BY-LAW NO. 2022-055
BEING A BY-LAW TO STOP UP, CLOSE AND CONVEY A PORTION
OF DENNIS ROAD AND WOODWORTH ROAD, BEING PART 1 ON
PLAN 11 R-10884 AND PARTS 2 AND 3 ON PLAN 11 R-10885
WHEREAS Section 11 of the Municipal Act, 2001, S.O. 2001, c. 25 as amended provides that a
lower tier municipality may pass by-laws respecting Highways, including parking and traffic on
highways;
AND WHEREAS Section 8 of the said Municipal Act provides that a municipality has the capacity,
rights, powers, and privileges of a natural person for the purpose of exercising its authority under
this or any other Act;
AND WHEREAS Section 270(1) of the Municipal Act provides in part that every municipality with
authority to sell land shall pass a by-law establishing procedures governing the sale of land;
AND WHEREAS the Municipality of Bayham passed By-law No. 2015-021 to establish a
procedure governing the sale of municipal owned land;
AND WHEREAS, as a condition of Consent Application E58-18: "As per Municipal Sale and
Disposition of Land by-law, an agreement with Chad Underhill to purchase the road allowance
and bridge "as is where is" at the southerly end of Dennis Road including that parcel of land
south of the bridge connecting to the requested easement located on Concession 3 between
North Part Lots 6 and 7 including the Municipality retaining a catch basin servicing easement";
AND WHEREAS the Council of the Municipality of Bayham is desirous of selling property owned
by the Municipality and has completed procedures pursuant to By-law No. 2015-021 for the sale of
the subject lands;
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM
ENACTS AS FOLLOWS:
1. THAT upon and after the passing of this By-law that portions of Dennis Road and Woodworth
Road, being Part 1 on Registered Plan 11 R-10884 and Parts 2 and 3 on Registered Plan 11 R-
10885 of the Municipality of Bayham, in the County of Elgin is hereby stopped up and closed;
2. AND THAT the Clerk or designate is hereby authorized to amend the parcel designation noted
in this By-law, if necessary, upon registration of this By-law;
3. AND THAT the Council of the Municipality of Bayham authorizes the Mayor and Clerk to
execute all documents as may be necessary to provide for the conveyance of real property
described as Part 1 on Registered Plan 11 R-10884, Part 3 on Registered Plan 11 R-10885, and
the bridge `as -is, where -is' to Chad Underhill for $6,250;
4. AND THAT the Council of the Municipality of Bayham authorizes the Mayor and Clerk to
execute all documents as may be necessary to provide for the sale of real property described as
Part 2 on Registered Plan 11 R-10885 to Douglas Dennis for $4,200"
5. AND THAT the Council of the Municipality of Bayham authorizes the Mayor and Clerk to
execute any ancillary agreements pursuant to the Agreement of Purchase and Sale;
6. AND THAT this by-law shall take effect upon the date of its registration in the Land Titles
Division for the County of Elgin (No. 11).
