Minor Variance Application A-15121 Frank and Lisa Fulop THE PURPOSE of the variance is to grant relief from Zoning By-law regulation Section 4.2 c) Accessory Uses to permit an accessory building in the front yard whereas accessory buildings are not permitted in the front yard; and Section 10.10 Rear Yard, to recognize a Minimum Rear Yard of 2.7 m (8.85 feet) whereas 7.0 m (22.9 feet) is required for a single detached dwelling for the property located at 34 Victoria Street, north of Wellington Street. THE EFFECT of this variance will be to permit construction of an accessory garage and recognize the existing rear yard of the single -detached dwelling. 2 Statutory Planning Minutes — Committee of Adjustment September 16, 2021 4. STAFF PRESENTATION A Report DS-54/21 by Margaret Underhill, Secretary/Treasurer Committee of Adjustment re Committee of Adjustment Minor Variance Application A-15/21 Fulop, 34 Victoria Street, Port Burwell Secretary/Treasurer M. Underhill presented Report DS-54/21. 5. PRESENTATIONS BY APPLICANT/AGENT None. 6. PUBLIC SUBMISSIONS None. 7. COMMITTEE QUESTIONS AND DISCUSSION R. Weisler inquired if there are any other similar properties with the garage in the front on the same street. M. Underhill replied that there are others in the Municipality where the only option is to place the accessory building in the front yard, however she could not say if there are any on the same street. 8. DECISION OF COMMITTEE (Motions) Moved by: S. Chilcott Seconded by: V. Donnell THAT the Committee of Adjustment Secretary/Treasurer's report DS-54/21 regarding the Fulop minor variance be received; AND THAT the Committee of Adjustment considered all written and oral submissions received on this application, the effect of which helped the committee to make an informed decision; AND WHEREAS the Committee agrees that the proposed variances as presented meet Section 45.1(1) of the Planning Act and are considered minor; THEREFORE application A-15/21 submitted by Frank and Lisa Fulop, pursuant to Section 45 of the Planning Act for minor variance, is granted to allow relief from Municipality of Bayham Zoning By-law Z456-2003: • Section 4.2 c) Accessory Uses to permit an accessory building in the front yard whereas accessory buildings are not permitted in the front yard Section 10.10 Rear Yard to recognize a Minimum Rear Yard of 2.7m (8.85 feet) for the existing main residential building whereas 7.Om (22.9 feet) is required for 3 Statutory Planning Minutes — Committee of Adjustment September 16, 2021 a single detached dwelling Provided the applicant relocate the existing municipal water and sewer service connections to the satisfaction of the Municipality. Minor Variance Application A-19/21 William Gibson THE PURPOSE of the variance is to grant relief from Zoning By-law regulation Section 9.7 Maximum Floor Area for an Accessory Building to permit an accessory building of 4 Statutory Planning Minutes — Committee of Adjustment September 16, 2021 112.4 mZ (1210 sq.ft.) whereas the maximum floor area is 75 m2 (807 sq.ft.) or 8% lot coverage whichever is less, for lands located at 10527 Culloden Road. THE EFFECT of this variance will be to permit an oversized accessory garage to store personal equipment and use as a shop accessory to an existing single detached dwelling. 11. STAFF PRESENTATION B. Report DS-55/21 by Margaret Underhill, Secretary/Treasurer re Committee of Adjustment Minor Variance Application A-19/21 Gibson, 10527 Culloden Road, North Hall Secretary/Treasurer M. Underhill presented Report DS-55/21. 12. PRESENTATIONS BY APPLICANT/AGENT None. 13. PUBLIC SUBMISSIONS None. 14. COMMITTEE QUESTIONS AND DISCUSSION V. Donnell noted that there seem to be numerous larger accessory buildings in the Municipality and expects there will be more. 15. DECISION OF COMMITTEE (Motions) Moved by: R. Weisler Seconded by: S. Chilcot THAT the Committee of Adjustment Secretary/Treasurer's report DS-55/21 regarding the Gibson minor variance be received; AND THAT the Committee of Adjustment considered all written and oral submissions received on this application, the effect of which helped the committee to make an informed decision; AND WHEREAS the Committee agrees that the proposed variances as presented meet Section 45.1(1) of the Planning Act and are considered minor; THEREFORE application A-19/21 submitted by William Gibson, pursuant to Section 45 of the Planning Act for minor variance, is granted to allow relief from Municipality of Bayham Zoning By-law Z456-2003: 5 Statutory Planning Minutes — Committee of Adjustment September 16, 2021 • Section 9.7 Maximum Floor Area of an Accessory Building to permit an accessory building of 112.4 m2 (1210 sq. ft.) whereas the maximum floor area is 75 m2 (807 sq. ft.) or 8% lot coverage whichever is less in the HR Zone.
