3. APPLICATION
A. Minor Variance Application A-06/22 Clarke — 56068 Heritage Line
THE PURPOSE of the variance is to grant relief from Zoning By-law regulations in Section
10.11 Regulations for Accessory Buildings in the Village Residential 1 (R1) zone, to permit
accessory building maximum floor area of 76.2 m2 (820 ft2) whereas 65 m2 (700 ft2) is the
permitted maximum; and to permit accessory building maximum height of 4.6 m (15.1 ft.)
whereas 4.5 m (14.7 ft.) is the permitted maximum, for lands located at 56068 Heritage Line,
north side, west of Sandytown Road, in the village of Straffordville.
THE EFFECT of this variance will be to permit, in addition to the existing accessory building
with floor area of 13.4 m2 (144.5 ft2), an accessory building with floor area of 62.8 m2 (676 ft2)
in the form of a two car garage with second storey storage area, intended to be used for
personal and vehicle storage accessory to an existing single detached dwelling use.

Secretary/Treasurer M. Underhill confirmed no submissions received
7. COMMITTEE QUESTIONS AND DISCUSSION
Committee members asked clarifying questions surrounding the height of the structure and
ensuring the use remains for storage and not a residence.
8. DECISION OF COMMITTEE (Motions)
Moved by: Committee Member C. Valerie Donnell
Seconded by: Committee Member Rainey Weisler
THAT the Committee of Adjustment Secretary/Treasurer's report DS-37/22 regarding the
Clarke minor variance be received;
AND THAT the Committee of Adjustment considered all written and oral submissions received
on this application, the effect of which helped the committee to make an informed decision;
AND WHEREAS the Committee agrees that the proposed variance as presented meets
Section 45.1(1) of the Planning Act and is considered minor;
THEREFORE application A-06/22 by Rob and Penny Clarke pursuant to Section 45 of the
Planning Act for a minor variance, is granted to allow relief from Municipality of Bayham
Zoning By-law No. Z456-2003:
* Section 10.11 b) and c) for maximum combined accessory building floor area of 76.3
m2 (821.3 ft2) and maximum accessory building height of 4.65 m
Condition: The proposed building is to be used only for personal storage use accessory to
the residential use.
