HomeMy WebLinkAbout11/25/2014 - Bayham Joint Cemetery Board Municipality of Bayham Joint Cemetery Board Meeting Minutes Bayham Municipal Office Council Chambers 9344 Plank Road, Straffordville Tuesday, November 25, 2014 at 7:00 p.m. Present were: Ralph and Marlene Carter, John Scott, Vera, Joe and Daphne Dickhout, Ed Carter, Joe Neville and Lynda Millard, Secretary. Councillor Wayne Casier was absent. 1. Call to Order & Appointment of Chairman The Secretary called the meeting to order and John Scott agreed to act as Chairman. 2. Welcome & Introductions Joe Neville and Daphne Dickhout were introduced and welcomed as new attendees. 3. Minutes of meeting held Tuesday, April 1, 2014 were read by the Chairman. The correspondence in the minutes and as repeated on the current agenda were reviewed, discussed and clarified as applicable. Moved by Daphne Dickhout Seconded by Ralph Carter "That the minutes of the meeting held April 1, 2014 be approved, as read." Carried 4. Correspondence & Reports Clarification of Documents from the last meeting (a) to (c) were confirmed. (a) Registrar's Policy on License Renewal Fees as of July 1, 2014 The license renewal fee of $15, plus $11 per body burial and $11 per interment of cremated human remains was in effect until June 30, 2014. Beginning July 1, 2014, the license renewal fee remains at $15, plus an increase to $12 per body burial and $12 per interment of cremated human remains. This fee ($11 / $12) is payable to the Municipality and has been coming from the $35 fee the Funeral Home pays to the cemetery board for identification and marking of a lot for burial. (b) Staff Memo 2014-01 regarding HST, fees and Corner Posts (c) Staff Memo 2014-02 regarding Board Assistance (d) Job Description & New Volunteer Application Forms — Daphne Dickhout and Mike Elliott will be appointed to the Guysboro and Eden Cemetery Boards respectively. No other potential new members were present. Cemeteries Minutes - 2 - November 25, 2014 (e) 2014 Invoices for grass cutting were distributed to Secretaries present. Members were advised that the contract for grass cutting has expired and the contractor, who was not willing to renew for a longer term than 2014 will likely request an increase. Those present confirmed that they were satisfied with the work being done, although the early wet spring had been challenging for most sites. The Secretary will pursue a satisfactory new contract with the current contractor and if satisfactory arrangements cannot be reached, other quotations will be sought. It is hoped these can be available for consideration at the April 2015 meeting. (f) Members were advised that the 2014 interest payment cheques would be available soon and they, along with garbage bag tags and grass cutting invoices, will be mailed out or delivered to the Secretary-treasurers. (g) Annual reporting requirements were handed out and reviewed. Secretery-treasurers were encouraged to submit any outstanding payments, including grass cutting, to the Municipality by separate cheques for HST, Care & Maintenance trust fund portions and the $11 / $12 per burial fees before noon, December 24th, to have their bank books updated, reports balanced and submitted, as soon as possible in the new year. (h) Municipal Application for a Cemetery License Members were advised that a new Municipal cemetery license application is to be completed by the Municipality and submitted to the Registrar by December 31St She advised that under Regulation 30/11 , Sections 20 to 29 prescribe the following conditions of every license of an operator: Section 20. An operator shall maintain an address for service in Ontario and shall inform the registrar of that address. Section 21. (1) An operator shall not operate from a location other than a location identified on the license. (2) An operator shall not invite the public to enter into contracts at a location other than the business location identified in the license. (3) Subsection (2) does not prohibit an operator from entering into a contract with a purchaser at a location requested by the purchaser. 22.(1) An operator shall ensure that there is a person in charge of the day-to-day operations of each business location identified on the operator's license and that the person has completed the education required as a result of section 42. (The person in charge is not required to complete the education required if the cemetery is not a commercial cemetery, unless, the cemetery operator holds, or Cemeteries Minutes - 3 - November 25, 2014 is required to hold money in trust under Section 52 of the Funeral, Burial & Cremation Services Act, 2002, in respect of a cemetery). The Secretary will seek clarification of the education requirements, how it applies to the Municipality and its Boards and report back. 5. Other Business Bill 119 WSIB Mandatory Coverage The Secretary advised members that if/when work is done on any Municipal property, which includes cemeteries, such as hiring a contractor to cut or remove trees or brush, the Cemetery Board must obtain from the contractor a WSIB clearance certificate plus a certificate of liability insurance coverage, from their insurer, in the minimum amount of$2,000,000., naming the Municipality of Bayham, as an additional insured. She noted that the contractor who digs the graves for body burials, and sometimes for a cremation burial, is hired to do so by the funeral home. In this situation, as the contractor is not paid by the Municipality, the proof of WSIB coverage is the responsibility of the funeral home. However, in this case, neither the Funeral Home nor the grave digging contractor is providing proof of liability insurance coverage or naming the Municipality as an additional insured. Other concerns and questions were discussed. It was agreed that the Secretary seek clarification and get back to the members. 6. Members Questions / Concerns / Comments None 7. Announcements Members were reminded to attend the Volunteer Appreciation Night at 7:00 p.m., Thursday, November 27th at the Vienna Community Centre. Family and friends are also welcome. 8.
