CALL TO ORDER Chairman Ketchabaw called the meeting to order at 6:45 p.m. 2. DISCLOSURES OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF None 3. APPLICATIONS A. Minor Variance Application A-06/20 J. Crumb & C. Tuffin Crumb THE PURPOSE of the variance is to grant relief from Section 10.11 Regulations for Accessory Buildings subsection a) setback from a public street and subsection b) maximum height for accessory buildings on a 1220 m2 (13,006 ft2) parcel of land in the Village Residential (R1) zone, to permit minimum front yard setback of 1.0m (3.2 ft.) whereas 6.0 m (19.6 ft.) is the permitted minimum and maximum height of 4.9 m (16 ft.) whereas 4.5 m (14.7 ft.) is the permitted maximum, located at 41 Erieus Street, west side Erieus St at corner of Robinson Street, village of Port Burwell. THE EFFECT of this variance will be to allow the construction of a garage/accessory building for personal storage in excess of the permitted height located closer to a public street (Robinson Street) than permitted. 4. STAFF PRESENTATION A. Report DS-56/20 re Minor Variance Application A-06/20 J. Crumb & C. Tuffin Crumb 2 2020 Committee of Adjustment Minutes August 20, 2020 Application A-06/20 Secretary/Treasurer M. Underhill presented Report DS-56/20 and advised no public submissions received. 5. PRESENTATIONS BY APPLICANT/AGENT A. None. 6. PUBLIC SUBMISSIONS A. None. 7. COMMITTEE QUESTIONS AND DISCUSSION A. None. 8. DECISION OF COMMITTEE (Motions) A. A-06/20 J. Crumb & C. Tuffin Crumb Moved by: Councillor Donnell Seconded by: Deputy Mayor Weisler THAT the Committee of Adjustment Secretary/Treasurer's report DS-56/20 regarding the Crumb minor variance be received; AND THAT the Committee of Adjustment considered all written and oral submissions received on this application, the effect of which helped the committee to make an informed decision; AND WHEREAS the Committee agrees that the proposed variances as presented meet Section 45.1(1) of the Planning Act and are considered minor; THEREFORE application A-06/20 submitted by James Crumb and Christine Tuff in Crumb, pursuant to Section 45 of the Planning Act for minor variance, is granted to allow relief from Municipality of Bayham Zoning By-law Z456-2003: • Section 10.11 Regulations for Accessory Buildings Subsection a) to permit a minimum public street setback of 1.0 m (3.2 ft) whereas 6.0 m (19.6 ft) is the permitted minimum, and Subsection b) to permit maximum height of 4.9 m (16 ft) whereas 4.5 m (14.7 ft) is the permitted maximum to permit the construction of a garage/accessory building for personal storage. Crumb & C. Tuffin Crumb be adjourned at 6:50 p.m.; AND THAT in accordance with the regulations of the Planning Act, a Notice of Decision be circulated by the Secretary/Treasurer accordingly.
