A-09/22 MacArthur — 29 Edison Drive, Vienna The October 6, 2022 Committee of Adjustment Meeting was held using hybrid technologies via Zoom and livestreamed on YouTube. Minor Variance Application A-09122 MacArthur — 29 Edison Drive, Vienna THE PURPOSE of the variance is to grant relief from Zoning By-law regulations in Section 4.2 c) and 4.2 d) to permit an accessory building to be located in the front yard and to permit an accessory building closer to the street than the main building is to that street whereas the proposed location would not be permitted, for lands located at 29 Edison Drive, west side and south side of Ann Street, in the village of Vienna. THE EFFECT of this variance will be to permit a new accessory building (garage) to be located on the east side of the property which is considered the front yard and would be closer to Edison Drive than the dwelling due to lot configuration and existing dwelling location. Report DS-55/22 by Margaret Underhill, Secretary/Treasurer re Committee of Adjustment Minor Variance Application A-09/22 MacArthur— 29 Edison Drive, Vienna Secretary/Treasurer M. Underhill presented Report DS-55/22. S. PRESENTATIONS BY APPLICANT/AGENT There were no presentations. S. PUBLIC SUBMISSIONS There were no public submissions received. 7. COMMITTEE QUESTIONS AND DISCUSSION The committee asked clarifying questions on the location of the house and if there will be an additional driveway to the garage. Secretary/Treasurer M. Underhill confirmed that the applicant will be looking to install a second driveway to the garage and will need to apply for a road access permit through Public Works for this. M. Underhill also noted that correspondence was received from LRPCA after the publishing of the report that noted no concerns. 8. DECISION OF COMMITTEE (Motions) Moved by: Committee Member C. Valerie Donnell Seconded by: Committee Member Dan Froese THAT the Committee of Adjustment Secretary/Treasurer's report DS-55/22 regarding the MacArthur minor variance be received; AND THAT the Committee of Adjustment considered all written and oral submissions received on this application, the effect of which helped the committee to make an informed decision; AND WHEREAS the Committee agrees that the proposed variance as presented meets Section 45.1(1) of the Planning Act and is considered minor; THEREFORE application A-09/22 by James and Stacey MacArthur pursuant to Section 45 of the Planning Act for a minor variance, is granted to allow relief from Municipality of Bayham Zoning By-law No. Z456-2001 Sections 4.2 c) and 4.2 d) to permit one accessory building on the subject lands located in the front yard and closer to the street than the main building is to that street, provided that the proposed structure is built in conformity to the other applicable provisions of the Zoning By-law and written clearance from the LPRCA is obtained 3 Statutory Planning Agenda — Committee of Adjustment October 6, 2022 ■ Section 10.10 Minimum Rear Yard Depth — to permit a rear yard setback of 4.0 metres for the existing dwelling Condition: The proposed building being used only for storage use accessory to the residential use. CARRIED 9. ADJOURNMENT Moved by: Committee Member C. Valerie Donnell Seconded by: Committee Member Sue Chilcott THAT the Committee of Adjustment hearing for consideration of Minor Variance Application A- 09/22 be adjourned at 6:53 p.m.; AND THAT in accordance with the regulations of the Planning Act, Notices of Decision be circulated by the Secretary -Treasurer accordingly.
