CALL TO ORDER E. Ketchabaw called the meeting to order at 6:57 p.m. 2_ DISCLOSURES OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF No disclosures of pecuniary interest were declared. 3. APPLICATION A. Minor Variance Application A-15/20 Anthony Guenther THE PURPOSE of the variance is to permit corner lot side yard setback of 1.78 m (5.57 ft) whereas 4.5 m (14.7 ft) is the permitted minimum, as per Zoning By-law Section 10.9.3; and to permit 34% lot coverage whereas 30% is the permitted maximum, as per Zoning By-law Section 10.6, located at 55879 First Street, south side, west of East Street. THE EFFECT of this variance will be to allow the development of a dwelling upon currently vacant lands with reduced side yard setback and increased lot coverage maximum. 4. STAFF PRESENTATION A. Report DS-03/21 by Margaret Underhill, Secretary/Treasurer re Committee of Adjustment Minor Variance Application A-15/20 A. Guenther, 55879 First Street, Straffordville Secretary/Treasurer, M. Underhill presented the Report. Secretary/Treasurer noted to the Committee that after the agenda was published the Applicant approached staff with a proposal to reduce the garage by 1.52 m (5 ft) to increase the side yard to 3.3 metres. PRESENTATIONS BY APPLICANT/AGENT Mr. Tony Guenther, the Applicant advised he can reduce the garage by five feet which will address the side yard setback requirement. 6. PUBLIC SUBMISSIONS None. 7. COMMITTEE QUESTIONS AND DISCUSSION D. Froese inquired if staff would support this change to which Secretary/Treasurer M. Underhill confirmed support. V. Donnell inquired if the reduced garage would have to be five feet or could it be less. Secretary/Treasurer M. Underhill responded the five foot reduction allowing for 3.3 metre setback would be considered minor and would allow access to the back yard. S. Chilcott questioned the visibility as this is a corner lot and it was confirmed the location will not inhibit the visibility. Secretary/Treasurer noted that the road allowance on East St is wider on the west side and with the proposed house placement visibility will not be inhibited. Mr. Guenther inquired about the location of existing houses and was advised the existing houses predate the current zoning regulations. 8. DECISION OF COMMITTEE (Motions) Moved by: R.Weisler Seconded by: V. Donnell THAT the Committee of Adjustment Secretary/Treasurer's report DS-03/21 regarding the Guenther minor variance be received; AND THAT the Committee of Adjustment considered all written and oral submissions received on this application, the effect of which helped the committee to make an informed decision; AND WHEREAS the Committee agrees that the proposed Amended side yard setback variance proposed by the landowner does meet Section 45.1(1) of the Planning Act and is considered minor; THEREFORE Minor Variance Application A-15/20 submitted and amended by Anthony Guenther pursuant to Section 45 of the Planning Act for minor variance, is granted to allow relief from Municipality of Bayham Zoning By-law Z456-2003: 3 Statutory Planning Agenda — Committee of Adjustment January 21, 2021 Application A-15/20 - Guenther Section 10.9.3 to permit an exterior side yard setback of 3.3 metres, whereas 4.5 metres is the permitted minimum, representing a 27% reduction in a corner lot exterior side yard setback to permit the construction of a new residence CARRIED 9. ADJOURNMENT Moved by: S. Chilcott Seconded by: V. Donnell THAT the Committee of Adjustment hearing for consideration of Minor Variance Application A-15/20 be adjourned at 7:08 p.m.; AND THAT in accordance with the regulations of the Planning Act, Notices of Decision be circulated by the Secretary -Treasurer accordingly.
