Burwell
and Vienna were successfully tested.
The purpose of the testing was to create a known flow rate demand within the water distribution,
which causes the static water pressure to drop to 20 psi. The results of the testing determines
the available water flow rates in the event of a fire as well as determines the areas of low
pressure that can lead to temporary water disruption to our users.
The contents of this report are particularly important for fire protection, where water demand is
acutely higher than normal demand periods. The Bayham Fire Department uses water from
Vienna and/or Port Burwell hydrants to support their operations and fire suppression efforts
when required and must be aware of flow constraints in the hydrant system.
Two variables that can be present during the time of the testing are the day-to-day water
demands as well as the height of the water tower located along Nova Scotia Line. NFPA 291
recommends that fire hydrants be colour-coded to a standard that visually identifies the
available flow rate.
The said recommended colour coding and firefighting rating is as follows (GPM = Gallons Per
Minute):
- Blue – 1500< GPM = Very Good
- Green – 1000 – 1499 GPM = Good
- Orange – 500 – 999 GPM = Marginal
- Red – <500 GPM = Inadequate
Based on the above, the Municipality currently has 79% of the hydrants rated as orange, 10%
as blue, 8% as green, and 3% as red. A map is attached, denoting the Red hydrant locations,
being the two (2) hydrants on Soper Road, south of Light Line.
With the majority of our water system fire hydrants scoring as Marginal, adequate fire protection
can be met under normal operations with minimal disruption to our drinking water customers. It
should be noted, however, that modern pumpers will draw water at up to 1060 GPM, which is
over the upper limit of the Marginal category and as such, only 18% of hydrants currently meet
the full abilities of a department pumper. This does not mean the Marginal hydrants cannot be
used; it, instead, means that the hydrants and water distribution systems were installed in an
era where pumpers were not as powerful and pumper technology has since surpassed the
technology of the day. If at a future date, staff and Council seek to improve the water distribution
system to improve the rating of select hydrants, capital works will be required to increase the
size of mains to permit greater flows.
Drinking water system compliance and fire protection concerns have been identified and
effectively managed by both the Water Department and Fire Services to ensure the needs of the
community are being met.

RE: FIRE FLOW TESTING IN THE MUNICIPALITY OF BAYHAM
Dear Mr. Roloson,
SCG Flowmetrix appreciated the opportunity to perform fire flow testing in the
municipality of Bayham. SCG Flowmetrix representative conducted fire flow testing
practices based on the NFPA 291. The purpose of the testing was to create a known
flow rate demand in the distribution system, which causes the static pressure to drop to
20 psi. The flow rate (measured in gallons per minute) required to cause the overall
pressure drop is the practical fire flow test rating of the hydrant under test.
Tests were performed in four days from October 17, 2022, to October 20, 2022, by SCG
Flowmetrix’s field representative Mr. Jordan Whitlock.
The total number of hydrants in Vienna and Port Burwell communities is eighty-four (84).
Sixty-eight (68) hydrants were tested successfully for the first part of testing,
In Vienna, there were ten (10) hydrants (#39,41,42,45,81,64,53,67,48 and 71) located
on a dead end, which couldn’t be tested due to false residual readings.
In Port Burwell, six (6) hydrants remained untested of which 4 of them (#84,33,31 and
78) were located on a dead end. Also, hydrant #77 couldn’t be opened because of
seized rod valve, so to avoid any damage to the hydrant the operator advised against
testing. Hydrant #79 was owned by OCWA, and the OCWA operator was required to
operate the hydrant.
During the first day of testing, it was realized that the flow in the hydrants was low and
opening two ports at the flow hydrant could cause the residual pressure to drop below 20
psi which is not recommended by NFPA 291. So, from the second day, only one port
flowed for testing to keep the residual pressure above 20 psi. Based on the results, the
fire flow test rating for all hydrant locations is more than 500 GPM. Please refer to
Appendix A for testing results.
Upon the client’s request on-site, a couple of hydrants were retested for the second part
of testing. Those hydrants have the, closed interconnect valve, which connects Vienna
and Port Burwell on the opposite side of the water feed. The purpose was to investigate
the effect of opening valves on the booster pump and pressure in the watermain. So, the
pressure monitoring locations on opposite ends of each community were selected, and
the hydrant with the open interconnector valve flowed. The interconnector valve is
located where Vienna and Port Burwell loop back from the farthest side of the watermain
feed.
For Port Burwell, one logger was installed on hydrant #24 to capture the main feed going
into the community. Then hydrant #33 was selected, which was the furthest hydrant from
the main watermain feed. The third logger was installed at hydrants #13, 22, and 36,
near each flow test location. The results show the open valve. The booster is triggered,
causing slightly less pressure drop compared to when the valve was closed. Please refer
to Appendix B for testing results.
For Vienna, one logger was installed on hydrant #24, and the second was installed on
hydrant #72, which was located right next to the booster. The third logger recorded the
lowest pressure, at the end of the watermain on hydrant #70. Then by flowing hydrants
#68, 43, and 50, for hydrant #24, the pressure drop was less than when the valve was
closed. But for hydrant #72, the pressure drop was significantly higher; at hydrant #70,
the residual pressure dropped to zero. Please refer to Appendix C for testing results.

TAKE NOTICE that the Council of the Corporation of the Municipality of Bayham passed By-
Law No. Z752-2022 on the 15th day of December 2022 under Section 34 of THE PLANNING
ACT.
AND TAKE NOTICE that any person or agency may appeal to the Ontario Land Tribunal in
respect of the By-law by filing with the Clerk of the Municipality of Bayham not later than the 8th
day of January 2023 a notice of appeal setting out the objection to the By-law and the reasons
in support of the objection.
THE PURPOSE of this By-law is to change the zoning on a 2.48 ha (6 acre) parcel of land from
Agricultural (A1) Zone to a Site Specific Agricultural (A1-43) Zone to permit: large-scale
supplementary farm dwelling use; maximum floor area of 306 square metres for the
supplementary farm dwelling; minimum 2.3 ha (5.7 acres) farmland area worked per labourer;
minimum lot area (existing) of 2.48 ha; minimum front yard depth for the existing dwelling of 10.8
metres whereas 15 metres is the permitted minimum; minimum front yard depth for the existing
accessory building of 8.4 metres whereas accessory buildings are not permitted in a front yard or
closer to the street than the main building is to the street; and minimum 0.9 metre setback for the
existing accessory building (north side) whereas 1.0 metre is the permitted minimum in Zoning
By-law Z456-2003. The subject lands are located on the west side of Plank Road, north of Glen
Erie Line and known as 4964 and 4968 Plank Road.
THE EFFECT of this By-law will be to permit a site-specific large scale supplementary farm
dwelling use with maximum permanent building floor area exceeding the maximum floor area of
167 m² (1,797 ft2) in the Official Plan, to permit the year-round occupancy of the supplementary
farm dwelling due to a longer growing season for apples and seasonal labourers employed during
the winter months for the apple storage facility, to recognize the maximum land area worked per
labourer for the farm operation, and to recognize existing front, rear and side yard setbacks for
the dwelling and accessory buildings. Official Plan Amendment No. 28 was approved by Elgin
County on November 9th, 2022, with no appeals filed within the statutory timeline, to permit the
site-specific large scale supplementary farm dwelling, therefore rezoning can proceed.
ONLY INDIVIDUALS, CORPORATIONS AND PUBLIC BODIES may appeal a by-law to the
Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or
group. However, a notice of appeal may be filed in the name of an individual who is a member of
the association or the group on its behalf.
NO PERSON OR PUBLIC BODY SHALL be added as a party to the hearing of the appeal
unless, before the by-law was passed, the person or public body made oral submissions at a
public meeting or written submissions to the council or, in the opinion of the Ontario Land
Tribunal, there are reasonable grounds to add the person or public body as a party.

Agricultural (A1-A) Zone to a Site Specific Agricultural (A1-A-44) Zone to permit: a large scale
supplementary farm dwelling use; supplementary farm dwelling maximum floor area of 322
square metres; the year-round operation of the supplementary farm dwelling; and minimum 2.3
ha (5.7 acres) farmland area worked per labourer for the farm operation, in Zoning By-law Z456-
2003. The subject lands are located on the south side of Chute Line, on the west side of Toll Gate
Road and known as 56237 Chute Line.
THE EFFECT of this By-law will be to permit a site-specific large scale supplementary farm
dwelling use with maximum permanent building floor area exceeding the maximum floor area of
167 m² (1,797 ft2) in the Official Plan, to permit the year-round occupancy of the supplementary
farm dwelling due to a longer growing season for apples and seasonal labourers employed
during the winter months for the apple storage facility, and to recognize the maximum land area
worked per labourer for the farm operation. Official Plan Amendment No. 29 was approved by
Elgin County on November 9th, 2022, with no appeals filed within the statutory timeline, to permit
the site-specific large scale supplementary farm dwelling, therefore rezoning can proceed.
ONLY INDIVIDUALS, CORPORATIONS AND PUBLIC BODIES may appeal a by-law to the
Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or
group. However, a notice of appeal may be filed in the name of an individual who is a member of
the association or the group on its behalf.
NO PERSON OR PUBLIC BODY SHALL be added as a party to the hearing of the appeal
unless, before the by-law was passed, the person or public body made oral submissions at a
public meeting or written submissions to the council or, in the opinion of the Ontario Land
Tribunal, there are reasonable grounds to add the person or public body as a party.

increased maximum floor area for an accessory building and Motor Vehicle Inspection Station
(MVIS) use; to permit an accessory building maximum floor area for the proposed use and
personal storage of 470.1 m2 (5,059.9 ft2) whereas 95 m2 or 8% lot coverage, whichever is
greater, is the permitted maximum; and to permit maximum height for an accessory building of
6.7 m (22 ft) whereas 6.0 m (19.7 feet) is the permitted maximum, in Zoning By-law Z456-2003.
The lands are located at 54296 Heritage Line, west of Culloden Road.
THE EFFECT of this By-law will be to permit the operation of a small, owner-operated small
business for the maintenance and repair of large agricultural vehicles inside the proposed
oversized accessory building and as the base of operations for repairs offsite and storage of parts
and repair equipment and to permit the owner to operate as part of the business a motor vehicle
inspection station (MVIS) use to be authorized by the Ministry of Transportation.
ANY PERSON may attend the public meeting and/or make a written or verbal representation in
support of or in opposition to the proposed amendment. When possible, please consider utilizing
written correspondence. Written comments are to be submitted on or before 12:00 Noon on

Council will note the marked decrease in Building activity in Q4 compared to earlier in 2022,
including 0 permits issued for houses for the first quarter in over 6 years. It is likely that this
slow-down in building activity is due, at least in part, to the interest rate hikes witnessed in 2022,
which affect borrowing of all types, including construction.

I am writing to advise you that at the Council meeting held on December 12,
2022, Council adopted the following recommendations regarding the above
referenced matter:
Whereas the Government of Ontario recently passed Bill 23, More
Homes Built Faster Act, 2022 without providing meaningful or
adequate opportunity for municipalities to provide input on ways to
increase the supply of housing and to improve housing affordability in
Ontario while ensuring the financial capacity of municipalities to
support growth and protection of the environment; and,
Whereas Bill 23 will have significant negative impact on heritage
housing, green standards, environmental protection of wetlands,
conservation, social housing and other significant areas of concern;
and,
Whereas a preliminary analysis of Bill 23 by the Association of
Municipalities of Ontario (AMO) indicates the transfer of up to $1 billion
a year in costs from private sector developers to property taxpayers
without any likelihood of improved housing affordability while also
undermining environmental protection; and,
Whereas the Town of Newmarket has been specifically identified as a
growth area, with a target to introduce 12,000 new homes by 2031,
despite a lack of sewage capacity until the southern solution as
mandated by the province is completed; and,
Whereas municipal estimates vary between a property tax impact of
Bill 23 between five and 15 per cent; and,
Whereas a growing number of municipalities have joined in expressing
their concern with the negative impacts of Bill 23;

1. That the Town of Newmarket formally express its opposition to
Bill 23 in its current form and that this resolution be forwarded
to the Premier, the Minister of Municipal Affairs and Housing
Steve Clark, and MPP Newmarket-Aurora Dawn Gallagher-

entire Province;

Municipal Act, 2001, Ontario Heritage Act, Ontario Land Tribunal Act,
2021, Planning Act and may make changes to the Ontario Building
Code along with the financial burden that this legislation will have on
municipalities and existing homeowners;

Township of West Lincoln concurs with City of Niagara Falls Council
and many others that the legislative program under the umbrella of the
Ontario Housing Supply Action Plan must be paused in order to have
a more in-depth consultation with municipalities and other
stakeholders;

Municipalities of Ontario,
At the Special Council Meeting of December 15, 2022, the Council of the Corporation of
the City of Cambridge passed the following Motion:

Whereas the More Homes Built Faster Act received Royal Assent on November 28, 2022;
and
Whereas these changes that will have significant impacts on several provincial Acts and in
turn, significant and longstanding impacts on Ontario municipalities; and
Whereas the Act defines affordable housing as 80% of the market rate; and
Whereas a definition of affordability which is tied to a percentage of market rates remains
largely unaffordable for many; and
Whereas the province has restricted the use of inclusionary zoning by limiting it to 5% of
dwellings within a development, thereby limiting affordable housing opportunities; and
Whereas the province has restricted the use of inclusionary zoning by capping the time to
remain affordable at 25 years, thereby limiting the longevity of housing affordability; and
Therefore, be it resolved that the Cambridge City Council requests that the provincial
definition of affordable be based on income and not market rates, and
Be it further resolved that the Cambridge City Council requests that the provincial limitation
of 5% of the use of inclusionary zoning within a development be increased; and
Be it further resolved that the Cambridge City Council requests that the provincial timelines
regarding the use of inclusionary zoning affordable housing be increased beyond 25 years;
Be it further resolved that the Cambridge City Council requests that the Province
reconsider how the More Homes Built Faster Act, 2022, will negatively impact environmental
protection, heritage preservation, public participation, and loss of farmland; and
Be it further resolved that Cambridge City Council also supports the resolution passed
on December 8, 2022 by the Ontario Big City Mayors regarding the More Homes Built
Faster Act.

RE: Bill 23 More Homes Built Faster Act
The Municipality of North Perth appreciates that housing is a top priority for the
Province and shares the desire for more homes, especially affordable homes.
However, following a high-level review of the proposed legislation, the
Municipality of North Perth believes that Bill 23 will do little to accomplish this
goal.
Firstly, we appreciate the opportunity to provide comments on this matter, but
find it important to acknowledge that staff and Council of the Municipality require
more than 30 days to digest and respond to a complex piece of legislation
affecting nine existing Acts.
North Perth was disappointed to learn that Bill 23 received Royal Assent on
November 28, 2022, despite the Province extending the comment period to
December 9th. The Municipality feels that this further proves that although
municipalities are the most informed on local housing issues, the Province does
not view them as a strategic partner in solution finding and action.
As outlined below, the Municipality of North Perth has several concerns to date
with the legislation.
The bill, as it is currently written, would eliminate the charges that developers
currently pay toward housing. This will eliminate hundreds of millions of dollars
that municipalities rely on for housing programs and dramatically reduce
municipal affordable housing efforts.
Development Charges (DC) are designed to help municipalities pay for a portion
of the capital infrastructure required to support new growth, to ensure that
existing taxpayers are not required to subsidize costs of the infrastructure or
services needed to support new residents and businesses. Without a new
revenue stream to offset DC payments, the legislation hampers the ability of
municipalities to fund and deliver growth-related infrastructure. The changes to
the Development Charges Act fundamentally impacts municipalities’ ability to
ensure growth pays for growth.
The changes to the various Acts have significant financial impacts on Ontario’s
municipalities along with their respective taxpayers. It is anticipated that these
changes will put additional pressure on property taxes and water and wastewater
rates. Property taxes and user fees are crafted to fund projects and programs
that communities need, however adding more costs to existing property owners
will increase their costs and could negatively impact their ability to keep their
current housing affordable. Provincial legislation should not unduly burden
homeowners and renters to guarantee the long-term success of solving the
housing crisis.
Municipalities are extremely limited in the ways that they can collect revenue,
relying on transfers from other levels of government to mitigate property tax rate
increases, fund critical infrastructure and balance annual budgets. Municipalities
already face an infrastructure funding gap that requires additional financial
investments, resources and supports. Planning for increasing additional dwelling
units will place more strain on water and wastewater systems which will require
upgrading to increase capacity. This will require additional financial resources to
manage, at a time when municipalities are already facing increased budgetary
pressures due to inflationary costs, increased citizen expectations and the
transfer of responsibilities from the Province. Without additional funding or
resources from the Province to offset these costs, municipalities will have little
option but to put these costs back on the taxpayer.
The amendment that all DC by-laws passed after January 1, 2022 (previously
June 1, 2022) must be phased-in for the first five years that the by-law is in force
will have an overall negative consequence to the goal of building more housing.
The phase-in will delay necessary infrastructure projects to unlock growth while
also providing incentives for development projects to be delayed until a new by-
law is enacted.
Growth-related infrastructure often centres on the infrastructure itself, but a
critical piece towards infrastructure is the land required to build. Land represents
a significant cost for some municipalities in the purchase of property to provide
services to new residents. This is a cost required due to growth and should be
funded by new development. Studies, such as Official Plans, are required to
establish when, where and how a municipality will grow. These growth-related
studies should remain funded by growth. Master Plans and environmental
assessments are essential to understand the servicing needs that development
will place on hard infrastructure; again, these are necessary studies to inform the
servicing required to establish the supply of lands for development. This would
restrict the supply of serviced land and would contradict the province’s intent to
create additional housing units.
Parkland dedication levies exist to ensure that municipal park systems grow
alongside other community developments. Increasing the supply and mix of
housing is an important goal that we all share; however, sufficient access to
parks and greenspace cannot be overlooked as we try to create meaningful
alternatives to single-family dwellings. Municipalities already face challenges with
the supply of adequate parkland due to the rising costs of land and current
limitations under the Planning Act relative to municipal parkland standards.
Upper-tier and single-tier municipalities across the province utilize DCs to help
fund the construction of new affordable housing units with the goal of providing
affordable housing to those in need. The removal of housing services and limiting
the tools available to municipalities to support homeless and underhoused
people and families will reduce municipality participation in creating affordable
housing units, putting further burden on municipal taxpayers.
In order for the Province to successfully achieve the goal of building 1.5 million
homes within the next ten years, municipalities must be viewed as strategic
partners. As the frontline level of government, municipalities are also eager to
resolve the housing crisis and are the most informed on what is needed to create
complete communities that the people of Ontario want and expect.
Please consider revisions to the regulations in Bill 23 for more meaningful review
and consultation with stakeholders and input from municipalities, and conduct
thorough analyses of both short and long-term impacts. To ensure informed
implementation of this proposal, alternatives to improve the legislation to
effectively create more attainable housing for Ontario need to be considered.

uncertainty and unfamiliarity, there have been so many moments of delight as we've finally
been able to resume the activities and traditions we hold dear. It's been so good to see
you again, Elgin County! As we take stock of a year almost complete we are deeply
grateful to be part of such an incredible community.

Earth + Honeybee
There are new beekeepers on the scene in Elgin County, and the community is already
abuzz! Husband and wife duo Melissa and Adam are new residents in Union, having just
arrived from the Ilderton area in October 2022, and they are already establishing a strong
local presence at farmers' markets and through their online shop.
The couple's passion for environmental stewardship is evident in everything they do, but
most significantly in the way they work with and for the bees in their care. Cultivating
spiritual ties with bees allows one to be able to connect with nature in a vulnerable way,
says Melissa. In caring for the hive you start to deeply understand the role bees play in the
broader ecosystem and to use all your senses to appreciate their contributions. One thing
Melissa enjoys most about beekeeping is the way that it becomes meditative, through the
hum of the bees and routine of their care. She reflects that being amidst an active hive of
bees makes you feel like you're stopped in time. Seeing them living with such structure
and instinct, serving a collective benefit that's greater than any one bee, is an inspiring
metaphor for life.
These are all lessons that the couple has learned in a relatively short amount of time,
having first started keeping bees as a hobby born from a brainstorming session in 2017.
At that time, they were looking for hobbies they could share but also potentially turn into a
business. Melissa thought about beekeeping, and it all started rolling from there,
eventually leading to her leaving her career in mental health to serve the business full-time
while Adam continues to work for the City of London. The process has all seemed quite
natural and symbolic, almost predestined! Since Melissa was a child, she has been
interested in name meanings, with hers being 'honeybee'. Adam's means 'red earth,' so
the combination of the two inspired the business name.
Education is at the core of Earth + Honeybee's identity. Melissa and Adam love to help
people learn more about honeybees, give them more confidence in starting or continuing
their beekeeping journeys, and providing access to affordable equipment and bee
byproducts that people may not otherwise be able to find. They are passionate about
inviting people to see firsthand how deeply they care for their hives as working members
of the operation, with bee health and welfare as their top priority.
The couple hopes that by learning about and experiencing beekeeping firsthand, people
can become more connected to the original roots of self-sustenance and join the network
of humans taking an active role in supporting pollinators. This, they feel, is connected to
broader activities and values that include soil maintenance through composting, wellness
and meditation, and planting pollinators. They plan to facilitate these educational and
healing encounters through experience-based opportunities at their new property in Union
as well as virtual workshops. Through sharing their love for bees and beekeeping, Melissa
and Adam are building a pretty incredible community!

Another new Elgin business with a very fitting name is Paleta Passion, now with a lovely
storefront on Talbot Street in Aylmer! Owner Christina Friesen, an Aylmer native, spent
part of her childhood in Mexico and was inspired to start a small business centred on a
nostalgic sweet treat from her time there.
The paleta is a Mexican frozen treat made from either fresh natural fruits or rich, creamy
ingredients, and it plays a strong role in the country's cultural tradition. Christina
remembers how exciting it was to enjoy paletas as a child and notes that in Mexico there
is a great deal of regional flavour variation, since they traditionally use fruits that are local

Christina jumped right into the creative freedom of crafting new flavours. She developed a
blueberry paleta that is unique because blueberries are not grown in Mexico! The most

now, this is the perfect holiday venture with the family.

Provincial Government Updates
On November 14, the Ontario Government released the 2022 Ontario Economic
Outlook and Fiscal Review - Ontario's Plan to Build: A Progress Update. It included
the government's progress report on previous budgetary commitments, as well as new
measures including support for small businesses. Key highlights:
Providing over $675M in Ontario income tax relief over 3 years by temporarily
allowing eligible businesses to immediately expense up to $1.5M per year for
certain capital investments
Proposing to extend the phase-out range for the small business Corporate Income
Tax rate to between $10M and $50M of taxable capital
Proposing to expand eligible expenditures for the Ontario Productions Services Tax
Credit to include location fees
Establishing consultation groups to support refocused red tape reduction efforts,
inviting representatives from key industries and areas of activity across the province
Proposing legislation to launch a voluntary Clean Energy Credit registry
Proposing amendments to the Securities Act to enable digital access to
documents
On November 23, the Provincial Ministry of Red Tape Reduction introduced the Less Red
Tape, Stronger Ontario Act, which includes 28 new measures to increase Ontario's
competitiveness, support stronger supply chains, and make government easier to access

Highlights of the package include:
Removing legislative barriers to support greater investment in clean and emission
reducing technologies.
Providing more data and tools to municipalities to determine optimal Reduced Load
Periods on roadways and improve supply chain efficiency.
Increasing court capacity and efficiency to improve service, including the
introduction of digital jury questionaries.
Modernizing the Veterinarians Act, including identifying opportunities to streamline
requirements or reduce compliance burden for vets and practice owners.
The Act also included the creation of the Grow Ontario Strategy, which outlines the
province's plan to strengthen the agri-food sector, ensure an efficient, reliable, and
responsive food supply and address ongoing vulnerabilities through new innovations.
The plan focuses on three key priorities:
Strengthen Agri-food Supply Chain Stability: Increase both the consumption and
production of food grown and prepared in Ontario by 30 per cent, increase Ontario’s
food and beverage manufacturing GDP by 10 per cent and boost Ontario’s agri-food
exports eight per cent annually by 2032. This includes opening applications for the
$10 million Food Security and Supply Chain Fund which will provide funding for
projects such as updated inventory software, expanded warehousing to allow
increased inventory levels or automation equipment to address labour gaps. The
province is also strengthening its food processing capacity and food security to
position the sector for growth through the $25 million Strategic Agri-Food
Processing Fund.
Increase Agri-food Technology and Adoption: Boost research infrastructure,
advance the uptake of new technologies, grow the market for Ontario innovative
technologies domestically and globally, and grow the use of data to support
efficiencies in the agri-food sector and value chain. The province will also begin
consultations on modernizing the Agricultural Research Institute of Ontario Act to
fuel innovation and support efforts to provide modern, relevant research information
to farmers and agri-food businesses.
Attract and Grow Ontario’s Agri-food Talent: The province aims to increase total
agri-food sector employment by 10 per cent by 2032, as well as increase
awareness of modern, high-tech agri-food careers, opportunities for mentorship and
hands-on job training, and support efforts to increase veterinary capacity in
underserviced areas of the province. This includes launching public consultations to
explore opportunities to modernize the Veterinarians Act as part of the plan to
increase access to veterinary care in Ontario.
On November 22, the Economic Development and Tourism team attended the Aylmer
Chamber of Commerce's Business After 5 networking event held in the future home of the
Aylmer-Malahide Museum and Archives. It was a great opportunity to connect with some
familiar faces and hear about all the exciting things happening in the Aylmer business
community!
Members of the Economic Development team attended the 2022 Growing Your Workforce
conference hosted in partnership with the Western Ontario Wardens' Caucus.
Members of the team also attended the St. Thomas and District Chamber of Commerce's

Re: 2023 Draft LPRCA Budget_________________________________________________
To the Mayor and Council,
In response to your letter dated December 9, 2022 requesting clarification on the nature of the
expenditure increases and the impacts to the 2023 draft consolidated operating budget the
main drivers are identified as follows:
a) Compensation Expenditures: The Authority had and independent external consultant
conduct a Pay Equity & Compensation Review in 2022 (last review conducted in 2012)
which found at the 50th percentile the Authority was 11.5% behind the comparators.
The LPRCA Board of Directors approved the consultants report and the new adjusted
pay grid at the October meeting. Additionally, the 2023 COLA for staff wages included
in the draft budget is 6.0%. COLA is based on the 12-month average of the CPI from
September through August. This method has historically been used to be applied to
the pay grid.
b) Conservation Authorities Act Regulatory Changes: The amended act requires
conservation authorities to have in place the following plans by December 31, 2023:
i. Conservation Lands Management Strategy Plan,
ii. Land Inventory Registry Plan,
iii. Ice Management Plan,
iv. Asset Management Plan (water control structures) and
v. Water Resources Management Plan.
LPRCA has already commenced initial work on developing these required plans. The
2023 draft budget includes the addition of two contract part-time positions (1.07 FTE’s)
to lead the initiative to complete the plans. Completing the plans in-house was
selected over using a consultant not only because of the cost effectiveness but a staff
member who has helped the Authority to fill staffing gaps and training new staff that

has the expertise & knowledge of the organization and watershed has agreed to
remain on staff to lead these projects during this transition period.
c) Campground and Motorpool Capital: The 2023 draft budget will recover campground
and motorpool capital requirements from current year surplus instead of relying on
levying our municipal partners for these capital items. In previous budgets current
year surplus was used to support (decrease) current year municipal operating levy.
This change resulted in a decrease in year-over-year capital levy to our municipal
partners of $231,000 or 60.7% and an increase of $231,000 in municipal operating
levy. The amended regulations effective January 1, 2024 changes the method
conservation authorities can levy for capital and LPRCA adapted these changes in
advance of the requirement.
d) Other items that impacted overall expenditures: Insurance premiums 10% increase
over 2022 actuals, employee benefits 15% increase over 2022 actuals, OMERS non-
full-time expansion, increase in both CPP and EI rates and overall inflationary
pressures.
Thank you for your inquiry. I trust this correspondence provides sufficient clarification as to
the main drivers of the increases of the 2023 draft budget operating expenditure increase and
the impacts to the 2023 draft consolidated budget.

REPORT: CAO-02/23 SUBJECT: PORT BURWELL LIGHTHOUSE HERITAGE AND STRUCTURAL ASSESSMENT
BACKGROUND
At its November 3, 2022 meeting, Council received Report CAO-63/22 re Port Burwell
Lighthouse Heritage Cladding Assessment Report. The Report provided Council with a
comprehensive background of the project to-date and advised that, per the Heritage Cladding
Assessment Report, prepared by a+LINK Architecture Inc. (a+LINK), further assessment was
required, including the following items:
Architectural Report and Cladding Review
Structural Report
Soil Test Report
Topographical Survey,
which would be further used to establish conservation and maintenance plans for the Port
Burwell Lighthouse.
The a+LINK Report identified that remediation should be the focus rather than replacement, and
includes the complete removal of the existing vinyl application, which has contributed
significantly to the observed deteriorated condition of the wood siding.
Upon of Report CAO-63/22, Council passed the following motion:

AND THAT cost estimates for the recommended items in the Heritage Cladding
Assessment Report be obtained and provided to Council for further consideration.
On December 21, 2022, staff received a formal Proposal for the Heritage Assessment,
Structural Assessment, and Digital Scanning services from a+LINK. The Proposal is attached to
this Report.
The soil test and updated topographical survey were handled operationally in Q4 2022.
Council is also aware that the Municipality was a recipient of $100,000 grant through the
Southwest Tourism Relief Fund (STRF) for exterior works at the Port Burwell Lighthouse. The
works through the STRF grant must have been completed and substantiated by year-end 2022.
DISCUSSION
The Proposal covers two of the four recommended processes discussed in Report CAO-63/22,
being the Architectural Report and Cladding Review, and the Structural Report. Digital Scanning
Services is a stand-alone item that would apply to the former as a part of a comprehensive
analysis process should there be any physical documentation requiring digitization.
The total proposed costing is $19,935.00.
Should Council opt to proceed, the outstanding works would take six (6) week and would be
capped with a Report. Given the timeline provided, the Report would be received by staff by the
end of February 2023 and would be received by Council in March 2023.
Staff recommend proceeding with the Proposal provided by a+LINK to ensure this important
work is actioned in the short-term.
Regarding the STRF grant, staff have confirmed two points for Council’s information: 1) The
grant cannot be extended past the December 31, 2022 deadline; and, 2) any background works
regarding studies for future Lighthouse works are eligible under the STRF’s funding so long as
these costs were incurred and invoiced prior to December 31, 2022.
In accordance and in November 2022, staff obtained costing and completed the soil test and
topographical survey updates for the Port Burwell Lighthouse. Total costs for these works were
approximately $9,000 and will be recouped through the STRF as well as costs incurred for the
previously-received Heritage Cladding Assessment Report. Total recouped costs are estimated
at $14,200.
The survey has since been provided to a+LINK for their use moving forward, should Council opt
to approve the Proposal.

WHEREAS under Section 5 (1) of the Municipal Act, 2001 S.O. 2001, Chapter 25, the powers of
a municipal corporation are to be exercised by the Council of the municipality;

exercised by by-law;
