THAT Report DS-57/20 regarding the Peters rezoning application be received for
information;
AND THAT pursuant to Planning Act Regulations Bill 73 Smart Growth for our Communities
Act, 2015, it be pointed out that at the public participation meeting held June 18, 2020, two
written submissions opposing the rezoning were received and the second public meeting
held August 20, 2020 associated with this application, there was one additional written
submission opposing the rezoning and no oral presentations and that all considerations
were taken into account in Council’s decision passing this resolution;
AND THAT Zoning By-law Z456-2003, as amended, be further amended by changing the
zoning on the lands owned by Henrich Peters identified as Concession 2 North Part Lot 10
from Agricultural (A1) to site-specific Agricultural (A1-37) Zone to permit “Kennel Use” for
the boarding, breeding and grooming of dogs as an additional permitted use;
AND THAT Zoning By-law Z712-2020 be presented to Council for enactment;
AND THAT By-law No. 2020-074 being a By-law to authorize the execution of a Site Plan
Agreement between Henrich Peters and the Municipality of Bayham for the Kennel
development at the property known as 54945 Vienna Line be presented to Council for
enactment.

The Chairman stated the purpose and effect of the proposed amendment.
4. PURPOSE AND EFFECT OF THE PROPOSED AMENDMENT
A. Application submitted by Henrich Peters, 54945 Vienna Line
THE PURPOSE of this By-law is to change the zoning on a 34.2 ha (84.6 acres) parcel of
land from an Agricultural (A1) zone to a site-specific Agriculture (A1-XX) zone to permit
kennel use in addition to the permitted uses in the A1 zone and to permit three (3) kennel
buildings with floor area of 27 m2 (291 ft2) and within a 600 m2 (6,458 ft2) fenced area, in
Zoning By-law Z456-2003. The second public meeting is being held to consider two (2)
additional kennel buildings for a total of 3 kennel buildings proposed. The subject lands
are located at 54945 Vienna Line, south side, west of Brown Road.
THE EFFECT of this By-law will be to allow a kennel for the boarding, breeding and
grooming of dogs in three buildings and a fenced area approximately 35 m (114 ft) south
of the existing dwelling.

TAKE NOTICE that the Municipality of Bayham has received a completed application for a
proposed Minor Variance (A-07/20).
AND TAKE NOTICE that the Committee of Adjustment of the Corporation of the Municipality of
Bayham will hold a public meeting on Thursday September 3, 2020 at 6:45 p.m. in the Municipal
Council Chambers, 56169 Heritage Line, Straffordville to consider a proposed minor variance to
Zoning By-law No. Z456-2003 under Section 45 of the PLANNING ACT.
THE PURPOSE of the variance is to grant relief from regulations Section 9.5.1 Maximum Building
Height for Accessory Buildings and 9.7 Maximum Floor Area for Accessory Building Regulations
on a 0.63 ha (1.5 acre) parcel of land in the Hamlet Residential (HR) zone, to permit maximum
height of 5.4 m (17.7 ft) whereas 4.5 m (14.7 ft) is the permitted maximum; and to permit maximum
floor area of 136.6 m2 (1,470 ft2) whereas the permitted maximum is 75.0 m2 (807 ft2), located at
53579 Calton Line, south side, east of Richmond Road.
THE EFFECT of this variance will be to allow the construction of an oversized accessory building
for personal storage of materials, fire wood and hobby equipment.

to permit an accessory use building as the main building on a 809.4 m2 (0.19 acre) parcel of land

RE: Completion of the 2019/20 LPRCA Riverine Flood Hazard Mapping Update
Dear Mr. Shipway,
The Long Point Region Conservation Authority (LPRCA) is pleased to announce that the Riverine
Floodplain Mapping Update is now complete and was approved by the LPRCA Board of Directors on
August 5, 2020. With support from the Federal National Disaster Program, this project has produced the
most up-to-date and accurate riverine floodplain information along the Big Otter Creek from Calton
Road through Vienna and into Port Burwell. Specifically, this project has:
Produced new digital floodplain mapping
Updated flood levels and floodlines for a range of flood events
Updated digital hydraulic models and tools
Consulted with the public, stakeholders, and organizations
Updated the Risk Assessment and calculated the dollar value of damages resulting from flooding
in the study areas
Municipality of Bayham staff have participated actively and worked collaboratively in this project as
members of the Project Team. The Project Team was instrumental to the success of the project by
supplying available information, providing input on the deliverables, and assisting with public
consultation.
Under LPRCA’s delegated responsibility to represent the provincial interest with respect to natural
hazards under Section 3.1 of the Provincial Policy Statement, 2020, LPRCA is providing the updated
riverine mapping to its partner municipalities. This project and its information will support the
preparation of municipal Official Planning and Zoning Bylaw documents. LPRCA will use the information
from this project to provide technical advice and comment on applications made under the Planning
Act. The updated floodplain mapping will be used to update the area regulated by LPRCA under Ontario
Regulation 178/06 in the study areas. Currently LPRCA staff are currently updating the regulated area
mapping with anticipated delivery to municipalities later this fall.

SUBJECT: 2021 COUNCIL SCHEDULE
BACKGROUND:
Please find the proposed 2021 Council Schedule attached hereto as Appendix ‘A’.
Please note that this schedule is subject to change due to additions of public planning meetings,
special council meetings or any other additions/deletions that may occur, however establishing
a 2021 meeting schedule is important for staff for 2021 schedule planning purposes. Meetings
during the summer recess are set for July 15th and August 19th 2021.
2021 Conferences are as follows:
•AMO AGM and Annual Conference will be held at the London Convention Centre in
London from August 15 to 18, 2021
•OGRA Conference will be held at the Fairmont Royal York in Toronto from February 21
to February 24, 2021
•ROMA Annual Conference will be held at the Sheraton Centre Toronto Hotel in Toronto
from January 23 to January 26, 2021
•FCM Annual Conference and Trade Show will be held in Quebec City from June 3 to
June 6, 2021
RECOMMENDATION
1.THAT Report CAO-37/20 re 2021 Council Schedule be received for information;
2.AND THAT Council approve the 2021 Meeting Schedule attached hereto as Appendix
‘A’.

BY-LAW NO. 2020-038
A BY-LAW TO CONFIRM ALL ACTIONS OF
THE COUNCIL OF THE CORPORATION OF
THE MUNICIPALITY OF BAYHAM FOR THE
COUNCIL MEETING HELD SEPTEMBER 3, 2020
WHEREAS under Section 5 (1) of the Municipal Act, 2001 S.O. 2001, Chapter 25, the powers of
a municipal corporation are to be exercised by the Council of the municipality;
AND WHEREAS under Section 5 (3) of the Municipal Act, 2001, the powers of Council are to be
exercised by by-law;
AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it
advisable that the proceedings of the meeting be confirmed and adopted by by-law.
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
BAYHAM ENACTS AS FOLLOWS:
1. THAT the actions of the Council of the Corporation of the Municipality of Bayham in
respect of each recommendation and each motion and resolution passed and other
action by the Council at the Council meeting held September 3, 2020 is hereby adopted
and confirmed as if all proceedings were expressly embodied in this by-law.
2. THAT the Mayor and Clerk of the Corporation of the Municipality of Bayham are hereby
authorized and directed to do all things necessary to give effect to the action of the
Council including executing all documents and affixing the Corporate Seal.
READ A FIRST, SECOND AND THIRD TIME and finally passed this 3rd day of September,
2020.
