1. CALL TO ORDER
Chairman Ketchabaw called the meeting to order at 6:45 p.m.

3. APPLICATIONS
A. Minor Variance Application A-09120 S. & R. Kristensen
THE PURPOSE of the variance is to grant relief from Section 5.2 Permitted Uses in the
Al zone for accessory uses on a lot with two zones, Agricultural (Al) and Hamlet
Residential (HR) zones; to permit accessory building to the residential use in the Al
zone with floor area of 122.6 m2 (1,320 ft2), located at 57220 Eden Line, Eden, north
side, west of Ridge Line.
THE EFFECT of this variance will be to recognize the existing building, to the rear of
the lot, as a permitted building and structure accessory to the dwelling.
B. Minor Variance Application A-08/20 R. Peidi & E. Scott
THE PURPOSE of the variance is to grant relief from Section 10.1 Permitted Uses in
the R1 zone to permit an accessory use building as the main building on a 809.4 m2
(0.19 acre) parcel of land in the Village Residential (R1) zone; to permit a building

accessory to the residential use on the abutting lot, as the main building on the lot,
located at Plan 205 Lot 15, 55861 Third Street, south side, east of West Street.
THE EFFECT of this variance will be to allow the construction of a new accessory
building for personal storage on a vacant lot.
C. Minor Variance Application A-07/20 J. & E. Unger
THE PURPOSE of the variance is to grant relief from regulations Section 9.5.1
Maximum Building Height for Accessory Buildings and 9.7 Maximum Floor Area for
Accessory Building Regulations on a 0.63 ha (1.5 acre) parcel of land in the Hamlet
Residential (HR) zone, to permit maximum height of 5.4 m (17.7 ft) whereas 4.5 m (14.7
ft) is the permitted maximum; and to permit maximum floor area of 136.6 m2 (1,470 ft2)
whereas the permitted maximum is 75.0 m2 (807 ft2), located at 53579 Calton Line,
south side, east of Richmond Road.
THE EFFECT of this variance will be to allow the construction of an oversized
accessory building for personal storage of materials, fire wood and hobby equipment.

THAT the Committee of Adjustment Secretary/Treasurer's report DS-58/20 regarding
the Kristensen minor variance be received;
AND THAT the Committee of Adjustment considered all written and oral submissions
received on this application, the effect of which helped the committee to make an
informed decision;
AND WHEREAS the Committee agrees that the proposed variance as presented meets
Section 45.1(1) of the Planning Act and is considered minor;
THEREFORE application A-09/20 submitted by Scott and Ruthanne Kristensen,
pursuant to Section 45 of the Planning Act for minor variance, is granted to allow relief
from Municipality of Bayham Zoning By-law Z456-2003:
• Section 5.2 Permitted Uses in the Al Zone for accessory uses on a lot with two
zones, Agricultural (Al) and Hamlet Residential (HR) Zones - to permit a building
accessory to the residential use in the Al Zone with floor area of 122.6 m2 (1320

THAT the Committee of Adjustment Secretary/Treasurer's report DS-59/20 regarding
the Peidl and Scott minor variance be received;
AND THAT the Committee of Adjustment considered all written and oral submissions
received on this application, the effect of which helped the committee to make an
informed decision;
AND WHEREAS the Committee agrees that the proposed variances as presented meet
Section 45.1(1) of the Planning Act and are considered minor;
THEREFORE application A-08/20 submitted by Ramona Peidl and Edward Scott,
pursuant to Section 45 of the Planning Act for minor variance, is granted to allow relief
from Municipality of Bayham Zoning By-law Z456-2003:
Section 10.1 Permitted Uses to permit an accessory use building with a
maximum floor area of 65.0 m2 (700 ft2) as the main building on the lot known as
55861 Third Street, subject to the following two conditions:
1) That notwithstanding that there is no dwelling on the subject lands, and
until such time as a dwelling is developed on the subject lands, the
building is an "accessory use building" accessory to the dwelling at 55867
Third Street
2) The building be constructed in accordance with applicable Accessory
Building Regulations for setbacks, location on the lot requirements and
height for accessory structures in the Village Residential (R1) Zone of the
Municipality of Bayham Zoning By-law.

the Unger minor variance be received;

received on this application, the effect of which helped the committee to make an
informed decision;
AND WHEREAS the Committee agrees that the proposed variances as presented meet

THEREFORE application A-07/20 submitted by Jake and ElizaI"eth Unger, pursuant to
Section 45 of the Planning Act for minor variance, is granted to allow relief from
Municipality of Bayham Zoning By-law Z456-2003:
Section 9.5.1 Maximum Building Height for Accessory Buildings to permit
maximum height of 5.5 metres (18.0 ft) height whereas 4.5 metres (14.7 ft) is the
permitted maximum in the HR Zone
and;
Section 9.7 Maximum Floor Area Accessory Building to permit maximum floor
area of 137 m2 (1474 ft') floor area whereas 75.0 m2 (807 ft2) is the permitted
maximum in the HR Zone.
