Dear Mr. Thayer and Bayham Township Council
We, the undersigned are sending you this letter to convey our serious on-going concern about a
safety issue in the village of Eden. Several of us who live on this Alley have contacted the Mayor
and other professionals at the Township office and the Police Department to let them know about
some very dangerous activities happening both on Plank Road and the Alley we live on. The Alley
in question is Gray Street.
Below are SOME of the immediate concerns that must be dealt with. A solution has to be
implemented immediately before we have a serious injury or death on this Alley.
Council calls this Alley a STREET. Gray Street does not meet the definition of what a street is. A
few of the new people moving to the village seem to think this alley is one of the 400 series
highways and race down it at great rates of speed with absolutely no consideration for safety for
children, pets, residentstaking a leisurelywalk, people backing outof theirdriveways, etc. etc. etc.
This situation is an accident waiting to happen. Council/ TWP have received numerous complaints
about this, yet nothing is happening to alleviate the problem.
Does someone have to be seriously injured or killed before this concern is addressed!!
Just one example; An individual who lives on this Alley witnessed a speeder who had to slam on
her brakes in order to miss hitting her child and dog running across the Alley. These types of
occurrences happen all the time and nobody seems to care. Several residents have almost been
rear ended when backing out of their driveways because the speeders refuse to slow down. The
culprits just don't care because there are absolutely no consequences imposed.
THIS HAS GOT TO STOP. We have tried to talk to them; asked them politely to slow down and
the result is they either deny their actions, or curse you out. Plank Line is just as bad for speeders
but at least you have some space and sidewalks to evade the drivers who have no conscience
about their actions. They refer to Eden as the 'country' and they can do what they want".
Residents of Eden should not be responsible to tell people to s/ow down. lt is not our job, nor do
we have the authority to do so. We need someone with authority to enforce some kind of laws.
WE NEED HELP DOWN HERE NOW
Below you will find some facts and possible solutions to consider.
Consideration of Council - speed bumps be placed on Gray St. in the Hamlet of Eden
- The alley's pavement is 13 ft wide - no sidewalk- Several speeders going down Gray St (alley) - over 50 km per hr. One clocked @ 70+ km
per hr- Local residents doing this (3)- Contractors - several- Plates and names of individuals taken- We, and several other neighbors have talked to the speeders - we were told to mind our
own business and we have no authority to tell them what to do - We placed SLOW DOWN
SIGNS on our front lawns - One speeder, (a resident) just laughed and ran over 2 of the
signs (drove up on a front yard) and destroyed them'- The police have been notified and said they would talk to the speeders.
- The police have talked to them- The same people continue to speed down the alley- We have talked to police again - they do not have the manpower to monitor the alley
We request immediate action from the Bayham Township Council on this matter
- The alley's pavement is 13 ft wide - no sidewalk. No safe area to get out of the way,
especially when a large truck takes up the whole width of the alley.
- There have been several near misses - children walking, riding bikes, playing etc.
- Women pushing their baby carriages- Residents backing out of their laneways have no time to get out safely.
- Elderly walkers, children riding their bikes, families, people walking their pets - are all
potential victims
We request that the Township place high quality speed bumps on the alley as soon as
possible before there is a serious injury or death.

chambers. The location of these are mainly located in the villages of Port Burwell and
Vienna. The estimated service population is 1590 with 820 fully metered service
connections. A booster pump station is located on the transmission main to Vienna.
This pump operates when the pressure drops to activate the pump which would
normally occur during fire flows or main line flushing.

SYSTEMS
Report
This report is a summary of water quality information for the Bayham Water
Distribution System, Water Works # 260004748, published in accordance with
Schedule 22 of the Ontario’s Drinking Water Systems Regulation for the reporting
period of January 1, 2021 to December 31, 2021. The Bayham Water Distribution
System is categorized as a Class 1, Large Municipal Residential Drinking Water System.
Who gets a copy of the Report:
The owner of the drinking – water system shall ensure that the following receive the
summary report no later than March 31 for the preceding calendar year;
in the case of a drinking water system owned by a municipality, the members of
the Municipal Council;
in the case of a drinking water system owned by a municipal service board
established under section 195 of the Municipal Act, 2001, the members of the
municipal service board; or
in the case of a drinking water system owned by a corporation, the board of
directors of the corporation.
What must the Report contain?
The report must,
(a) list the requirements of the Act, the regulations, the system’s approval and any
order that the system failed to meet at any time during the period covered by
the report and specify the duration of the failure; and
(b) for each failure referred to in clause (a), describe the measures that were taken
to correct the failure.
The Bayham Water Distribution System complied with the following Drinking Water
Legislation;

O. Reg 170/03, O. Reg 128/04
System Drinking Water Licence # 061-101, and Permit #061-102
What else must the report contain?
The report must also include the following information for the purposes of enabling the
owner of the system to assess the capability of the system to meet existing and planned

period covered by the report;
A comparison of the summary referred to in paragraph 1 to the rated capacity and
flow rates approved in the system’s approval.

The community is serviced by two drilled overburden wells and treatment equipment
upgrades including raw water softeners, nitrate filters, pre and post chlorination, post
filtration, uv disinfection, on-line continuous monitoring equipment including nitrate,
turbidity and chlorine. The system is monitored and alarmed by a computerized
SCADA system.

TAKE NOTICE that the Municipality of Bayham has received a completed application for a
proposed Minor Variance (A-01/22).
AND TAKE NOTICE that the Committee of Adjustment of the Corporation of the Municipality of
Bayham will hold an electronic virtual public meeting on Thursday, February 3rd, 2022 at 6:45
pm to consider a proposed minor variance to Zoning By-law No. Z456-2003 under Section 45 of
the PLANNING ACT. Please reference the Committee of Adjustment subject Agenda on the
municipal website for the electronic meeting link. If you wish to participate in the virtual public
meeting, you must register with the Planning Coordinator a minimum 48 hours prior to the
meeting.
THE PURPOSE of the variance is to grant relief from Zoning By-law regulations in Section 5.3
Minimum Lot Area, to permit minimum lot area of 17.2 ha (42.7 acres) whereas 20.0 ha (50 acres)
is the permitted minimum, for lands located at 54990 Baldwin Line, north side, west of Maple
Grove Line.
THE EFFECT of this variance will be to recognize existing reduced minimum lot area which would
permit the development of a single detached dwelling on a vacant farm parcel.
ANY PERSON may attend the public meeting and/or make a written or verbal representation in
support of or in opposition to the proposed minor variance.

law Amendment.
AND TAKE NOTICE that the Council of the Corporation of the Municipality of Bayham will hold a virtual
electronic public meeting on Thursday, February 17th, 2022 at 7:30 p.m. in the Municipal Council
Chambers in Straffordville to consider a proposed Zoning By-law amendment under Section 34 of the

virtual public meeting, you must register with the Planning Coordinator a minimum 48 hours prior to the
meeting.
THE PURPOSE of this By-law is amendment to change the zoning regulations on 5,775 m2 (1.4 acre)
of land from an Institutional (I) zone to a Hamlet Residential (HR) zone to recognize the change in land
use from institutional in nature to residential in nature in Zoning By-law Z456-2003. The subject lands
are located on the north side of Eden Line, east side of Culloden Road, known as 54246 Eden Line in
the hamlet of North Hall.
THE EFFECT of this By-law will be to fulfill conditions of Consent E89/21 and E90/21 to rezone the
severed lands consisting of two single-detached residential lots from an institutional zone to a residential
zone.
ANY PERSON may attend the virtual public meeting and/or make a written or verbal representation in
support of or in opposition to the proposed amendment. *** Given the current COVID-19 legislative
restrictions and limitations, land use planning meetings remain open to public comment. Please be
advised that equal consideration is given to all written and oral presentations provided to the municipality

Dear Premier Ford:
This is to advise that City Council,at a meeting held on November 22,2021,
passed the following resolution regarding fire safety measures:
"WHEREAS the Government of Ontario,in December 1975,enacted the
Ontario Building Code for the purpose of regulating the construction of new,
safe buildings within the Province of Ontario;and,
WHEREAS the Government of Ontario,in November 1981 enacted the
Ontario Fire Code for the purpose of maintaining the life safety systems of
all buildings within the Province of Ontario;and,
WHEREAS the Government of Ontario,in November 1983 began the
process of amending the Ontario Fire Code to include Retrofit provisions,
for the purpose of providing a minimum level of life safety for those existing
buildings which had not been built under the provisions of any version of the
Ontario Building Code;and,
WHEREAS the government of Ontario,in October 1992 amended the
Ontario Fire Code Retrofit provisions,for the purpose of providing a
minimum level of life safety to buildings classed as low rise residential (9.5);
and,
WHEREAS October 2021 marks twenty-nine (29)years since the
requirements outlined by Retrofit 9.5 have been substantially updated;and,
WHEREAS this lack of currently appropriate standards for se|f—closing
devices on suite doors and positive latching on exit stain/vell doors has led
to significant serious injuries,deaths,long term dislodgement of residents,
and significant unnecessary insurance loss due to allowed building
deficiencies;
.2.
THEREFORE IT BE RESOLVED that the City of Kitchener urges the
government of Ontario to direct the Ontario Fire Marshal's Office —
Technical Services,to undertake an immediate review of that portion of the
Ontario Fire Code known as Retrofit Section 9.5;
THEREFORE IT FURTHER BE RESOLVED that the City of Kitchener
urges the Government of Ontario to,as expeditiously as possible,amend
the Ontario Fire Code Sentence 9.5.2.8.(1)to require self closing devices
on all suite closures (doors)within low rise residential buildings:and,
THEREFORE IT FURTHER BE RESOLVED that the City of Kitchener
urges the Government of Ontario to,as expeditiously as possible,amend
the Ontario Fire Code Sentence 9.5.3.3.(3)to require that closures (doors)
entering exit stairwells be equipped with both self-closing devices and
positive latching;and,
THEREFORE IT FINALLY BE RESOLVED that a copy of this resolution be
forwarded to the Honourable Premier of Ontario,the Minster of Municipal
Affairs and Housing,the Association of Municipalities of Ontario;and,all
other Ontario municipalities."

SUBJECT: 2023 BUDGET SCHEDULE BACKGROUND
Section 290(1) of the Municipal Act requires local municipalities in each year to prepare and
adopt a budget. The Municipality currently prepares three budgets: current year Capital Budget,
rate supported Operating Budget and the 10-Year Capital Plan. This report presents the
proposed meeting dates for Council review and approval of the above mentioned 2023 Budgets.
The purpose of preparing budgets is to allow Council to develop policy in financial terms and to
assist in setting priorities and establishing service levels for the upcoming year before
expenditures take place.
DISCUSSION
In order to begin developing Bayham’s 2023 Operating Budgets and Capital Plan, Council
approval of the proposed budget schedule is required. The proposed timelines are the same as
prior years’ timelines to allow for tendering and effective procurement months before 2023
purchases.

2023 BUDGET CONSULTATIONS
In 2022, staff will continue the practice of posting budget background information explaining the
purpose of the Operating Budget and Capital Budget and the difference between Operating and
Capital expenses. This information will continue to be posted on the 2023 Budget Consultations
portion of the Municipal Website.
During the consultation, it will be clear the role of the consultation is to obtain public comment
on the budgets and ideas for the upcoming budgets for Council consideration. This consultation
is to obtain comments of an advisory nature for Council consideration during budget
deliberations. The same comments will be attached to the respective budget reports as an
Appendix.
Notice of consultation will be posted on the Municipal website and posted on the Municipal
Office and Library notice boards. Notice will also be posted on the winter and summer
newsletter in the mail out of February and August tax bills.
POTENTIAL BASE BUDGET IMPACTS
For 2023, the most significant potential base operating budget drivers that may have an impact
are as follows:
annualization of initiatives undertaken in 2022
general inflation
foreign exchange fluctuations
utility cost increases
impact of fluctuating fuel costs and costs of petroleum based products
increased operating charges from approved capital projects
increased transfers to Reserves and Reserve Funds to fund capital programs based on
10 year capital budget from 2022
provincial funding level changes
The actual impacts of these items are unknown at this time and will depend on further
information and decisions.
GUIDELINES
Some of the costs identified above can be avoided and others will be directly related to previous
decisions or are uncontrollable. In the interim, staff will be directed to prepare the 2023 Budgets
following past practices with the goal to maintain costs at their current level wherever possible.
These guidelines are an integral part of the budget process to assist staff when reviewing
operational needs and service levels.
CONCLUSION
In order to meet these dates, staff has initiated the 2023 budget process. This will allow staff the
time required to present a responsible, complete, comprehensive, and accurate budget for
Council review and consideration.
RECOMMENDATION
1. THAT Staff Report TR-02/22 re 2023 Budget Schedule be received for information.
2. AND THAT the proposed Budget Guidelines and meeting dates be approved as set
out in Report TR-02/22.

BACKGROUND
At its April 21, 2016 meeting, Bayham Council received Report CAO-32/16 re Tree Planting
Considerations and passed the following resolution:

THAT Report CAO-32/16 re Tree Planting Considerations be received for information;
AND THAT Council direct staff to support Option 2, amending clause 4 to include trees
be planted within two (2) meters from the private/municipal property line;
AND THAT the above direction be incorporated into the Bayham Tree Policy (Tree
Removal Policy);
AND THAT staff be directed to create an application for the same commencing in 2017.

Since this time, Bayham Council has been allocating funds to a Tree Planting Program, which
commenced in 2017, for residents to obtain trees through the LPRCA.
Included in the 2022 Capital Budget is an allocation of $3500 for this program.
DISCUSSION
Applications to the Tree Program are submitted online through the Municipality’s Laserfiche
Forms system. The application limits three (3) trees per property owner. Generally the
application process is kept open until April in a calendar year, however, applications received to-
date have already reached the $3500 capital allocation for the Tree Program.
Staff are looking for direction for if Council wishes to allocate further funds to this program for
2022 or if staff should close applications immediately as the existing and approved allocation
has been exhausted.

Municipality of Bayham Tree Application Program
The Council of the Corporation of the Municipality of Bayham is pleased to announce the continuation of the Bayham Tree Application Program.
The Council of the Corporation of the Municipality of Bayham has budgeted $3,500 for
the Tree Program in 2022.
The Tree Program is application based, utilizing a digital application to track applicants, on a first come first serve basis to a maximum of three (3) trees per Bayham property owner until the funding is utilized or April 3, 2022. Successful applicants will be notified via email in late spring about the success of their application.
Complete and submit Tree Program Application to apply.
Please be advised the program operates as follows:
1. Tree type to be determined by LPRCA subject to availability of native trees.
2. Confirmation of delivery period and a tree planting guide will be provided in the confirmation email in the spring. 3. Delivery will consist of:
a. Tree (approx. 4 ft.)
b. Brush blanket c. Pins
d. Rodent Guard e. 1 stake
4. Application will be contingent upon the Trees being placed wholly on Private
Property within two (2) meters from the private/municipal property line.
5. The location of the tree may be inspected after delivery in April or May and any tree improperly planted may require replanting
6. The Applicant will be responsible for planting and maintenance of the subject
tree(s).

A BY-LAW TO CONFIRM ALL ACTIONS OF
THE COUNCIL OF THE CORPORATION OF
THE MUNICIPALITY OF BAYHAM FOR THE
COUNCIL MEETING HELD FEBRUARY 3, 2022
WHEREAS under Section 5 (1) of the Municipal Act, 2001 S.O. 2001, Chapter 25, the powers of
a municipal corporation are to be exercised by the Council of the municipality;
AND WHEREAS under Section 5 (3) of the Municipal Act, 2001, the powers of Council are to be
exercised by by-law;
AND WHEREAS the Council of The Corporation of the Municipality of Bayham deems it
advisable that the proceedings of the meeting be confirmed and adopted by by-law.
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
BAYHAM ENACTS AS FOLLOWS:
1. THAT the actions of the Council of The Corporation of the Municipality of Bayham in
respect of each recommendation and each motion and resolution passed and other
action by the Council at the Council meeting held January 20, 2022 is hereby adopted
and confirmed as if all proceedings were expressly embodied in this by-law.
2. THAT the Mayor and Clerk of The Corporation of the Municipality of Bayham are hereby
authorized and directed to do all things necessary to give effect to the action of the
Council including executing all documents and affixing the Corporate Seal.
