THE CORPORATION OF THE
MUNICIPALITY OF BAYHAM
BY-LAW NO. Z752-2022
VIENNA FARMS LTD.
BEING A BY-LAW TO AMEND BY-LAW NO. Z456-2003, AS AMENDED
WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to
amend Zoning By-law No. Z456-2003, as amended;
THEREFORE, the Council of the Corporation of the Municipality of Bayham enacts as follows:
1) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending
Schedule “A” Map No. 14 by changing the zoning symbol on the lands from Agriculture
(A1) to site-specific Agriculture (A1-43), which lands are outlined in heavy solid lines and
marked A1-43 on Schedule “A” Map No. 14 to this By-law, which schedule is attached to
and forms part of this By-law.
2) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending
Section 5.12 Exception – Agriculture (A1/A1-A) Zone by adding the following clauses:
5.12.43.1 Defined Area
A1-43 as shown on Schedule “A”, Map No. 14 to this By-law.
5.12.43.2 Minimum Lot Area
2.4 hectares
5.12.43.3 Additional Permitted Use
Large-scale Supplementary Farm Dwelling
5.12.43.4 Maximum Floor Area for the Large-Scale Supplementary Farm Dwelling
306 square metres
5.12.43.5 Minimum Front Yard Depth
10.8 metres for the existing dwelling
5.12.43.6 Minimum Front Yard Depth
8.4 metres for the existing accessory building
5.12.43.7 Minimum Side Yard Setback (north side)
0.9 metres for the existing accessory building
5.12.43.8 Minimum Farmland Area Worked Per Seasonal Labourer
2.3 hectares
5.12.43.9 Seasonal Time Period
Notwithstanding the maximum eight months per calendar year for
seasonal farm dwellings in the definition for “Dwelling, supplementary
farm”, the subject farm operation large scale supplementary farm dwelling
may operate year-round.
3) THIS By-law comes into force:
a) Where no notice of objection has been filed with the Municipal Clerk within the
time prescribed by the Planning Act and regulations pursuant thereto, upon the
expiration of the prescribed time; or
b) Where notice of objection has been filed with the Municipal Clerk within the time
prescribed by the Planning Act and regulations pursuant thereto, upon the
approval of the Ontario Land Tribunal.
READ A FIRST TIME AND SECOND TIME THIS 15TH DAY OF DECEMBER 2022.

BEING A BY-LAW TO AMEND BY-LAW No. Z456-2003, AS AMENDED
WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to
amend Zoning By-law No. Z456-2003, as amended;
THEREFORE, the Council of the Corporation of the Municipality of Bayham enacts as follows:
1) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending
Schedule “A” Map No. 12 by changing the zoning symbol on the lands from Agriculture
(A1) to site-specific Agriculture (A1-A-44), which lands are outlined in heavy solid lines
and marked A1-A-44 on Schedule “A” Map No. 12 to this By-law, which schedule is
