Underhill presented the Staff Report D2010-20 outlining the purpose and effect of the minor variance for the reduced lot frontage. 6. COMMITTEE QUESTIONS AND DISCUSSION The Secretary-Treasurer was asked if the 66'frontage is along the road allowance to which she replied yes. When asked about the status of the road allowance,she responded by saying it has not been closed. The committee asked if Bayham should ever develop the road allowance how would that affect the minor variance. The Administrator responded by saying the minor variance becomes mute point if the frontage is developed along the road allowance. The committee questioned the feasibility of developing the road allowance to which the applicant responded it would not be feasible to develop due to the expansive gully at the end of the allowance. 9. Underhill presented the Staff Report outlining the request for minor variance to permit the reduced front yard setback to allow for the construction of an addition to the northside of the existing dwelling. PUBLIC SUBMISSIONS Arnold and Nancy Row,adjacent neighbours to the applicant,expressed concern regarding the constuction noise,heavy equipment and safety concerns with their therapy riding stable being next door. The applicant was asked about the construction of the addition and replied that there is no basement,therefore no large hole,and that the construction was limited to the normal construction practices for adding the addition to the front of the house. STAFF PRESENTATION (a) Staff Report D2010-06 regarding Minor Variance Application A-1/10 FROESE The Secretary-Treasurer presented Staff Report D2010-06 explaining that in order to keep access to the steel sided barn the owner wishes to place the house to the westerly side of the subject lands with a 1.52 metre setback and not the required 4.5 metre setback from a municipal storm drain. She added that the Drainage Superintendent, staff and the planner are supportive of the application and that it complies with the"four tests" of a Minor Variance as per the PlanninE Act. She recommended that a condition be included to remove the small shed entirely or relocate the shed to a Iocation in accordance to proper setbacks. 6. PRESENTATIONS BY APPLICANT/AGENT Page 1 of 4 Committee of Adjustment A-01110 Page March 4,2010 John Froese provided a site plan to the Committee as prepared by Kim Husted Surveying showing the actual proposed lot layout. He explained that the lot layout shows the northwesterly corner of the residence to be closest to the drain at 1.65 metres and the southwesterly corner at approximately 4.65 metres, slightly rotated from the application sketch. He is acceptable to the relocation of the small shed. 7. PUBLIC SUBMISSIONS Lori Debenedetti,westerly neighbour residing at 9540 Flank Road,expressed concerns that a new residence will worsen the drainage problem around her property. She explained that her land is the lowest in the area and that she has water in her yard on a regular basis. She requested that an engineer review the Froese site plan to confirm in writing that the existing drain's capacity will handle any additional runoff from the new residence. 8. COMMITTEE QUESTIONS AND DISCUSSION Administrator Kruger responded to Ms.Debenedetti's question about drainage by saying that a lot grading plan would be presented with a building permit application and reviewed. by the Chief Building Official/Drainage Superintendent. Administrator Kruger responded to the question of municipal liability by saying the municipality assumes some liability for the drain functioning properly,however,the design would have been engineer approved at time of installation. Members concurred that an engineer's written comment on the existing drain capacity as it relates to the construction of a new dwelling is needed. Administrator Kruger suggested that the engineer's comment is not a requirement to obtain a building permit and the cost of obtaining this assurance would be the municipality's and not the property owner's. When asked,Mr. Froese informed the Committee that the drain was a 12"pipe at a depth of 4 feet. Ms. Debenedetti asked if heavy equipment would be allowed to be parked on the property. Secretary-Treasurer responded by saying the site-specific zoning only allowed the parking of heavy equipment related to the former truck trailer driver training school but that the school no longer exists and the primary use of the property is residential. 9.
