Over the spring and summer of 2015, Meritech conducted structure investigations, CCTV inspections and GPS survey of the storm structures to determine the extent of the existing storm sewer systems in Port Burwell and Vienna. From this information along with any 4 existing drawings made available a map of the networks was produced. Page 6 of 92 MERITECH Storm Sewer System Assessment Executive Summary The storm water management systems in the villages of Vienna and Port Burwell consist of roadside swales, ravines, culverts, and storm pipes ranging in diameter and length. The runoff catchment areas consist of grassed areas, asphalt pavement roads, parking lots, and residential areas. The purpose of this report is to describe the existing conditions of the storm systems within the villages of Port Burwell and Vienna and what is required of the municipality to establish an effective storm water management system in accordance with the Ministry of the Environment guidelines or as directed by Public Works. The identification of existing conditions began with a site examination with multiple pictures and inspections of manhole structure conditions and locations, storm sewer invert elevations, catchment areas, and outlet locations. Following the site inspections spanning over a period of 2 weeks, CCTV inspections were coordinated and carried out at storm sewer locations believed to be significant due to large pipe diameters, unknown outlets, and to identify deficient storm pipes. The results of the inspections were compiled, correlated and analyzed for use in developing the storm water network in AutoCAD as well as in the storm sewer hydraulic design analysis. In both Port Burwell and Vienna many of the sewers are cracked, deformed, or plugged with sediment resulting in inefficient drainage systems. Many of the areas drain through private properties through swales/ditches and culverts and possibly without easement rights. It is our opinion that the Municipality is best served by having their infrastructure within their own right of ways and replacing deficient storm sewers and structures thereby reducing liability risk to the Municipality. Recommendations include characteristics for the future design of the systems, replacement strategies and next steps. Page 9 of 92 MERITECH Storm Sewer System Assessment Introduction This section will introduce the villages of Vienna and Port Burwell, the purpose of the existing conditions assessment, and the main scope of the report. Background These two villages are located within the Municipality of Bayham which is part of Elgin County (see Figure 1). The storm drainage flows to Big Otter Creek, and eventually to Lake Erie. Page 10 of 92 MER EE C H Storm Sewer System Assessment Purpose The Municipality of Bayham sought assistance in assessing the existing storm sewer conditions for Port Burwell and Vienna in order to determine whether remedial work was required to improve efficiency and reliability of the storm drainage systems. The Municipality also sought to improve up to date records of the storm systems in Vienna and Port Burwell. Drainage systems provide the Municipality with a method to reduce liability and risk of flooding. Rainfall and runoff from municipal right of ways are carried to adequate outlets along with drainage from private lands. It is important for the Municipality of Bayham to understand the system and to make informed decisions on its maintenance and configuration. Scope This report includes how the existing conditions were determined and how that information was used to provide appropriate conclusions and recommendations based on the need of the Municipality. The findings include catchment areas, storm water networks flowing to each outlet, deficient storm sewers and structures. It will also include conclusions gathered from these finding and recommendations on how to improve the existing storm water systems. Approach This section provides what was required in the assessment of existing conditions and the techniques used to gather that information. It also describes how that information was used to determine the effectiveness of the existing drainage systems. The assessment began with an inspection of each individual manhole and catchbasin structure and the sewers entering at each location. Sewers on County Roads were excluded from the assessment; though some local sewers discharge into County sewers. Each structure was inspected for type, size, shape, material, condition and opening locations for each storm sewer. Within each structure, each storm sewer was inspected for direction, size, material, visible conditions, and 'dips'(distance from the invert of the pipe to the top of the lid). The Structure Dip Sheets are included in Appendix A. Surveyors then visited the site to determine the location of each structure and the elevation at the centre of each lid using GPS technologies. This information was used together with the 'dips' to determine the invert elevations and slopes of each pipe. After the invert elevations and slopes were determined, the information was input into the AutoCAD file along with the surveyed structure locations to develop the network. This is to be provided to the Municipality for inclusion in the GIS system. In order to determine the sewer condition, direction and connectivity to the network, a video inspection was required. CCTV (Closed Camera Television) inspections were then coordinated at specific locations including sewers with diameters 300mm and larger and sewers with unknown inlets or outlets. Page 11 of 92 MEC H Storm Sewer System Assessment the sewers was required to allow the camera to pass through the sewers. Unfortunately, the CCTV inspections could not be completed in many areas due to large debris, blockages (silt) or pipe deformation. Many assumptions were made while developing the network and many of the sewer inlets and outlets remain unknown. The cost to flush these unknown pipes in order to facilitate further CCTV is high; therefore flushing and additional CCTV inspections is not recommended as these pipes are already not working and are recommended to be replaced. The storm pipe sizes, types, and slopes were used together with the catchment areas and runoff coefficients to determine whether the pipes can perform under the 5 year storm flow conditions. This was determined using storm sewer hydraulic design calculations. This part of the project shall be built upon with a proposed condition system with the detailed design of future systems. This report will provide the municipality with a guiding document for future work for a drainage system in Vienna and Port Burwell. Port Burwell Port Burwell is comprised of seven separate drainage networks. These networks have been created based on outlets. Page 13 of 92 MERITECH Storm Sewer System Assessment Network One Network One has an outlet to Lake Erie located south of Brock Street with the network comprised of manhole and catchbasin structures on Robinson Street. This network takes a total catchment area of approximately 3.25 hectares and also takes additional flow from a County road network north of Wellington Street (see Figure 2 — Green). This section contains approximately 510m of pipe with approximately 50% of the pipe lengths assumed due to blind pipes to the main as well as deformed pipes, blockages and debris that could not be inspected. Approximately 290m of pipe is cracked, deformed and damaged which makes up approximately 70% of the network. Network Two Network Two has an outlet to Big Otter Creek located west of the intersection of Pitt and Robinson Streets with the network comprised of catchbasin structures on Pitt, Brock, and Robinson Streets (see Figure 2 — Yellow). This network takes a total catchment area of approximately 3.5 hectares. This section contains approximately 600m of pipe with approximately 75% of the pipe lengths assumed due to blind pipes to the main as well as deformed pipes, blockages and debris that could not be inspected. Approximately 140m of pipe is deformed and damaged which makes up approximately 25% of the network. Network Three Network Three has an outlet to Lake Erie located south from the Memorial Park Drain Extension with the network comprised of manhole and catchbasin structures on Strachan Street(see Figure 2 — Blue). This network takes a total catchment area of approximately 8.5 hectares and also takes additional flow from a culvert near the intersection of Brock Street and Strachan Street. This section contains approximately 730m of pipe with approximately 30% of the pipe lengths assumed due to blind pipes to the main as well as deformed pipes, blockages and debris that could not be inspected. Also, this network contains a 600mm diameter pipe with an assumed length of approximately 210m which is greater than the distance of 90m between structures recommended by the Ministry of the Environment. Approximately 90m of pipe is deformed and damaged which makes up approximately 15% of the network. Network Four Network Four has an assumed outlet to a 450mm culvert south of Wellington Street, along Elizabeth Street, with the network comprised of catchbasin structures on Elizabeth Street (see Figure 2 — Orange). This network takes a total catchment area of approximately 1.6 hectares. This section contains approximately 300m of pipe with approximately 85% of the pipe lengths assumed due to blind pipes to the main as well as deformed pipes, blockages and debris that could not be inspected. Approximately 110m of pipe is deformed and damaged which makes up approximately 40% of the network. Network Five Network Five has an outlet to Lake Erie south of Pitt Street with the network comprised of catchbasin structures on Pitt Street between Elizabeth and Victoria Streets (see Figure 2 — Red). This network takes a total assumed catchment area of 2.9 hectares from an assumed swale behind the homes between Victoria and Elizabeth Streets. Page 14 of 92 MERITECH Storm Sewer System Assessment assumed inlet. Approximately 10m of pipe is damaged due to a displaced and offset pipe toward the outlet. Network Six Network Six has an outlet to Big Otter Creek located northeast of the Strachan Street and Robinson Street intersection with the network comprised of catchbasin structures on Elizabeth, William, Victoria, Newton, Milton, Shakespeare, Strachan and Robinson Streets (see Figure 2 — Turquois). This network takes a total catchment area of approximately 12 hectares and is the largest single network in Port Burwell. This section contains approximately 1400m of pipe with approximately 40% of the pipe lengths assumed due to blind pipes to the main as well as deformed pipes, blockages and debris that could not be inspected. Also, this network contains a 450mm and 300mm diameter pipe with assumed lengths exceeding the distance of 90m between structures recommended by the Ministry of the Environment. Approximately 200m of pipe is deformed, damaged, or collapsed which makes up approximately 15% of the network. Network Seven Network Seven has an outlet to a ravine located southwest of Burwell Street with the network comprised of manhole and catchbasin structures on Homer, Cowper, Tennyson, and Addison Streets (see Figure 2 — Pink). This network takes a total catchment area of approximately 4.6 hectares. This section contains approximately 800m of pipe with approximately 25% of the pipe lengths assumed due to blind pipes to the main as well as deformed pipes, blockages and debris that could not be inspected. Also, this network contains a 100mm and 300mm diameter pipe with assumed lengths exceeding the distance of 90m between structures recommended by the Ministry of the Environment. Approximately 200m of pipe is corroded or damaged which makes up approximately 25% of the network. Unknown Networks There are a number of pipes within Port Burwell that have unknown inlets and outlets. A total of approximately 1600m of pipes are unknown and assumed across all streets in Port Burwell. These pipes range from 100mm to 400mm in diameter and have not been inspected via CCTV. Also, much of the network on County roads is unknown and drainage areas to these networks remain unknown. This network takes a total catchment area of 2.1 hectares. This section contains approximately 350m of pipe with approximately 60% of the pipe lengths assumed due to blind pipes to the main as well as deformed pipes, blockages and debris that could not be inspected. Approximately 70m of pipe is deformed and damaged which makes up approximately 20% of the network. Network Two Network Two has an outlet to Big Otter Creek located east of the intersection of Edison Drive and Fulton Street with the network comprised of catchbasin structures on Edison Drive and Fulton Street (see Figure 3 —Yellow). This network takes a total catchment area of 1.8 hectares. This section contains approximately 200m of pipe with approximately 50% of the pipe lengths assumed due to blind pipes to the main as well as deformed pipes, blockages, and debris that could not be inspected. Approximately 70m of pipe is deformed and damaged which makes up approximately 35% of the network. Network Three Network Three has an outlet to Big Otter Creek located north of the intersection of Queen and Oak Street with the network comprised of catchbasin structures on Oak, Ann, Chestnut, and Queen Streets (see Figure 3 — Blue). This network takes a total catchment area of 4.1 hectares. This section contains approximately 800m of pipe with approximately 60% of the pipe lengths assumed due to blind pipes to the main as well as deformed pipes, blockages and debris that could not be inspected. Approximately 200m of pipe is cracked, deformed and damaged which makes up approximately 25% of the network. Network Four Network Four has an outlet to a culvert located southeast of the intersection of Fulton and Centre Street with the network comprised of catchbasin structures on Centre Street (see Figure 3 — Orange). This network takes a total catchment area of 4.9 hectares. This section contains approximately 550m of pipe with approximately 20% of the pipe lengths assumed due to blind pipes to the main as well as blockages and debris that could not be inspected. Also, this network contains a 100mm diameter pipe with an assumed length of approximately 100m which is greater than the distance of 90m between structures recommended by the Ministry of the Environment. Network Five Network Five has an outlet to Big Otter Creek located northeast of the intersection of Plank Road and Chapel Street with the network comprised of manhole and catchbasin structures on Chapel Street (see Figure 3 — Red). This network takes a total catchment area of 1.8 hectares. This section contains approximately 350m of pipe with approximately 15% of the pipe lengths assumed due to blind pipes to the main as well as deformed pipes, blockages and debris that could not be inspected. Approximately 40m of pipe is cracked, deformed and damaged which makes up approximately 10% of the network. Page 17 of 92 MERITECH Storm Sewer System Assessment Network Six Network Six has an outlet to Big Otter Creek located south of North Street with the network comprised of catchbasin structures on North Street (see Figure 3 —Turquois). This network takes a total catchment area of 1.2 hectares. This section contains approximately 350m of pipe with approximately 40% of the pipe lengths assumed due to blind pipes to the main as well as deformed pipes, blockages and debris that could not be inspected. Approximately 94m of pipe is cracked, deformed and damaged which makes up approximately 30% of the network. Also, this network contains a 600mm diameter pipe with an assumed length of approximately 130m which is greater than the distance of 90m between structures recommended by the Ministry of the Environment. Unknown Networks There are a number of pipes within Port Burwell that have unknown inlets and outlets. A total of approximately 2100m of pipes are unknown and assumed across all streets in Port Burwell. These pipes range from 40mm to 400mm in diameter and have not been inspected via CCTV. Also, much of the network on County roads is unknown and drainage areas to these networks remain unknown. Conclusions Both communities are serviced with road side swales and underground storm sewers for storm runoff. Properties are situated in some instances at grades lower than the road way. We have concluded that the existing storm sewer systems are not functioning as intended. Storm runoff is currently being conveyed predominately overland instead of within the sewer systems. Road drainage appears to be draining without proper outlets, or secured easements. Many of the installed sewers are of a size smaller than recommended by the Ministry of the Environment. In Port Burwell a total of approximately 6200m of storm sewers are present with approximately 25% of the networks assumed and approximately 25% of the networks unknown. Out of the known and assumed networks, the total percentage requiring replacement due to damage is approximately 25%. In Vienna a total of approximately 4400m of storm sewers are present with approximately 30% of the networks assumed and approximately 40% of the networks unknown. Out of the known and assumed networks, the total percentage requiring replacement due to damage is approximately 15%. Calculating the adequacy of the size of the sewers is of no advantage until such time as a proposed network can be properly determined. Page 18 of 92 MERITECH Storm Sewer System Assessment Recommendations In order to ensure success in the future of storm water management in the villages of Port Burwell and Vienna a number of recommendations can be made. All networks should be discretized, with catchment areas accurately measured, and each pipe sized accordingly using each network's existing outlet. Annual inspections and storm cleanout programs should be coordinated in order to maintain the effectiveness and reliability of the storm sewer systems. All of the manhole and catchbasin structures should be designed and installed using current (MOE or Elgin County) standards and all new developments should provide onsite stormwater management. The Municipality is best served by having their infrastructure moved within their own right of ways where possible in order to facilitate future maintenance if required. Remedial efforts should begin in Port Burwell as much more is known about the existing conditions in comparison to Vienna. The storm sewers in networks One, Two, and Three should be moved within the right of ways where possible. While doing so this will replace deficient sewers and will reduce liability risk to the Municipality. Networks One and Two drain to outlets in the beach that are subject to burial by the sand and waves from Lake Erie. Creating a new outlet for the Robinson Street storm sewer will require a Schedule C Class EA to be processed, complete with public consultation. It will be important to include Elgin County in this process as the storm systems intertwine. Port Burwell currently utilizes mostly roadside swale drainage systems without curb and gutter. It is recommended that curb and gutter be installed at any roadway equal to or greater than 18m in width per common municipal guidelines. In Vienna all of the deficient sewers should be replaced with an underground storm system as opposed to a roadside swale and culvert system. Culverts commonly cause frost heaving in the winter months which can cause damage to public and private driveways. The detailed design of the storm sewer systems should include: 1. Catchment areas based on drainage divides, 2. Geotechnical consideration for groundwater, 3. A 5-year return period and a lower run-off coefficient to accurately reflect the land use, 4. Consideration of sewer crossings, 5. Re-use of existing outlets, 6. Co-ordination with the County of Elgin, especially where local sewers discharge into the County sewer system and where County roads have sewers connecting into local sewers. Meritech Engineering performed a storm sewer assessment program and concluded that the existing storm sewer systems are not functioning as intended. Storm runoff is currently being conveyed predominately overland instead of within the sewer systems. Road drainage appeared to be draining without proper outlets, or secured easements. A proposed sewer network was estimated utilizing existing topographic information, sanitary sewer design drawings and the inverts and sizes from the existing conditions assessment. A network for both towns was created and catchments estimated. This information was combined into a spreadsheet (and sizes of storm sewers were in order to provide the municipality with expected costs. The proposed conceptual network was scored based on area served, path and importance to a network as well as the condition of the existing infrastructure. Four priorities were assigned. The analysis concludes that Priority 1 networks are to be replaced first and is expected to cost the municipality $2,912,000 over the proposed 5-year program. Priority 2 networks total $1,677,000 and Priority 3 and 4 streets are proposed for works greater than 10-years from today and would improve the conditions for the remainder of the towns. It is recommended that the outlet configurations and storm drainage areas be assessed in each town independently, and this document be used as a guide as to where to put the resources. Approach This section provides how the costing analysis of a proposed network was prepared. A proposed sewer network was estimated utilizing existing topographic information, sanitary sewer design drawings and the inverts and sizes from the existing conditions assessment. A network for both towns was created and catchments estimated. This information was combined into a spreadsheet (refer to Appendix A), and sizes of storm sewers were estimated (based on assumed lengths, slopes and initial time of concentration). The network was proposed to be within municipal rights of way and discharging to existing outlets. Some of these outlets are County Roads, and we have assumed that for the detailed design work the County will be involved as a team partner. It was assumed that in Port Burwell a new outlet would be required to correct the current situation within the beach. A cost estimate was prepared based on a cost per metre for the length of storm sewer. Page 27 of 92 MERITECH Storm Sewer Costs Assessment Report Once the networks were set up, they were compared against one another for priorities. Each section was scored on three categories; 1. Catchment 2. Area Serviced 3. Existing Condition The Catchment category refers to the importance each section played in the overall network with the outlet being the most important to the critical path and the beginning of the network as the least important to the path. A low score represents a section of pipe that is not very important in creating the network, whereas a high score represents a critical segment, such as the outlet. The Area Serviced category refers to the size of the catchment area each section represents. A score of 1 represents a small catchment area, normally at the crest of a hill, with few homes contributing to the sewer. A score of 10 represents a large catchment, with a large number of homes draining to the sewer. The Existing Conditions category refers to how structurally damaged and/or how blocked the water flow is in each section based on the CCTV inspections. A score of 1 represents a pipe in good condition and a score of 10 represents a broken pipe, or unknown connection. The categories were weighted mathematically based on the maximum catchment area, the worst condition, and the largest pipe and issued a number between 1 and 10. Each section was totalled with the sections with largest numbers being greater priorities. For example a pipe segment with a small catchment, that services only a few houses, doesn't have many pipes connecting into it, is in fair to good condition would not need to be replaced. However the pipe leading to the outlet, with a large number of pipes feeding into it, servicing a large catchment area, is ranked high on the priority. It is also worthy of noting that the pipes that service the largest areas are of higher costs. The storm sewer sizing spreadsheet was also used to rank the pipe segments by ranking the accumulated catchments. As this represents areas as they are combined into the sewer segments. This simplified numeric ranking was compared to the score ranks to see the impact of condition. The top quarter of rankings were assigned to the Priority 1 or the first 5 years. This allows the Municipality of Bayham to budget appropriately for the works to be carried out and will get the work done to the more important pieces in the network first. This analysis ignored the town boundaries and therefore has work in both towns being done within each priority. The estimates show the top two priorities having the highest cost, and they can be balanced out to meet budgetary requirements. The outlets to the creek became the majority of the Priority 1 projects, because they serve the largest area with the most legs of sewers connecting into them. It is also logical to replace these outlets first, to give the upstream areas a functioning discharge point and construction is easier working from the low invert upstream. A new outlet would require a Class EA to be carried out, and the cost of this analysis has not been included. A Class EA is currently being proposed for Port Burwell to analyze the outlet to the beach and the ability to change the network within the town. A similar study may be carried out for Vienna. As part of our investigation and recommendations of the existing system we found that there a were sufficient enough deficiencies in condition and alignment to warrant a re-design of the ± system. The first step of this analysis has been completed, with conceptual routing, sizing and W F. costing prepared within the previous work. From this information, we will formulate a public E document, including presentations to fulfill the Class EA process to determine the preferred w alternative. At this time we expect the alternatives to be: 3 1. Do Nothing (leave the system as is) 3 2. Repair existing sewers in existing locations (same size). 3 3. Design sewers for modern day parameters (may include curb and gutter on some streets, larger diameter storm sewer, connections for sump pumps, etc.) 4. Determine outlet location(s) The EA is expected to take approximately 9 months to complete, part of this is a posting period for which residents can review and comment. This will involve 2 public meetings spaced apart to garner appropriate input, as well as meetings specific to government agencies. It will be important to meet at the outset with both Elgin County and Long Point Conservation Authority to determine their level of involvement and requirements for works within County roads and for works within the Creek(outlets). Upon determination of a preferred solution, detailed design of the system can be completed. From the video it was evident of the successs of the event which provided great family fun and much enjoyment for many. Mr. Kirby went on to present financial information on the success of Beachfest.The event generated$15,309.40 in revenue, $19,546.00 in donations and had expenses of$24,383.07.There was a balance remaining of $10,472.11 from which donations were made to various local events and groups.The committee will remain open to providing support for additional initiatives within the community, however they hope to use the resources to continue to improve future events. Mr. Kriby acknowledged that the Bayham Beachfest Committee is organizing and taking responsibility for both the Port Burwell and Straffordville 2015 Santa Claus parades. On April 16, 2015, Council appointed Spriet Associates to make an examination of the drainage area and prepare a report for Council's consideration. DISCUSSION: An onsite meeting was held with the Engineer, Bayham Drainage Superintendant, Bayham Road Manager and landowners in the watershed in the early May 2015. Engineer's Report#213376 received from Spriet Associates dated November 19, 2015 was filed with the Clerk on November 23, 2015. Council should now determine whether it wishes to proceed with Notices under the Drainage Act and direct the Clerk to send a copy of the Report and Notice of Public Meeting setting out the date of the Council meeting at which this report will be considered to: (a) Every landowner within the area requiring drainage. I have been recently notified that their application was denied. The Municipality had indicated that they do not agree with the reason given for denial. The Municipality of Bayham has indicated that the Richmond Community and Bayham water system in in such a state of disrepair that the Ministry of Environment has sent correspondence supporting their application to this fund. Also, P.Shipway confirmed that municipal staff are allowed to become full voting members of this committee. Therefore Lynda Millard could apply for membership. There was a lively discussion regarding the best representation of membership on this committee. Younger members as well as representation from the low- German community would be desirable. If possible all 3 wards should be represented. b) Changing Road Signs: P.Shipway has advised that directional signs for the Edison Museum and the Wind Interpretive Centre will be dealt with (removed)by Bayham staff. c) Presentation to Beach Canal Lighthouse Group: C.Buchanan prepared a slideshow presentation on the history of our lighthouse and lens collection. He and B.Hickey traveled to Burlington on Nov.8 where they spoke to a group of 14 from the Beach Canal Lighthouse Group. They gave a $50 honorarium to Museums Bayham in thanks. NEW BUSINESS: a) Letter of Support for Canada 150 Funding: The County of Elgin is applying for a grant from the Department of Canadian Heritage to celebrate the 150th Anniversary of Confederation. They are planning 5 different activities. Firstly they plan to provide new signage for farms that are 100 years old and buildings that are at least 150 years old. Secondly they plan to erect directional signage for National Historic Sites and thirdly to develop a joint exhibition in 2017 with the theme "Transportation"using artefacts from all Elgin museums. Fourthly they plan to digitize Confederation-era documents and develop a virtual exhibit pertaining to Elgin's role in Confederation. Fifthly they plan to hire a contract co-ordinator to lead the marketing of these afore mentioned events. It was moved by M.Schafer and seconded by R.Maddox that Museums Bayham supports the County of Elgin's application for funding from the Canada 150 Fund. Motion Carried. Interest payment cheques were provided, as applicable. (c) 2015 invoices for reimbursement to the Municipality for grass cutting costs were handed out by Treasurer and discussed. Secretary-Treasurers completed and submitted their cheques for grass cutting costs to the Treasurer. (d) Review of grass-cutting for 2015 Members acknowledged their support for grass cutting services based on an average of 10 to 12 cuts for each cemetery during the season. (e) Cemetery By-law 2015-116 was handed out. The Secretary advised Board Members that the by-law was approved by Council on November 19th, notices have been placed at each site and in the local papers and reviewed the fee schedule and responded to questions. A copy of the by-law has also being mailed or delivered to local funeral homes, monument dealers and others providing services to the municipal cemeteries. The necessary documents will also be sent to the Registrar at the Cemetery Regulation Unit for final approval. Secretary-Treasurers will be advised upon return of the approved by-law (and changes, if any), upon receipt by the Municipality, to take effect immediately. Approved copies will be provided to the Secretary-Treasurers and for handout to new cemetery supply purchasers. AMO and UQM will work together to share policy and advocacy efforts and best practices to achieve climate action goals under the agreement.The Associations highlighted a range of initiatives municipal governments have undertaken in Ontario and Quebec to reduce greenhouse gases and protect their communities and economies from extreme weather,noting more local action needed to be taken to meet climate change goals. The Agreement comes as a number of initiatives on climate change are moving forward.The Premiers and Prime Minister Trudeau met in Ottawa on Monday to discuss Canada's position at the United Nations Paris Climate Change Conference.It is widely thought that a global agreement to tackle climate change may result from this conference.On Sunday,the Alberta Government announced a new carbon tax to limit greenhouse gas emissions in that province. Page 72 of 92 MUNICIPALITY OF BAYHAM MEMORANDUM DATE: NOVEMBER 27, 2015 TO: Council FROM: Lynda Millard, Clerk RE: Doors Open East Elgin NUMBER: C2015-02 As Council will recall, Bayham has been participating with the Town of Aylmer and the Township of Malahide to encourage local participation in tourism promotion of various attractions and businesses beyond our own borders for a number of years, through the Doors Open initiative organized by the Ontario Heritage Trust. This is a province-wide annual event, however, East Elgin has not participated in the year of a municipal election. The lead municipality for the participating three municipalities is rotated each year and it is Bayham's turn for 2016. The registration fee is $1,695, split three ways, amounts to $565 each. Any promotion costs in addition to the registration fee are split and shared by the three municipalities. Each Council appoints a member representative intended to reach out to the community to encourage participation. A municipal staff person assists the Council rep, working with the participants to see that the required forms, pictures, etc are completed and submitted in a timely manner. The staff person for the lead municipality arranges joint promotion ads and materials on behalf of all the participants and based on input from them. As registration and payment is due by December 18th, I have asked staff at Aylmer & Malahide for their respective Council to consider their participation at their next meeting. Should Council wish to proceed, the following is recommended. THAT the Municipality of Bayham take a lead role in the "2016 Doors Open" activities, subject to participation confirmation by the Township of Malahide and the Town of Aylmer; THAT be appointed as the Bayham Council representative; THAT Bayham's $565 share of the registration fee be allocated to the 2016 Tourism and Marketing account; AND THAT Bayham staff be directed to take the necessary steps to organize the event. The Tender is for annual Municipal Bridge Washing Services for a time period of January 1, 2016— December 31, 2018 (with two additional one year mutual options to renew at an annual increase of 1.5% in 2019 and an additional 1.5% in 2020). The contractor is required to supply all labour, equipment, and materials required to clear the bridges of all accumulated sand/gravel and salt(collectively referred to as debris)on the bridge structure. In order to limit the migration of these materials, the contractor is to first remove as much of the debris as possible prior to washing the structure. The Contractor is required to remove and to properly dispose of all debris from the bridge structure. The Municipality is responsible for a total of 17 County and Municipal structures. The Contractor is required to remove and to properly dispose of all debris from the bridge structure. 2.3 The Contractor shall clean the structure including all structural components using high pressure water washing that will render all those components free of dirt, debris and salt residue. 2.4 Bridge Washing shall include, but is not limited to, the cleaning of the bearings, approaches, joints, curbs and gutters attached to the structure, hand rails, barrier walls, light standards, sign supports, bearing seats, deck drains, sidewalks, curbs, structure components, railings and the deck surface. 2.5 It is the Municipality's intent to power sweep the structures prior to the commencement of the bridge washing. The Municipality sweeps the structures early in the spring to facilitate good drainage. This work shall not, in any way, alleviate the contractor from their obligation to remove any unwanted debris on the structure prior to undertaking the bridge washing. 2.6 The Contractor is required to submit inspection reports for each structure detailing the work completed and identifying any bridge deficiencies or damages which were found during the work. A sample report may be obtained from the municipality prior to the commencement of work. 2.7 The Contractor shall supply a competent supervisor as defined by OHSA and operators(s) suitably trained and experienced to perform and monitor the process of sweeping and pressure washing processes. The contractor is responsible for all signage and traffic control during bridge washing. 2.8 The Contractor shall supply pressure washing equipment including pump, spray wand, nozzle, hoses, valves, on/off controls suitable to perform the required operation. The minimum acceptable requirements for pressure washing equipment are 520kPa (75 PSI)with a volume of 225 litres (50 gallons) per minute, continuous running operation. 2.9 The Municipality expects that once the project starts the Contractor will work continuously towards its completion. The Contractor shall be required to notify the Municipality of any By-Law 2015-120 Being a By-law to authorize the execution of.. Page 80 of 92 delays. The Contractor will provide a contact list of phone numbers for their onsite supervisors/office. Section 3—Schedule of Work& Payment for Work 3.1 The Municipality does not guarantee any volume of work and volume of work is dependent upon budget. The Municipality reserves the right, at its sole direction, to procure either more or less without altering the contracted price. 3.2 Payment shall be made in accordance to attached `Appendix A"' subject to the provision of monthly invoices submitted to the Municipality. Section 4- Insurance 4.1 The Contractor shall, at his/her expense, obtain and keep in force during the term of this Agreement, Commercial General Liability Insurance satisfactory to the Municipality, including the following and underwritten by an insurer licensed to conduct business in the Province of Ontario: i. A limit of liability of not less than $2,000,000/occurrence ii. The Municipality shall be named as an additional insured iii. The policy shall contain a provision for cross liability in respect of the named insured iv. Non-owned automobile coverage with a limit of at least$2,000,000 including contractual non-owned coverage v. Products and completed operation coverage (Broad Form)with an aggregate limit not less than $2,000,000 vi. That 30 days prior notice of an alteration, cancellation or material change in policy terms which reduces coverage shall be given in writing to the municipality 4.2 A Certificate of said insurance shall be provided to the Municipality prior to any bridge washing activities and upon each renewal. 4.3 The Contractor shall indemnify and save harmless the Municipality from all injuries and accidents arising from any work undertaken as a result of this Agreement save and except from damage caused by the negligence of the Municipality or their employees. 4.4 The Contractor shall be required to show proof of registration with the WSIB. Once the contract commences, each invoice must be accompanied by a current WSIB Clearance Certificate not more than 3 months old. Section 5-Termination 5.1 If the Contractor neglects or fails to carry out or to comply with any of the terms, covenants, undertakings or conditions of this Agreement, the Municipality may, after having given written notice to the Contractor of such default, terminate this Agreement by giving thirty(30)days notice in writing to the Contractor and this Agreement shall be deemed to be terminated on the day specified in the notice. 5.2 The Contractor may terminate this Agreement for any reason by giving thirty (30) days notice in writing to the Municipality and this Agreement shall be deemed to be terminated on the day specified in the notice. Nothing in this Agreement derogates from, interferes with, or fetters the exercise by the Municipality's officers, employees, agents, representatives or elected and appointed officials of all of their rights, or imposes any obligations on the Municipality's officers, employees, agents, representatives or elected and appointed officials, other than as expressly set out in this Agreement. Page 82 of 92 7.5 No communication or dealing between the Contractor and any department, committee, body, officer, employee, agent, representative or elected or appointed official of the Municipality that is not clearly in respect of and in accordance with this Agreement will not be deemed to be a communication or dealing under this Agreement between the Contractor and Municipality as parties to this Agreement or affect the Municipality with notice of any such communication or dealings. It is intended and agreed that any communication or dealing between the Contractor and the Municipality as parties to this Agreement will only be effective if delivered in accordance with the notice provisions in this Agreement. No communication or dealing between the Municipality as party to this Agreement and the Contractor as a party to this Agreement will relieve the Contractor from the responsibility of discharging its lawful obligations to the Municipality imposed by statute, regulation, by-law or by any other lawful manner separate and apart from the obligations imposed under this Agreement. Section 8- No Waiver 8.1 No condonation, excusing or overlooking by the Municipality of any default, breach or non- observance of any of the Contractor's obligations under this Agreement at any time or times shall affect the Municipality's remedies or rights with respect to any subsequent(even if by way of continuation)default, breach or non-observance. 8.2 No waiver shall be inferred from or implied by anything done or omitted by the Municipality. 8.3 Any written waiver by the Municipality shall have effect only in accordance with its express terms. 8.4 Except as stated otherwise in this Agreement, time shall be of the essence in the performance of all covenants and agreements herein. Section 9-Successors and Assigns 9.1 This Agreement shall enure to the benefit of and be binding upon the parties hereto and their respective heirs, executors, administrators, successors and assigns. 9.2 This Agreement shall not be assigned or transferred in any way by the Contractor. Section 10-Counterparts 10.1 This Agreement may be simultaneously executed in several counterparts, each of which when so executed shall be deemed to be an original and such counterparts together shall constitute but one and the same instrument. Section 11-Interpretation 11.1 In construing this Agreement,words in the singular shall include the plural and vice versa and words importing the masculine shall include the feminine, and the neuter and vice versa, and words importing persons shall include corporations and vice versa. Hereinafter called "Contractor" of the Second Part WHEREAS the Council of the Corporation of the Municipality of Bayham desires to provide Canine Control Services for the residents of the Municipality of Bayham; AND WHEREAS the Contractor has agreed to supply the services of Canine Control and Pound Keeper for the Municipality of Bayham; NOW THEREFORE this Agreement witnesseth that in consideration of the mutual covenants herein contained, the parties agree with each other as follows: Section 1 -Canine Control Services 1.1 The Contractor shall provide the services of Canine Control Officer and Pound Keeper within the geographic limits of the Municipality of Bayham and agrees to pick up stray dogs. 1.2 The Contractor shall provide a vehicle suitably equipped to pick up such stray dogs. The vehicles shall be maintained in a safe and clean condition. 1.3 The Contractor shall expressly understand that at no time shall the said vehicle become the property of the Municipality and that the responsibility for its operation, fuel, maintenance, license and insurance shall rest solely with the Contractor. The Contractor shall agree to indemnify and save harmless the Municipality from any and all claims arising out of or in connection with the use of the said vehicle. 1.4 The Contractor shall agree to answer all telephone complaints authorized by Municipal Staff as quickly as possible and to carry out patrols within the Municipality, if requested. 1.5 The Contractor agrees to respond to Municipal Staff requests for the pick up of confined dogs during the hours of 8:30 a.m. to 7:00 p.m. daily, excluding statutory holidays. The term "confined" shall mean, "kept restricted within certain limits" such as but not limited to the dog being kept or restricted to the interior of a building or fenced in area. 1.6 The Contractor agrees to respond to humane requests for the pick up of dogs at large that are deemed vicious, injured and/or ill, when requested by Municipal staff. Page 87 of 92 Section 2- Pound Facilities 2.1 The Contractor shall provide and maintain a pound facility, as owner of or through a contractual arrangement, to serve the Municipality. Such facility shall be kept in good order and state of cleanliness at all times in accordance with the Animals for Research Act, R.S.O. 1990, Chapter A.22, as amended and any Regulations thereof. 2.2 The Contractor shall ensure that pound facility and all dogs impounded shall be kept clean, well cared for, fed and watered during the time of confinement. 2.3 Sick or Injured Dogs: (a) The Contractor shall ensure that all sick or injured dogs will receive immediate medical attention by certified veterinary staff. If, in the opinion of the medical staff, any dog is too severely injured or diseased and medical care will only prolong the suffering of the dog, the dog shall be humanely euthanized by a certified veterinarian and properly disposed of. (b) Every attempt shall be made by the Contractor to contact the owner of any such dog before such action is taken. The Contractor shall charge any and all veterinary service expenses to the Municipality. (c) The Contractor shall be reimbursed by the Municipality for all veterinary service expenses authorized by Municipal staff. 2.4 The Contractor shall keep a record of all dogs impounded, their disposition and all fees collected from Municipality of Bayham dog owners which shall be submitted to the Municipality within ten (10)days following the end of each month. 2.5 The Contractor shall ensure that all dogs impounded shall be kept for a minimum of three (3)days, excluding holidays and the day on which the dog was impounded. Any dog kept longer than the minimum shall be at the discretion and expense of the Contractor. 2.6 The Contractor shall attempt to contact the owner of any dog as quickly as possible. 2.7 When The Contractor quarantines an animal under the authority of the Elgin County Medical Officer of Health and Municipal staff, the Municipality shall pay the costs of the quarantine. 2.8 The Contractor shall display contact phone numbers and office hours at the pound facility in a place that is accessible to the public at all times. 2.9 The Contractor shall recover from the Municipality of Bayham any fees related to Veterinary costs unless the animal has been claimed by the owner. 2.10 The Contractor shall recover from the dog owner such pound fees to cover the cost of pick up and boarding together with any and all veterinary services, if applicable. 2.11 In the case of a quarantine period required by law, the Contractor shall recover all fees from dog owners, including boarding fees and veterinary expenses, if applicable. 2.12 The Contractor agrees that any dogs impounded shall not be released to the owner or other person until a current tag has been purchased from the Contractor. Funds collected from the sale of tags shall be submitted to the Municipality on a monthly basis. By-Law 2015-121 Being a By-law to authorize the execution of.. Page 88 of 92 2.13 The Contractor agrees that any dog not claimed by the owner shall become the property of the Contractor and may be adopted, gifted, sold or humanely euthanized and properly disposed of, in accordance with the Animals for Research Act, R.S.O. 1990, Chapter A.22, as amended and any Regulations thereof. Section 3—General Provisions 3.1 The Contractor shall maintain and pay for Comprehensive General Liability Insurance, including coverage for all operations as Canine Control Officer and Pound Keeper. This insurance coverage shall be subject to limits of not less than two million ($2,000,000.00) dollars, inclusive per occurrence for third party bodily injury and property damage. The coverage shall include the Municipality of Bayham as an additional insured in respect of all operations performed by or on behalf of the Municipality. The coverage shall not be altered, cancelled or allowed to expire or lapse without thirty(30)days prior written notice to the Municipality. A Certificate of Insurance shall be filed with the Municipality upon the signing of the Agreement and annually thereafter throughout the term of the Agreement. 3.2 The Contractor shall agree to fulfill all of his obligations in compliance with the Occupational Health and Safety Act and further agrees to take responsibility for any health and safety violation that may occur. The Contractor shall indemnify and save harmless the Municipality from any and all charges, fines, penalties and costs that may be incurred or paid by the Municipality. 3.3 The Contractor shall provide a Certificate from Workplace Safety and Insurance Board indicating that all payments by the Contractor to the WSIB in conjunction with this Agreement have been made and that the Municipality will not be liable to the Board for future payments in connection with this Agreement. The Certificate shall be provided upon signing of the Agreement and yearly thereafter until the expiry or termination of this Agreement. 3.4 The Contractor shall provide current fee structure, hours of business and after hours contact numbers. Section 4-Administration 4.1 The Municipality shall by appropriate By-law appoint the Contractor as Canine Control Officer and Pound Keeper for the Municipality of Bayham, effective immediately and to hold office during such time as the Agreement is in full force and effect. 4.2 The Municipality shall, in return for the Contractor providing canine control and pound facility services, pay to the Contractor upon submission of monthly reports and invoices, the fees according to Schedule"A"attached hereto. 4.3 This Agreement shall take effect on the 4th day of January, 2016 and shall remain effect for a period of three (3)years with two additional (1)year municipal renewal options. 4.4 It is understood by the parties hereto that there will be no adjustment in fees paid by the Municipality during the full term of this Agreement 4.5 The Municipality or the Contractor may terminate this Agreement upon forty-five (45) days notice in writing to the other party. Such notice may be mailed by ordinary prepaid mail to the other party, and this Agreement shall terminate on the forty-fifth day following the date of the mailing.
