AND TAKE NOTICE that the Committee of Adjustment of the Corporation of the Municipality of Bayham will hold an electronic virtual public meeting on Thursday, November 4th, 2021 at 6:45 pm to consider a proposed minor variance to Zoning By-law No. Z456-2003 under Section 45 of the PLANNING ACT. THE EFFECT of this variance will be to permit reduced minimum lot frontage on an opened maintained road by way of the applicant entering into development agreement with the Municipality for the applicant to upgrade and extend the municipal roadway on a 50.0 m by 20.1 m (665 ft) portion of unopened road to municipal standards, where the existing zero lot frontage is improved to permit future development of the subject lands. THE PURPOSE OF THIS MEETING is to inform the public of the nature of the Draft Plan of Subdivision proposal, to invite public input and to answer questions regarding the application. Sincerely, Todd Coles City Clerk Attachment: Extract (linked) www.leamington.ca Legislative Services 111 Erie Street North Leamington, ON N8H 2Z9 519-326-5761 clerks@leamington.ca October 22, 2021 To Whom it May Concern: Please be advised that the Council of The Corporation of the Municipality of Leamington, at its meeting held Tuesday, October 12, 2021 enacted the following resolution: No. C-303-21 Whereas routine eye care is critical in early detection of eye diseases like glaucoma, cataracts, and macular degeneration, and the health of eyes is critical to overall health and quality of life; and Whereas conditions that may be detected with an annual eye exam include Diabetes mellitus, Glaucoma, Cataract, Retinal disease, Amblyopia (lazy eye), Visual field defects (loss of part of the usual field of vision), Corneal disease, Strabismus (crosses eyes), Recurrent uveitis (an inflammation of the uvea, the middle layer of the eye that consists of the iris, ciliary body and choroid), Optic pathway disease; and Whereas payments from OHIP have only increased 9% over the last 30 years, which has not come close to matching inflation of costs (which include rent, staff, utilities, equipment, taxes and supplies); and Whereas the lack of funding makes it difficult to invest in modern technology, and newer technology means earlier detection of eye disease; and Whereas the Provincial government’s refusal to formally negotiate with Optometrists for more than 30 years has forced the Optometrists to absorb approximately 173 Million dollars annually in the cost to deliver eye care to Ontarians; and Whereas the 2021 Ontario Budget did not address OHIP-insured eye care, Ontario Optometrists took action and voted to withdraw OHIP services starting September 1, 2021, unless the government agrees to legally-binding negotiations to fund these services at least to the cost of delivery; and Whereas this job action will jeopardize good eyecare for those who need the care of an optometrist the most and will have the greatest impact on the most vulnerable groups. www.leamington.ca Children, who’s lifetime ability to learn and develop depends on good vision and to the elderly, who are at the greatest risk for vision-threatening ocular diseases; Now Therefore, be it resolved that the Municipality of Chatham-Kent requests that the Provincial government recognize the value that access to quality eye care brings to all Ontarians and act now to protect it; and further That the Provincial government address the OHIP-insured eye care immediately and enter into legally-binding negotiations with Ontario Optometrists to fund these services at least to the cost of delivery, prior to any job action taking place; and further That a copy of this resolution be forwarded to Premier Ford, Ontario Minister of Health Christine Elliot, to the Ontario Association of Optometrists, and to all municipalities in Ontario.” Carried Dated today, the 22nd day of October, 2021. ______________________________ Brenda Percy, Clerk The Corporation of the Municipality of Leamington REPORT TREASURY DEPARTMENT TO: Mayor & Members of Council FROM: Lorne James CPA, CA, Treasurer DATE: November 4, 2021 REPORT: TR-15/21 SUBJECT: DMAF ENGINEERING COST ASSESSMENT STUDY BACKGROUND The Municipality of Bayham is making application for the Disaster Mitigation and Adaptation Fund (DMAF) for the Port Burwell Storm Sewer Phases 1C-1F, Phase 2, Phase 3, and Phase 6 for $20,800,000.00. A total of 4,390 metres of stormsewer works would be included and would service the following road segments: Phase 1C/D: Brock Street and Erieus Street Phase 1E/F: Pitt Street (both East and West of Strachan) Phase 2: Victoria Street, Elizabeth Street, Wellington Street Phase 3: Robinson Street and Wellington Street Phase 6: Addison Street, Libbye Avenue, Burwell, Tennyson, Southey, Cowper, Homer If successful, the proposed works could be completed by 2025 at an approximate cost of $20,800,000, which includes construction labour, surveying, engineering, and inflation/CPI influence. As the DMAF contemplates a maximum 40% contribution, the breakdown for costing is as follows: Responsibility Amount Municipality of Bayham (60%) $12,800,000 DMAF (40%) $8,000,000 DISCUSSION The Municipality is seeking the engineering cost assessment schedule breakdown for each of the Phases to help determine: Bayham Road portion, Elgin County Portion, and the remaining amounts to be funded with other sources of revenue. Municipality of Bayham staff have reached out to Spriet Associates to help assist in the assessment schedule for the Phases 1C/D/E/F, and will continue this approach on future phases in advance of each respective constructions. Spriet Associates has outlined costs of this work for the Phases to be in the range of $140,000 to $160,000. The Engineering Cost Assessment work would include: - Full survey of the roads in the next two phases - Survey of all locates - Tie down all locates to field survey - Attendance at Hydro-vac of any utilities (Bayham to pay Hydro Vac charge) - Plot all existing services on drawings to determine any conflicts , sanitary , open waterman valves and measure down - Design of road profile and cross section along route to determine if surface flows can be directed Storm sewer analysis and design: - Preliminary Design of any retaining walls required, I.e. church , at Erieus and Pitt - Detailed design to the level requested including some cross sections on drive ways , yards - Design of sidewalks , curbs and gutter - Calculation of cut and fill quantities - Calculation of granular quantities - Drafting of plans and profiles - Cost estimates to level requested and broken down by storm sewers, road reconstruction, etc. - Determination of fee for connections , with consultation form financial planner Staff are seeking Council support and direction to engage Spriet Associates to perform this work over the coming months prior to the status of the DMAF application notice. The expenditure will be funded in 2022 out of the Road Construction Reserve and then re-apportioned to the project’s soft costs including engineering in future years. RECOMMENDATION 1.
