HomeMy WebLinkAboutNovember 19, 2015 - Planning - Committee of Adjustment Neufeld COMMITTEE OF ADJUSTMENT MINUTES THE CORPORATION OF THE MUNICIPALITY OF BAYHAM 9344 Plank Road, Straffordville, ON Council Chambers Thursday, November 19, 2015 6:30 p.m. The Committee of Adjustment for the Municipality of Bayham met on November 19, 2015 at the Municipal Council Chambers at 9344 Plank Road, Straffordville to consider Minor Variance Applications A-07/15 Keep and A-08/15 Neufeld. Committee Members present were Paul Ens, Tom Southwick, Randy Breyer, Wayne Casier and Ed Ketchabaw. Also present were CAO Paul Shipway and Secretary-Treasurer Margaret Underhill. Signed in Attendees: Barry Keep 1. CALL TO ORDER (a) The Secretary-Treasurer called the meeting to order at 6:30 p.m. and asked for those in attendance for this meeting to sign in at the podium. 2. APPOINTMENT OF CHAIRMAN (a) Appointment Moved by: Deputy Mayor Southwick Seconded by: Councillor Breyer THAT Paul Ens be appointed Chairman of the Committee of Adjustment for consideration of Minor Variance Applications A-07/15 submitted by Barry and Sandra Keep and A-08/15 submitted by Jacob and Margaretha Neufeld. CARRIED 3. DECLARATION OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF (a) No disclosures of pecuniary interest were declared. 4. APPLICATION(S) (a) Minor Variance Application A-07/15 Keep - Request for variance to grant relief from Zoning By-law Z456-2003 Section 10.11 - regulations for accessory buildings c) maximum floor area to allow for the construction of an oversized accessory building for the personal storage of motor and recreational vehicles Page 1 of 4 Council Municipality of Bayham Committee of Adjustment November 19, 2015 (b) Minor Variance Application A-08/15 Neufeld - Request for variance to grant relief from Zoning By-law Z456-2003 Section 10.11 - regulations for accessory buildings b) maximum height and c) maximum floor area to allow for the construction of an oversized accessory building for the personal storage of motor and recreational vehicles 5. Underhill presented Report DS-68/15 and advised no public comments were received. (b) Report DS-69/15 regarding Committee of Adjustment- Minor Variance-A08/15 Neufeld File: C-07/ D12. Neufeld Secretary-Treasurer M. Underhill presented report DS-69/15 and advised no public comments were received. 6. PRESENTATIONS BY APPLICANT/AGENT (a) None. (b) None. 7. PUBLIC SUBMISSIONS (a) None. (b) None. 8. COMMITTEE QUESTIONS AND DISCUSSION (a) None. (b) None. 9. DECISION OF COMMITTEE (MOTIONS) Page 2 of 4 Council Municipality of Bayham Committee of Adjustment November 19, 2015 (a) Decision Moved by: Councillor Ketchabaw Seconded by: Councillor Casier THAT the Committee of Adjustment Secretary-Treasurer's report DS-68/15 regarding the KEEP minor variance be received; AND WHEREAS the Committee agrees that the proposed variances meet Section 45.1(1) of the Planning Act and the variance is considered minor; THEREFORE application A-07/15 submitted by Barry and Sandra Keep, pursuant to Section 45 of the Planning Act for minor variance, is granted to allow relief from Municipality of Bayham Zoning By-law Z456-2003: • Section 10 Village Residential Subsection10.11 Regulations for Accessory Buildings c) Maximum floor area—to increase the floor area to 117 m2 from 65 m2 in Zoning By-law Z456-2003 for a 1,219 m2 (0.30 acre) property known municipally as 71 Robinson Street Port Burwell CARRIED (b) Decision Moved by: Deputy Mayor Southwick Seconded by: Councillor Breyer THAT the Committee of Adjustment Secretary-Treasurer's report DS-69/15 regarding the NEUFELD minor variance be received; AND WHEREAS the Committee agrees that the proposed variances meet Section 45.1(1) of the Planning Act and the variance is considered minor; THEREFORE application A-08/15 submitted by Jacob and Margaretha Neufeld, pursuant to Section 45 of the Planning Act for minor variance, is granted to allow relief from Municipality of Bayham Zoning By-law Z456-2003: • Section 10 Village Residential Subsection 10.11 Regulations for Accessory Buildings b) Maximum height—to increase the height to 5.0 meters from 4.5 metres and c) Maximum floor area—to increase the floor area to 106 m2 from 65 m2 in Zoning By-law Z456-2003 fora 1505 m2 (0.37 acre) property known municipally as 8383 Sandytown Road, Straffordville CARRIED Page 3 of 4 Council Municipality of Bayham Committee of Adjustment November 19, 2015 10. ADJOURNMENT ((a) Adjournment Moved by: Deputy Mayor Southwick Seconded by: Councillor Casier THAT the Committee of Adjustment hearing for consideration of Minor Variance Applications A-07/15 and A-08/15 be adjourned at 6:38 p.m.; AND THAT in accordance with the regulations of the Planning Act, Notices of Decision be circulated by the Secretary-Treasurer accordingly.
