PURPOSE AND EFFECT OF THE PROPOSED AMENDMENT 2 (a) Application submitted by William and Jacqueline Ringland The purpose of the public meeting is to consider an application to change the zoning on a recently severed parcel from the Agricultural (Al) Zone to the site-specific Rural Residential (RR- 27) Zone and to change the zoning on the retained parcel of land from the Agricultural (Al) Zone to the site-specific Special Agricultural (A2-11) The effect of the by-law will be to accommodate the severance of a surplus dwelling and to prohibit the establishment of any new residential dwellings on the retained agricultural lands in accordance with the land severance policies of the Official Plan 5. AND TAKE NOTICE that the Council of the Corporation of the Municipality of Bayham will hold a public meeting on Thursday, September 17, 2015 at 7:30 p.m. in the Municipal Council Chambers in Straffordville to consider a proposed Zoning By-law amendment under Section 34 of the PLANNING ACT. THE PURPOSE of this By-law is to change the zoning on a recently severed lot measuring 3173 sq. m. (0.78 acre)in area, from the Agricultural(A1)Zone to the site-specific Rural Residential(RR-27)Zone,and to change the zoning on the retained 21.4 hectares(53 acres)of land from the Agricultural (Al)Zone to the site- specific Special Agricultural(A2-11)Zone in Zoning By-law Z456-2003.The subject lands are located on Part Lots 13& 14, Concession 5, on the north side of Calton Line, at the intersection with Bogus Road,and known municipally as 55738 Calton Line. THE EFFECT of this By-law will be to accommodate the severance of a surplus dwelling, and to prohibit the establishment of any new residential dwellings on the retained agricultural lands in accordance with the land severance policies of the Official Plan. Site-specific regulations on the severed lands are required to address the lot area of 0.32 ha, where 0.4 hectares is the required minimum lot area and the dwelling front yard depth of 9.45 metres,where 15.0 metres is the required minimum front yard depth and the accessory building's side yard setback of 2 metres, where 3.0 meters is the required minimum side yard setback for a Rural Residential (RR)parcel. Site-specific regulations are also required on the retained lands to recognize the reduced lot frontage of 132.5 metres,where 150.0 metres is the required minimum lot frontage for an agricultural parcel. Subject to Elgin County Land Division Consent Application E45/15. ANY PERSON may attend the public meeting and/or make a written or verbal representation in support of or in opposition to the proposed amendment. IF A PERSON OR PUBLIC BODY does not make oral submissions at a public meeting or make written submissions to the Municipality of Bayham before the by-law is passed,the person or public body is not entitled to appeal the decision of the Council of the Corporation of the Municipality of Bayham to the Ontario Municipal Board. IF A PERSON OR PUBLIC BODY does not make oral submissions at a public meeting, or make written submissions to the Municipality of Bayham before the by-law is passed,the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board,there are reasonable grounds to do so. IF YOU WISH to be notified of the adoption of the proposed amendment, you must make a written request to the undersigned.
