HomeMy WebLinkAboutBy-law No. 2021-053THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW 2021-053 A BY-LAW TO AUTHORIZE THE EXECUTION OF AN AMENDING AGREEMENT WITH HER MAJESTY THE QUEEN IN RIGHT OF ONTARIO AS REPRESENTED BY THE SOLICITOR GENERAL FOR THE PROVISION OF POLICE SERVICES FOR THE ELGIN GROUP MUNICIPALITIES WHEREAS the Municipal Act, 2001 S.O, c.25, as amended, authorizes municipalities to enter into agreements; and AND WHEREAS under Section 4(1) of the Police Services Act, R.S.O. 1990, c.P.15, municipalities are required to provide adequate and effective police services in accordance with its needs; WHEREAS under Section 10 of the Police Services Act, R.S.O. 1990, c.P.15, the Solicitor General may enter into an agreement with the council of a municipality or jointly with the councils of two or more municipalities for the provision of police services for the municipality or municipalities by the Ontario Provincial Police; AND WHEREAS under Section 29, the Parties may amend the Agreement by written agreement; AND WHEREAS the Corporation of the Municipality of West Elgin, the Corporation of the Municipality of Bayham, the Corporation of the Municipality of the Township of Southwold, the Corporation of the Municipality of Central Elgin, the Corporation of the Municipality of Dutton Dunwich and the Corporation of the Municipality of the Township of Malahide (herein after collectively called the "Elgin Group") seek to enter into a single amending agreement for the provision of Police Services by the Ontario Provincial Police; NOW THEREFORE the Council of the Corporation of the Municipality of Bayham enacts as follows: 1. The Mayor and the Clerk are hereby authorized, on behalf of the Corporation of the Municipality of Bayham to enter into and execute under its corporate seal an agreement for the provision of Police Services with the Solicitor General of Ontario. 2. The Police Services agreement with the Solicitor General of Ontario shall also be authorized by the five other Municipalities, being the other members of the Elgin Group. 3. The Police Services amending agreement will commence on the 30th day of December 2021 and will conclude on the 31 st day of December 2022. 4. A copy of said amending agreement shall remain attached to and form part of this by-law. 5. This By-law shall come into force and effect upon the final passing thereof. THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2021-049 BEING A BY-LAW TO FURTHER AMEND BY-LAW NO. 2016-014 A BY-LAW TO REGULATE TRAFFIC AND PARKING ON HIGHWAYS, PRIVATE PROPERTY AND MUNICIPAL PROPERTY WITHIN THE MUNICIPALITY OF BAYHAM WHEREAS the Council of the Municipality of Bayham on the 31 day of March, 2016 enacted By -Law No. 2016-014, being a by-law to regulate traffic and parking; AND WHEREAS the Council of the Municipality of Bayham did by By -Law No. 2016-038, By -Law No. 2016-075, By -Law No. 2017-082 and By -Law No. 2018-014 amend By -Law No. 2016-014; AND WHEREAS Council of the Municipality of Bayham deems it necessary to further amend By-law No. 2016-014; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: THAT Appendix A, Schedule A and Schedule B, and Appendix B be added to By-law No. 2016-014 THAT in all other respects, By-law No. 2016-014 is hereby confirmed and remains unchanged; AND THAT this by-law shall come into force and take effect upon final passing. SECTION 13 - PENALTIES 13.3 In addition to any other penalty provided by this By-law, upon discovery of any vehicle parked, stopped on a highway, parked or left unauthorized area of Municipal property or on private property in contravention of any provision of this By-law, a municipal law enforcement officer may cause such a vehicle to be moved or taken to and placed and stored in a suitable place and all costs and charges for removing, caring and storage thereof, if any, are a lien upon the vehicle being released and may be enforced in the manner provided by the Repair and Storage Liens Act, R.S.O. 1990, c.25 as amended. Authority to allow the towing of vehicles is under section 170 of the Highway Traffic Act, R.S.O. 1990, c. H.8 and under section 101 of the Municipal Act, 2001, S.O. 2001, c. 25.
