HomeMy WebLinkAboutOctober 15, 2015 - Planning - O'Connor COMMITTEE OF ADJUSTMENT MINUTES THE CORPORATION OF THE MUNICIPALITY OF BAYHAM 9344 Plank Road, Straffordville, ON Council Chambers Thursday, October 15, 2015 6:30 p.m. The Committee of Adjustment for the Municipality of Bayham met on October 15, 2015 at the Municipal Council Chambers at 9344 Plank Road, Straffordville to consider Minor Variance Application A-06/15, O'Connor. Committee Members present were Paul Ens, Tom Southwick, Randy Breyer and Ed Ketchabaw. Also present were CAO Paul Shipway and Secretary-Treasurer Margaret Underhill. Wayne Casier was absent. Signed in Attendees: Patricia M. Deane-Cobb, Victor W. Cobb 1. CALL TO ORDER (a) The Secretary-Treasurer called the meeting to order at 6:36 p.m. and asked for those in attendance for this meeting to sign in at the podium. 2. APPOINTMENT OF CHAIRMAN (a) Appointment Moved by: Deputy Mayor Southwick Seconded by: Councillor Breyer THAT Paul Ens be appointed Chairman of the Committee of Adjustment for consideration of Minor Variance Application A-06/15 submitted by Randy O'Connor. CARRIED 3. DECLARATION OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF (a) No disclosures of pecuniary interest were declared. 4. APPLICATION(S) (a) Minor Variance Application A-06/15 O'Connor- Request for variance to grant relief from Zoning By-law Z456-2003 Section 10.8- minimum front yard depth, Section 10.9.2 - minimum side yard depth, Section 10.4 - minimum lot frontage and Section 10.3 - minimum lot area to meet condition of Consent Application E96/14 Page 1 of 3 Council Municipality of Bayham Committee of Adjustment October 15, 2015 5. STAFF PRESENTATION (a) Report DS-65/15 regarding Committee of Adjustment - Minor Variance -A06/15 O'Connor File: C-07/ D12.00ON Secretary-Treasurer M. Underhill presented Report DS-65/15. 6. PRESENTATIONS BY APPLICANT/AGENT (a) None. 7. PUBLIC SUBMISSIONS (a) Neighbours Patricia and Victor Cobb inquired about the nature of the meeting and expressed concerns regarding future construction on the new lot. T. Southwick advised the sideyard setbacks for the R1 vacant lot property are not changing. E Ketchabaw confirmed the diagram shows the setback from the lot line is greater than five feet and advised the severance was granted, the purpose of this meeting is to grant the variances. 8. COMMITTEE QUESTIONS AND DISCUSSION (a) P. Ens stated the municipal planner suggests these are minor variances. Victor and Patricia Cobb advised they would like to see a site plan of the proposed building as they have concerns surrounding what may be built. P. Ens responded that the Committee is not aware of what is to be built as that information is not required for the purpose of the meeting. 9. DECISION OF COMMITTEE (MOTIONS) (a) Decision Moved by: T Southwick Seconded by: R Breyer THAT the Committee of Adjustment Secretary-Treasurer's report DS-65/15 regarding the O'Connor minor variance be received; AND WHEREAS the Committee agrees that the proposed variances meet Section 45.1(1) of the Planning Act and the variances are considered minor; THEREFORE application A-06/15 submitted by Randy O'Connor, pursuant to Section 45 of the Planning Act for minor variance, is granted the following four (4) variances to the Village Residential (R1) Section 10 of the Municipality of Bayham Zoning By-law Z456-2003 to allow relief from: Page 2 of 3 Council Municipality of Bayham Committee of Adjustment October 15, 2015 For the Existing dwelling: • Section 10.8— Reduction in the minimum front yard depth from 7.0 m to 6.47 m and • Section 10.9.2— Reduce the minimum side yard depth from 1.7 m to 1.17 m For the Proposed lot: • Section 10.4— Reduce the minimum lot frontage from 20.0 m to 16.0 m and • Section 10.3— Reduce the minimum lot area of 900 m2 to 648 m2 CARRIED 10. ADJOURNMENT (a) Adjournment Moved by: T Southwick Seconded by: E Ketchabaw THAT the Committee of Adjustment hearing for consideration of Minor Variance Aplication A-06/15 be adjourned at 6:54 p.m.; AND THAT in accordance with the regulations of the Planning Act, Notices of Decision be circulated by the Secretary-Treasurer accordingly.
