Page 6 of 164 Gil nONTA * Conservation ON TAR 10 Reviewing the Conservation Authorities Act to Reflect the Realities of Today Conservation Authorities' activities around Ontario's natural resources has changed significantly over the years in response to increasing challenges to our water and land resources. Stresses such as climate change, rapid growth, and changing land uses significantly challenge the ability of our natural ecosystems to support economic growth, a sustainable environment, and the lifestyles and health of residents. Conservation Authority programs contribute significantly to addressing Ontario's environmental priorities. Conservation Authorities are recognized for their watershed management, science- based expertise and for being able to adapt to changing conditions. A more integrated relationship with the Province and sustainable provincial funding would ensure greater consistency and continuation of programs. Key Priorities of Conservation Authorities Conservation Authorities are looking to discuss key priorities which include: 1. Confirm the current Conservation Authority Mandate as outlined in the Conservation Authorities Act which is to undertake watershed-based programs for the conservation, restoration, development and management of natural resources; 2. Formalize and expand the CA working relationships across Ontario provincial ministries in order to capitalize on the important contributions of CA programs and services, and to more widely leverage and support Conservation Authority efforts in local watersheds; 3. Discuss the governance model in relation to the funding model; 4. Sustainable provincial funding formula that captures and reflects the actual range of Conservation Authority programs and services that support multiple provincial objectives. Present were Mayor Paul Ens, Deputy Mayor Tom Southwick, Councillors Randy Breyer,Wayne Casier and Ed Ketchabaw,CAO Paul Shipway and Clerk Lynda Millard. DISCUSSION: Marisa Zilli of Amazing Animal Tricks is a recognized, professional studio animal trainer. Ms.Zilli is requesting an exemption to the by-law, pursuant to Section 5.1(j)of Municipality of Bayham By-Law 2015-070,to allow her to keep a Philander Opossum. She has provided information on the species describing the Philander Opossum as a solitary species that will avoid conflict whenever possible. RECOMMENDATION 1. The City of London owns the dyke and through an agreement, the Upper Thames River Conservation Authority (UTRCA) undertakes major maintenance activities. The UTRCA retained Stantec Consulting Ltd.in 2009 to complete a Master Repair Plan covering the next 20- year period to address aging infrastructure, flood protection, public use, and integration of other City initiatives. The study was placed on hold in early 2013 pending updates to flood elevation information. With new information now available,Stantec is in the process of completing the Master Repair Plan. This study is being conducted as a Master Plan(Phases 1 and 2)under the Municipal Class Environmental Assessment process (Municipal Engineer's Association, as amended in June 2007 and 2011). The current legislative framework for policing in Ontario dates back to 1990.It has not been changed significantly in twenty-five years.The Minister announced that the consultation will seek input on how to: o Enhance accountability and strengthen civilian governance of police services boards as well as how to ensure police oversight bodies are effective and have clear mandates. o Improve interactions between police and vulnerable Ontarians,including enhancing frontline responses to those in crisis. o Clarify police duties,modernize training programs and deliver services using a range of public safety personnel. o Develop a provincial framework for First Nations policing to ensure equitable and culturally responsive policing for the province's First Nations communities. Page 33 of 164 Subject:AMO POLICY UPDATE August 14,2015 Municipal POA Courts Cost Recovery — Ministry of the Attorney General Announces 50% Increases The Ministry of the Attorney General(MAG)has announced that it will increase costs for municipal government Provincial Offences Act(POA)Courts administration to offset increased Ministry costs for Justices of the Peace(JP) services and oversight of transfer agreements. AMO understands that these increases will be effective January 1, 2016 and represent significant increases. The changes were announced in letters to municipal courts administrators and to their Heads of Council on August 13,2015. AMO understands that the increased costs for municipal governments will come from two areas: A 50%increase in the costs per hour for JP services,from$200/hr to$300/hr to reflect salary and benefit increases for JPs;and A 50%increase in the cost of monitoring the agreements with municipalities that transfer POA courts to local governments to reflect 100%of the cost for this activity(MAG has not been recovering all costs previously). Compensation for members of the judiciary is set by an independent panel and is not subject to approval by the Province or municipal governments. JP costs increases represented in this announcement are well above inflation. Municipal governments use the POA fine revenue to help with their budget bottom line. This fiscal hit will impact 2016 budgets. AMO believes these changes could be better timed or phased-in to coincide with anticipated enhancements to the collection of POA fines that will allow license plate denial and pursuit of fines on out of province vehicles. These system changes are anticipated within the next two years. POA fines help to support other municipal services and cost increases will have an impact on service provision at the local level. Members were assured that they do not have to follow the policies "to the letter",but rather the policies are there to fall back on if we ever have a conflict resolution issue. This committee is covered under the municipality's liability insurance but not under WSIB. As per Occupational Health & Safety Policy, we can refuse to do anything that we feel is unsafe. As an Advisory Committee, it is unlikely that we will experience "Pecuniary Interest". Whenever this committee would like a direct answer from council, there is now a separate form to submit, rather than communicating through committee minutes. All agendas and minutes are to be sent to Brenda Gibbons at bgibbons@bayham.on.ca. Agendas need to be sent to committee members and staff a few days prior to any meeting. It was noted that there is very little change between the 2015 and 2016 draft budgets. L.Millard will seek clarification in 2015 line items; "Sundry" in the amount of$7,000 and$4,500 under"Building Renovations". It was suggested that these amounts were just incorrectly posted. In answer to our desire to have part time curatorial services, P.Shipway advised that we are not likely to receive any grants for such services and therefore Council is unlikely to justify those costs from the general coffers. He noted that even if we did qualify for CMOG grants, they do not contribute significant funds anyway. Regarding the current storefront location of the Edison Museum, P.Shipway advised that the contract for the building, including utilities, is paid until Dec. 31, 2015. The bulk of our collection remains in the building on Snow Street. In the new year, the storefront artefacts will be returned to Snow Street. L.Millard asked that the committee be prepared to approve the Draft Budget at our September meeting. With "The Hall's" central geographical position to many communities within the boundaries of Bayham and the other outside features of"The Hall" has to offer, such as the ball diamonds, the pavillion, food booth, concrete pad (which could be utilized for much more than just a basketball court at one end), storage building and a fenced in children's playground as well as small forested area and other green space that could facilitate other activities such as soccer or just a good old game of tag. I would also be remiss if I didn't point out"The Halls" prime location on Heritage Line(County Road 38) a well travelled thoroughfare in the Municipality of Bayham. I am aware that the Federal Canada 150 Infrastructure Program had received request for funding separately for the Straffordville Community Centre and the Vienna Community Centre from the Municipality of Bayham. Knowing that the request for the Vienna Hall funding was rejected and the the funding for re-hab of The Straffordville Community Centre("The Hall")did get approval, I think it's only common sense that we take advantage of this opportunity. When we can get funding for 50% of the costs to complete the work required to re-open Our Hall. i am confident that if my community was asked to spearhead some form of fundraising inititives,that we would stand together to make it happen, if it was necessary at all, considering the generous deal currently on the table through the Canada 150 Program, which is up to $250,000.00 (contingent on matching funds formula). I understand the municipalty currently has an undisclosed amount of funds available in a Straffordville Community Centre fund as well as other contingency funds available. I would also suggest that council take a second look at the earlier quotes they had received to rehabilitate "The Hall", which I felt was exhorbitantl I think our main goal should be to do the work required to get"The Hall" re-opened. Any other expenditures, such as kitchen upgrades could be done at a later date if the total costs for a complete rehabilitation were to exceed any constraints placed on us in regards to our required 50%share of costs. It really does have all the favorable amenities that a Community needs. Although it ran a deficit,Vienna did as well,Straffordville seems to be the Community Centre of choice as there were more bookings in Straffordville. Maybe the discounted fee offered to service groups was part of the deficit problem. I also believe with the upgrades and managed efficiently it could be profitable as well. If Straffordville were the only Community Centre in Bayham of it's size the rentals would also increase. I also think Eden and Vienna should be given the opportunity to manage their centres on their own to see if they can be self sustainable. When communities work together and through fundraising anything is possible. Just my two cents but when we are paying a 6,000,000.00 debt we would look pretty foolish turning down a 250,000.00 grant from the government. That core is our Community Centre. It is a place that allows residents a common setting to congregate for recreation and exercise. It is a place that provides residents with a better quality of life, increases property values, attracts tourists, and brings the community together. Having access to our park and community centre provides today's youth a safe place to develop respectful relationships and a sense of community.This in turn lowers juvenile delinquency and reduces petty crime in our community while providing a sense of civic pride and cohesion. I have been a life long resident of Bayham and choose to raise my family here because I value a community that unites together to support one another and looks out for each other's well being. Our community center provides a central place for everyone to gather where they can feel like they belong. It is a valuable asset that brings neighbours together for the good of the community. Just as the Ojibwa is a treasured piece of history that we have invested in preserving, so too is our community centre. I feel it should be preserved to further enhance our community's economic future and civic pride. It is my understanding that the alternative to accepting the grant money is to sell the community center to a group of people who agreed to make it available to residents after they make the necessary repairs. I am not in favour of this option. My issue with this is that the said group has the deciding power as to who and when the community center can be rented. They could possibly renege on their promises to keep our community center available to residents.We would lose a fundamental piece of our community history. The existing hall is at least the third of such buildings on the same site.With a church for smaller events, it is the only building at the centre of the municipality to hold large meetings. When I last offered guidance to council I urged the consideration of selling the building to the Mennonite congregation that has been using it on Sundays. It seemed one way to save the building for traditional uses. I was not aware that no alcohol could be used in the hall in such a case.That mean that many traditional uses such as the Watermelon Fest and dances would be barred. Now that we have the financial means to restore the building I see no reason for hesitating to do it as expeditiously as possible, not only to meet the date of being eligible for the grant but to let us enjoy the traditional uses at the earliest. I approve the suggestions made to council Ken Andrews about repairing only the things needed to return the hall to standards for public use. The kitchen has been a costly ammenity in the past. It is not essential to the restoration because there are excellent catering services nearby to provide whatever food is needed for events. If there is enough money available to do it, replacing the heating system with one of energy efficiency is to be encouraged. I too would be willing to give financial support to restore the hail if needed, but given the information elicited by councillor Ed Ketchabaw at the last meeting of council there seems no reason to have to call on us. Also,the Straffordville bingo has been held in Vienna with less attendance especially during the winter months.All the seniors cannot or do not wish to drive in the snow and in the dark and they are the ones who support it the most.The firemen use to rent it for various occasions.After the Christmas parade kids got to see Santa in the hall,have hot chocolate and warm up along with their parents. A lot of people would rent it for weddings, birthday gathering,family get together's and other such function and the February New Years Eve dance could again be held there. If people were able to make use of the kitchen it would draw a lot more events. We used it for our son's Buck and Doe approximately 19 years ago because we could use the kitchen. We had heard in the last few years,individuals could not use the kitchen. Also,since Straffordville has been offered a grant(which they applied for) of up to$250,000. (contingent on matching funds by Bayham) it would go a long way to update the hall for years to come. What about the money that currently is in the Straffordville Community Centre fund. It is going to put the Bayham Township elected officials in a bad light if they turn it down after all the publicity in the paper. Straffordville is in about the centre of the township where Vienna is a lot further for the northern part of the township residents to travel.Those residents would be better off spending their time and money by renting facilities in Tillsonburg. Vienna does not have the playground, baseball diamond,the Lioness Food booth or the new cement pad.We also understand that even though repairs were made to the Vienna hall a couple of years ago, it still does not come up to standards and their grant request was not approved for enough. Bayham Council has voted in favour of disposal of the Community Centre primarily,I believe,as a result of the current economic crisis we find ourselves in.This crisis is without a doubt real but it is not the result of the rate payers demanding or the municipality providing more services than we can afford nor the municipality maintaining more facilities than Bayham can support.It is sadly,a direct and indisputable result of previous actions of Council.There will ultimately,I expect,be a reckoning of those past actions.While I welcome Council's efforts to seek further input on the future of this and other facilities,I would respectfully remind you that the response you receive to this invitation may well not represent the majority of opinion in the municipality nor does this invitation to comment necessarily give Council a moral mandate for disposal of one of our most significant assets;an asset that has been entrusted to you by current and many past generations of Bayham residents. I implore you also not to simply count the yeas and nays,read and duly consider the opinions and suggestions put forward. Declaring the Bayham Community Centre in Straffordville as surplus seems to me to be the easy and short-sighted,way out for Council.This decision is unlike many of the financial decisions that must be made by our Municipal Council such as whether or when to tar and chip a particular road,or when to replace a culvert or when to purchase a new dump truck or rescue van.These decisions are of course important and we entrust our Council to make decisions on these things based on the best information they have available. However,all such decisions have a very limited-time impact on the rate-payers or on the future of the municipality.The decision to abandon Bayham's Community Centre in Straffordville however,is far different than any other decision this or any future Council will make. It is irreversible and the effects are forever. A community centre has stood at the present site in Straffordville for over a century.This building(and its predecessor)and the grounds it sits on have been used for weddings,funerals,birthday parties, anniversaries,dances,private parties,church services,youth entertainment,elections,electioneering, Municipal Facility Surplus Comments Page 68 of 164 health clinics,public meetings,school events and community events such as Carnivals,Watermelon Fest,talent shows and many more.It has been used as a library and as the(now sadly defunct)Lion's Club meeting place.The demise of the Lion's Club bears specific scrutiny;it was perhaps inevitable but it was without doubt hastened if not caused outright by the temporary long-term closure of the Community Centre. Inevitable or not,what a terrible loss to Bayham to lose such a dedicated supportive club that has thrived for my entire lifetime and longer,I expect.It helped so many children and families both locally and across the world in so many ways,often unrecognized and under- appreciated here at home in Bayham. This Community Centre has been financially viable for more than a century so why is it so difficult to believe it cannot still be made viable with some effort?And a viable Community Centre does not necessarily mean a profitable Community Centre.The many years my wife and I lived in Straffordville we walked past the Community Centre almost nightly and it was often occupied by the Lion's Bingo,a Teen Town dance,a church group etc.The grounds were busy with organized baseball,scrub games, skateboarding,roller blading and even ice skating if winter permitted. The place was alive with young people and adults alike.What happens to the grounds in the event of a sale?What happens to minor ball or other non-organized healthy activity when no other greenspace is available to groups and to the children in Straffordville and central Bayham? Don't be fooled into believing private enterprise or some self-interest group or community that may take possession of this facility will accommodate and share with the greater community. How much effort has really gone into finding a solution that would see the preservation and promotion of this facility?A federal carrot of$250,000 has been dangled by Ottawa and the municipality does have undisclosed reserves available to it.Let's be sure not to dismiss this life line out of hand.I have previously suggested to Council that one such option to assist the financial burden might include corporate sponsorship of the Centre. Eastlink,the incumbent and near-monopoly local telephone,cable and Internet provider has been a major sponsor of the East Elgin Community Centre in Aylmer and a similar facility in Forest donating tens of thousands of dollars.That company and its predecessors have reaped millions of dollars from Bayham residents over the past 100 plus years.What have they given back to this municipality?What have they ever been asked to give back?There are other potential corporate sponsors as well such as NRG,CIBC,Magnum,etc.,etc. That is one potential option only and there are no doubt others.This of course requires thought, commitment and a willingness to try rather than to take the easy road and declare this facility as surplus.There is I believe a strong willingness in this community to see the Community Centre saved from auction and even to help find and manage a solution.Perhaps a volunteer Board of Management is needed to work with Council and staff to ensure this and other facilities are properly promoted and cared for over the long term. I urge Council to do the courageous thing and try to save this Community Centre and the grounds it stands on for current and future generations and if you believe,after every conceivable effort is made, that it cannot be saved,let the people make the final determination. I have always been proud of our beautiful Bayham we have so much to offer. Ward three has all the business & industries and probably pay the highest taxes, ward 2 has our municipal office and a very central Community hail, Ward 3 has tourism and a great Provincial Park & beach. I have attended many functions at the Straffordville Hall over the years and feel we are being deprived of an essential part of our community by deeming it surplus. It has been greatly missed this past year. The grade eight graduation had to be moved and although it worked,it was definitely more challenging getting the students there for set up,tear down and pictures. The Grad committee had to go to Aylmer to do their fundraising dance. Seeing Santa after the Christmas parade was not as comfortable at the fire hall with only a few people staying to visit,and the Watermelon fest,in a stifling tent made it difficult for the vendors and spectators to enjoy the day. The future cost to use a tent in place of the hall may be a financial burden the Fest will not be able to support. If we lose the Watermelon Fest Straffordville's businesses will be affected as will our sense of community. With the folding our Lions and Lioness clubs we have already lost too much. We have an opportunity to rebuild our community with the help of this grant. The high cost of the renovations and a shortfall in the reserves were the reason for possibly closing the hall permanently. Now,based on information previously received regarding money in reserve and matching it with money from the grant we will be able to do more than just the minimum required. Many people and groups worked hard to give us a community center and deserve to be able to use it for years to come. If managed and advertised effectively (possible by creating a Straffordville Hall Committee},a renovated or new Straffordville hall will keep current users in Bayham and draw people from other communities. It is the out of date decor and state of disrepair the sent people outside of Bayham. We can and will bring them back. I realise the"wish"is to have an"All-in-one"building,but it needs to be a building that Is easily accessible to all. Most people heading to Vienna and Port Burwell will pass through Straffordville on their way,making visits to the Municipal office convenient,whereas people in Straffordville will need to make a special trip to pay taxes,get licenses,etc. Someone also suggested that since the Straffordville hall needed a new roof as part of the repairs,perhaps the upper floor could be converted to Municipal Offices at the same time.This would provide the space needed for everyone and be less costly than operating both facilities. Of course it would need to be made handicap accessible with a ramp or an elevator so all Bayham residents can use it. This would allow the current office building to be sold or used as a storage facility for all the historical,legal and accounting documents currently being stored offsite. The old office facility could be kept at a lower temperature, reducing utilities and would not need to be upgraded allowing more cash flow for the hall. It is also known that the German community has made an offer to purchase the hall and have stated that they would be willing to rent the hall for functions to those outside of their community. However,since the hall will be used as their church in the short term while they build a new church on the concrete pad,any functions serving alcohol will not be permitted. This rules out most functions-stag and does,weddings,New Year's and Fireman dances,to name a few. There are other similar rules that will be in effect for the long term making the hall a non-choice for most. Basically,the hall will not be useful to many of Bayham's non-German citizen's. It is my sincere hope and that of my family and friends that you will decide to take the opportunity offered by this grant and Save Our Hall. Professional Studies were conducted and suggestions made,but as shown above there may be other options that are potentially viable solutions. I attend meetings regularly and keep apprised of what is happening in Bayham via council meetings and the Bayham website.In the past,I have not offered my written opinion given that during council meetings and the review of available information,my opinion often changes.I do believe it's time for me to turn a new leaf and offer my suggestions and/or comments on pertinent information that affects our community and the taxpayers as a whole. While we are all entitled to change our opinions from time to time,I do find it disturbing that I sat in council chambers not once,but twice and witnessed the decision to surplus the Eden and Straffordville community centres.In addition to that,I understood that the Vienna hall had the most recent updates and therefore was the future site of a unified Bayham Community Centre.Some councillors argued that Vienna wasn't the best location as it wasn't noticeable,nor is it immediately assessable from a main artery road. My only comment on this is to ask the question—is Toronto centrally located in Ontario? Is Ottawa centrally located in Canada?Is the"complex"community centre in Aylmer centrally located?Is the community centre in Simcoe(A.Carr Rec Centre)centrally located?The answer to all is no. I am not for nor am I against fixing up the Straffordville Community Centre instead of the Vienna Community Centre.What I would like to see is our council make an educated decision based on what's right for our community and not an emotional decision based on what a handful of residents want. The proposed accessibility renovations were supported by a $50,000 grant from the Enabling Accessibility Fund. DISCUSSION The Enabling Accessibility Grant funds had an original expiry date of March 31, 2015. The Municipality, over seven months ago, applied for an extension on the grant until the end of 2015 on the grounds that the Municipality needed to verify the funds were being spent on a sustainable facility. The Municipality is still in possession of the$50,000 and has been informed that an extension of use of the funds has been granted until December 1, 2015. On June 18, 2015 the Council of the Corporation of the Municipality of Bayham passed the following resolution: THAT Report CAO-39/15 re Vienna Community Centre Accessibility Renovations be received for information; AND THAT Council direct staff to proceed with tendering utilizing the Spriets Associates proposal; AND THAT funds for the project be allocated from the Enabling Accessibility Fund Grant, Vienna Community Centre Reserve and the Facility Reserve if required. On March 1, 2012 the Council of the Corporation of the Municipality of Bayham passed By-law No. 2012-029 being a by-law for the provision of Waste Collection and Recycling in the Municipality of Bayham. On August 21, 2014 the Council of the Corporation of the Municipality of Bayham passed the following resolution: THAT Staff Report F2014-023 regarding 2015 Garbage Bag Tags be received; THAT Schedule 'A'of By-Law 2012-029 be amended to indicate that 1.5 bags be provided to each residential property and proportional to other properties and that additional bag tags be sold at a cost of$2.00/tag, effective January 1, 2015; AND THAT the Administrator be directed to arrange a Promotion and Education Program to educate the public about the 2015 Bag Tag Program. DISCUSSION Waste Disposal is currently funded through the municipal levy. Waste Disposal, excluding recycling is projected to have a total cost of approximately$315,000 for the 2016 calendar year. The total amount is composed of two components: 1) Collection Fees-$15,128/month ($181,536/year—approximately)—2015 costs 2) Disposal Fees-$65.16/metric ton In 2013 the Municipality disposed of 1,164.04 metric tons of non-recyclable waste. The Municipal Datacall conducted by Waste Diversion Ontario is compiled two years in arrears hence the use of 2013 figures. Staff respectfully recommend Council consider going to a 100% pay as you throw system for 2016 with no 'free'tags provided. This would mean that for the most part the levy would cover the collection costs and the bag tags would cover the tonnage costs. When considering waste disposal it is critical to also analyze recycling. Recycling is one of the few opportunities where the citizen's efforts can directly correlate into increased revenue for the Municipality. Firstly, the Municipality receives a share of the revenue for marketed recyclable materials. In short, the more the Municipality recycles the more revenue the Municipality generates from the Material Recovery Facility. Secondly, Waste Diversion Ontario provides funding to all Municipalities based off of a formula which is calculated by factoring in Net Cost of Recycling Program (50%weight), Recovered Tonnage (35%weight)and WDO Datacall Best Practices (15% weight). Municipalities that enact systems including the following statistically have higher diversion rates: i. User Pay-Pay As You Throw Programs ii. Bag limits iii. Garbage collection frequency less than recycling iv. Collection frequency v. Requirement for clear bags in the last year As an example of the success of said programs in 2012 the County of Oxford, which has a Pay as You Throw program, obtained a diversion rate of 58% and a landfill rate of 42%to rank first in the rural regional collection grouping (a comparative grouping to the Municipality of Bayham grouping). Many factors influence diversion rates, but the diversion programs play a significant portion. Further in 2012 of the 231 Municipal respondents to the WDO Datacall, 117 indicated a Pay as You Throw program in effect. The benefit of a Pay as You Throw program is that it puts the responsibility and opportunity clearly in the hands of the residents of the Municipality. In implementing a Pay as You Throw system issues arise including increased illegal dumping, specifically in rural areas and as such the budget amount for enforcement and clean up would be increased from $1,000 to$5,000. This fact is supported by the response of participants in the 2011 survey associated with the 2cg Waste Management Plan which indicated approximately 60% of respondents want to see Municipalities striving to reach a diversion rate of 60% or higher, with the added statistics that 61% of respondents are not willing to pay more to fund enhanced waste diversion programs. AND WHEREAS the estimated total cost of constructing the drainage work is$61,100.00; AND WHEREAS the Council is of the opinion that the drainage of the area is desirable; NOW THEREFORE the Council of the Municipality of Bayham enacts as follows: 1. Engineer Report No. 214226, dated May 28, 2015 and attached hereto, is hereby adopted and the drainage works as therein indicated and set forth are hereby authorized and shall be completed in accordance therewith. 2.1 The Corporation of the Municipality of Bayham may borrow, on the credit of the Corporation,the amount of$61,100.00, being the amount necessary for construction of the drainage works. 2.2 The Corporation may arrange for the issue of debentures on its behalf for the amount borrowed less the total amount of, (a) grants received under Section#85 of the Act; (b) commuted payments made in respect of lands and roads assessed within the municipality; (c) monies paid under Subsection#61(3)of the Act; and monies assessed in and payable by another municipality,and such debentures shall be made payable within five(5)years from the date of the debenture and shall bear interest at a rate not higher than the rate charged by a chartered bank of Canada.
