Background
The Municipality currently imposes water and sewer
connection fees from new users to recover costs related to
the capital infrastructure. These fees are imposed in the
areas of :
Port Burwell;
Vienna;
Eden (Sewer Only);
Straffordville (Sewer Only); and
Richmond (Water Only).
These fees are currently provided through by-laws under
the Municipal Act, 2001 2
Background (continued)
Given that the connection fees also apply to new
development, it would be appropriate to provide these fees
under a Development Charge (D.C.) by-law under the
Development Charges Act, 1997 (as amended) to properly
administer this type of charge with respect to new units.
The following slides provide an overview of these charges.

Wastewater Infrastructure

The historical wastewater infrastructure capital costs were provided in
Report 2000-27, with a net cost of $3,508,154 (in 2000$)
These amounts were indexed from 2000 to 2022 dollars and divided by
the total population it can accommodate (3,650).
This provided a dollar per capita recovery, which is multiplied by the
appropriate persons per unit to generate a charge per residential unit
type (similar calculation for water).
The following table provides the recalculation of the sewer charge for
all areas:

With respect to the other fees imposed by the Municipality, limited
background information was available.
The connection fees noted in those by-laws will be carried over to a
D.C. by-law for new construction.
For existing lots, the charges identified within the rates and fees by-law
will continue.
With respect to the fees that are related to the length of a property’s
frontages, the D.C.s will be based on an assumed frontage of 84 feet
as per staff’s input.
The current fees and charges by-law provides a minimum of 60 feet, to a
maximum of 150 feet.

Additional D.C.s for Consideration
•The municipality is undertaking a Storm Water
Rehabilitation project within the community of Port Burwell
which is estimated to cost $29.3 million.
•The municipality has an outstanding application for the Disaster
Mitigation Adaption Fund (DMAF) for $8 million.
•The remaining portion of this amount (net of grants) could
be recovered from D.C.s., own sources of revenue, county
and road apportionments, and local area charges.
•The D.C. process can be undertaken at Council’s direction.
•Council can also consider D.C.s for other municipal-wide
services (e.g. roads, parks and recreation, etc.)

D.C. Application for Bayham
•D.C.s can assist in recovering for costs associated with
(but not limited to):
•Roads and related infrastructure –New or upgrades
(conversions from one road type to another)
•Water, Wastewater, Stormwater Infrastructure
•Assist in the development of new parkland and recreation
facilities.
•Purchasing additional/new/upgraded vehicles and equipment
•New construction or expansion of facilities related to the
above
•Studies related to eligible services

Next Steps
•Council to consider the following Options:
1.Water and Wastewater D.C.s
2.Water and Wastewater D.C.s, plus the addition of an enhanced
D.C. for the Port Burwell Storm Water Rehabilitation project
3.Option 2, plus the addition of undertaking a D.C. process for all
other municipal services.
•Based on one of the above options, the following steps would be
required to be undertaken (Options 2 and 3 will require additional
analysis):

BY-LAW NO. 2022-049
A BY-LAW TO CONFIRM ALL ACTIONS OF
THE COUNCIL OF THE CORPORATION OF
THE MUNICIPALITY OF BAYHAM FOR THE
SPECIAL COUNCIL MEETING HELD JULY 6, 2022
WHEREAS under Section 5 (1) of the Municipal Act, 2001 S.O. 2001, Chapter 25, the powers of
a municipal corporation are to be exercised by the Council of the municipality;
AND WHEREAS under Section 5 (3) of the Municipal Act, 2001, the powers of Council are to be
exercised by by-law;
AND WHEREAS the Council of The Corporation of the Municipality of Bayham deems it
advisable that the proceedings of the meeting be confirmed and adopted by by-law.
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
BAYHAM ENACTS AS FOLLOWS:
1. THAT the actions of the Council of The Corporation of the Municipality of Bayham in
respect of each recommendation and each motion and resolution passed and other
action by the Council at the Council meeting held July 6, 2022 is hereby adopted and
confirmed as if all proceedings were expressly embodied in this by-law.
2. THAT the Mayor and Clerk of The Corporation of the Municipality of Bayham are hereby
authorized and directed to do all things necessary to give effect to the action of the
Council including executing all documents and affixing the Corporate Seal.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 6th DAY
OF JULY 2022.
