The Committee of Adjustment for the Municipality of Bayham met on September 3, 2015 at the
Municipal Council Chambers at 9344 Plank Road, Straffordville to consider Minor Variance
Application A-05/15 Patten. Committee Members present were Paul Ens, Tom Southwick,
Randy Breyer, Wayne Casier and Ed Ketchabaw. Also present were CAO Paul Shipway and
Secretary -Treasurer Margaret Underhill.

1. CALL TO ORDER
(a) The Secretary -Treasurer called the meeting to order at 6:30 p.m. and asked for
those in attendance for this meeting to sign in at the podium.
2. APPOINTMENT OF CHAIRMAN
(a) Appointment

Seconded by: R Breyer
THAT Paul Ens be appointed Chairman of the Committee of Adjustment for
consideration of Minor Variance Application A-05/15 submitted by Shawn & Diane
Patten.
CARRIED
3. DECLARATION OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF
(a) No disclosures of pecuniary interest were declared.
4. APPLICATION(S)
(a) Minor Variance Application - A05/15 - Request for variance to grant relief from
Zoning By-law Z456-2003 Section 4.6(b) - maximum floor area for an Agricultural
Home Occupation in an Agricultural (A1) Zone to permit an addition to an existing
building submitted by Shawn & Diane Patten

6. PRESENTATIONS BY APPLICANT/AGENT

(a) None
8. COMMITTEE QUESTIONS AND DISCUSSION
(a) E Ketchabaw inquired as to the percentage of lot coverage being considered for
the home occupation to which M Underhill responded the percentage would have
to be calculated.
S Patten advised the property size is 22,000 m2, therefore the home occupation
would be less than 1%.
P Ens stated he was supportive of the proposal.
DECISION OF COMMITTEE (MOTIONS)
(a) Decision

Seconded by: W Casier
THAT the Committee of Adjustment Secretary -Treasurer's report DS -58/15
regarding the Patten minor variance be received;
AND WHEREAS the Committee agrees that the proposed variances meet Section
45.1(1) of the Planning Act and the variance is considered minor;
THEREFORE application A-05/15 submitted by Shawn and Diane Patten, pursuant
to Section 45 of the Planning Act for minor variance, is granted to allow relief
from Municipality of Bayham Zoning By-law Z456-2003:
• Section 4.6 b) Agricultural Home Occupation — to permit a maximum of 267.23
m2 of floor area for an agricultural home occupation, where maximum seventy
(70.0) square metres of floor area is currently permitted in the Agricultural (Al)
Zone in Zoning By-law Z456-2003

10. ADJOURNMENT

THAT the Committee of Adjustment hearing for consideration of Minor Variance
Application A-05/15 be adjourned at 6:37 p.m.;
AND THAT in accordance with the regulation of the Planning Act, Notices of
Decision be circulated by the Secretary -Treasurer accordingly.
