A. Minor Variance Application A-04/20 J. Thiessen
THE PURPOSE of the variance is to grant relief from Section 10.11 Regulations for
Accessory Buildings subsection b) maximum height and subsection c) maximum floor
area for accessory buildings on a 1,404.6 m2 (0.3 acre) parcel of land in the Village
Residential (R1) zone, to permit maximum height of 6.0 m (19.6 ft.) whereas 4.5 m
(14.7 ft.) is the permitted maximum; and to permit maximum floor area of 81.3 m2 (875
ft2) whereas the permitted maximum is 65.0 m2 (700 ft2), located at 55859 Second
Street, south side, east of West Street.
THE EFFECT of this variance will be to allow the construction of an oversized
accessory building for personal storage of materials in excess of the permitted height,
property maintenance equipment and to park vehicle for resident’s profession.
B. Minor Variance Application A-05/20 W. Anderson & P. Smith
THE PURPOSE of the variance is to grant relief from Section 8.10.2 and 8.13.9.2
permitted floor area maximum for accessory buildings on a 4,006 m2 (1 acre) parcel of
land in the site-specific Estate Residential (ER-9) zone, to permit an unenclosed
accessory use structure with floor area of 30 m2 (322 ft2), in addition to site-specific
permitted accessory building floor area maximum of 157m2 (1,690 ft2), for total
maximum of 187m2 (2,012.8 ft2), located at 9743 Plank Road, west side Plank Rd, north
of the village of Straffordville.

patio/gazebo structure for recreational purposes associated with the existing pool.

NOTICE OF A PUBLIC MEETING
CONCERNING A PROPOSED
MINOR VARIANCE
IN THE MUNICIPALITY OF BAYHAM

TAKE NOTICE that the Municipality of Bayham has received a completed application for a
proposed Minor Variance (A-04/20).
AND TAKE NOTICE that the Committee of Adjustment of the Corporation of the Municipality of
Bayham will hold an electronic public meeting on Thursday June 18th, 2020 at 6:45 p.m. to
consider a proposed minor variance to Zoning By-law No. Z456-2003 under Section 45 of the
PLANNING ACT. Please reference the Committee of Adjustment subject Agenda on the
municipal website for the electronic meeting link.
THE PURPOSE of the variance is to grant relief from Section 10.11 Regulations for Accessory

and oral presentations provided to the municipality at a public meeting in regards to land use
planning applications. When possible please consider utilizing written correspondence
addressed to the undersigned.
IF YOU WISH to be notified of the decision of the Committee of Adjustment, you must make a
written request to the undersigned.

RECOMMENDATION
THAT the Committee of Adjustment Secretary-Treasurer's report DS-46/20
regarding the Thiessen minor variance be received;
AND THAT the Committee of Adjustment considered all written and oral
submissions received on this application, the effect of which helped the
committee to make an informed decision;
AND WHEREAS the Committee agrees that the proposed variances as presented
meet Section 45.1 (1) of the Planning Act and are considered minor;
THEREFORE application A-04/20 submitted by John Thiessen, pursuant to
Section 45 of the Planning Act for minor variance, is granted to allow relief from
Municipality of Bayham Zoning By-law 2456-2003:
•Section 10.11 b) Accessory Buildings Maximum Height: 4.5 metres,
whereas 6.0 metres is required for the construction of a personal storage
shop
•Section 10.11 c) Accessory Buildings Maximum Floor Area: 65.0 m2,
whereas 82 m2 is required for the construction of a personal storage shop

Planning Act Section 45. (1) for a minor variance to the zoning by-law. The planner's
memorandum dated June 8, 2020 outlines the variances required for compliance and the full
analysis of the four "tests".

regarding the Anderson Smith minor variance be received;
AND THAT the Committee of Adjustment considered all written and oral
submissions received on this application, the effect of which helped the
committee to make an informed decision;
AND WHEREAS the Committee agrees that the proposed variances as presented
meet Section 45.1 (1) of the Planning Act and are considered minor;
THEREFORE application A-05/20 submitted by Wayne Anderson and Patti Smith,
pursuant to Section 45 of the Planning Act for minor variance, is granted to allow
relief from Municipality of Bayham Zoning By-law 2456-2003:
•Section 8.2 Permitted Buildings and Structures, and
•Section 8.13.9.2 Regulations for Accessory Buildings in the ER Zone to
permit an additional unenclosed accessory use structure with floor area of
30 m2 (322 sq. ft.), in addition to site-specific pe rmitted accessory building
floor area maximum of 157 m2 (1690 sq. ft.) for two existing accessory
buildings, to permit a combined accessory building floor area maximum of
187 m2 (2012.8 sq. ft.)
