BY-LAW NO. 2015-082
A BY-LAW TO AUTHORIZE THE EXECUTION OF A
DEVELOPMENT AGREEMENT BETWEEN
MICHAEL GUNSTONE AND
THE CORPORATION OF THE MUNICIPALITY OF BAYHAM
WHEREAS Section 34.(16)of the Planning Act, R.S.O. 1990 c P.3 as amended provides in part that a Council may
pass a zoning by-law to require the Undersigned Party of the land to enter into one or more agreements with the
municipality dealing with some or all of the terms and conditions;
AND WHEREAS Section 36.(1)of the Planning Act, R.S.O. 1990 c P.3 as amended provides in part that a Council
may in a by-law passed under section 34, by the use of the holding symbol "H" (or"h") in conjunction with any use
designation,specify the use to which lands, buildings or structures may be put at such time in the future as the holding
symbol is removed by amendment to the by-law;
AND WHEREAS Section 8.16.1.5 of the Official Plan of the Municipality of Bayham provides that conditions may be
applied to lands prior to the removal of a holding zone symbol regarding the development of the land;
AND WHEREAS the Municipality of Bayham has approved Zoning By-law Z640-2015 whereby changing the zoning
on an existing lot measuring approximately 0.17 hectares (0.41 acres) in area from Agricultural (A1) Zone to the
Agricultural [A1(h2/h3)] Zone known municipally as 7787 Gregson Road located on Part Lot 7 Concession 5;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICPALITY OF BAYHAM ENACTS AS
FOLLOWS:
1. THAT the Mayor and Clerk be and are hereby authorized and directed to execute the Agreement with Michael
Gunstone affixed hereto and forming part of this By-law and marked as Attachment"A".
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 16th DAY OF JULY 2015.
