Samuel and Merrigje Kersten A-12/21 The June 17, 2021 Committee of Adjustment Meeting was held virtually via Zoom and livestreamed on YouTube. DISCLOSURES OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF No disclosures of pecuniary interest were declared. 3. APPLICATION A. Minor Variance Application A-12/21 Samuel and Merrigje Kersten THE PURPOSE of the variance is to grant relief from Zoning By-law regulation Section 5.3 Minimum Lot Area to permit minimum lot area of 17.2 ha (42.5 acres) whereas 20 ha (49.4 acres) is the required minimum; and Section 5.4 to permit minimum lot frontage of 88 m (288 ft) whereas 150 m (492 ft) is the required minimum, located at 56771 Green Line, south side, east of Talbot Line. THE EFFECT of this variance will be to recognize lot area and lot frontage on an existing undersized lot to facilitate the development of a new single -detached dwelling. 4. Report DS-38/21 by Margaret Underhill, Secretary/Treasurer re Committee of Adjustment Minor Variance Application A-12/21 Kersten, 56771 Green Line Secretary/Treasurer M. Underhill presented Report DS-38/21. 5. PRESENTATIONS BY APPLICANT/AGENT Mr. Kersten advised the proposed application is for a house and shop as one building ie half of the building is house and half is shop. Weisler requested confirmation that the only dwelling is as per the map attached to the Report to which Mr. Kersten provided confirmation. S. Chilcott inquired if this would be referred to as a barndominium to which Mr. Kersten confirmed as it is one part living quarters and one part shop. 8. DECISION OF COMMITTEE (Motions) Moved by: V. Donnell Seconded by: R. Weisler THAT the Committee of Adjustment Secretary/Treasurer's report DS-38/21 regarding the Kersten minor variance be received; AND THAT the Committee of Adjustment considered all written and oral submissions received on this application, the effect of which helped the committee to make an informed decision; AND WHEREAS the Committee agrees that the proposed variance as presented meets Section 45.1(1) of the Planning Act and is considered minor; THEREFORE application A-12/21 submitted by Samuel and Marietta (Merrigje) Kersten, pursuant to Section 45 of the Planning Act for minor variance, is granted to allow relief from Municipality of Bayham Zoning By-law Z456-2003: Section 5.3 Minimum Lot Area to permit a minimum lot area of 17.2 m2 (42.5 acres) whereas 20.0 ha (49.4 acres) is the required minimum for an Agricultural (Al) Zoned parcel; and, Section 5.4 Minimum Lot Frontage to permit a minimum lot frontage of 88 m (288 ft.) whereas 150.0 m (492 ft.) is the required minimum for an Agricultural (Al) Zoned parcel to facilitate the development of a single -detached dwelling and accessory uses. 3 Statutory Planning Minutes — Committee of Adjustment June 17, 2021 A recorded vote was held: Member of Committee of Adjustment C.
