Cory Matthews A-17/21 B. Jeff and Dana Deconinck A-18/21 The September 2, 2021 Committee of Adjustment Meeting was held virtually via Zoom and livestreamed on YouTube. CALL TO ORDER E. Ketchabaw called the meeting to order at 6:46 p.m. 2, DISCLOSURES OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF No disclosures of pecuniary interest were declared. 3, APPLICATION A. Minor Variance Application A-17/21 Cory Matthews THE PURPOSE of the variance is to grant relief from Zoning By-law regulation Section 10.9.1 Minimum Side Yard Width to permit 1.0 m (3.2 feet) whereas 1.7 m (5.6 feet) is the required minimum for both sides of a two storey dwelling with an attached carport, located at 9513 Plank Road, Straffordville. THE EFFECT of this variance will be to permit a second storey addition above the first storey, to the existing single detached dwelling and recognize the location of the existing carport. 2 Statutory Planning Minutes — Committee of Adjustment September 2, 2021 4. STAFF PRESENTATION A. Report DS-50/21 by Margaret Underhill, Secretary/Treasurer Committee of Adjustment re Committee of Adjustment Minor Variance Application A-17/21 Matthews, 9513 Plank Road, Straffordville Secretary/Treasurer M. Underhill presented Report DS-50/21. 5. PRESENTATIONS BY APPLICANT/AGENT None. 6. PUBLIC SUBMISSIONS None. 7. COMMITTEE QUESTIONS AND DISCUSSION R. Weisler asked if the carport will be permitted to remain. Secretary/Treasurer Underhill advised R1 zoning permits carports. S. Chilcott asked the reason for reduced setback when a building goes higher. Secretary/Treasurer Underhill advised the reason is for maintenance purposes. 8. DECISION OF COMMITTEE (Motions) Moved by: V. Donnell Seconded by: S. Chillcott THAT the Committee of Adjustment Secretary/Treasurer's report DS-50/21 regarding the Matthews minor variance be received; AND THAT the Committee of Adjustment considered all written and oral submissions received on this application, the effect of which helped the committee to make an informed decision; AND WHEREAS the Committee agrees that the proposed variances as presented meet Section 45.1(1) of the Planning Act and are considered minor; THEREFORE application A-17/21 submitted by Cory Matthews, pursuant to Section 45 of the Planning Act for minor variance, is granted to allow relief from Municipality of Bayham Zoning By-law Z456-2003: ■ Section 10.9.1 Minimum side Yard Width — to permit both a northerly and southerly reduced side yard from 1.7 metres (5.6 feet) to 1.0 metres (3 feet) to permit a second storey addition to the dwelling and recognize the existing carport setback. Chilcott THAT the Committee of Adjustment hearing for consideration of Minor Variance Application A-17/21 be adjourned at 6:52 p.m.; AND THAT in accordance with the regulations of the Planning Act, Notices of Decision be circulated by the Secretary -Treasurer accordingly. Minor Variance Application A19/21 Jeff and Dana Deconinck THE PURPOSE of the variance is to grant relief from Zoning By-law regulation Section 10.11 b) to permit a maximum height of 4.7 m (15.4 feet) whereas 4.5 m (14.7 feet) is the permitted maximum; and Section 10.11 c) Maximum Floor Area to permit a garage floor area of 98.7 m2 (1 062 sq.ft.) in addition to the existing shed 9.2 m2 (100 sq.ft.) whereas 65.0 m2 (700 sq.ft.) is the permitted maximum located at 35 Union Street, Vienna. Statutory Planning Minutes — Committee of Adjustment September 2, 2021 THE EFFECT of this variance will be to permit a detached oversized garage and retain the existing shed on a lot with a single detached dwelling. 11. STAFF PRESENTATION B. Report DS-51/21 by Margaret Underhill, Secretary/Treasurer Committee of Adjustment re Committee of Adjustment Minor Variance Application A-18/21 Deconinck, 35 Union Street, Vienna Secretary/Treasurer M. Underhill presented Report DS-51/21. 12. PRESENTATIONS BY APPLICANT/AGENT None. 13. PUBLIC SUBMISSIONS None. 14. COMMITTEE QUESTIONS AND DISCUSSION V. Donnell asked if the amount of lot coverage will have a negative effect. Secretary/Treasurer Underhill advised since the lot is quite sizeable there will be no concerns in regard to lot coverage. 15. DECISION OF COMMITTEE (Motions) Moved by: S. Chilcott Seconded by: V. Donnell THAT the Committee of Adjustment Secretary/Treasurer's report DS-51/21 regarding the Deconinck minor variance be received; AND THAT the Committee of Adjustment considered all written and oral submissions received on this application, the effect of which helped the committee to make an informed decision; AND WHEREAS the Committee agrees that the proposed variances as presented meet Section 45.1(1) of the Planning Act and are considered minor; THEREFORE application A-18/21 submitted by Jeff and Dana Deconinck, pursuant to Section 45 of the Planning Act for minor variance, is granted to allow relief from Municipality of Bayham Zoning By-law Z456-2003: Section 10.11 b) Maximum Height to permit an accessory building maximum height of 4.7 m (15.4 feet) whereas 4.5 metres (14.7 feet) is the permitted maximum; and 5 Statutory Planning Minutes — Committee of Adjustment September 2, 2021 * Section 10.11 c) Maximum Floor Area to permit a new garage floor area of 98.7 m2 (1062 sq. ft.) in addition to the existing shed floor area of 9.2 m2 (100 sq. ft.) for a combined accessory building floor area of 108 m2 (1162 sq. ft.) whereas 65.0 m2 (700 sq. ft.) is the permitted maximum.
