permission for the EarlyON Child and Family Centre – East Elgin to use:
• The Straffordville Community Park Pavilion on Monday mornings from 9:30 a.m. – 11:30 a.m. and Monday afternoons from 1:30 p.m. – 3:00 p.m.
• Vienna Community Park on Tuesday mornings from 9:30 a.m. – 11:30 a.m.
• The Straffordville Community Park Pavilion on Wednesday mornings from 9:30 a.m. – 11:30 a.m.
• The Port Burwell Pavilion on Thursday mornings from 9:30 a.m. – 11:00 a.m. from the beginning of May until the end of September 2021 subject to provision of liability insurance certificate in the minimum amount of $2,000,000.00 naming the Municipality of Bayham as additional insured; AND THAT vehicle access to the requested locations be granted for the purpose of
unloading items, if necessary; AND THAT the cleanup of the requested locations be the responsibility of the
organizers.

ZONING BY-LAW AMENDMENT
IN THE MUNICIPALITY OF BAYHAM

TAKE NOTICE that the Municipality of Bayham has received a complete application for a Zoning
By-law amendment.
AND TAKE NOTICE that the Council of the Corporation of the Municipality of Bayham will hold
an electronic virtual public meeting on Thursday, May 6, 2021 at 7:30 p.m. in the Municipal
Council Chambers in Straffordville to consider a proposed Zoning By-law amendment under
Section 34 of the PLANNING ACT.
THE PURPOSE of this By-law is amendment to change the zoning regulations on 36.8 ha (90
acres) of land to allow supplementary farm dwelling floor area maximum of 279 m2 (3,003 ft2) in
the form of two mobile trailers and one permanent building to accommodate up to eighteen (18)
seasonal farm labourers, in Zoning By-law Z456-2003. The subject lands are located at 8542
Plank Road, east side, north of Jackson Line.
THE EFFECT of this By-law will be to recognize the existing supplementary farm dwelling in the
form of a 65 m2 (700 ft2) floor area trailer, which will be relocated, for up to five (5) labourers; to
permit a second trailer of the same dimensions and capacity; and, to permit the development of
a third supplementary farm dwelling in the form of a 149 m2 (1,603 ft2) permanent building for up
to eight (8) labourers, with combined floor area exceeding the maximum of 167 m2 (1,800 ft2).
ANY PERSON may attend the public meeting and/or make a written or verbal representation in
support of or in opposition to the proposed amendment.
IF A PERSON OR PUBLIC BODY does not make oral submissions at a public meeting or make
written submissions to the Municipality of Bayham before the by-law is passed, the person or
public body is not entitled to appeal the decision of the Council of the Corporation of the
Municipality of Bayham to the Local Planning Appeal Tribunal.
IF A PERSON OR PUBLIC BODY does not make oral submissions at a public meeting, or make
written submissions to the Municipality of Bayham before the by-law is passed, the person or
public body may not be added as a party to the hearing of an appeal before the Local Planning
Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

SECOND NOTICE OF A PUBLIC MEETING
CONCERNING A PROPOSED
MINOR VARIANCE
IN THE MUNICIPALITY OF BAYHAM
APPLICANT: JACQUELIN DITCHFIELD, 2 ELIZABETH STREET,

TAKE NOTICE that the Municipality of Bayham has received a completed application for a
proposed Minor Variance (A-07/21).
AND TAKE NOTICE that the Committee of Adjustment of the Corporation of the Municipality of
Bayham will hold an electronic virtual public meeting on Thursday, May 6th, 2021 at 6:45 pm to
consider a proposed minor variance to Zoning By-law No. Z456-2003 under Section 45 of the
PLANNING ACT. Please reference the Committee of Adjustment subject Agenda on the
municipal website for the electronic meeting link. If you wish to participate in the virtual public
meeting, you must register with the Planning Coordinator a minimum 48 hours prior to the
meeting.
THE PURPOSE of the variance is to permit zero (0) lot frontage whereas new development is not
permitted on lands without street frontage and 20 m (65 ft) is the required minimum in the Village
Residential (R1) zone, as per Zoning By-law Section 4.18 and 10.4. The lands are located at 2
Elizabeth Street, east side, south of Wellington Street, in the village of Port Burwell.
THE EFFECT of this variance will be to recognize existing zero lot frontage where access to the
lands is by way of easement to permit the owners to enlarge the existing dwelling. The previously
scheduled Public Meeting held on April 1st, 2021 was deferred to April 15th, 2021 for additional
information to be provided regarding access. With no additional information to consider, the April
15, 2021 meeting was cancelled.
ANY PERSON may attend the public meeting and/or make a written or verbal representation in
support of or in opposition to the proposed minor variance.
*** Given the current COVID-19 legislative restrictions and limitations, land use planning meetings
remain open to public comment. Please be advised that equal consideration is given to all written
and oral presentations provided to the municipality prior to or at a public meeting in regards to
land use planning applications. When possible please consider utilizing written
correspondence.

amendment.
AND TAKE NOTICE that the Council of the Corporation of the Municipality of Bayham will hold an
electronic virtual public meeting on Thursday, May 20, 2021 at 7:30 p.m. to consider a proposed Zoning
By-law amendment under Section 34 of the PLANNING ACT. If you wish to participate in the virtual
public meeting, you must register with the Planning Coordinator a minimum 48 hours prior to the meeting.
THE PURPOSE of this By-law is an amendment to change the zoning regulations on 29.7 ha (73.4 acres)
of land to permit an oversized farm produce outlet in a 260.0 m2 (2,000 ft2) portion of an existing
structure (barn) and 92 m2 (1,000 ft2) roofed area with ancillary retail sales, in Zoning By-law Z456-2003.
The subject lands are located at 7462 Plank Road, east side, south side Calton Line.
THE EFFECT of this By-law will be to recognize the existing farm produce outlet use which has been
moved from a road side stand to inside a portion of the existing barn where farm produce outlets are not
intended to be in permanent buildings; to permit ancillary sales of non-farm food items; and where the
Official Plan permits small-scale farm-related commercial uses.
ANY PERSON may attend the public meeting and/or make a written or verbal representation in support
of or in opposition to the proposed amendment.

Residential (HR-XX) and site-specific Agricultural (A1-XX) zone to permit: a maximum one single-detached
dwelling and one oversized accessory building located in the A1 zoned portion of the lands by recognizing
existing zero (0) lot frontage and reduced lot area of 0.85 ha (2.1 acres) whereas the required minimum lot
area in the A1 zone is 20.0 ha (49 acres); oversized accessory building floor area of 115 m2 (1,200 ft2)
whereas 75 m2 (807 ft2) is the permitted maximum for dwellings in hamlets; and to recognize one dwelling
maximum is permitted on the entirety of the lands in the site-specific HR zoned portion, in Zoning By-law
Z456-2003. The subject lands are located at 53768 Heritage Line, north side, west of James Street.
THE EFFECT of this By-law will be to facilitate development of a single-detached dwelling and oversized
accessory building where new dwellings are only permitted on lands meeting the minimum lot area and lot
frontage regulations in the A1 zone, due to topography and drainage connection constraints of the HR
zoned portion.

This is to advise that City Council, at a meeting held on March 22, 2021, passed
the following resolution regarding Planning Act Timelines:
“WHEREAS the City of Kitchener, like many Ontario municipalities, is
experiencing significant growth; and,
WHEREAS the City of Kitchener has conducted extensive work through its
Development Services Review to remove red tape and improve public
engagement; and,
WHEREAS the Province of Ontario's Planning Act provides a legislative
framework for processing development applications including established
timeframes which permit applicants to appeal to the Local Planning Appeal
Tribunal if a Council fails to make a decision within a prescribed timeline; and,
WHEREAS the passing of Bill 108 in 2019 reduced the timelines for
processing development applications before they can be appealed to the
Local Planning Appeals Tribunal (LPAT) for a non-decision from those
outlined in Bill 139, the Building Better Communities and Conserving
Watersheds Act, 2017 as follows:
• from seven months (210 days) to four months (120 days) for Official
Plan amendments;
• from five months (150 days) to three months (90 days) for Zoning By-
law amendments; and
• from six months (180 days) to four months (120 days) for Plans of
Subdivision; and
WHEREAS the shortened timeframes create unreasonable pressures on
municipalities, even outside the context of navigating city business in a global
pandemic, and result in reduced opportunities for meaningful public
engagement and limited time for the public to provide written submissions on
a development application;
THEREFORE BE IT RESOLVED that Kitchener City Council urge the Province
of Ontario to review and reconsider the current timelines established for review
of Planning Act applications before an appeal is permitted to the Local
Planning Appeals Tribunal and to return to the timelines that were in effect
under Bill 139, the Building Better Communities and Conserving Watersheds
Act, 2017;
THEREFORE BE IT FURTHER RESOLVED that a copy of this resolution be
sent to the Ontario Minister of Municipal Affairs and Housing, to the local MP’s
and MPP’s, to the Federation of Canadian Municipalities, to the Association of
Municipalities Ontario, and all other municipalities in Ontario.”

RE: Road Management Action On Invasive Phragmites
WHEREAS Phragmites australis (Phragmites) is an invasive perennial grass that
continues to cause severe damage to wetlands and beaches in areas around the
Great Lakes including Georgian Bay; and
WHEREAS Phragmites australis grows and spreads rapidly, allowing the plant to
invade new areas and grow into large monoculture stands in a short amount of
time, and is an allelopathic plant that secretes toxins from its roots into the soil
which impede the growth of neighboring plant species; and
WHEREAS Phragmites australis results in loss of biodiversity and species
richness, loss of habitat, changes in hydrology due to its high metabolic rate,
changes in nutrient cycling as it is slow to decompose, an increased fire hazard
due to the combustibility of its dead stalks, and can have an adverse impact on
agriculture, particularly in drainage ditches; and
WHEREAS invasive Phragmites has been identified as Canada’s worst invasive
plant species by Agriculture and Agrifood Canada; and
WHEREAS the Ontario government has made it illegal to import, deposit,
release, breed/grow, buy, sell, lease or trade invasive Phragmites under the
Invasive Species Act; and
WHEREAS Phragmites occupy over 4,800 hectares of land around Lake St. Clair
alone, while 212 hectares of Phragmites occupy land along the St. Lawrence
River. The Georgian Bay Area is particularly affected by Phragmites australis,
with more than 700 stands along the shorelines and multiple visible stands on the
highways and roads that threaten valuable infrastructure and wetland areas; and
WHEREAS volunteers, non-governmental organizations, and various
municipalities have invested tens of thousands of dollars in investments and
labour annually for more than eight years in executing managements plans to
control invasive Phragmites on roads, coasts, shorelines and in wetlands; and
WHEREAS roads and highways where Phragmites that are left untreated
become spread vectors that continually risk new and treated wetlands and
coastal shoreline areas; and

WHEREAS according to “Smart Practices for the Control of Invasive Phragmites
along Ontario’s Roads” by the Ontario Phragmites Working Group, best road
management practices for Phragmites australis include early detection, herbicide
application, and cutting; and
WHEREAS these best management practices are most effective when used in a
multi-pronged approach as opposed to when used as stand-alone control
measures; and
WHEREAS mother nature does not recognize political boundaries. Therefore, it
is imperative that Municipalities, Districts, the Province, and the Federal
government work together in collaboration to eradicate Canada’s worst invasive
plant species Phragmites australis;
NOW THEREFORE BE IT RESOLVED that Council for the Corporation of the
Township of The Archipelago directs its staff to implement best management
practices to promote early detection of invasive Phragmites, and to implement
best management practices for invasive Phragmites, and to join the Ontario
Phragmites Working Group to collaborate on the eradication of Phragmites in
Ontario.
BE IT FURTHER RESOLVED that Council for the Corporation of the Township
of The Archipelago directs staff to insert clean equipment protocols into tenders
and that there is oversight that the protocols are followed; and
BE IT FURTHER RESOLVED that Council for the Corporation of the Township
of The Archipelago requests the Ontario Ministry of Transportation to map and
treat invasive Phragmites annually on all its highways; and
BE IT FURTHER RESOLVED that the Ontario Ministry of Transportation (MTO)
communicates the strategy on mapping (detecting sites) and controlling invasive
Phragmites on provincial highways, the specific highway management plans and
results by each MTO region and each highway in the region and work in
coordination with the Township of The Archipelago; and
BE IT FURTHER RESOLVED that Council for the Corporation of the Township
of The Archipelago directs its staff to send this resolution to all municipalities that
are part of the Georgian Bay watershed, to all municipalities in the Great Lakes
watershed, to the Minister of Transportation, Christopher Balasa the Manager,
Maintenance Management Office, and MPP Norman Miller.
BE IT FINALLY RESOLVED that Council for the Corporation of the Township of
The Archipelago requests all levels of government to consider funding support to
aid the Township of The Archipelago in managing invasive phragmites; and
directs staff to send a copy of this resolution to the Ontario Minister of
Environment, Conservation and Parks and the Minister of Environment and
Climate Change Canada.

Dear Minister Bibeau Our agricultural advisory board (AAB) who represents the agricultural sector in Norfolk
County, Ontario is very concerned about the federal government’s current carbon
pricing policies. It is our hope that you consider our concerns and move to exempt all
primary agriculture producers from current and future carbon taxes.
Carbon tax remains as a major cost of production for producers in Norfolk County.
Although some farm fuel purchases are exempt, it is selective and does not meet the
needs of the entire agriculture industry. Currently crop drying, heating/cooling of
livestock barns and cooling of perishable commodities are still subject to full carbon
taxes.
Currently there are no replacements for fossil fuels in agricultural production. As a
result, carbon tax policies are not appropriate for the agricultural sector and only
decrease farm margins.
Norfolk County which is known as Ontario’s garden is home to one of the country’s
largest diversity of crop production. In addition to the extensive vegetable, fruit and grain
production it boasts some of the highest ecological diverse natural habitats, plants and
animals in Canada. There is approximately 25% tree cover in the county which is the
highest percentage of forested land in Southwestern Ontario. Norfolk County It is also
home to over 10,000 acres of woodlots and wetlands protected under Long Point
Conservation Authority. In addition to the natural woodlots and wetlands there is also
extensive fruit production with 2000 acres of apples and 1000 acres of sour cherries. A
mature orchard can fix upwards of 18 mt of C02 annually.
The adoption of production practices to protect the soil and environment are advanced
in Norfolk County. There has been a wide implementation of cover cropping, planting
green and reduced tillage practices all of which sequester carbon. Additional farming
practices of 4R nutrient management coupled with precision technology ensure that
appropriate nutrients are applied at the right time, place and rate. In many cases
sensitive water sources around ponds and wetlands are planted with buffer strips and
soil erosion control measures of grassed waterways and windbreaks are also common
practices. ALUS (alternative land use) programs have been embraced across the
county, taking unproductive land out of production, and returning it to natural native
grass plantings, trees and constructed wetlands. Currently there are 1148 active
projects with 189 producers covering 1573 acres in Norfolk County managed under the
ALUS program.
The agriculture industry has made great strides to protect the environment and will
continue to improve production practices that reduces the carbon footprint in food
production.
The AAB board believes that all on farm fuels used in agricultural production should be
exempt from carbon tax. This should include natural gas, propane, gas, and diesel. We
strongly urge the government to be consistent with a sector wide exemption to current
carbon tax policies.

Re: Resolution - City of Cambridge Council – Request for Paid Sick Leave
At the Special Council Meeting of April 20, 2021, the Council of the Corporation
of the City of Cambridge passed the following motion:

WHEREAS as a result of the COVID-19 pandemic and the increase in cases in
Ontario, our hospitals and Intensive Care Units s are overrun with people sick with
the virus;
AND WHEREAS according to the Provincial Science Advisory Table on COVID-19
we need to protect essential workers and support them with paid sick leave;
AND WHEREAS it is being reported that the drivers of transmission are indoor work
places, particularly industrial workplaces, warehouses, and distribution centres;
AND WHEREAS the COVID-19 crisis has unmasked the inequalities in our Province
as most of the people now getting sick are the most vulnerable in our society and
are those who cannot afford to stay home and often live and work in crowded
conditions;
AND WHEREAS Workers who are denied paid sick days do not avoid illness, they
bring the infections to work with them, and they transmit them to their coworkers,
employees without paid sick leave;
THEREFORE BE IT RESOLVED that Cambridge Council urge the Honourable Doug
Ford, Premier to require Ontario employers to provide no less than five paid sick
days annually to workers — after three months of employment — by amending the
Employment Standards Act, 2000, or through a different mechanism and to provide
necessary funding, fiscal relief and/or support to employers so that all workers in
Ontario have access to no less than 10 paid sick days annually in the event of a
declared infectious disease emergency, such as the COVID-19 pandemic and
ensure all Ontario workers have access to protected and paid emergency leave so
care can be provided to children, parents, and/or other family members who may
become ill and that all workers may receive paid time off to enable them to receive
the COVID-19 Vaccine.
AND FURTHER that upon Council’s approval of this motion that it be forwarded to
the Association of Municipalities of Ontario, the Provincial Minister of Labour, the
Premier, and each Ontario municipality.

Dear Premier Ford:
On behalf of my Council, I am urging your government to immediately implement and fund the
necessary policies to provide adequate paid sick day benefits for Ontario’s workers.
It is a widely accepted fact that workplaces are a significant source of COVID-19 transmission
throughout our province. Sadly however, too many Ontarians are still going to work when they
are sick for fear that they will lose pay should they stay at home. This is entirely
counterproductive to our collective efforts to contain this deadly virus and is contributing to the
high case counts that we continue to see throughout Ontario.
The federal Canada Recovery Sickness Benefit is not nearly sufficient to rely upon as our only line
of defense on this front. While it offers some help, this program is temporary, not fully accessible
to all workers, and the delays involved in applying fail to adequately cover the crucial first few
days of an illness. We can do better Mr. Premier.
I am confident that a “Team Ontario” approach to this issue will find the kind of tailored solution
needed to meet the needs of workers within our province. A universal Ontario paid sick day
policy must ensure accessible and timely supports to allow workers to stay home when they are
sick, get tested, self-isolate and follow all necessary COVID-19 control measures without fear of
income-loss and financial hardship. We owe this to our workers who have given so much over this
past year.

WHEREAS the Government of Canada introduced Bill C-45 (the Cannabis Act) to create the foundation for a comprehensive national framework to provide restricted access to regulated cannabis, and to control its production, distribution, sale, importation, exportation, and possession;
WHEREAS the police have not been given lawful authority to lay charges under the Cannabis Act to appropriately respond to violations of Health Canada Registrations and Licenses;
WHEREAS there is no direct communication or dedicated effort to provide a communication channel between Municipal government staff or Police Agencies for dealing with Health Canada Registrations and Licenses;
WHEREAS the Township of Brock has not been consulted by Health Canada prior to the issuance of licenses for properties not in compliance with municipal zoning by-laws;the future;
BE IT RESOLVED THAT the Township of Brock requests that Health Canada:
1. Require Federal Licenses and Registrations for Designated Growers to conform with local zoning and control by-laws;
2. Ensure local authorities are provided with notification of any licence issuance, amendment, suspension, reinstatement or revocation within their region;

3. Provide dedicated communication with local governments and Police services;
4. Provide lawful authority to Police agencies to lay charges when registered or licences operations grow in excess of their registration or licence through Health Canada; and,

AND FURTHER BE IT RESOLVED THAT the Township of Brock will forward this motion by email to the following partners: All municipalities in Ontario; the MP and MPP of Haliburton–Kawartha Lakes–Brock; the Minister of Agriculture, Food and Rural Affairs; the Minister of Agriculture and Agri-Food; and the Durham Region Police Services with the request that the Federal government enact legislation to better support local governments with land use management and enforcement issues as they relate to Cannabis Production and Processing.

Please be advised the Municipal Council of the Town of Fort Erie at its meeting of April 26,
2021 passed the following resolution:
Whereas the Municipal Council of the Town of Fort Erie passed a resolution on October 21st,
2019 identifying that 1,100 private water wells were in operation in the Town of Fort Erie, of
which 75% were used for domestic purposes including human and livestock consumption, and
Whereas the Municipal Council of the Town of Fort Erie further identified in that resolution that
Council requires the protection of water in the aquifer supplying water to those wells from
contamination as the result of any remediation of Pit One owned by the Port Colborne Quarries
in the City of Port Colborne, and further
Whereas Report No. PDS-23-2021, approved by Council on March 22, 2021, identified that
while the Niagara Peninsula Conservation Authority, The Regional Municipality of Niagara and
Local Area Municipalities work together to protect source water, these plans do not generally
apply to private servicing, and
Whereas Report No. PDS-23-2021 further identified efforts undertaken by the Town of Fort
Erie through available provincial planning policy, regulation and legislation to protect source
water within the Town of Fort Erie without any explicit ability to designate source water
protection for private services, and
Whereas on July 28, 2010, through Resolution 64/292, the United Nations General Assembly
explicitly recognized the human right to water and sanitation and acknowledged that clean
drinking water and sanitation are essential to the realization of all human rights, and

Dear Mayor Ketchabaw,
I write to you in my capacity as Chair of the Elgin Group Police Services Board (Elgin Group) to advise you that
the Elgin Group’s contract with Ontario Provincial Police (OPP) expires on June 30th, 2021.
The Elgin Group is on a different billing cycle from other municipalities served by OPP and OPP has asked us to
consider extending our current contract to December 31st, 2021.
Extending our current contract by executing an amending agreement will accomplish the following:
• Ensures we are on the same billing cycle as other municipalities across the province, supporting a
streamlined process for OPP; and
• Provides flexibility for anticipated amendments related to Bill 68 – Community Safety and Policing Act,
2019, S.O. 2019, c. 1, which we expect will be enacted later this year.
Municipalities served by OPP in the Elgin Group will be required to pass a By-law to amend the Agreement and
extend the contract until the 31st of December 2021.
I have enclosed a copy of the Elgin Group Amending Agreement, as provided by OPP. Additionally, I have
enclosed a draft by-law prepared by the Elgin Group’s Secretary Administrator and reviewed by the County’s
Solicitor.

The 2021 Census is almost here! As you know, census data are critical to decision makers and
Canadians from coast to coast to coast. In addition to informing public policy, census data are
vital for planning schools, hospitals, daycare centres, family services, public transportation, and
skills training for employment. In addition, census data support numerous municipal programs
related to infrastructure and public transportation and are used to measure Canada sustainable
development and environmental goals. Information from the 2021 Census will be even more
crucial because it will help your community evaluate the impact of the COVID-19 pandemic and
to better plan for the future.
Census collection will begin on May 3, 2021. Statistics Canada has adapted the collection
process to ensure that all Canadians and our employees remain safe while participating in this
vital national exercise. Data collected in the 2021 Census will inform many of the economic and
health-related policy decisions that must be made by all levels of government in the coming
months and years, as the aftermath of the COVID-19 pandemic continues to affect the lives of
Canadians.
Statistics Canada will do everything it can to get Canadians to respond to the census without an
in-person visit from a census employee. Completing the census questionnaire online is the best
and fastest way to fulfill the census obligation. We anticipate that the great majority of
Canadians will complete the questionnaire through our efficient, secure and user-friendly
online application. Respondents without reliable access to the Internet can also call the Census
Help Line to complete their census questionnaire over the phone or request a paper
questionnaire.
In cases where a Statistics Canada census employee is sent to a dwelling for non-response
follow-up, a new no-contact protocol will be followed. Under this protocol, no interviews will
be conducted inside the respondent's dwelling. These interviews will instead be physically-
distanced and the census employee will be required to wear a mask, and follow all public health
guidelines.
I would appreciate your active support in helping us make the 2021 Census a success. We have
developed the Community Supporter Toolkit and brought together products and resources to
help you spread the word about the benefits and positive impact of the census for your
community.

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: THAT By-law No. 2015-070 to prohibit or otherwise regulate the keeping of certain animals within the Municipality of Bayham be amended as follows:
2.9 No person shall keep, own, harbour, or permit to be kept, owned or harboured any livestock within the Municipality of Bayham and furthermore, livestock, including animals such as pets raised or housed for recreational or hobby purposes, shall not be kept in identified areas in accordance with the Municipality of Bayham Zoning By-Law No. Z456-2003, as amended.
2.10.1 Any person who keeps, owns or harbours livestock under Section 2.10, has the responsibility to properly control their livestock in order that the livestock remains on their own property. THAT in all other respects, By-law 2015-070 is hereby confirmed and remains unchanged;

BY-LAW NO. 2021-029
BEING A BY-LAW TO ESTABLISH A LEVY FOR THE YEAR 2021 TO
ADOPT TAX RATES, PROVIDE FOR PENALTY AND INTEREST IN
DEFAULT OF PAYMENT AND THE COLLECTION THEREOF WHEREAS Section 290 of the Municipal Act, S.O. 2001, as amended, provides that a local municipality shall in each year prepare and adopt a budget including estimates of all sums required during the year for
the purposes of the municipality, and; WHEREAS By-law No. 2021-028, passed by Council, adopted a capital improvement plan for 2021 in the amount of $1,923,500 and in lieu of the municipality providing for the 2021 estimated amortization of fixed assets and;
WHEREAS Section 312 (2) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that a
local municipality shall pass a by-law to levy a separate tax rate on the assessment in each property class, and; WHEREAS Section 307 (2) (b) of the Municipal Act, 2001, S.O. 2001, c.25 requires tax rates to be established in the same proportion to tax ratios, and;
WHEREAS it is necessary and expedient to levy on the whole rateable property according to the last
revised assessment roll of the Municipality the sum of $5,110,685 for the purposes of the lower-tier municipality for the current year, and;
WHEREAS certain regulations made under Part IX of the Municipal Act, 2001, S.O. 2001, c.25 require
reductions in certain tax rates for certain classes or subclasses of property, and; WHEREAS by action of the Municipal Property Assessment Corporation, provision was made for the taking of the assessment of the Municipality, as the assessment on which the rate of taxation for the year 2021 should be levied;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM
HEREBY ENACTS AS FOLLOWS:
1. THAT the current estimates for 2021 set out in Schedule “B” are hereby adopted. 2. THAT the tax rates required to raise the current estimates for 2021, set out in Schedule “A”, be hereby adopted, and levied for the year 2021 upon the whole of the said assessment of the Municipality, according to the last revised assessment roll.
3. THAT for the purpose of providing for the County of Elgin general levy the tax rates set out in County of Elgin By-Law 21-03, be hereby levied for the year 2021, upon the whole of the said assessment of the Municipality, according to the last revised assessment roll.
4. THAT in addition, for the purposes of providing for the public and separate school education purposes, the tax rates set out by the Minister of Finance under Regulation 6/21 of the Education
By-law 2021-029 - 2 -
Act, be hereby levied for the year 2021, upon the respective portions of the said assessment of
the School supporters of the said Municipality, according to the last revised assessment roll. 5. THAT the assessment contained in the assessment roll of the Municipality of Bayham, as made pursuant to Province of Ontario Regulations, be hereby adopted and confirmed as the assessment on which the rate of taxation for the year 2021 shall be levied.
6. THAT the said assessment roll be hereby adopted and confirmed as the last revised assessment
roll for the said Municipality and be used with the above noted rates to calculate said taxes as summarized in Schedule “C” 7. THAT all taxes and other special rates shall be paid in the office of the Tax Collector or Treasurer of the Municipality of Bayham.
8. THAT taxes for all properties shall become due and payable one-half on or before August 27,
2021 and one-half on or before October 29, 2021, and non-payment of the amount, as noted, on the dates stated in accordance with this section shall constitute default. 9. THAT on all taxes, which are in default on the 1st day following the above noted due dates, a penalty of 1.25% shall be added and thereafter a penalty of 1.25% per month will be added on the
1st day of each and every month the default continues, until December 31st, 2021.
10. THAT on all taxes in default on January 1st, 2021, interest shall be added at the rate of 1.25% per
month for each month or fraction thereof in which the default continues.
11. THAT penalties and interest added in default shall become due and payable and shall be collected as if the same had originally been imposed and formed part of such unpaid tax levy.
12. THAT the Collector shall cause the same to be mailed to the residence or place of business of such person indicated on the last revised assessment roll, a written or printed notice specifying that amount of taxes payable.
13. THAT all by-laws inconsistent with the provisions of this by-law are hereby repealed.

THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW 2021-030 A BY-LAW TO AUTHORIZE THE EXECUTION OF AN AMENDING AGREEMENT WITH HER MAJESTY THE QUEEN IN RIGHT OF ONTARIO AS REPRESENTED BY THE SOLICITOR GENERAL FOR THE PROVISION OF POLICE SERVICES FOR THE ELGIN GROUP MUNICIPALITIES WHEREAS the Municipal Act, 2001 S.O, c.25, as amended, authorizes municipalities to enter into agreements; and AND WHEREAS under Section 4(1) of the Police Services Act, R.S.O. 1990, c.P.15, municipalities are required to provide adequate and effective police services in accordance with its needs;
WHEREAS under Section 10 of the Police Services Act, R.S.O. 1990, c.P.15, the Solicitor General may enter into an agreement with the council of a municipality or jointly with the councils of two or more municipalities for the provision of police services for the municipality or municipalities by the Ontario Provincial Police; AND WHEREAS under Section 29, the Parties may amend the Agreement by written agreement; AND WHEREAS the Corporation of the Municipality of West Elgin, the Corporation of the Municipality of Bayham, the Corporation of the Municipality of the Township of Southwold, the Corporation of the Municipality of Central Elgin, the Corporation of the Municipality of Dutton Dunwich and the Corporation of the Municipality of the Township of Malahide (herein after collectively called the “Elgin Group”) seek to enter into a single amending agreement for the
provision of Police Services by the Ontario Provincial Police; NOW THEREFORE the Council of the Corporation of the Municipality of Bayham enacts as
follows: 1. The Mayor and the Clerk are hereby authorized, on behalf of the Corporation of the Municipality of Bayham to enter into and execute under its corporate seal an agreement for the provision of Police Services with the Solicitor General of Ontario. 2. The Police Services agreement with the Solicitor General of Ontario shall also be authorized by the five other Municipalities, being the other members of the Elgin Group. 3. The Police Services amending agreement will commence on the 1st day of July 2021 and will conclude on the 31st day of December 2021. 4. A copy of said amending agreement shall remain attached to and form part of this by-law. 5. This By-law shall come into force and effect upon the final passing thereof.

THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2021-031 BEING A BY-LAW TO AMEND BY-LAW NO. 2018-005 A BY-LAW TO GOVERN THE PROCEEDINGS OF THE COUNCIL OF THE MUNICIPALITY OF BAYHAM AND OF ITS COMMITTEES AND THE CONDUCT OF ITS MEMBERS WHEREAS Section 238(2) of the Municipal Act S.O. 2001, c.25 as amended requires every Municipality to pass a Procedural By-law for governing the calling, place and proceedings of meetings; WHEREAS the Council of the Municipality of Bayham on the 4th day of January, 2018 enacted By-Law No. 2018-005, being a by-law to govern the proceedings of the Council of the Municipality of Bayham and of its committees and the conduct of its members
AND WHEREAS the Council of the Municipality of Bayham deems it necessary to amend By-law No. 2018-005;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: THAT By-law No. 2018-005 to govern the proceedings of the Council of the Municipality of Bayham and of its committees and the conduct of its members be amended as follows: 4.8.7 The Motion to rise from “In Camera” shall include the time that Council arose followed by a subsequent, generic motion for each item considered in Closed Session. 5.1.4. In order to ensure accountability and transparency of decision-making and to protect the public interest and ensure equitable treatment of all citizens, additions to the Agenda shall not be permitted, except when a matter is of a time-sensitive nature. Time-sensitive matters will be determine and agreed upon by the CAO|Clerk and the Mayor. A time-sensitive matter will be added to the Agenda by Addendum or brought forth at the meeting of Council only when it is not possible to issue an Addendum beforehand. Any matter not deemed time-sensitive and not included on the Agenda prior to publication as noted in 5.1.2 will be included on the Agenda for the next meeting of Council. 5.1.5 For the purpose of this section, a matter is deemed to be of a time-sensitive nature when it will negatively impact the health, safety and well-being of persons, expose the Municipality to liability or negatively impact the Municipality’s position in negotiation if Council does not make a decision and the Municipality does not act on the matter prior to the next regular meeting of Council. 5.1.6 In order to address accountability and transparency and in the event a Verbal Matter is proposed for inclusion on the Agenda, it shall be the responsibility of the member of staff or Council proposing the item to complete a Verbal Matters Form prior to the meeting, which will be included in the Agenda package and the Agenda reposted. In the event a Verbal Matters Form cannot be provided prior to the meeting, it is required to be provided to the CAO|Clerk no later than five (5) business days post-meeting to be included on the Agenda package and the Agenda reposted.
THAT in all other respects, By-law 2018-005 is hereby confirmed and remains unchanged;
AND THAT this by-law shall come into force and take effect upon final passing.

THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2021-032 A BY-LAW TO CONFIRM ALL ACTIONS OF THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM FOR THE COUNCIL MEETING HELD MAY 6, 2021 WHEREAS under Section 5 (1) of the Municipal Act, 2001 S.O. 2001, Chapter 25, the powers of
a municipal corporation are to be exercised by the Council of the municipality; AND WHEREAS under Section 5 (3) of the Municipal Act, 2001, the powers of Council are to be exercised by by-law; AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it advisable that the proceedings of the meeting be confirmed and adopted by by-law. THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the actions of the Council of the Corporation of the Municipality of Bayham in respect of each recommendation and each motion and resolution passed and other
action by the Council at the Council meeting held May 6, 2021 is hereby adopted and confirmed as if all proceedings were expressly embodied in this by-law.
2. THAT the Mayor and Clerk of the Corporation of the Municipality of Bayham are hereby
authorized and directed to do all things necessary to give effect to the action of the Council including executing all documents and affixing the Corporate Seal.
