Act, 2015, it be pointed out that at the public participation meeting held March 5, 2020
associated with this application, there were no written submissions or oral presentations
regarding this matter and that all considerations were taken into account in Council’s
decision passing this resolution;
AND THAT Zoning By-law Z456-2003, as amended, be further amended by changing the
zoning on the lands owned by Isaac Michael and Annie Reimer identified as Plan 22 Part

3. CHAIRMAN’S REMARKS ON THE PURPOSE OF THE MEETING
The Chairman stated the purpose and effect of the proposed amendment.
4. PURPOSE AND EFFECT OF THE PROPOSED AMENDMENT
A. Application submitted by Henrich Peters, 54945 Vienna Line
THE PURPOSE of this By-law is to change the zoning on a 34.2 ha (84.6 acres) parcel
of land from an Agricultural (A1) zone to a site-specific Agriculture (A1-XX) zone to
permit “kennel use” in addition to the permitted uses in the A1 zone and to recognize
the kennel facilities, in Zoning By-law Z456-2003. The subject lands are located at
54945 Vienna Line, south side, west of Brown Road.
THE EFFECT of this By-law will be to allow a kennel for the boarding of dogs in an
accessory building with floor area of 9 m2 (96 ft2) and within a fenced area of 600m2
(6,458 ft2) approximately 35 m (114 ft) south of the existing dwelling.

Henrich Peters stated he received the neighbour’s letters earlier today and further described his
proposal to establish a Kennel for the family as a business and hopes that the neighbour’s
concerns can be addressed.
6. CORRESPONDENCE
Deputy Clerk/Planning Coordinator informed that two email correspondence, neighbours Greg &
Jocelyn Underhill and Albert and Joyce Assel, has been received expressing concerns with
dogs running loose, number of dogs at the property exceeds the limit and safety for themselves
and their family pets.

CONCERNING A PROPOSED
ZONING BY-LAW AMENDMENT
IN THE MUNICIPALITY OF BAYHAM
APPLICANT: BAYHAM HISTORICAL SOCIETY

TAKE NOTICE that the Municipality of Bayham has received a complete application for a Zoning By-law
amendment.
AND TAKE NOTICE that the Council of the Corporation of the Municipality of Bayham will hold a n electronic
public meeting on Thursday, July 16, 2020 at 7:30 p.m. to consider a proposed Zoning By-law amendment
under Section 34 of the PLANNING ACT. Please reference the subject Agenda on the municipal website for the
electronic meeting link.
THE PURPOSE of this By-law is to change the zoning on a 3,237 m2 (0.8 acres) parcel of land from a Central
Business District (C1) zone to a site-specific Institutional (I) zone to permit institutional use for a proposed
museum; to recognize existing reduced front yard setback of 3.7 m (12 feet) where 7.5 m (24 feet) is the permitted
minimum; and to recognize the existing accessory building located in the exterior side yard, in Zoning By-law
Z456-2003. The subject lands are located at 6209 Plank Road, north side, west side of Oak Street.
THE EFFECT of this By-law will be to allow a museum (The Edison, Vienna & Area Museum) in the existing
building (former restaurant) with reduced front yard depth and accessory building in the exterior side yard.
ANY PERSON may attend the public meeting and/or make a written or verbal representation in support of or in
opposition to the proposed amendment.
*** Given the current COVID-19 legislative restrictions and limitations, land use planning meetings remain open
to public comment. Please be advised that equal consideration is given to all written and oral presentations
provided to the municipality at a public meeting in regards to land use planning applications. When possible,
please consider utilizing written correspondence.
IF A PERSON OR PUBLIC BODY does not make oral submissions at a public meeting or make written
submissions to the Municipality of Bayham before the by-law is passed, the person or public body is not entitled
to appeal the decision of the Council of the Corporation of the Municipality of Bayham to the Local Planning
Appeal Tribunal.
IF A PERSON OR PUBLIC BODY does not make oral submissions at a public meeting, or make written
submissions to the Municipality of Bayham before the by-law is passed, the person or public body may not be
added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of
the Tribunal, there are reasonable grounds to do so.

PLANNING ACT.
THE PURPOSE of this By-law is to change the land use designation on 90 ha (222 acres) of land from
“Agriculture” to “Special Policy Area” in the Official Plan of the Municipality of Bayham; and to change
the zoning on the same lands from an Agricultural (A1), site-specific Agricultural (A1-25 and A1-A-25)
and Rural Residential (RR) zone to a modified site-specific Agricultural (A1-25 and A1-A-25) zone, to
permit ecotourism use with overnight accommodations; one (1) single detached dwelling (Owner’s
residence); three (3) year round accommodation buildings – one (1) “Guest House” dwelling and two
(2) winterized cabins; two (2) seasonal “Guesthouse accessory” sleeping cabins”; five (5) seasonal
cabins; three (3) seasonal camping areas; sixteen (16) kilometres of passive nature trails (no motorized
vehicles); and private beach along Otter Creek; in addition to the agricultural use in Zoning By-law Z456-
2003. The subject lands are located on the north and east sides of McQuiggan Line, west of Woodworth
Road, known as 53688 and 53800 McQuiggan Line.
THE EFFECT of this By-law will be to repeal the previous site-specific zone category permitting limited
overnight accommodations in order to permit five (5) additional cabins added to the properties since
2011; to recognize two (2) cabin locations moved since 2011; to allow 2 seasonal sleeping
buildings/cabins accessory to the guest house rental; to allow two cabins and the guest house for year-
round rental use; to allow 1 new cabin to be constructed; to permit 3 new campsites; to include one
additional parcel in the site-specific zone as part of the ecotourism use; and to permit 16 km of passive
nature trails, as part of an ongoing ecotourism operation.
ANY PERSON may attend the public meeting and/or make a written or verbal representation in support
of or in opposition to the proposed amendment.
*** Given the current COVID-19 legislative restrictions and limitations, land use planning meetings
remain open to public comment. Please be advised that equal consideration is given to all written and
oral presentations provided to the municipality at a public meeting in regards to land use planning
applications. When possible please consider utilizing written correspondence.
IF A PERSON OR PUBLIC BODY does not make oral submissions at a public meeting or make written
submissions to the Municipality of Bayham before the by-law is passed, the person or public body is not
entitled to appeal the decision of the Council of the Corporation of the Municipality of Bayham to the
Local Planning Appeal Tribunal.
IF A PERSON OR PUBLIC BODY does not make oral submissions at a public meeting, or make written
submissions to the Municipality of Bayham before the by-law is passed, the person or public body may
not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless,
in the opinion of the Tribunal, there are reasonable grounds to do so.

and subsequent years as municipalities recover from the economic hardships associated with
COVID-19.
Municipalities play a crucial role in delivering services that affect the day to day lives of all
Ontarians. Additionally, municipalities are responsible for ensuring the maintenance of safe and
accessible infrastructure for our residents and business communities.
Transfer payments from the Federal government are a critical source of municipal revenue,
particularly for small rural communities with limited tax bases. These payments ensure that
residents in these communities have access to the same caliber of services as their urban
counterparts. A reduction in these transfers could have a significant impact on municipalities’
ability to deliver these services.
In addition to existing pressures of an aging population, rapidly changing technologies, and a
lack of broadband internet connectivity, rural communities are now also facing unprecedented
financial challenges in the face of the COVID-19 pandemic. Municipalities are on the front lines
of the pandemic and are experiencing non-recoverable losses as a result of dwindling revenues
combined with the considerable costs of implementing new health and safety measures.
The COVID-19 pandemic is a global crisis that has affected all levels of government and all
industries. Our residents have experienced high levels of economic uncertainty and
unemployment. As service providers, it is important that municipalities are able to rely on a
stable source of funding in order to continue to serve our residents and local businesses as they
begin the challenging process of economic recovery. I again respectfully request that the
Ministry of Finance provide confirmation that Federal transfer payments to municipalities will
remain stable throughout these challenging times.

Dear Local Municipal Partners,
Re: WOWC Appeals for Equitable Broadband Funding for Southwestern Ontario
At the June 23rd County Council Meeting, Council resolved to join the Member Counties and
Local Municipalities of the Western Ontario Wardens Caucus (WOWC) in advocating for the
region’s fair share of the CRTC’s $750M Broadband Fund. WOWC and its Member Counties
and Local Municipalities will be advocating for 10% (or $75M) of the funding as the region
represents 10% of the population of Canada. WOWC will also advocate for the region’s fair
share of the Innovation, Science and Economic Development (ISED) $1.7B Universal
Broadband Fund. Applications are opening this year and WOWC will once again be
advocating for 10% (or $170M) for Southwestern Ontario based on population.
Advocacy will take the form of a letter writing campaign to the CEO of the CRTC and the Hon.
Navdeep Bains, Minister of Innovation, Science and Industry. Please find attached the
advocacy appeal from the WOWC and template letters of support for your consideration.

Currently more than half a million residents are lacking access to high-speed
broadband across Southwestern Ontario.
In the past funding for broadband in Southwestern Ontario has been undervalued and

Southwestern Ontario broadband funding can not be undervalued. It has been estimated that it
would cost approximately $2.5 billion to provide a fibre-based solution to address all Southwestern
Ontario’s underserved areas, including in areas of Elgin County – wireless could help to reduce these
costs in some areas. The region which is 90% rural and represents 10% of the Canadian population
has been overlooked in the past for funding.
Connectivity is key to the social and economic success of our communities – we need to ensure that
the residents living in our underserved communities do not go unnoticed. Adequate and equitable
funding for the region is required to ensure that broadband, an essential utility, is accessible for all.
The COVID-19 outbreak has laid bare the challenges our underserved communities in Elgin County
and across Southwestern Ontario are facing.
In today’s unprecedented times, where children are required to attend school remotely, online ordering
is the new norm and virtual meetings are now a workplace requirement, broadband is not a luxury, it is
essential.
On behalf of Elgin County, we are respectively asking the Canadian Radio-television and

5.2 Elgin County 2020 Grant and Festival Events Partnership Program Allocations
– Recommendation – Councillor Ketchabaw
Councillor Ketchabaw, Chair of the Rural Initiatives and Planning Advisory
Committee, provided an overview of the Committee’s most recent meeting, held on
May 12, 2020. Several events and programs have been cancelled as a result of the
COVID-19 pandemic and the Committee reviewed status updates from the
applicants. Two (2) grant proposals were withdrawn, some applicants indicated that
they required more time to adjust their plans, and a revised proposal was received
from Eat2Learn. With the closure of schools, this organization has partnered with
several local food banks to assist families who need food at this time.

The General Manager of Economic Development presented a report regarding the
formation of the Elgin-St. Thomas Economic Resiliency and Recovery Taskforce.
The Taskforce was formed as a collaboration between stakeholders within the
Elgin-St. Thomas area and the Economic Development Department in order to
determine how best to respond to the economic crisis that is currently impacting the
local business community.

performance for April 2020. The budget comparison for the County shows a
favourable performance of $87,000 for the month of April, primarily the result of

year-to-date performance to $294,000.

5.7 Centennial Road / Elm Line Intersection Improvements – Online Public
Information Centre – Director of Engineering Services
The Director of Engineering Services provided an overview of the ongoing online
Public Information Centre, which presents background information, evaluation of
alternatives, and a Technically Preferred Alternative for intersection improvements
at Centennial Road and Elm Line. The intersection is a four-way intersection
currently only controlled at its north and south approaches with stop conditions.
Existing conditions require significant driver concentration to navigate the
intersection during peak vehicular periods, and improvements of this intersection
are required prior to full subdivision build-out.

Agreement Renewal – Director of Engineering Services
The Director of Engineering Services presented a report on the County’s current
agreement with Ontario Clean Water Agency (OCWA) to operate the Wastewater
Treatment Plant located behind Elgin Manor. The OCWA has operated the plant

expires on December 31, 2020.

Officer
The Chief Administrative Officer presented a report on the connectivity challenges
in Elgin County. Accessible high-speed internet is no longer a luxury, but a basic

implementation can result in new and improved online services, including
commerce, government, health and education. Through their support of equitable
access initiatives and collaborative efforts, including private sector investments,

5.12 Rural Connectivity Conference – General Manager of Economic Development
The General Manager of Economic Development provided information on a virtual
“rural connectivity” conference proposed by Information Technology and Economic
Development staff. The conference would be part of the Economic Development
Department’s yearly conference series. Although still in the early planning stages, a
key component of this conference would be to have Internet Service Providers
(ISPs) present various ideas or solutions for rural communities struggling to provide
high speed internet to their residents.

5.13 Electronic Meeting Provisions – post pandemic – Chief Administrative Officer
The Chief Administrative Officer presented a report on the continued importance of
virtual meetings in a post-pandemic society. In light of the pandemic, municipalities
were expected to adopt a virtual format for the majority of their meetings and
services, to minimize travel and gathering of large crowds. The flexibility afforded to
Council through the changes to the Municipal Act during a declared state of
emergency would be helpful on a go-forward basis.

7.1 Statements/Inquiries by Members
Councillor Martyn provided an update on the COVID-19 Assessment Centre at the
St. Thomas Elgin General Hospital. Anyone who is worried that they have been
exposed to or have contracted COVID-19, even if they do not have symptoms, can
be tested. The Assessment Centre has expanded its hours of operation, and
residents of St. Thomas and Elgin County no longer need a referral to visit.
Residents will require an appointment to be tested.
Councillor Purcell announced that the Terrace Lodge Redevelopment Steering
Committee will have a virtual meeting on Tuesday, May 26, 2020 at 1:00 p.m.

The Warden welcomed the new Manager of Planning. Nancy Pasato comes from
the City of London, where she has worked in planning roles of increasing
responsibility for the past twenty (20) years.
4.2 Thames Valley District School Board – Meagan Ruddock
Meagan Ruddock on behalf of the Thames Valley District School Board requested
Council’s support in encouraging the community to decorate their yards and
businesses with decorative lights this June in celebration and recognition of the
Class of 2020.

6.1 COVID-19 Update – Warden
The Warden provided an update on the County’s response to the COVID-19
pandemic. He emphasized that Elgin County’s Long-Term Care Homes team is
deeply committed to providing the highest level of care and service possible and that
County Homes have taken all precautions possible to stop the spread of COVID-19.
While the pandemic is not over yet, staff are beginning to look ahead and build the
roadmap to our new reality – one where COVID-19 is present in our community.

6.3 Homes – Notice and Extension of Service Accountability Agreement(s) SAA –
Extending Letter – Director of Homes and Senior Services
The Director of Homes and Senior Services presented a report on the extension of
service accountability agreements (SAA). In light of the current pandemic, the Local
Health Integration Networks (LHINs) and Ontario Health (OH) recognize it is not
realistic to press ahead and engage in a SAA refresh process that would further
pressure health service providers and the system as a whole. The LHINs and OH
have received Ministry of Health (MOH) endorsement to continue with the
extension of the 2020/21 fiscal year SAA for the period of July 1, 2020 to March 31,
2021.

6.5 Wide Area Network Services – RFP Contract Award – Manager of Information
Technology
The Manager of Information Technology provided details on Request for Proposal
(RFP) No. 2020-P28 recently issued by the County for the provision of High-Speed
Wide Area Network (WAN) connectivity between existing facilities. The County of
Elgin WAN consists of private high-speed connections between the Administration
Building data centre and the County's three (3) Long-Term Care Homes. Because
Elgin Manor serves as the backup data centre for the County, the connection
between it and the Administration Building is ten (10) times faster than the
connection with the other Homes. The increased speed provides the capacity
necessary to operate hot standby servers as well as off-site backups of all servers
and data.
One (1) complete proposal submission was received from Eastlink. The cost of this
agreement would be $4,500 per month, an increased cost of $500 from the 2015
price of $4,000. This increase is a little over 2% per year and is contained within
the IT budget. The new agreement provides the following increased services:
• A doubling of bandwidth to the Administration Building from 1000 Mbps,
which previously cost $2,125 monthly, to 2000 Mbps for $2,325 monthly – a
doubling of speed for a $200 per month increase; and
• An internet connection for each of the three (3) Long-Term Care Homes at
$100 each.
The total cost for the enhanced services from Eastlink is $54,000 per year. The
pricing is guaranteed for the three (3) year term of the agreement.

the County the connection between it and the administration building is 10 times
faster then the connection with the other homes. The increased speed provides
the capacity necessary to operate hot standby servers as well as off-site backups
of all servers and data.
Data traffic volume between the administration building and our 9 libraries can be
handled by public internet connections such as Bell, EastLink and Rogers which
secured using GRE (Generic Routine Encapsulation) protocol and was not included
in this WAN RFP.
The WAN provides staff at the long-term care homes with access to resources at
the data center such as the file server. The WAN is also used to route internet
traffic from all locations, both staff and public, through the firewall out to the
internet.
The current contract for WAN services with EastLink has been in place for 5 years.
During that time EastLink has responded to our need for increased internet
capacity, driven by the homes and the libraries, by providing incremental
bandwidth increases as no charge.
A review of our WAN requirements identified the following needs:
1.Provide backup internet connections to each of the long-term care homes.
Although the loss of the internet connection at the administration building
is infrequent a backup internet connection would insure that the critical
connection to resident care and pharmacy information is not lost.
2.Increased internet bandwidth to meet the demand from staff and the
public, primarily from the libraries.
In order to meet the increased demand and to future proof the WAN for the next
3 to 5 years the RFP included an increase in bandwidth to administration building
from 1000 to 2000 Mbps. This is necessary to deal with the increased internet
speeds at the libraries and to accommodate IT services provided to municipal
partners.
WAN RFP Council Presentation – June 9, 2020
The increased bandwidth of the WAN connection to the administration building
means that an upgrade to our main router will also be required this year. This
upgrade was part of our asset management plan and is contained within 2020
capital budget.
On April 29th the County issued a request for proposal to provide a high-speed
wide area network to included the administration building and our 3 long-term
care homes.
The RFP closed on May 20, 2020. Questions were received during the process from
Proponents and Addendum 1 was issued. An extension for the RFP was not
requested during the question period.
The County received two electronic submissions. Upon further review of the
proposals received, one complete proposal was received from Eastlink and one
partial proposal was received from Packet-Tel Corp to service one of the four
facilities with internet service only.
Due to the fact that only one complete submission was received, a formal RFP
evaluation was not conducted. It should be noted however that both proposals
were reviewed in depth.
Staff has reviewed the Eastlink proposal and is recommending that a new
agreement be entered into with Eastlink for a three-year term. Eastlink has
provided excellent service in the past and the pricing received is favourable.

Re: Temporary New/External Patios – Conditions for Approval
1.ACGO Requirements/Directives
(a)Extension of existing licenced patio or add new patio within approved period (up to January 1,
2021);
(b)physical extension must be adjacent to the premises which are licensed to sell liquor;
(c)no objection from local municipality;
(d)licensee is able to demonstrate sufficient control over physical extension;
(e)no condition on licensee prohibiting patio;
(f)new/extended patio does not exceed 1.1 sq. metres per person.
Note: * Licensee not required to comply to ACGO or pay a fee for extension
*Licensee not required to submit documentation to ACGO but must produce if
demanded
** municipalities have discretion to require documentation for Licensee so
as to permit temporary patio
2. Servers can carry alcohol over non-licensed areas to get to temporary patio.
3.Maximum capacity applicable to existing patio space continues to apply. Licensee can accommodate
patrons above that capacity in temporary patio so long as 1.1 square metres maximum is satisfied.
4. Social distancing requirements must be satisfied in any existing and new/extended temporary patio.
Municipal Conditions
5.Municipalities should recognize distinction between new/extended patios on private lands (ie. owned
by Licensee or others (Landlord)) and on public lands (ie. sidewalks/road allowances).
6. Local municipalities have a statutory interest in licensed activities as both private lands and lands
which it owns and should establish appropriate standards to accommodate new/temporary patios
within its territorial limits.
Upper tier municipalities should consider appropriate standards to accommodate new/temporary
patios upon lands which is owns and/or over which jurisdiction is exercised, primarily its owned road
allowances, but should consider standards otherwise required by local municipalities when amending its
own standards to be satisfied.
7. Sample standards for local municipality (Chatham-Kent) for extensions/new patios on private
property attached as Schedule “A” to this Memorandum.
Considerations for County Council Consideration
8. Does County Council support the concept of temporary patios on County-owned property, including
road allowances and sidewalks (hereinafter “public property”)?
9. If County Council supports the concept of temporary patios on public property, the following factors
are suggested for consideration in respect of any specific request:
(i) What standard, if any, for temporary patios has been adopted by the local municipality?
Do these standards provide compliance with regulatory requirements and otherwise establish
appropriate control over patio design and use so as to protect the interests of Elgin County?
(ii) What additional standard(s) are required by Elgin County?
(iii) Does the proposed patio design incorporate lands (ie. shoulders/sidewalks) which force
pedestrian traffic towards vehicular traffic? In these circumstances, the County Solicitor
recommends against incorporation of those areas within the temporary patio design as creating
unacceptable risk to patio users and pedestrians.
(iv) Does the temporary patio design create accessibility issues (ie. width between tables;
necessity of ramps)? If so, any permission must be conditional upon prior acceptable
accessibility detail design and installations prior to any permission for patio on public property
should be permitted.
(v) Does temporary patio location/design raise spectre of incompatibility with neighbouring
uses? This factor should be a local factor but may become a County consideration if not subject
matter of local standard.
(vi) Any permission for a temporary patio, if granted, should be terminated as of December
31, 2020, or the re-opening of the associated licensed area for in-house patronage, whichever is
earliest.
(vii) In respect of all temporary patios for which Elgin County Council, or its designate, grants
permission to operate a temporary patio on its property, the Licensee (ie. person/entity holding
liquor licence) shall enter into a revocable Licence Agreement with Elgin County addressing the
following factors:
(a) Identification of Parties;
(b) Terms of Licence (ie. Termination date);
(c) Licence Fee (if any);
(d) Compliance with all federal, provincial, and municipal regulatory requirements,
including those of social distancing established by Southwest Public Health;
(e) Indemnity and Save Harmless requirements in favour of Elgin County;
(f) Insurance requirements, including naming Elgin County as additional insured; and
(g) Consent/approval of local municipality, particularly if local municipality is current
occupant of lands upon which temporary patio to extend.

Re: Long Term Care Home Improvements
At its meeting held on June 22, 2020, Sarnia City Council adopted the following
resolution submitted by Councillor Margaret Bird with respect to the conditions
in Long Term Care homes exposed by the pandemic:
That due to the deplorable conditions exposed by the pandemic
in LTC homes in the province, and because this is a time for
action, not just continuous streams of investigations,
commissions and committees, and because the problems have
been clearly identified, that Sarnia City Council direct staff to
send this motion to the 444 Ontario Municipalities, asking them
to urge Premier Ford to start implementing the required
resolutions immediately, as follows:
1. increasing hours for all part-time and casual labour
2. since the government provides funding for privately-
operated homes, they have an obligation to inspect these
homes and see that they are being properly run, and that funds
are being used for the benefit of the residents and not the huge
profitability of the operators, and
3. to end the neglect and unacceptable conditions being
experienced, each day, by our vulnerable seniors.

Dear Head of Council:
The COVID-19 outbreak has touched everyone in the province, creating personal and
financial hardship, and resulting in losses far greater than anyone could have imagined.
We are making steady progress in the safe reopening of the province, and we
acknowledge and celebrate those who went above and beyond through this crisis.
I am writing to inform you that on July 8, 2020, our government introduced the COVID-
19 Economic Recovery Act, 2020, to help get Ontario back on track. Our proposed bill
will address three critical needs Ontario faces: restarting jobs and development;
strengthening communities; and creating opportunity for people.
Our government recognizes the key role that municipalities play in restarting the
economy, and that their efficient functioning and economic sustainability is critical to
Ontario’s future success. We are also continuing to negotiate with our federal partners
to ensure communities across Ontario receive the urgent financial support they need.
We know that municipalities require fair and flexible investment to protect front line
services and help restart the economy.
This bill includes proposals that will enable municipal councils and local boards to meet
electronically on a permanent basis and allow municipal councils to decide if th ey wish
to have proxy voting for their members. Our government also proposes to finalize the
community benefits charges framework; enhance the Minister of Municipal Affairs and
Housing’s existing zoning order authority to provide more certainty when fast tracking
the development of transit oriented communities; make it faster to update and
harmonize the Building Code so that we can break down interprovincial trade barriers,
and permanently establish the office of the Provincial Land and Development Facilitator
to help solve complex land use issues. We are also working on optimizing provincial
lands and other key provincial strategic development projects that will help facilitate
economic recovery efforts.
My ministry will be hosting a technical information briefing on the proposed community
benefits charges framework, including proposed changes to development charges and
parkland dedication, so that municipal staff can gain a better understanding of the
proposal. The technical briefing will take place in the near future and invitations from the
Assistant Deputy Minister of Local Government and Planning Policy Division to
municipal Chief Administrative Officers, Treasurers and Chief Planners will be

In addition to initiatives that I have outlined above from my ministry, there are several
other proposals included in our proposed legislation that will support your communities.
Changes proposed will modernize our outdated environmental assessment framework ,
provide more local say on future landfill sites, and ensure strong environmental
oversight, while supporting faster build-out of vital transport and transit infrastructure
projects to support our economy. Municipally-run courts will be able to use technology
to deliver services remotely and we are also moving to fill justice of the peace vacancies
faster and more transparently.
We will be extending the validity period of unused marriage licences and protecting the
province’s most vulnerable consumers who rely on payday loans, by proposing limits on
related interest rates and fees.
Also proposed is the reduction of regulatory burdens on farming while preserving the
environmental rules that will support this vital part of our economy. Businesses will be
able to count on clear, focused and effective rules that do not compromise people’s
health, safety or the environment through our changes that continue to focus on cutting
red tape. At the same time, our changes will allow health and safety standards to be
updated more quickly to ensure worker safety in a changing economy.
As the province continues to reopen and the economy recovers, it’s more critical than
ever to position Ontario as a top-tier destination for investment, domestic growth, and
job creation. A key measure to support this objective is the creation of a new investment
attraction agency, Invest Ontario, that will promote the provinc e as a key investment
destination and work closely with regional partners to coordinate business development
activities.
Our proposed changes will also help our communities respond in part to the challenges
that this outbreak has brought to our education system. Changes proposed would allow
school boards to select the best candidates for director of education for their respective
communities. We will also reduce red tape that is preventing access to school for some
First Nation students and by limiting unproductive suspensions for our very youngest
students. Students with severe learning disabilities will have an opportunity to complete
their studies in the upcoming school year and by broadening the mandates of TVO and
TFO, our broadcasters will be able to support students’ learning needs better during
these challenging times.
Through this proposed legislation, we will take the first step towards a strong restart and
recovery. More information on our proposals can be found on the Legislative Assembly
of Ontario’s website.
Our greatest challenges lie ahead of us, and we know we cannot overcome them alone.
It’s time for everyone to play a role in rebuilding Ontario together. We will ensure no
community or region is left behind. Every community must recover if all of Ontario is to
grow and prosper again.

BACKGROUND
The Q2 (second quarter) financial reports are provided for Council’s fiduciary review. This report
provides a summary of current revenue and expenditure to June 30, 2020 and variances to the
Operating Budget and Capital Budget.
The Operating Budget and Capital Budget is at expected levels given the cyclical nature of
operations and the current COVID-19 pandemic and financial policy implications.
CONCLUSION:
Capital expenses have commenced in all departments, and with an early passed budget
permitted department managers to secure competitive pricings and availability of service
providers with some projects already completed.

The Municipality of Bayham obtains Winter Salt through a regional bulk procurement program led
by the City of London. Winter Salt is provided by K+S Windsor Salt Ltd. The regional bulk
procurement program includes an option of trucking delivery costs for Winter Salt by K+S Windsor
Salt Ltd. The Municipality utilizes approximately 1,500 tonnes of Winter Salt per winter season.
Wilson Trucking provided Winter Salt Trucking Services for the 2018/2019 and 2019/2020 winter
seasons via Agreement No. 0699 as authorized by By-law No. 2019-079. Staff propose to extend
the Winter Salt Trucking Services Agreement for an additional season with all terms and conditions
remaining unchanged.
RECOMMENDATION
1.THAT Report CAO-33/20 re RFT 20-04 Contractor Winter Maintenance be received for
information;
2.AND THAT staff be directed to bring forward a by-law to enter in an Agreement with
Wilson’s Lawn Care & Snow Removal for for the provision of contractor winter maintenance

WHEREAS pursuant to the Municipal Act, 2001, S.O. 2001 c.25, as amended, municipalities may
appoint officers and employees as may be necessary for the purposes of the Corporation;
AND WHEREAS Subsection 6 (1) of the Fire Protection and Prevention Act, 1997, S.O. 1997, C. 4
provides that if a fire departmen t is established for the whole or a part of a municipality or for more
than one municipality, the council of the municipality or the councils of the municipalities, as the
case may be, shall appoint a fire chief for the fire department;
AND WHEREAS Ontario Regulation 380/04, a Regulation passed under authority of the Emergency
Management Act, R.S.O. 1999, C. E.9, provides in part that every Municipality shall designate an
employee of the municipality or a member of the council as its emergency management p rogram co-
ordinator;
AND WHEREAS Subsection 3 (2) of the Building Code Act, S.O. 1992, c.23, as amended, provides
that the council of each municipality shall appoint a chief building official and such inspectors as are
necessary for the enforcement of the Act, in the areas in which the municipality has jurisdiction;
AND WHEREAS, the Council of the Municipality of Bayham deems it necessary and expedient to

OF
THE CORPORATION OF THE MUNICIPALITY OF BAYHAM
BEING A BY-LAW TO GOVERN THE PROCEEDINGS OF THE
PROPERTY STANDARDS COMMITTEE
WHEREAS Section 15.1 (3) of the Building Code Act, 1992, S.O. 1192, c.23 as amended,
provides the Municipality of Bayham the authority to pass a by-law prescribing standards for the
maintenance and occupancy of property within the municipality and requires that any property not
in conformity can be maintained to conform or be cleared and left in a levelled condition;
AND WHEREAS the Official Plan for the Corporation of the Municipality of Bayham includes
provisions relating to property conditions as required by section 15.1 (3) of the Building Code Act,
1992, S.O. 1992, c.23 as amended;
AND WHEREAS section 391 (5), of the Municipal Act, 2001, S.O. 2001, c. 25, as amended
provides that Council may by by-law impose fees for services and activities provided or done by or
on behalf of the Municipality of Bayham;
AND WHEREAS Section 238(2) of the Municipal Act, S.O.2001, c.25 as amended, requires
every Municipality to pass a Procedural By-law for governing the calling, place and proceedings
of meetings;
AND WHEREAS it is deemed expedient to establish Rules of Procedure for the Property
Standards Committee.
NOW THEREFORE the Council of the Corporation of the Municipality of Bayham enacts as
follows:
SECTION 1 – DEFINITIONS
1.1 For the purposes of this By-law; unless stated otherwise or the context requires a different
meaning:
1.1.1 “Appeal” means an Appeal to the Property Standards Committee of a Property
Standards Order;
1.1.2 “Appellant” means an owner or occupant that has been served with a Property
Standards Order and who has sent a notice of appeal to the Secretary within the
specified time period after being served with the Property Standards Order;
1.1.3 “Building Code” means the Building Code Act, 1992, S.O. 1992, c.23 as amended, and
includes the regulations made thereunder;
1.1.4 “Committee” means the Property Standards Committee;
1.1.5 “Corporation” means the Corporation of the Municipality of Bayham;
1.1.6 “Property Standards Order” means an order made under the Property Standards By-law
of the Corporation of the Municipality of Bayham;
1.1.7 “Proceeding” means a matter brought before the Committee under the provisions of the
By-law or the Building Code Act;
1.1.8 “Property Standards Officer” means a person designated as such by a resolution or by-
law of Council and shall include the Municipal Law Enforcement Officer and the Chief
Building Official of the Municipality of Bayham;
1.1.9 “Quorum” means the majority of the members of the Property Standards Committee in
attendance and eligible to participate;
1.1.10 “Representative” means a person authorized by an Appellant to represent the Appellant;
1.1.11 “Secretary” means the Secretary for the Property Standards Committee, deemed to be
the CAO|Clerk of the Corporation or designate;
1.1.12 “Statutory Powers Procedure Act” means the Statutory Powers Procedure Act, R.S.O.
1990, c. S.22 as amended;
SECTION 2 - INTERPRETATION
2.1 These Rules shall apply to all proceedings before the Committee.
2.2 The rules shall function in accordance with By-law No. 2018-100, as amended the Advisory
Board & Committee Policy and By-law No. 2018-036 the Property Standards By-law.
SECTION 3 - APPLICATION
3.1 These rules apply to every proceeding, subject to the Statutory Powers Procedure Act,
and any successor legislation thereto, and any other legislation governing the
Committee.
3.2 These Rules do not apply if a statute or the By-law provides for a different procedure to
govern proceedings of the Committee in the exercise of its statutory powers of decision.
SECTION 4 - MEETINGS
4.1 The Committee shall meet at the request of the Secretary.
4.2 Meetings of the Committee shall be held at the Municipal Office, 56169 Heritage Line,
Straffordville, ON, or such other location or medium as the Secretary deems advisable.
4.3 All members of the Committee in attendance at a meeting, including the Chair of the
meeting, shall vote on all motions and other questions submitted at a meeting of the
Committee, unless a member is prohibited by law from voting.
4.4 The Committee shall review and adopt, with or without amendment, the Minutes of a
previous meeting at a subsequent meeting.
SECTION 5 – ROLE OF THE SECRETARY
5.1 The Secretary shall keep on file records of all official business of the Committee including
records of all applications and minutes of all decisions respecting these applications.
5.2 The Secretary shall provide an agenda before the Hearing to each member of the
Committee.
SECTION 6 – FAILURE TO COMPLY
6.1 Where a party to a proceeding has not complied in full with any Rules, the Committee
may:
a) adjourn the proceeding until it is satisfied that such rule or order has been
complied with; or
b) take such other steps as it considers just and reasonable.
6.2 No proceeding is invalid by reason only of a defect or other irregularity in form.
SECTION 7 – REQUEST FOR A HEARING
7.1 Where an Appellant submits a notice of appeal and requests a Hearing before the
Committee, the request for a Hearing shall be in writing to the Secretary and shall
include:
a) a copy of the Property Standards Order appealed from;
b) a statement setting out the grounds for the appeal;
c) the name, address, telephone number and, where available, email address
and facsimile number of the Appellant and Representative, if applicable;
d) the non-refundable Appeal Fee of $250.
7.2 When a notice of appeal is received by the Secretary, the Secretary shall confirm that
the notice was sent within the allowed appeal period. Late notices are invalid and are
disqualified.
7.3 Where an owner or occupant of property that is subject to a Property Standards Order
submits a notice of appeal that is not substantially in accordance with these Rules, the
Secretary shall send to the owner or occupant or Representative, a letter within twenty
(20) calendar days of receipt of the notice of appeal to specify what additional
information is required by the Property Standards Committee. If the Secretary does not
receive a response to the letter within twenty (20) calendar days of the letter being
sent, the Property Standards Committee may consider the attempted Appeal to be
abandoned.
SECTION 8 – NOTICE OF HEARING
8.1 Where a complete notice of appeal has been submitted as determined by the Secretary,
the Secretary shall set the time and place of a Hearing.
8.2 Once a date has been set for a Hearing, it may not be adjourned except by notification
from the Secretary. The reason for adjournment must be reasonable and justified.
8.3 Notice of Hearing shall be sent by the Secretary in writing to all parties affected by the
order at least fourteen (14) calendar days in advance of the Hearing. A notice of hearing
shall include the time, place and purpose of the Hearing and a statement that, if the
Appellant, or Representative if applicable, does not attend the Hearing, the Property
Standards Committee may proceed in the absence of the Appellant, or Representative
and the Appellant and Representative shall not be entitled to any further notice in the
Proceeding.
8.4 Where notice of hearing has been given in accordance with these Rules and the
Appellant or Representative do not attend at the Hearing, the Property Standards
Committee may proceed in the absence of the Appellant and Representative and the
Appellant and Representative are not entitled to further notice in the Proceeding.
SECTION 9 – FAILURE TO ATTEND
9.1 Where a person is notified of a Hearing and does not attend at the time and place
appointed, the Committee may proceed in that person’s absence and without further
notice to that person.
SECTION 10 - FILING
10.1 Filing of any document, excluding the request for the appeal may be effected by personal
delivery, by ordinary or registered mail, or otherwise as the Committee may order, to the
Secretary.
10.2 The time frame for filing of any document, excluding the request for the appeal, as
evidence at the Hearing, shall be served on all other parties no later than fifteen (15)
calendar days before the Hearing date and shall file eight (8) copies of the documents
with the Secretary no later than fifteen (15) calendar days before the Hearing date.
10.3 Where a document is filed, the date of the receipt stamp on the document shall be
deemed to be the date of the filing, unless the Committee orders otherwise.
10.4 Where the Committee or the Secretary has no record of the receipt of a document alleged
to have been filed, the documents shall be deemed not to have been filed, unless the
Committee orders otherwise.
10.5 If the Appellant or Representative fails to serve and file a document pursuant to the
Rules, the Appellant or Representative may not refer to the document in evidence at the
Hearing without the consent of the Committee, which may be subject to terms and
conditions that the Committee considers just.
SECTION 11 - EXHIBITS
11.1 All parties to a Hearing shall be required to bring to the Hearing a sufficient number of
copies for the Committee, Secretary and opposing counsel of clear photos and/or other
documents to be entered as evidence or exhibits.
11.2 Where the Committee is satisfied as to its authenticity, a copy of a document or other
thing may be admitted as evidence at a Hearing.
SECTION 12 - DISCLOSURE
12.1 At any stage of the Proceeding before completion of the Hearing, the Property
Committee may make orders for:
a) the exchange of documents;
b) the oral or written examination of a Party;
c) the exchange of witness statements and reports of expert witnesses;
d) the provision of particulars; or,
e) any other form of disclosure relative to the subject matter.
12.2 The Committee may not make an order requiring the disclosure of privileged
information.
12.3 Individual members of the Committee holding a Hearing shall not have taken part,
before the Hearing, in any unauthorized communication, either directly or indirectly in
relation to the subject matter of the Hearing, with the Appellant, Representative or any
Party or Parties to the Hearing.
12.4 If a Party fails to comply with a production order of the Committee or these Rules, the
Party may not refer to the document or thing, or introduce the document or thing, in
evidence at the Hearing without leave of the Committee, which may be on terms and
conditions as the Committee considers just.
SECTION 13 – CONDUCT OF PROCEEDINGS
13.1 A Proceeding shall be conducted in the following order of presentation, unless the Chair
directs otherwise:
a) The Chair shall call the meeting to order after confirming a Quorum of the
Committee and the Secretary is present.
b) The Chair shall request interested parties to the Appeal to identify themselves
including any other persons who intend to give evidence on behalf of either party
to the Appeal.
c) The Chair shall explain to those in attendance at the Hearing the format of the
Proceeding and the specific purpose of the Hearing. The Chair should advise
those present that the Committee will only be considering the compliance and
non-compliance of a property or building with respect to the standards of the By-
law, and the time granted for compliance. The Hearing is not for determining the
resolution of any landlord and tenant disputes.
d) The Chair shall ask Committee members in attendance at the Hearing for any
declarations of pecuniary interest under the Municipal Conflict of Interest Act,
R.S.O. 1990, c. M.50 as amended or any successor legislation thereto, or other
interest in any matter on the agenda for consideration.
e) The Property Standards Officer is requested to present the order to comply and
related evidence.
f) The Property Standards Officer may be questioned by members of the
Committee through the Chair to clarify any evidence presented.
g) If the Appellant is represented by legal counsel, legal counsel may cross-
examine the Property Standards Officer at this time.
h) No legal counsel
i. If the Appellant is not represented by legal counsel, any questions the
Appellant or Representative who is not legal counsel may wish to ask the
Property Standards Officer shall be directed to the Committee through the
Chair.
ii. The Committee may allow the question to be put to the Property Standards
Officer or rule that the question is improper or out of order.
i) Other Persons in support of the Order
i. After any cross-examination of the Property Standards Officer, the
Committee may hear from anyone else who supports the confirmation of the
order to comply.
ii. Preference in the order of hearing, will be given to those who identified
themselves as an “other interested person” at the beginning of the Hearing.
iii. The Committee through the Chair, may question the other interested
persons giving evidence to clarify any evidence presented.
j. The Appellant or Representative is requested to present evidence with respect
to the Appeal;
i. The Appellant may be questioned by members of the Committee
through the Chair to clarify any evidence presented.
ii. The Committee will allow the Appellant or Representative to complete
their presentation before asking questions, unless clarification is
required before the presentation is completed.
iii. If evidence is to be given by anyone other than the Appellant or a
witness called by the Appellant, preference of hearing will be given to
those who identified themselves as “other interested persons” at the
beginning of the Hearing.
k. After the Appellant’s presentation, the Committee shall hear from anyone else
who wishes to make representations before the Committee pertaining to the
matter.
l. After all of the evidence has been adduced by all parties to the Proceeding, the
Property Standards Officer may make a closing address followed by the closing
address of the Appellant if he or she decided to do so; and
m. Where there are two or more Appellants, the order of presentation shall be as
directed by the Chair.
n. The Committee shall ensure there is no undue harassment or embarrassment of
the witness as he or she is giving evidence and may disallow a question put to
the witness that is vexatious or irrelevant to any matter that may be properly
inquired into at the Proceeding.
SECTION 14 – ADMINISTRATION OF OATHS
14.1 The Chair or any member of the Committee may administer oaths and affirmations for
the purpose of any of its proceedings.
SECTION 15 - ADJOURNMENT
15.1 A Hearing may be adjourned at the discretion of the Committee upon its own motion
or upon the motion of the Appellant or Representative.
15.2 In deciding whether to grant an adjournment or not, the Committee may consider one
or more of the following factors:
a) the sufficiency of the reasons given for the request to adjourn;
b) the timeliness of the request;
c) the resources of the Committee;
d) the prejudice of the Appellant and of the Representative;
e) whether any adjournments have been granted previously;
f) the consent of the Appellant or the Representative; and
g) any other relevant factor as determined by the Committee.
15.3 The Committee may grant adjournments on such terms and conditions as it
considers just.
15.4 The Committee may, in its sole discretion, refuse an adjournment even though
the Parties consent.
SECTION 16 – COMMITTEE DECISION
16.1 The Committee may decide:
a) to uphold the order in whole or in part, with no additional time granted for
compliance;
b) to uphold the order in whole or in part with additional time granted for all or
some of the deficiencies to be complied with;
c) to remove any items from the order that have already been complied with, or
have been determined to be invalid;
d) to modify any items within the order in any manner seen fit by the
Committee;
e) to quash the order, in whole or in part, based on any technical or procedural
error;
f) to defer a decision to a later date pending the receipt of additional information
from any party to the Hearing.
16.2 The Secretary shall prepare a written record of the Hearing including minutes of the
Hearing and the decision with conditions, if applicable.
SECTION 17 – ORDER CONFIRMATION
17.1 An order that is deemed to be confirmed pursuant to subsection 15.3(2) of the Building
Code Act or that is confirmed or modified by the Committee under subsection 15.3(3) of
the Building Code Act or a Judge under subsection 15.3(6) of the Building Code Act as
the case may be, shall be final and binding upon the owner and occupant who shall
carry out the repair or demolition within the time and manner specified in the order.
SECTION 18 – EFFECTIVE DATE
18.1 This by-law shall come into force on the day of the final passing thereof.

BY-LAW NO. Z713-2020
BAYHAM HISTORICAL SOCIETY
BEING A BY-LAW TO AMEND BY-LAW No. Z456-2003, AS AMENDED
WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to
amend Zoning By-law No. Z456-2003, as amended;
THEREFORE, the Council of the Corporation of the Municipality of Bayham enacts as follows:
1) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending
Schedule “H” Vienna by changing the zoning symbol on the lands from Central Business
District (C1) Zone to site-specific Institutional (I-6) Zone, which lands are outlined in
heavy solid lines and marked I-6 on Schedule “H” Vienna to this By-law, which schedule
is attached to and forms part of this By-law.
2) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending
Section 24.10 Exceptions – Institutional (I) Zone by adding the following clauses:
24.10.6.1 Defined Area
I-6 as shown on Schedule “H” Vienna to this By-law.
24.10.6.2 Minimum Front Yard Depth
3.7 metres
24.10.6.3 Additional Regulations for Accessory Buildings
Notwithstanding Section 4.2 c) the existing accessory building is
permitted in the exterior side yard.
3) THIS By-law comes into force:
a) Where no notice of objection has been filed with the Municipal Clerk within the
time prescribed by the Planning Act and regulations pursuant thereto, upon the
expiration of the prescribed time; or
b) Where notice of objection has been filed with the Municipal Clerk within the time
prescribed by the Planning Act and regulations pursuant thereto, upon the
approval of the Ontario Municipal Board.

A BY-LAW TO CONFIRM ALL ACTIONS OF
THE COUNCIL OF THE CORPORATION OF
THE MUNICIPALITY OF BAYHAM FOR THE
COUNCIL MEETING HELD JULY 16, 2020
WHEREAS under Section 5 (1) of the Municipal Act, 2001 S.O. 2001, Chapter 25, the powers of
a municipal corporation are to be exercised by the Council of the municipality;
AND WHEREAS under Section 5 (3) of the Municipal Act, 2001, the powers of Council are to be
exercised by by-law;
AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it
advisable that the proceedings of the meeting be confirmed and adopted by by-law.
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
BAYHAM ENACTS AS FOLLOWS:
1. THAT the actions of the Council of the Corporation of the Municipality of Bayham in
respect of each recommendation and each motion and resolution passed and other
action by the Council at the Council meeting held July 16, 2020 is hereby adopted and
confirmed as if all proceedings were expressly embodied in this by-law.
2. THAT the Mayor and Clerk of the Corporation of the Municipality of Bayham are hereby
authorized and directed to do all things necessary to give effect to the action of the
Council including executing all documents and affixing the Corporate Seal.
